January 4, 2010  Monday      9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Much of the morning was spent in discussion of holiday pay.  Currently, employees required to work on official holidays are paid at double time for hours worked.  The argument is that the Road & Bridge personnel who had to work during the blizzard on Christmas Eve and Christmas Day should be compensated more than that, since it was a holiday and they were scheduled to be off, as opposed to the Sheriff’s Department and the Correctional Center, which are staffed 24/7, regardless of holidays.  Joanne Long discouraged the commissioners from assigning different classifications for different employees and felt that all employees should be compensated with parity.  After discussion, Terry Graham made a motion to create the classification of Inclement Weather Holiday Pay for Road & Bridge employees called in to work a holiday, such as Christmas, at double time over the holiday, retroactive to December 24, 2009.  Harold Coleman seconded the motion and all voted in favor.  (Example: The holiday is 8 hours.  If they work 10 hours on the holiday, they will be paid 8 hours for the holiday and double-time for the 10 hours worked.)
 
As it is the New Year, Joanne Long asked commissioners to re-organize the Board.  Harold Coleman made a motion to re-appoint Terry Graham as Chairman.  Jingles Endicott seconded the motion and all voted in favor.  Harold Coleman then made a motion to appoint Jingles Endicott as Vice-Chairman.  Terry Graham seconded the motion and all voted in favor.
 
Joanne Long presented Resolutions 01-10 through 05-10 for consideration.  They were:
 
Resolution 01-10 Official Holidays and Closed Days for 2010
Resolution 02-10 Waiver of GAAP Principles
Resolution 03-10 Mileage .50/mile
Resolution 04-10 Cancellation of Checks 2 yrs old
Resolution 05-10 Official Depository and Newspaper
 
Jingles Endicott made a motion to adopt the above resolutions, as presented.  Harold Coleman seconded the motion and all voted in favor.
 
Joanne Long also discussed the countywide 1% sales tax.  It expires June 30, 2011.  She said that if we want to continue it, we will need to have an election this spring, prior to the 2011 budgets being prepared in July.  We may consider having it sooner rather than later, in case it doesn’t pass the first time.  She also offered that they can consider changing up the wording to perhaps allow for something for the jail.  No action at this time.

Marty Pearson gave a road report.  The crews have had to reopen roads from blowing snow.  The commissioners said they think the County crews have done an outstanding job, considering the weather they’ve had to work with.
 
Karen Paddock discussed storage.        
 
Bill Keith spoke about the landfill site.

Terri Johnson spoke with commissioners about sewer district business.
 
Keith Jeffers requested another Declaration of Disaster Emergency for continuing conditions the County has experienced since the blizzard on Christmas Eve and Christmas Day 2009.  Terry Graham made a motion to adopt Resolution 06-10 as such.  Harold Coleman seconded the motion and all voted in favor.
 
Mr. Jeffers also spoke with commissioners about Emergency Preparedness items.
 
Tim Cunningham, Executive Director of Tri-Valley, met with commissioners to have an agreement signed between the County and Tri-Valley for 2010 services.  Mr. Cunningham has been working with Terri Johnson on this for a few weeks.  Harold Coleman made a motion to sign the agreement. Terry Graham seconded the motion and all voted in favor.
 
Terri Johnson met with commissioners and requested an executive session to discuss legal matters.  Harold Coleman made a motion to go into executive session, for a period of 10 minutes, under the Attorney/Client Privilege Exception to the Kansas Open Meetings Act.  Terry Graham seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson and Joanne Long.  The session began at 11:13 am and ended at 11:23 am with no action.
 
After routine business, the meeting adjourned at 11:52 am.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Bills and payroll for the period were reviewed and approved.
 
Marty Pearson gave a road report.
 
Terri Johnson spoke with commissioners.  She wants to put herself and Valorie down as attorneys for the County on the sewer business, that way if either is in court, the other can work on any issues that my arise.  She gave commissioners a copy of the proposed letter as such to send to the State about it.  They also discussed the proposed sewer district.  Letters have been sent on the grant award.  We’re waiting to hear.
 
Tom Palzer met with commissioners to check on a road closing.  Joanne Long said that she hit a dead-end with it because the property was not listed under his name, but that of a business in Overland Park and there was no way to contact him.  He confirmed that the business was him and so Ms. Long said that she can continue with the request.
 
Keith Jeffers told commissioners there will be a damage assessment meeting on Wednesday at 9:00 am, involving FEMA, KDEM and public agencies which were affected by the storms.
 
Laura Moore, SEKRPC, met with commissioners.  Michael Pommier, Fort Scott Tribune, was present.  Jingles Endicott made a motion to allow Terry Graham to sign the contract documents, the notice to proceed for the work and an amended budget, which changed some individual line-items but not the overall budget figure.  Harold Coleman seconded the motion and all voted in favor.  She said that the asbestos inspection showed asbestos in the old pool hall, which will require removal.  She said they hope to begin pre-construction on December 15th with an estimated project completion on July 19.
 
Tom McNeil informed commissioners that Bob Medina will be here next week.  Mr. McNeil also stated that he’s to begin inspecting abandoned wells as part of his duties.
 
Jingles Endicott made a motion to adopt a resolution revising the Bourbon County Solid Waste Management Plan.  It is an annual resolution.  Harold Coleman seconded the motion and all voted in favor.
 
Harold Coleman made a motion to sign an addendum to the contract Bourbon County has with Berlin Wheeler for going after delinquent personal property tax.  Terry Graham seconded the motion and all voted in favor.
 
David Neville spoke with commissioners about a rusted and leaking radiator in the basement.  The commissioners viewed the radiator.  No action at this time.

January 22, 2010         Friday        9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and corrected.
 
We received the funding for the sewer project.  Terry Graham met with the County Attorney and others earlier this week regarding the sewer to discuss the next step.
 
Susan Quick spoke with commissioners about the Tax Sale, scheduled for next Wednesday at noon.  She’s spoken with the City Manager about special assessments.  He has already agreed to forgive the assessments from 2009 and prior.  She will also ask about any assessments set to go on in 2010.  She returned to the meeting to say that the City has also agreed to waive any specials which are to go on in 2010 for properties sold at this tax sale.

Harold Coleman made a motion to appoint the Trustees and Alternates as recommended.  Jingles Endicott seconded the motion and all voted in favor.
 
Jake Gross thanked the commissioners for their services.
 
David Neville met with commissioners to ask about the radiator in the basement.  No one has called back about it.  He informed commissioners that there was a sewer back-up in the basement on the corrections side.  The insurance adjuster will be here later today. 
 
Marty Pearson gave a road report.
 
Jess Pfannenstiel, KCAMP, met with commissioners.  He just viewed the basement from the problem this week.  He said we’ll only have to remove/replace the carpet.  We probably won’t need to replace any plaster, as the walls are block down there.
 
Laura Moore, SEKRPC, met with commissioners with another budget amendment.  They wouldn’t accept the one she presented last week so she’s re-worked it to something they’ll accept.  Jingles Endicott made a motion to adopt the budget amendment as presented.  Harold Coleman seconded the motion and all voted in favor.
 
Terri Johnson met with commissioners.  She worked with commissioners on a news release and notice to landowners about the sewer district informational meeting.  Terry Graham made a motion to have informational meeting Feb 6th at 10:00 am at the Fine Arts Center of FSCC and public hearing on Feb 12th at the County Commission meeting.  Jingles Endicott seconded the motion and all voted in favor.
 
Tom McNeil and Bob Medina, KDHE, met with commissioners to discuss sanitation issues, including illegal dump sites and clean-up.  The meeting continued down in the basement through lunch and adjourned at 1:20 pm.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Harold Coleman made a motion to re-appoint Jingles Endicott to the BEDCO Board.  Terry Graham seconded the motion and all voted in favor.  The annual meeting is scheduled for Thursday, March 11th at 3:30 pm, at the Citizens Bank boardroom.
 
Marty Pearson gave a road report.
 
Terri Johnson met with commissioners.  She discussed sewer district business and storage.
 
The commissioners signed a letter of support to the Pike National Historic Trail Association.
 
Dennis Quick asked commissioners for gravel on his road. 
 
Philip Gorman spoke with commissioners about the sewer district.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Bills and payroll for the period were reviewed and approved.
 
Marty Pearson gave a road report.  He had phone quotes for engine and transmission work on a dozer.  The commissioners will make a decision on Monday.
 
Ron Gray and Jimmy Nichols met with commissioners.  They reported that they had to send the female inmates to Cherokee County last night.  They said we had too many here and they were causing a lot of trouble.  We will subsidize the expense with male out-of-county prisoners from Linn County.
 
Joanne Long presented commissioners with a letter concerning the asbestos removal for the Garland Community project.  We’re trying to get a waiver of the 10-day waiting period.  Terry Graham signed the letter.
 
Terry Graham and Harold Coleman, defendants in a civil rights case by a former inmate, signed a letter stating no conflict of interest for his new attorney to be employed by the former firm of the County’s attorney in the case.
 
Tom McNeil spoke with commissioners about septic issues.
 
Terri Johnson asked about storage.  She also discussed the sewer district and the jail housing situation.
 
Lee Davis discussed his budget.  He wants to transfer $4,000 from Noxious Weed to the Noxious Weed Equipment Fund from his 2009 budget.  The commissioners will review the budget/cash numbers and consider the request.
