- The Bourbon County Commission
met in open session with all commissioners and the county clerk present.
Minutes of the previous meeting were read and approved.

- Bills and payroll for the
period were reviewed and approved.

- Mark Shead was present.

- Marty Pearson gave a road
report. It’s time to pay the 10% County share for the Slick Rock Bridge
project, in the amount of $167,000.00. We will be reimbursed for this
from the T-Works program.

- Marty also presented quotes
from Berry Tractor for work on a Komatsu loader. They were $17,700 to
rebuild the existing engine or $20,200 for a re-manufactured engine. No
action, as commissioners need more information.

- Elwin Ermel asked about fence
viewing in Section 8, Township 24, Range 22. He paid his $15.00 for
commissioners Endicott and Warren to view it. The viewing will be
scheduled, according to law.

- Commissioners will review the
specifications with Marty and an electrician and make a decision on
November 28th.

- Kansas Senator Bob Marshall
met with commissioners. Gary Harper was also present. Senator Marshall
was contacted by Gary Harper about the change in acreage on his property
tax statements. He’s concerned with what that will mean for the deeds.
Shane Walker, GIS Coordinator, came up to explain. He said that the old
maps were only as accurate at the guys who measured the land, and that the
old way didn’t take into account the curvature of the land or “orthorectification”.
The new GPS satellites are accurate to within 18” 1000’. Other changes
could occur from erosion or changes to waterways, where Kansas law says
you own to the center of the waterway. Mr. Walker remembers this parcel,
as it butts up against the river. His side is heavy with trees and the
old measurements couldn’t get through the trees, so they estimated. There
are also a handful of parcels that were recorded in an old atlas book,
where it was recorded that a parcel was a set number of acres, because
that’s what was believed to be there, but in actuality, it’s considerably
different. The acreage is only listed for taxation purposes and most
deeds indicate “more or less” to account for variations in calculated
acres. If a person has a survey, the acreage can be adjusted in the
Appraiser’s Office, and the survey may be filed with the Register of
Deeds, to affect a change in the deed.

- Marty Pearson asked Keith
Jeffers about narrow band radios. Keith said there will be discussion
about them at the communications meeting, Monday afternoon at 1:30, in the
EOC, and invited Marty to attend.

- Judy Wallis came up with an
example of a legal description, using the terms “about” and “more or less”
in the description.

- Keith Jeffers discussed recent
training.

- Susan Quick met with
commissioners to discuss the tax sale. Dan Meara is working on the cases
to file in District Court and says he has some he wants to file now, but
the Treasurer’s Office has been telling people they have to December 1 to
pay. For fairness, she would like the commissioners to ask that all cases
be filed at the same time. It would only be a matter of six business
days. Otherwise, she feels that some people would have more time to pay
than others. Jingles said that he would speak with Mr. Meara about it.
There was also discussion of what “Other” means on the statements. It is
the Community College. Another question was the designation of “Make
checks payable to Susan Quick”. This has been the same every year, since
Opal Hess was Treasurer. “Extension” is the Southwind Extension
District”, which was a change from the Bourbon County Extension Council to
the district. The Extension Council used to be a part of the General Fund
of the County. Mrs. Quick also stated that the Payment Plan has been
completely stopped and all payments have been applied to the CIC tax
system. As to the tax sale, Mrs. Quick would like to see a set date for
it each year and to work backwards from there on the filings, so a set
date can be made available to people as to when they need to be caught up
on their taxes to stay off the sale.

- Allen Warren commented on the
2008 delinquent listing, provided by Mrs. Quick. He would like to see
listings for 2009 and 2010.

- Joanne Long spoke with
commissioners about a request she received from Sheila Nichols, widow of
Jimmy Nichols. She has asked if she can place donation canisters in the
courthouse offices for the annual Sheriff’s Department Toy Drive.
Commissioners approved the request.

- Allen Warren left at 11:55 am.

- Keith Jeffers and Shane Walker
asked to speak with commissioners in executive session. Harold Coleman
made a motion to go into executive session, for a period of five minutes,
under the security exception to the Kansas Open Meetings Act, to discuss
courthouse security. Jingles Endicott seconded the motion and both voted
in favor. Those present for the session were Harold Coleman, Jingles
Endicott, Shane Walker and Keith Jeffers. The session began at 11:57 am
and ended at 12:02 pm. Once in open session, commissioners approved the
purchase of security cameras for the courthouse.
