The Bourbon County Commission met in open session with Harold Coleman and Jingles Endicott present.  Shirley Goltra was also present.
 
Terri Johnson met with commissioners.  She received a lease purchase agreement for Fire District 3 to review.  She is not their legal counsel.  The commissioners would like to speak with Delwin when Terry Graham is here, as he knows more about the set-up of the fire district because he’s been a commissioner longer.  They will discuss it on Friday.
 
After routine business, the meeting adjourned at 11:16 am.

November 5, 2010     Friday  9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present. 
 
Sheriff Gray and Jimmy Nichols met with commissioners to announce that Ron, Jimmy and three other staff have been selected by the Department of Justice to head up one of five 5 man teams to go to the Department of Justice, in either Washington, DC or in Colorado, to help write new guidelines for an inmate management behavior program.  The commissioners offered their congratulations.  All expenses will be covered for the trip from the Federal Government.
 
Marty Pearson gave a road report.
 
Marty Pearson and Lois Coyan spoke with commissioners about a person who had a 24’ culvert installed and wanted to increase it to a total of 40’.  Public Works put in additional 16 and a band to tie them together.  Lois sent a bill for the additional 16’ and the band.  The landowner refuses to pay for it citing he is a taxpayer.  The commissioners said to bill him for it and put it as an assessment on the property if he refuses to pay.
 
Charlie Elliott spoke with commissioners about a problem he’s having with a person in his area who continues to harass him about his graded roads.  He’s been threatened by this person and is afraid something may happen.  He shows up anywhere Charlie is in his district.  Harold Coleman said he will speak with the person to see if he can settle things.
 
Ann Ludlum wants to know if any commissioners will be attending the annual meeting Monday night.  She said that spouses are welcome.  No commissioners will be attending.
 
Joanne Long asked commissioners what to do about Shane & Marty’s sick and vacation time.  If we can settle this, all non-elected exempt personnel will be the same.  Marty Pearson said it doesn’t matter to him and Shane has already said he’d like to get them paid off and removed.  Commissioners agreed to pay off Marty Pearson and Shane Walker, as if they were leaving employment, and wiping their sick and vacation time away.  This is what was done for Joanne Long, Susan Quick and Sharon Elder when they moved up from office staff to elected positions.  All commissioners were in agreement with this decision.
 
Terri Johnson, Delwin Mumbower and Lou Howard met with commissioners about the lease purchase of a truck for Fire District 3.  The commissioners set up Fire District 3 under a statute which gave them a board of trustees, which has final authority on expenditures.  However, they submit a budget to the County Commissioners for approval each July.  Terry Graham made a motion to authorize Terri Johnson to act as legal counsel to Fire District 3, on a limited basis.  Harold Coleman seconded the motion and all voted in favor.  Terri Johnson indicated that she’ll need some information from Delwin to give counsel on the lease purchase, including minutes of the meeting and bid procedures. 
 
Terri Johnson spoke with commissioners about the sewer district.  The Sauerwein’s have a trailer on their lot, as was demanded by the City in order to purchase it.  It has electricity but no running water, and there’s no active holding tank.  They don’t want to install a grinder pump at this time.  The commissioners said if they remove the trailer, it will be a vacant lot.  Then, they can forego the grinder pump and have no debt repayment.  The only way they will allow this is to remove the structure and have no holding tank.
 
Ron Center spoke with commissioners about tire removal.  The Chanute landfill, where we take them, has doubled their prices from $60/ton to $120/ton for discarding now.  He’s been looking for someplace else to take them.  Yoho Tire in Yates Center is an option, but Champlain Tires at Weir is $100/ton with rims. Weir is closer and less expensive than Chanute.  He also asked commissioners to increase our prices for taking tires at our landfill to make up the difference of the increase.  He said we haven’t had an increase since 1988.  Jingles Endicott made a motion to increase Bourbon County’s prices for accepting tires to:
 
                   Car tires                            $ 1.75 each (no rims)
                   Tires up to 10 x 22              $ 5.25 each
                   Tractor tires up to 18R x 46 $25.00 each
                   Car tire with rims               $  3.50 each
 
Terry Graham seconded the motion and all voted in favor.
 
Bill Danley met with commissioners to ask about a cemetery south of Mapleton which needs cleaned up.  It’s not listed as a cemetery on any of our maps.  It’s not a family cemetery.  Jingles located the deed where the property surrounding it was transferred to Karns, but specifically mentions excluding that part which is a cemetery.  The township is willing to maintain it.  There would need to be help to the road to it.  The commissioners will research it further.
 
Joanne Long asked commissioners if they would sponsor a location for health screenings for our insurance.  The commissioners were not interested.
 
Joanne Long asked if they’ve made any decisions on the west parking lot.  They have not but will discuss it on Monday.
 
Terri Johnson came back after speaking with the Sauerweins.  They are now interested in saying yes to a grinder pump, but not installing it right away.  This way, they would pay the debt repayment and wouldn’t have to pay extra at a later date to get a grinder pump if/when they decide to improve their lot.  The commissioners will verify that’s allowable with the engineer.  They do recommend installing the casing now, even if they hold off on putting in the pump, as it would save money for them.
 
Joanne Long presented a request for a vacation of roads in Marco Estates.  Commissioners set a public hearing for 10:00 am on December 10th to hear about it.  Joanne Long will proceed with the requirements.

The Bourbon County Commission met in open session with all commissioners and the county clerk present. 
 
Allen and Jackie Warren were present.  Joanne Long confirmed changing Terry Graham’s registration for the KAC annual conference to Allen Warren.
 
Bill Metcalf spoke with commissioners about coming back to work after surgery.  He’s been released for light duty.  We have no light duty and gave him a letter stating as such, per his request.
 
County Board of Canvassers met at 9:30 am to finalize the November 2nd General Election.  Allen and Jackie Warren were present.  Joanne Long and Tony George reviewed the provisional ballots to be considered.  In the end, 71 were fully counted at 6 were partially counted.  Those totals were added to the preliminary numbers from November 2nd.  No race results were changed with the addition of the provisional votes.
 
Marty Pearson gave a road report.
 
The commissioners discussed the west parking lot. They decided to open spot 3 for additional Health Department parking.
 
The commissioners informed Joanne Long that they will view the cemetery that Bill Danley spoke about at a previous meeting on Monday.  They will leave here at 10:00 am.  It’s located in Section 4, Township 24, Range 23, in Timberhill Township.  That will be the last appointment of the day.
 
Joanne Long announced that Sexual Harassment training has been scheduled for December 8th and 9th.  The commissioners confirmed that it is mandatory for all employees to attend.  It will be held at the 4-H Building at the following times and will last about an hour each.

The Bourbon County Commission met in open session with Harold Coleman and Jingles Endicott present.  Minutes of the previous meetings were read and approved.
 
Bills and payroll for the period were reviewed and approved.
 
Charles Steve Shireman met with commissioners to see about a fence viewing between himself and a neighbor.  The neighbor doesn’t live in Kansas and doesn’t want a fence.  He’s been contacted by the neighbor’s attorney about it.  The commissioners looked over the fence viewing laws, but they appear to be conflicting in some areas.  They need to speak with the County Counselor about it.  Mr. Shireman left money for a viewing, depending upon what Terri Johnson tells them.
 
Keith Jeffers met with commissioners.  He said we’re expected to receive an additional inch of rain before the concert starts tomorrow.
 
Terri Johnson met with commissioners.  They asked her about the fence viewing laws.  She will review them and get back with them on Monday.
 
Mrs. Johnson also spoke briefly about cemeteries.  No action.

November 15, 2010   Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Harold Coleman informed commissioners and Marty that he spoke with the person in Charlie Elliott’s district that has had complaints.
 
Joanne Long informed commissioners that the 10 day period has passed from the time she sent the registered letter to the Timberhill Township Clerk regarding the request for a Cereal Malt Beverage License for the Mapleton Café and C-Store.  There has been no response.  Terry Graham made a motion to approve the CMB license.  Jingles Endicott seconded the motion and all voted in favor.
 
Terri Johnson met with commissioners to discuss abandoned cemeteries and fence viewing laws.  She also spoke about the Wade Aluminum agreement.  After discussion, Terry Graham made a motion to sign the agreement.  Harold Coleman seconded the motion and all voted in favor.
 
The commissioners left at 10:00 am to view an abandoned cemetery in Timberhill Township.  They returned at 11:45 am.
 
Jimmy Nichols met with commissioners about the jail.  We’re still spending about $10,000 per month to house some of our people in Cherokee County.  He would like to get most, if not all of them, back under our roof.  He wants to purchase bunk beds for additional bed space in the jail.  He had quotes for 4 beds (sleeps 8).  They were:

Jingles Endicott made a motion to purchase the beds from Charmtex for $2,547.  Terry Graham seconded the motion and all voted in favor.  There will be an agreement drawn up for those who will volunteer to stay in the bunk beds, for less square footage.  There will be benefits for them if they agree.

November 19, 2010     Friday        9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.  He also informed commissioners he’ll need to purchase some culverts before spring.  Commissioners will review the budget to see what we can afford.
 
Valorie Leblanc updated commissioners that she has all but seven easements back for the sewer district.
 
Joanne Long asked commissioners about people who are on vacation on the days of the Sexual Harassment class, due to hunting season.  The commissioners reiterated the class is mandatory and they can swing an hour or two if they’re in the county.
 
Jingles informed commissioners and Marty that the National Cemetery told him that they have a lot of replaced headstones that they’re willing to donate to the County to grind up.  He said they’ve even indicated they will haul them to us.
 
Joanne Long said that Health for Life is asking to set up an open house with us as a potential corporate account.  Commissioners said it’s not feasible at this time.
 
Ms. Long also informed commissioners of an email she received from Jeffrey Tamkin, Public Facilities Investment Corporation, who is interested in speaking with us about any improvement projects we may have.  The commissioners said to tell him we’re not interested at this time.
 
Joanne Long also informed Jingles Endicott of a meeting with the 69 Hwy Corridor Management group on December 1, at 1:30 pm.  Jingles is aware of the meeting and plans to attend.
 
Ms. Long informed commissioners we’ve been approached by the first of our agents who sell supplemental insurance to County employees asking when they can come speak with commissioners about open enrollment.  Based on events from last year, the commissioners agreed to have them all come on the same day so employees get the full story about their choices.
 
David Neville left a proposed contract for services from Cintas.  They handle the uniforms for Public Works and our towels and rugs at the courthouse.  They have asked for a contract before but we’ve refused to sign.  They’re asking again.  The commissioners want Terri Johnson to review it, as it still has the 60 month clause, which was our main point of contention in prior years.  It also has automatic renewal and price increases.
 
Lora Holdridge confirmed that the three parking spaces in the west lot are open on Fridays for anyone to park in, since the Health Office is closed on Fridays.  The commissioners agreed.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Allen Warren, commissioner-elect, was present.
 
Charlie Blevins complained about his taxes and his neighbors with bobcats.  He wants to know if the commissioners will ban them for county roads.  They will not.  He left unhappy and said that he’d go to the State and the Federal government after this.
 
Commissioners reviewed quotes for culverts.  Two were received.

Terry Graham made a motion to purchase from Welborn Sales.  Jingles Endicott seconded the motion and all voted in favor.
 
Joanne Long relayed a phone complaint she received last Friday on a County Employee.  Commissioners will speak with the employee about it.
 
Terri Johnson spoke with commissioners on several topics.  She advised commissioners not to sign a contract with Cintas, as it is for 60 months, does not conform to the cash-basis law, and does not allow for us to get out of it.  She also spoke with commissioners about fence viewing.  She advised commissioners to have the viewing that has been requested.  On the sewer district, she working with the City of Fort Scott on the inter-local agreement and verified that she and Valorie will continue to receive payment for their work on the project.  Terry Graham made a motion to authorize placing receptacles as a landowner option on the bids, when letting the contract.  Harold Coleman seconded the motion and all voted in favor. 
 
The commissioners and Terri Johnson spoke with Shane Walker about GPS mapping for the sewer line.  That will be worked into the agreement with the City, also.
 
Commissioners also authorized the County Attorney to get a sign for her building.
 
Commissioners scheduled a fence viewing for Friday, December 3, 2010, at 10:00 am.  Terry Graham and Jingles Endicott will be the viewers.  Allen Warren and Harold Coleman may also go to observe.
 
Bill Danley met again with commissioners to ask about the abandoned cemetery in Timberhill Township.  Commissioners said they viewed it last week, but that it will take a lot of work to get it back in shape.

Allen Warren thanked commissioners and Marty for the rock at the fairgrounds for the concert.

Much of the meeting was spent discussing septic tank regulations in the County.  No action at this time.
