November 4, 2011       Friday        9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meetings were read and approved.
 
Ann Ludlum presented the monthly progress reports for the Extension Office.
 
Jim Harris was present.  He discussed financing and trade-in specifics for the rock crusher.  The commissioners are still waiting to hear back from Citizens for a financing option, so there was no action on that front. 
 
Allen Warren made a motion to purchase a 53’ semi trailer, unit number 7135, from GP Express, for $2,500.  Jingles Endicott seconded the motion and all voted in favor.
 
Allen Warren made a motion to purchase, from Berry Tractor, a Screen Machine 4043T impact crusher plant and Screen Machine 512T Spyder screening plant, pending financing.  Harold Coleman seconded the motion and all voted in favor.  Jingles Endicott signed a sales agreement for the equipment.
 
Joanne Long had Chairman Endicott sign a sales tax exemption certificate for Heartland Rural Electric for the lift station utility bill. 
 
Ms. Long also asked the Chairman to sign a drawdown request for CDBG funds for the Sewer District project.  Mr. Endicott signed the request.
 
David Neville met with commissioners.  Shane Walker and Keith Jeffers are hoping to get four cameras on the courthouse roof to cover the courthouse grounds.  The system costs about $4,000, and he’s been asked to see if the commissioners have $1,000 from the General Fund, to supplement funds they can provide for the remainder of the cost.  No action at this time, as the commissioners want to mull it over.
 
Doylene Chapman presented commissioners with two road cut requests for Running Foxes Petroleum.  The commissioners are forwarding them to Marty to review.
 
Joanne Long presented commissioners with the bill for Terry Sercer for his work in the Treasurer’s Office.  Commissioners said to pay it out of the Treasurer’s Department.
 
Allen Warren left the meeting at 10:50 am to go to City Hall for a ceremony.  He returned at 11:25 am.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Mark Shead was present.
 
Frank Pulliam reported hitting large rock on a county road.  He filled out an insurance claim with the clerk’s office.
 
John Scott and Curt Shankel met with commissioners to request the commissioners appoint the following to the Bourbon County Sewer District #1 Advisory Committee: Tim Culbertson, Dana Davis, Bob Lemons, John Scott, Curt Shankel and Don Tucker.  Jingles Endicott made a motion to approve the appointment of the members of the advisory committee.  Allen Warren seconded the motion and all voted in favor.  There was no term listed for the appointments, as the committee will advise the commissioners if someone moves or otherwise is no longer active on the committee.
 
Jingles commended the committee for all it’s done with regard to communication with owners, especially on gaining the easements.
 
Ron Center spoke with commissioners about setting the Saturday following Veteran’s Day as a holiday for the Landfill.  After discussion, Jingles Endicott made a motion to expand the holidays at the Landfill to be closed on Saturdays, when an observed national holiday falls on the following Monday or preceding Friday.  Harold Coleman seconded the motion and all voted in favor.
 
Gary Judd, Mayor of Redfield, spoke with commissioners about a situation with an alleged Peeping Tom/stalker in Redfield.  He said that people are starting to arm themselves and he’s concerned that someone is going to get hurt.  Commissioners suggest he speak with the sheriff.
 
Commissioners will be meeting with Public Works staff at the County Barn, Wednesday morning at 7:00 am, to discuss the move to the new rock quarry.  All commissioners will be present.  Notice will be sent of the meeting, in accordance with the Kansas Open Meetings Act.
 
After routine business, the meeting adjourned at noon.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Bills and payroll for the period were reviewed and approved.
 
Mark Shead was present.
 
Marty Pearson gave a road report.  It’s time to pay the 10% County share for the Slick Rock Bridge project, in the amount of $167,000.00.  We will be reimbursed for this from the T-Works program. 
 
Marty also presented quotes from Berry Tractor for work on a Komatsu loader.  They were $17,700 to rebuild the existing engine or $20,200 for a re-manufactured engine.  No action, as commissioners need more information.
 
Elwin Ermel asked about fence viewing in Section 8, Township 24, Range 22.  He paid his $15.00 for commissioners Endicott and Warren to view it.  The viewing will be scheduled, according to law.
 
Generator Bids were opened at 10:00 am.  Four were received.  They were:

Commissioners will review the specifications with Marty and an electrician and make a decision on November 28th.
 
Kansas Senator Bob Marshall met with commissioners.  Gary Harper was also present.  Senator Marshall was contacted by Gary Harper about the change in acreage on his property tax statements.  He’s concerned with what that will mean for the deeds.  Shane Walker, GIS Coordinator, came up to explain.  He said that the old maps were only as accurate at the guys who measured the land, and that the old way didn’t take into account the curvature of the land or “orthorectification”.  The new GPS satellites are accurate to within 18” 1000’.  Other changes could occur from erosion or changes to waterways, where Kansas law says you own to the center of the waterway.  Mr. Walker remembers this parcel, as it butts up against the river.  His side is heavy with trees and the old measurements couldn’t get through the trees, so they estimated.  There are also a handful of parcels that were recorded in an old atlas book, where it was recorded that a parcel was a set number of acres, because that’s what was believed to be there, but in actuality, it’s considerably different.  The acreage is only listed for taxation purposes and most deeds indicate “more or less” to account for variations in calculated acres.  If a person has a survey, the acreage can be adjusted in the Appraiser’s Office, and the survey may be filed with the Register of Deeds, to affect a change in the deed. 
 
Marty Pearson asked Keith Jeffers about narrow band radios.  Keith said there will be discussion about them at the communications meeting, Monday afternoon at 1:30, in the EOC, and invited Marty to attend.
 
Judy Wallis came up with an example of a legal description, using the terms “about” and “more or less” in the description.

Susan Quick met with commissioners to discuss the tax sale.  Dan Meara is working on the cases to file in District Court and says he has some he wants to file now, but the Treasurer’s Office has been telling people they have to December 1 to pay.  For fairness, she would like the commissioners to ask that all cases be filed at the same time.  It would only be a matter of six business days.  Otherwise, she feels that some people would have more time to pay than others.  Jingles said that he would speak with Mr. Meara about it.  There was also discussion of what “Other” means on the statements.  It is the Community College.  Another question was the designation of “Make checks payable to Susan Quick”.  This has been the same every year, since Opal Hess was Treasurer.  “Extension” is the Southwind Extension District”, which was a change from the Bourbon County Extension Council to the district.  The Extension Council used to be a part of the General Fund of the County.  Mrs. Quick also stated that the Payment Plan has been completely stopped and all payments have been applied to the CIC tax system.  As to the tax sale, Mrs. Quick would like to see a set date for it each year and to work backwards from there on the filings, so a set date can be made available to people as to when they need to be caught up on their taxes to stay off the sale. 
 
Allen Warren commented on the 2008 delinquent listing, provided by Mrs. Quick.  He would like to see listings for 2009 and 2010.
 
Joanne Long spoke with commissioners about a request she received from Sheila Nichols, widow of Jimmy Nichols.  She has asked if she can place donation canisters in the courthouse offices for the annual Sheriff’s Department Toy Drive.  Commissioners approved the request.
 
Allen Warren left at 11:55 am.
 
Keith Jeffers and Shane Walker asked to speak with commissioners in executive session.  Harold Coleman made a motion to go into executive session, for a period of five minutes, under the security exception to the Kansas Open Meetings Act, to discuss courthouse security.  Jingles Endicott seconded the motion and both voted in favor.  Those present for the session were Harold Coleman, Jingles Endicott, Shane Walker and Keith Jeffers.  The session began at 11:57 am and ended at 12:02 pm.  Once in open session, commissioners approved the purchase of security cameras for the courthouse.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Commissioners reviewed the generator bids.  No action.
 
Daniel Crook, Executive Director, Southeast Kansas Regional Planning Commission (SEKRPC), met with commissioners.  He discussed the types of programs SEKRPC offers.
 
Allen Warren made a motion to purchase, from Berry Tractor, a remanufactured engine for a loader at the rock quarry for $17,000.00.  Jingles Endicott seconded the motion and all voted in favor.
 
Doylene Chapman had Chairman Endicott sign a form for T-Works on reimbursement for culverts and another for annual renewal of registration for fuel tanks.
 
Tommy Moore met with commissioners.  He has property that’s set to be on the sale this year and wants to know how long he has to pay to stay off, as he’s heard conflicting information.  The commissioners said by December 1st.  He thanked the commissioners for the information.
 
Terri Johnson and Dan Meara spoke with commissioners about legal issues.  No actions.
 
Jingles Endicott made a motion to go into executive session, for a period of 20 minutes, under the attorney/client privilege exception to the Kansas Open Meetings Act, to discuss pending litigation regarding Bourbon County Sewer District #1.  Allen Warren seconded the motion and all voted in favor.  Those present for the session were the commissioners and Terri Johnson.  The session began at 11:49 am and ended at 12:09 pm with no action.
 
Joanne Long reminded commissioners that there is no meeting this Friday, due to the holiday.  Allen Warren informed the commissioners that he would not be here Monday, November 28th.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Bills and payroll for the period were reviewed and approved.
 
Harold Coleman left at 9:45 am to attend a funeral.
 
Commissioners discussed the recent generator bids.  Allen Warren made a motion to purchase from Cummins for $46,079.00.  Jingles Endicott seconded the motion and both voted in favor.  There will be a 10-wk delivery period.  The generator will be used to power the rock conveyors on the crusher at the quarry. 
 
Allen Warren made a motion to finance the crusher and generator through Citizens Bank, N.A. at 4.0%.  Jingles Endicott seconded the motion and both voted in favor.  It was noted that Berry Tractor offered 3.899%, but commissioners decided to stay local.
 
Marty Rivers met with commissioners.  He’s looking to purchase the Hill’s service stations, which have several years’ back taxes.  Commissioners informed him that if he can pay off 2007 and prior, by December 1st, it would remove him from the upcoming sale.  Mr. Rivers thanked commissioners and looks forward to opening up the stations and getting revenue flowing through them again.
 
Harold Coleman returned at 10:45 am.
 
There was discussion about the holiday resolution regarding the upcoming Christmas/New Year’s holidays.   Joanne Long explained that, in January, the commissioners approved the 26th for Christmas and 27th for New Year’s, as most people travel for Christmas to see family and would rather have the time then, than on January 2nd.
 
Keith Jeffers, David Neville and Shane Walker met with commissioners.  We will be moving some vehicles around and need to clear the sally port at the jail to stow the Emergency Response Vehicle.  That means the mower, snow blower and 4-wheeler need to be relocated.  They want to buy a storage building to place in the west lot, between the dumpster and sewage tank, in what is known as Parking Space #1.  They will then relocate Parking Space #1 to the south side of the sewage tank.  The cost of the building will be about $3,000, and paid for out of the Emergency Management Grant funds.  Jingles Endicott made a motion to purchase the 12 x 8 x 8 building, to be placed in the west courthouse parking lot, between the dumpster and sewage tank, and to relocate Parking Space #1 to south of the sewage tank.  Allen Warren seconded the motion and all voted in favor.
 
Mark Shead asked commissioners about access to land-locked property.  No action.
 
James Maine and Kimberly Alexander met with commissioners.  Mr. Maine asked if he can set up an account at the dump.  He’s in a contract with KOA to tear down six trailers.  After discussion, commissioners granted him a monthly credit of $100 at the landfill.  They thanked the commissioners. 
 
Tom McNeil and Mark Houser stopped in to talk to the commissioners about the sewer project.  The contractor has nearly all the grinder pumps installed.  With the winter weather imminent, they asked if we could suspend the job until the workable weather returns, sometime in February/March, for the demolition of holding tanks.  They said with so many different plumbers working at the lake, it would save time and money to be able to go door-to-door and do them all at once.  Commissioners will take it under advisement.
