February 1, 2010         Monday      9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and corrected.
 
Marty Pearson gave a road report.  He and the commissioners discussed repairs to a bulldozer.  The commissioners authorized repairs.
 
Tom McNeil met with commissioners.  He confirmed with commissioners the time of the Informational meeting this Saturday at 10:00 am at the Fine Arts Center at FSCC.
 
Terri Johnson and Valorie Leblanc met with commissioners.  They asked commissioners who is the custodian of the records on the Sewer District.  It was determined that Tom McNeil is.
 
Mrs. Johnson asked commissioners for an executive session to discuss matters of attorney/client privilege.  Terry Graham made a motion to go into executive session, for a period of 15 Minutes, under the attorney/client privilege exception to the Kansas Open Meetings Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson, Valorie Leblanc, Tom McNeil and Joanne Long.  The session began at 10:05 am and ended at 10:20 am with no action. 
 
The commissioners left the meeting to view a possible storage location at 11:00 am.  They returned at 11:40 am.
 
After routine business, the meeting adjourned at noon.

February 5, 2010         Friday        9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.  He also reported on an asphalt class he attended yesterday.
 
Tom McNeil discussed the sewer district informational meeting tomorrow.

Lee Davis presented his Noxious Weed annual report for 2009 and his 2011 plan.  Commissioners signed the reports.
 
Terri Johnson and Valorie Leblanc met with commissioners.  She gave the commissioners a comment form for residents to fill out and return by next Friday regarding the sewer district.
 
Phillip and Kevin Gorman met with commissioners to discuss the sewer district.  They said that the water quality reports show low levels of E. coli and no proof that it comes from humans.  E. coli comes from all mammals and birds they said.  The levels are less than 5% of the legal limit allowed in water.  They think it can be managed by strict enforcement of sanitary codes and don’t think it is right to spend over $2,000,000 for less than 50 full-time residences when there’s no water quality problem.

February 8, 2010 Monday     9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present. 
 
Justin Meeks gave commissioners a report on the recent tax sale.  35 of 37 properties sold.  Over $48,000 in back taxes was redeemed prior to the sale.  He feels we should combine the 2006 and 2007 sales together after skipping a year to keep the cost margins up.
 
Bill Keith, Landfill Director, and Frank Young, Ag Engineering, met with commissioners to discuss monitoring wells at Landfill #1 (the old landfill).  Jingles Endicott made a motion to send plans to KDHE for approval.  Harold Coleman seconded the motion and all voted in favor.

Paul Marx, Deanna Ross, Maura O’Halloran and Rick Bean, Kansas Department of Health and Environment, met with commissioners to discuss the Wade’s Aluminum site.  Bill Keith was also present.  They reviewed the meeting with Terri Johnson and Terry Graham they had last month.  After discussion, Jingles Endicott made a motion to develop an agreement with KDHE regarding clean-up at the site.  Terry Graham seconded the motion and all voted in favor.

February 12, 2010               Friday        9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.
 
Terri Johnson met with commissioners and requested an executive session.  Harold Coleman made a motion to go into executive session, for a period of 15 minutes, under the attorney/client privilege exception to the Kansas Open Meetings Act.  Terry Graham seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson and Joanne Long.  The session began at 9:01 am and ended at 9:16 am with no action.
 
Mrs. Johnson spoke with commissioners about a fence question they received.  She researched it and there is no “new fence law” as is stated in the email.  She also said that disputes over the legality of a fence would be settled in civil court.  Commissioners are only involved in fence viewings, which determine the area of fence responsible by each neighbor, not the legality of a fence.

At 10:00 am, a public hearing was held for a proposed road closing on Yale Road.  Tom and Miae Palzer were present, along with commissioners and the county clerk.  After hearing no objections, Terry Graham closed the hearing at 10:05 am.  Harold Coleman made a motion to adopt Resolution 08-10, closing a portion of Yale Road between 265th St and 267th St.  Jingles Endicott seconded the motion and all voted in favor.
 
At 10:30 am, a public hearing was held for Bourbon County Sewer District #1.  The following were present:  Vernon and Lori Thompson, Pat Steffens, Allen Warren, Charles Russell, Shirley and John Sauerwein, Stephanie Cummings, Chris Kraft, Bob and Debi Cook, Jim Gladbach, Curt Schankel, Tom McNeil, Delbert and Marilyn Fluty, Jack Hembree, Dr. W.J. Friend, Jack Link, William Pool, Bob and Betty Lemons, LeLola Martin, Don Ducker, Joe Dawson, Robin Button, Don and Janet Zornes, Steve Hedges, Terry Parrott, John Scott, Loren Todd, Gerald Chester, Nancy Maze, Philip Gorman, David Lewis, Frank Halsey, Aileen Pollock, James Smith, Dallas Smith, Joe Turner, Sam Mason, Billy Webster, Tim Culbertson, Bob Hosack, Gary Bukowski, Tim Alexander, Christina Rockhold, Danny Ellis, Mark Ward, the county commissioners, Joanne Long and Terri Johnson.  The hearing was moved to the large courtroom to accommodate the crowd.  Terry Graham gave a history of the project, including the petition, funding attempts and finally the grant award in January 2010.  This public hearing is required by law because the cost estimates have increased over 10% over the initial estimates.  The commissioners took comments from the audience.  Some members of the audience feel we should abandon the sewer project and uphold the current septic tank regulations.  Others feel the sewer system is a once in a lifetime opportunity to improve the lake and look for the future.  The City of Fort Scott is concerned over water quality at the lake.  It was countered that the reports show the water levels are good and that shouldn’t be a factor.  There was discussion of changing the project to more of a fee-structured cost based on use, as several houses are not full-time residences and that would allow those who create the sewage will pay more for it.  Another suggested that if the project moves forward, that we write a maximum price into the contract and not allow any change orders.  Part of the hearing was spent discussing the comment sheet that was distributed.  The commissioners thanked everyone for their comments and hope to have a decision as to the future of the project next Friday, which will allow more comment forms to get back.  The commissioners assured the audience that they would disseminate their decision by mail, regardless of their decision.  The public hearing was closed at 11:45 am.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meetings were read and approved.
 
Marty Pearson gave a road report.
 
Curt Shankel, Tom McNeil, Bob Hosack and John Scott met with commissioners.  The commissioners reviewed the returned comment sheets for the sewer district.  The comments were over 2 to 1 in favor of the sewer district.  After discussion, Terry Graham made a motion to move forward with Sewer Project and sign the grant paperwork with Commerce and Housing.  Harold Coleman seconded the motion and all voted in favor.  Bob Hosack will contact Stuart Porter to say we’re moving forward and to encourage him to start working on the easements.  Mr. Hosack will also find out if we are allowed to add more people to the sewer district to help pay down the debt.  We were told when the LMI survey was completed at the beginning of this process that we were locked into only having the houses at the lake for at least two years.
 
Brian Wade asked for two loads of gravel in the ruts between Joe Savage and 265th St. 
 
Debbie Engstrom and Rosalita Allen of Othick Abstract met with commissioners to discuss tax sales.  They want to be considered for future tax sales and guidelines as to what is expected.

February 22, 2010       Monday      9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Curt Shankel and Tom McNeil met with commissioners.  Terri Johnson was also present.  They discussed the inter-local agreement with the City of Fort Scott.  They reviewed the revised agreement sent over by the City and made further revisions.  Terri Johnson will take the revised agreement to Bob Farmer after lunch.
 
David Neville met with commissioners.  District Court needs new chairs in the hallway for when people are waiting for court.  His church is replacing their theater seats with pews and has some they’d likely sell for scrap.  They are fabric covered, 40 years old and would have to be attached either to the floor or to a wood plank.  Commissioners will look at the space.

February 26, 2010       Friday        9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report. 
 
Tom McNeil met with commissioners to present a proposed agreement to clean up an illegal dump site.  Jingles Endicott made motion for Terry Graham to sign the agreement with KDHE on Illegal Dumping Site #1 at 1263 205th Street, Section 25, Township 25, Range 11.  Harold Coleman seconded the motion and all voted in favor.  In the agreement, KDHE is funding up to $10,000 in a 75/25 match for us to clean up the site.
 
Keith Jeffers is applying for his annual Emergency Management Performance Grant.  It’s just under $10,000.  Harold Coleman made a motion to allow the chairman to sign the grant application.  Jingles Endicott seconded the motion and all voted in favor.
 
Joe Turner, City Manager of Fort Scott, met with commissioners to discuss the proposed inter-local agreement for the sewer district.  They have made additional changes to the agreement, and we need to review it with the County Attorney.
 
The City has asked to meet with the County Commissioners and the Sheriff Monday at noon, to discuss the Armory.  They will provide lunch.
