August 1, 2011         Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Much of the meeting was spent working on the 2012 County budget.  Commissioners discussed the budget with Judy Wallis and Shane Walker.
 
Harold Coleman made a motion to go into executive session, for a period of five minutes, under the attorney/client privilege exception to the Kansas Open Meeting Act.  Jingles Endicott seconded the motion and all voted in favor.  Those present for the session were the commissioners and Terri Johnson.  The session began at 11:00 am and ended at 11:05 am with no action.
 
Terri Johnson, Susan Quick, Lora Holdridge, Joanne Long and Ron Gray met with commissioners to discuss the proposed wage decrease for elected officials in 2012.  They said the proposed 10% cut is too much, but would consent to 5%, if the other department heads were involved.
 
Allen Warren made a motion to go into executive session, for a period of 20 minutes, under the non-elected personnel exception the Kansas Open Meetings Act.  Jingles Endicott seconded the motion and all voted in favor.  Those present for the session were the commissioners.  The session began at 12:12 am and ended at 12:32 pm with no action.
 
Commissioners planned a budget work session for Thursday, August 4, 2011, at 9:30 am.
 
After routine business, the meeting adjourned at 12:52 pm.

The Bourbon County Commission met in special session for a budget work session.  All commissioners and the county clerk were present.  Also present were Terry Sercer, Valorie Leblanc, Terri Johnson and Larry Gazaway.
 
Commissioners continued to revise the County’s 2012 budget, with no finality, and adjourned at 11:00 am.

The Bourbon County Commission met in open session with Jingles Endicott and Harold Coleman present.  Joanne Long was also present.  Minutes of the previous meetings were read and approved.
 
Marty Pearson gave a road report.
 
Richard Johnson, Foley Equipment, met with commissioners to have purchase documents and warranty agreements signed on the two Cat motor graders the County recently agreed to purchase. Jingles signed the documents.
 
Steve Kibble met with commissioners.  He wants to join Bourbon County Sewer District #1.  Commissioners are unsure if/how that is possible.  They will speak with Terri Johnson about it.
 
Larry Sharp, KCAMP, met with commissioners to discuss claims history/loss ratio for the County.
 
Keith Jeffers presented commissioners with an Emergency Management update.
 
Terri Johnson met with commissioners to discuss Mr. Kibble’s request to join the sewer district.  She will research the law.
 
Terri Johnson asked commissioners to inform the elected officials if the salary reduction to 10% is revisited.  They agreed to do so.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Tom McNeil updated commissioners on grinder pumps in the Sewer District.
 
Commissioners signed the biennial update for bridge inspection and analysis with Schwab-Eaton.
 
Commissioners received a request for intermittent closing of roads for the Marmaton Watershed.  Jingles Endicott made a motion to move forward with the requested road closings.  Allen Warren seconded the motion and all voted in favor.  Notice of public hearing will be published, according to law, and a hearing was set for 10:00 am, Friday, August 26, 2011, to hear the matter.
 
Keith Jeffers met with commissioners for an emergency management update.  He said that FEMA is awarding Drywood Township with an additional $5,000 grant to purchase a storm siren.
 
Terri Johnson and Valorie Leblanc met with commissioners to ask for an executive session.  Jingles Endicott made a motion to go into executive session, for a period of 15 minutes, under the attorney/client privilege exception to the Kansas Open Meetings Act, to discuss possible litigation.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson and Valorie Leblanc.  The session began at 10:50 am and ended at 11:05 am with no action.

Harold Coleman made a motion to go into executive session, for a period of 20 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act, to discuss employee matters related to the budget.  Allen Warren seconded the motion and all voted in favor.  Those present for the session were the commissioners and Terri Johnson.  The session began at 1:01 pm and ended at 1:21 pm with no action.
 
Harold Coleman made a motion to return to executive session, for a period of 20 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act, to discuss employee matters relating to the budget.  Allen Warren seconded the motion and all voted in favor.  Those present for the session were the commissioners and Terri Johnson.  The session began at 1:22 pm and ended at 1:42 pm with no action.
 
Allen Warren made a motion to go into executive session, for a period of 15 minutes, to discuss employee matters related to the budget.  Jingles Endicott seconded the motion and all voted in favor.  Those present for the session were the commissioners and Judy Wallis.  The session began at 2:04 pm and ended at 2:19 pm with no action.
 
After discussion, Jingles Endicott made a motion to publish the County’s 2012 budget with an estimated 4.710 mill increase.  Harold Coleman seconded the motion and all voted in favor.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meetings were read and approved.
 
Bills and payroll for the period were reviewed and approved.
 
Tom McNeil spoke about sanitation issues.
 
Marty Pearson gave a road report.
 
Jim Adams and Carter Stegall, Land Man with Running Foxes Petroleum met with commissioners.  Mr. Stegall picked up an application for road access permit.
 
Larry Gazaway spoke with commissioners about the County budget.
 
Commissioners received a formal petition from Harold A. Cox for access to land that is landlocked.  He also sent a formal request to subdivide his 63 acres into a subdivision.  Terri Johnson will research these items.
 
Terri Johnson discussed the sewer district.  She presented a draft letter to the Sauerweins from the County.  Commissioners signed the letter.  She’s also looking up laws on roads for Mr. Cox.
 
Todd Beerbower met with commissioners.  He expressed concern over the sewer line clean-up along the ditches on Indian Road and discussed the budget.

Marty Pearson gave a road report.
 
Charley Ballou and Joe Johnson stopped in to ask questions about the County budget.
 
Troy Arnold asked commissioners the status on 240th St.  He also said that Charles St needs a center line for safety and really needs to be widened.
 
Charlie Blevins was here for the budget hearing but it’s not until the 22nd.
 
Terri Johnson spoke with commissioners about legal issues.
 
Curt Shankel spoke with the commissioners about the budget.
 
Mrs. Bob Sipe complained to commissioners about excessive brush on 165th Street, south of Quail Road.

August 19, 2011    Friday 9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meetings were read and approved.
 
Marty Pearson gave a road report.  They also discussed rock crushing equipment.  No action.
 
Larry Arndt thanked the commissioners for the road around West Bourbon Elementary.  It looks great.
 
Jim and Cecelia Kramer met with commissioners.  Cecelia asked about the delinquent tax listing that was recently published.  Susan Quick was present for the discussion.  It was confirmed that people on the payment plan are not on the listing.  Mrs. Kramer feels the payment plan should be offered to everyone.  She mentioned that Susan Quick and members of her family are on this plan.  She asked for a list of people on a payment plan, what they’ve paid and when.  Susan stated that 2007 delinquent taxes will be on the sale next year.  The commissioners want a list of people and payments on the plan, too.
 
Dan and Jan Laughlin met with commissioners to discuss the recent vacancy of the office of Timberhill Township Treasurer, due to the death of Mark Scharenberg.  Mark’s brother, David, has agreed to fill the vacancy, if the commissioners will appoint him.  Allen Warren made a motion to appoint David Scharenberg, 1045 Yale Rd, Mapleton, as Timberhill Township Treasurer.  Harold Coleman seconded the motion and all voted in favor.
 
Commissioners signed an amendment to CDBG 09-RA-001, for $5,000, for a storm siren in Garland, as an extension of the Drywood Community Building project.
 
Tom McNeil met with commissioners to discuss sanitation issues.
 
Allen Warren made a motion to close the Transfer Station on Saturdays preceding observed federal Monday holidays.  Jingles Endicott seconded the motion and all voted in favor.
 
Keith Jeffers reported on Emergency Management issues.
 
Terri Johnson met with commissioners.  She researched the laws pertaining to landlocked properties.  The law requires the petitioner to state where he wants the road to be, so that the County may notify the appropriate affected parties.  As for the subdivision issue, if he’s in the three-mile limit of Fort Scott, he would need to go through the City’s Planning Commission.  Terri will write a letter to inform Mr. Cox of the additional requirement.

Commissioners discussed the payment plan with Susan Quick.  They would like Susan to work with Terri Johnson to enforce the contracts we have and to research the statutory authority of the programs.
 
Don George, KDWP, met with commissioners to discus recent incidences at Cedar Creek Lake, involving vandalism and littering, and the increased sheriff’s patrol at the lake.
 
Tom McNeil and Shane Walker spoke with commissioners about Lake Fort Scott, as it concerns the City’s 3-mile zone.

August 22, 2011  Monday      9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
David Middleton spoke with commissioners about the Hiattville Fire District.  He says they’re not happy as a member of Fire District 3 and want to create their own.  A petition was circulated to this effect a couple of years ago but nothing came of it.  The commissioners said that the tax dollars generated by the properties in the district couldn’t support the station and that it wasn’t in the best interest of the taxpayers to separate from FD3.  There was also discussion of the training requirements the station must keep up to maintain FEMA funding.
 
Jingles Endicott called the County budget hearing to order at 10:00 am.  Those present were the commissioners, Joanne Long, Michael Pommier, Terry Sercer and Terri Johnson.  Terry Sercer went over the budget preparation process and explained the cuts that have been made in spending, wages and a couple of employees, as well as the continuing rise of employee benefits.  After hearing no objections, Jingles Endicott made a motion to close the hearing at 10:11 am.  Allen Warren seconded the motion and all voted in favor. 
 
Jingles Endicott made a motion to adopt Resolution 12-11, as a part of the budget.  Harold Coleman seconded the motion and all voted in favor.
 
Jingles Endicott left the meeting at 10:12 am to be a pall bearer at a funeral.
 
Allen Warren made a motion to adopt the 2012 County Budget with an estimated 3.880 mill increase over this year.  Harold Coleman seconded the motion and both voted in favor.  Several copies of the budget were signed by the Board.
 
Joanne Long informed commissioners that she has located two times when the Treasurer’s delinquent tax payment plan has been mentioned in the minutes.  They were both in conjunction with discussion of a tax sale.
 
Ron Gray spoke with commissioners about vehicle repairs needed to sheriff vehicles.
 
Terri Johnson and Susan Quick met with commissioners.  Terri researched the payment plan law and found K.S.A. 79-2024, which provides for the county treasurer to accept partial payments for delinquent real property tax, under guidelines set forth by the county treasurer.  Therefore, she says the payment plan is within the law.  She does feel that all delinquent property taxpayers should be listed in the notice, regardless of whether or not they are on a payment plan.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Jim and Cecelia Kramer, Melvin and Fleeta Antrim, Bobbi Kemna, Claudia Wheeler, Fred Judy, Steven Mason, Iliah Parson, Jane Burns, Evelyn and Gary Thurston, Sandy Wrench, Cathy and Andrew Pechin, Shirley Goltra, Phil and Nancy Clayton, Gene and Peggy Cowan, Shirley Palmer, Larry and Sue Porter, Leola Miller, Randall Handly, Darrell Parker met with commissioners.  Michael Pommier, reporter with the Fort Scott Tribune, County Treasurer, Susan Quick, and County Attorney, Terri Johnson, were also present.  Chairman Endicott re-read a portion of the minutes from last Friday to get people up to speed on the delinquent tax discussion.  A heated discussion ensued, with allegations of wrong-doing by the Treasurer, with regard to publishing the delinquent tax notice, and discussion of the legality of a delinquent tax payment plan and how it is operated.  Some of the specific questions and answers are:
 
K.S.A. 79-2302 says all delinquent taxes are to be listed.  The Treasurer is running an addendum to put the names of those on the payment plan in the paper. 
 
Where’s the legal right to take people out of the publication?  No answer.
 
Tax Sale:  There was not one this year because it wouldn’t have been financially feasible.  2007 and prior will be sold in early 2012, regardless of if you’re on the payment plan.  The real money in a tax sale is from redemptions.  The attorney advised us not to have one this year and to sell 2007 and prior in 2012.
 
Allegations that some people were held off tax sale that were on the payment plan.
 
Accusation that the County Clerk is not taking minutes.  The clerk read back her notes, explained that minutes are a record of who’s in attendance and actions taken.  Minutes are not taken verbatim, and are approved by the commissioners, who have said to add/remove or change things before.  Commissioners do not want to record the meetings.
 
The charge for the requested list.  Allen Warren made a motion to waive the charge and to have the Treasurer provide two copies by 1:00 pm, Monday.  Jingles Endicott seconded the motion and all voted in favor.
 
Request for commissioners to ask for a state audit of the Treasurer’s accounts.
 
Questions to Terri Johnson about Susan breaking the law.  Terri explained that not following a statute doesn’t necessarily mean a crime has been committed.  And independent investigation may be needed.  She said that the commissioners have some authority to request an independent cash count.  We also have an annual audit. 
 
Are penalties and interest taken off the top?  Some question as to that not being the case.
 
Are people on the payment plan paying interest, and if so, how much?  Yes, the amount is set by the State annually.
 
Is there a written policy on the payment plan?  No.
 
Do other counties have this payment program?  Yes, 60 have responded that they do, 2 that they do not take partial payments on delinquent taxes.
 
Commissioners thanked the people for coming up and expressing concern.  They will look into the allegations and move forward from there.
 
A public hearing was opened at 10:00 am for consideration of a permit for Watershed 102 for temporary closing of roads in the county, caused by the inundation of the roads by flood waters from Dam Site N-1, also known as Cedar Creek Reservoir.  Joanne Long explained that the notice was published in accordance with law and notices were sent to the affected utilities.  After hearing no objections, the hearing was closed at 10:12 am.  Jingles Endicott made a motion to approve the permit.  Allen Warren seconded the motion and all voted in favor.  The permit and the bill for publication will be sent to Frank Young at Ag Engineering, in accordance with law.
 
Dylan Marlow met with commissioners to give commissioners a head’s up on a huge influx of inmates downstairs.  We are at 70 inmates, currently and shipping 11 to Cherokee.  They are all Bourbon County inmates.
 
Harold Coleman nominated Jingles Endicott as Bourbon County’s delegate to KAC.  Allen Warren seconded the motion and all voted in favor.
 
Jingles Endicott nominated Allen Warren as 1st Alternate to KAC.  Harold Coleman seconded and all voted in favor.
 
Allen Warren nominated Harold Coleman as 2nd Alternate to KAC.  Jingles Endicott seconded and all voted in favor.
 
Jim Adams spoke with commissioners about Running Fox Petroleum business.
 
Tina Rockhold, Mercy Health Systems, met with commissioners to discuss the upcoming annual celebration of Mercy Day, Saturday, September 24th.  There is a half-marathon involved this year, with the route going from Mercy, south on 215th Street, passed Indian to Hwy 39, looping back up 215th, passed Mercy, along Horton north to 8th Street, loop Burke, back up Horton to the hospital.  They plan to have aid stations, port-a-potties and volunteers to guide traffic along the approximate 13.1 miles.  They want to use the west side of road 6’ to the shoulder for a run/walk lane.  She’s here to ask the commissioners to prepare the rural roads to make them safe for the participants and to verify that it’s okay to use it.  She’d also like the commissioners to notify the residents in the area of the plans.  Commissioners said they can put up barricades at Indian and 215th to allow for local traffic only and make sure the potholes are filled and the grass is mowed.  Mrs. Rockhold said the race starts at 7:00 am and should be concluded by noon. 
 
Lois Coyan presented phone quotes for 384 oz. of Escort XP.  Three were received.  They were:

Jingles Endicott made a motion to purchase from CPS at $4.05/gal, for a total of $1,555.20.  Harold Coleman seconded and all voted in favor.
 
Susan Porter, Larry Porter, Bobbi Kemna, James Kramer, Cecelia Kramer, Phil Clayton, Nancy Clayton, Shirley Goltra, Evelyn Thurston, Gary Thurston, Leola Miller, Peggy Cowan, Gene Cowan and Steve Mason met with commissioners.  Mrs. Porter turned in her ID badge.  She was terminated after 8 yrs of employment, at-will on Tuesday.  She explained that she was afraid to speak with commissioners about any concerns, for fear of losing her job.  She went on to claim that she was told to do things she wasn’t comfortable with, concerning people’s tax payments, the payment plan and interest.  She cited several examples where interest was dropped off of someone’s taxes, property removed from the tax sale and at least one instance where a payment was made on one property but then reversed and credited to another property of the same owner, once the first was sold off to someone else.
 
Mrs. Porter also discussed the lower interest amounts the County accounts now receive compared to years past.  She knows of other counties that move their money around a lot in order to get the most interest.  Bourbon County has had its main account with UMB for the last six or seven years.  She also says that Susan Quick told her employees they needed to support Joanne Long.
 
Terri Johnson was asked what law allows removing interest from late payments.  Terri said there’s only an exception on bankruptcy cases.
 
Mrs. Johnson explained what will happen now.  The commissioners will make a decision, of which Mrs. Johnson will offer advice.  The allegations will be researched to see if any rise to the level of “criminal” behavior.  She will ask for an investigation.
 
On the topic of the recent at-will terminations, the County Attorney cannot advise those people, as she is the County’s attorney/Counselor and cannot advise private individuals.  Some in the audience feel that a reason should be given, regardless of state law not requiring one.  Perhaps a committee of department heads and commissioners should be formed to discuss proposed terminations in the future before they happen.  The clerk and treasurer spoke with the employment law attorney prior to the terminations.  None of the firings were Terri Johnson’s decision.
 
The future of the payment plan was also discussed.  Some feel it should be eliminated altogether.  Others feel it should be publicly offered to everyone.  The group feels that clearly defined procedures for the plan should be made available.
 
Susan Quick talked to the bank.  The interest rates we get now are 0.015%.  Also, we don’t receive interest on our checking account, but we get free checks and deposit slips because of the large balance we maintain.  Also, she doesn’t deal with her sister at the bank and never has.  The addendum to the delinquent tax listing will be in the paper as soon as possible and will be printed three times.  Commissioners asked her about distributing partial tax payments, but she’s not sure if that’s allowed. 
 
Sheriff Ron Gray informed commissioners of a large arrest this morning.  Terri Johnson says she hopes to charge them Monday.
 
Terri Johnson plans to look into the laws to see what control commissioners have over an elected office, so that commissioners can answer questions without promising something they can’t keep.
 
Shane Walker presented a weekly report of his activities.  He also discussed security cameras with commissioners.

The Bourbon County Commission met in open session with all commissioners present.  Tony George was also present.

Bills and payroll for the period were reviewed and approved.
 
Lynne Oharah stopped in, but had no business.
 
Susan Quick provided commissioners with a list of taxpayers on the payment plan.
 
Terri Johnson informed commissioners that she has asked the KBI and Attorney General’s office for help, based on the information presented at the August 26, 2011, commission meeting.  She also recommended that commissioners meet with Terry Sercer and advised them about K.S.A. 19-506b, which allows for the commissioners to conduct a surprise cash count of all accounts managed by the treasurer.
 
After discussion, Allen Warren made a motion to adopt Resolution 13-11, a surprise cash count of all accounts handled by the County Treasurer.  The count is to be as of close of business, Friday, August 26, 2011, and include all checking, savings, CDs and all interest year to date on such funds.  They ask that the report be presented at 9:00 am, Friday, September 2, 2011.
 
Tom McNeil reported that the correct amperage for the grinder pumps in the Sewer District should be 30 amps, vs. the previously stated 20 amps.  He also discussed a lot which has multiple users with 5th wheel trailers, which he believes should be required to hook up to the sewer line, based on length of time they are on the lot.
 
Keith Jeffers presented an Emergency Management report, including recent and future training opportunities.
 
Terri Johnson also discussed the bidding process with commissioners.
 
Joanne Long presented Pay Estimate #5 to McInroy for approval.  Jingles Endicott signed the document.
 
Harold Cox spoke with commissioners about access to his property which is land-locked.
 
Steve Kibble spoke with commissioners about his previous request to join Bourbon County Sewer District #1.
