- The Bourbon County Commission
met in open session with all commissioners and the county clerk present.

- Terri Johnson met with
commissioners and requested an executive session. Harold Coleman made a
motion to go into executive session, for a period of 15 minutes, under the
attorney/client privilege exception to the Kansas Open Meetings Act.
Terry Graham seconded the motion and all voted in favor. Those present
for the session were the commissioners, Terri Johnson and Joanne Long.
The session began at 9:01 am and ended at 9:16 am with no action.

- Mrs. Johnson spoke with
commissioners about a fence question they received. She researched it and
there is no “new fence law” as is stated in the email. She also said that
disputes over the legality of a fence would be settled in civil court.
Commissioners are only involved in fence viewings, which determine the
area of fence responsible by each neighbor, not the legality of a fence.

- Marty Pearson gave a road
report.

- At 10:00 am, a public hearing
was held for a proposed road closing on Yale Road. Tom and Miae Palzer
were present, along with commissioners and the county clerk. After
hearing no objections, Terry Graham closed the hearing at 10:05 am.
Harold Coleman made a motion to adopt Resolution 08-10, closing a portion
of Yale Road between 265th St and 267th St. Jingles
Endicott seconded the motion and all voted in favor.

- At 10:30 am, a public hearing
was held for Bourbon County Sewer District #1. The following were
present: Vernon and Lori Thompson, Pat Steffens, Allen Warren, Charles
Russell, Shirley and John Sauerwein, Stephanie Cummings, Chris Kraft, Bob
and Debi Cook, Jim Gladbach, Curt Schankel, Tom McNeil, Delbert and
Marilyn Fluty, Jack Hembree, Dr. W.J. Friend, Jack Link, William Pool, Bob
and Betty Lemons, LeLola Martin, Don Ducker, Joe Dawson, Robin Button, Don
and Janet Zornes, Steve Hedges, Terry Parrott, John Scott, Loren Todd,
Gerald Chester, Nancy Maze, Philip Gorman, David Lewis, Frank Halsey,
Aileen Pollock, James Smith, Dallas Smith, Joe Turner, Sam Mason, Billy
Webster, Tim Culbertson, Bob Hosack, Gary Bukowski, Tim Alexander,
Christina Rockhold, Danny Ellis, Mark Ward, the county commissioners,
Joanne Long and Terri Johnson. The hearing was moved to the large
courtroom to accommodate the crowd. Terry Graham gave a history of the
project, including the petition, funding attempts and finally the grant
award in January 2010. This public hearing is required by law because the
cost estimates have increased over 10% over the initial estimates. The
commissioners took comments from the audience. Some members of the
audience feel we should abandon the sewer project and uphold the current
septic tank regulations. Others feel the sewer system is a once in a
lifetime opportunity to improve the lake and look for the future. The
City of Fort Scott is concerned over water quality at the lake. It was
countered that the reports show the water levels are good and that
shouldn’t be a factor. There was discussion of changing the project to
more of a fee-structured cost based on use, as several houses are not
full-time residences and that would allow those who create the sewage will
pay more for it. Another suggested that if the project moves forward,
that we write a maximum price into the contract and not allow any change
orders. Part of the hearing was spent discussing the comment sheet that
was distributed. The commissioners thanked everyone for their comments
and hope to have a decision as to the future of the project next Friday,
which will allow more comment forms to get back. The commissioners
assured the audience that they would disseminate their decision by mail,
regardless of their decision. The public hearing was closed at 11:45 am.
