September 4, 2009   Friday 9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Doylene Kennedy presented commissioners with a new proposed CFAP contract (Community Fisheries Assistance Program).  The Kansas Department of Wildlife and Parks wants to continue the program for 10 years.  This grant provides funding to cities and counties in lieu of charging for fishing/boating permits at public waterways.  We receive approximately $12,000 annually.  Harold Coleman made a motion to enter into the contract for 5 years.  Jingles Endicott seconded the motion and all voted in favor.  Terry Graham signed the contract. 
 
At 10:00 am, a public hearing was opened for the purpose of considering application for grant funding for the proposed Bourbon County Sewer District 1 at Lake Fort Scott.  Those present were the commissioners, Joanne Long, Bob Hosack, Curt Shankel, Tom McNeil, Mark Pressly, Philip Gorman, John Scott and Joan and Eldon Isaac.  Mr. Hosack informed commissioners that this is the third application for funding.  This year, we are requesting the maximum of $500,000 by including the City of Fort Scott as a beneficiary because the low-to-moderate income population is at least 51%.  Otherwise, the scope of work is the same.  After hearing discussion from those present, the public hearing was closed at 10:30.  The commissioners said they will try to be as fair and equitable as possible to everyone concerned with this project.  Terry Graham made a motion to allow Bob Hosack to submit application for $500,000 for a CDBG grant for the sewer district.  Harold Coleman seconded the motion and all voted in favor.  Resolution 20-09, stating the County has legal authority to submit the application was proposed as part of the grant document.  Terry Graham made a motion to adopt Resolution 20-09 as submitted.  Jingles Endicott seconded the motion and all voted in favor.  Resolution 21-09, assuring the Kansas Dept. of Commerce that the County will maintain the system was presented.  It needs to reflect the new numbers per lot owner, now that the City of Fort Scott has amended their charges.  The commissioners will hold off adopting this resolution until the correct figures are in it.  Mr. Hosack should have that resolution available at the next commission meeting.  The commissioners also signed the residential anti-displacement and relocation plan, which are standard documents which coincide with CDBG applications. 
 
Curt Shankel showed commissioners the draft of a letter he plans to send the lake residents about the recent meetings and their results so that the information is factual to everyone.  The commissioners also asked that the copy of the letter of support from the City Commission be included in the mailing.  The Commissioners approved the letter to be sent to the lot owners.
 
Brent Eslinger met with commissioners to ask to bid the County’s commercial liability and worker’s compensation insurance.  The plan is new to Kansas but all they do are cities and counties and he would like to submit a bid for Bourbon County’s insurance.  The commissioners will mull over whether or not to open the insurance up to bid this year and get back to him next week.
 
Lee Davis asked to purchase more chemical.  He said that he’s already got all the chemical sold or spoken for at this time (13 cases).  He has about $17,000 available in his 2009 budget.  Commissioners approved the order of three additional cases.
 
Lavon Burns asked for gravel at Osaga Cemetery from gate to gate.  The commissioners will inform Marty.
 
Norman Thole of Running Fox Petroleum asked for a culvert to be put in at 80th Street at Hwy 65.  They asked him to speak with Marty about it.
 
Shane Walker spoke with commissioners about programming and plans for updates in the future.

September 7, 2009   Monday         Labor Day-Holiday  No meeting

September 11, 2009            Friday           9:00 am 
 
The Bourbon County Commission met in open session with all commissioners and Shirley Goltra present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.  He showed commissioners pictures of the repair work of the handicap area at Elm Creek Lake.  The commissioners were very satisfied with the results of the completed project.  Mr. Pearson asked about replacing some of the employees which have left or retired and not been replaced on the Public Works department.  He suggested moving some part-time help to full time. No action at this time.
 
Doylene Kennedy reported that a computer in her office needs to be replaced.  The cost will be approximately $500.00.  Commissioners approved the request.
 
Per a request from Whendi Martin, Jingles Endicott made a motion to proclaim the month of September 2009 as United Way of Bourbon County Month.  Harold Coleman seconded the motion and all voted in favor. The commissioners signed the Proclamation.
 
Sheriff Ron Gray and Jimmy Nichols met with commissioners to ask permission to send two employees to Indianapolis for a week long tactical training. The cost is $750.00 per person, but one employee said he would drive them there and pay for his own training. The County would be responsible for room and board of both employees and the cost of training for one employee. They approved the request. 
 
Keith Jeffers met to give updates on emergency preparedness issues. He updated them on the amount of generators available in the event of an emergency power outage that Terry Graham had asked about.  He also updated them on the H1N1 virus and when the vaccine will become available. He said there will only be one shot to take instead of two, as previously reported.  Mr. Jeffers also presented a copy of a release that Governor, Mark Parkinson sent to President Obama requesting a federal disaster declaration for six Kansas counties affected by severe storms this past July. Bourbon County was included as one of the counties.
 
Joe Jolly stopped in to ask about a memorial sign that had been knocked down north of Hammond which had been erected 14 years ago when his son drowned in a pond in that area. He didn’t know if the County cut a tree which knocked it down or if it was knocked as a result of recent storms. The commissioners said they would check into it and if it was by action of the County, we would put it back up.

September 14, 2009            Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners and Shirley Goltra present. Minutes of the previous meeting were read and approved. 
 
Marty Pearson gave a road report.  He said that the crew is hauling rock to Mapleton so they can start chip and seal there. 
 
Harold Coleman said he went to the area where the memorial sign of Joe Jolly’s son was suppose to be. He spoke to neighbors and the road crew and they did not cut a tree down to damage the sign.  It evidently was damaged from storms in that area and the memorial sign was no longer there to even be erected back in place. 
 
Bills and payroll for the period were reviewed and approved. 
 
Ann Ludlum presented a monthly progress report from the Extension Office.  She said they are having a Diabetes program connected with Blue Cross Blue Shield. This will be a two hour program where they will cook and people will sample the products for a healthy lifestyle.  They have around 75 people who have signed up at this time, with 2 weeks to go.  Mrs. Ludlum said there would be a meeting on October 6th at 6:30 pm and invited the commissioners to attend. The meeting is to talk about joining a district with Linn and Neosho counties.  If the district is approved, it would require a resolution to be signed. 
 
Commissioners received a phone call from Michael Jacobson about Elm Creek Lake. He is handicapped and said he can not get down to the rock jetties to fish.  He thinks that we should have a pier that you can drive down to the rock jetties to fish, like Miami County has. Miami County is where he lives, but he is originally from Fort Scott. 
 
Terry Graham made a motion to pay Bill Keith an additional $50.00 per month for his extra management duties at the Landfill.  Jingles Endicott seconded the motion and all voted in favor.  A pay change notice was signed and given to Kendell Mason to be effective starting September 16, 2009. 
 
The commissioners received a phone call from Debbie Hurd about having some trees trimmed by some bridges, about two miles north of Grand Rd. on 245th St in the Garland area.  They contacted Marty Pearson to have it put on the agenda to have the work done. 
 
Tom Palzer stopped in to tell the commissioners that he is going to petition for a road closure.  The area is from 255th St. to 267th Terrace on Yale Rd.  The commissioners informed him of the procedure.

September 18, 2009    Friday        9:00 am
 
The Bourbon County Commission met in open session with Terry Graham and Harold Coleman present.  Shirley Goltra was also present.  Minutes of the previous meeting were read and approved.
 
The commissioners received a phone call from Joan Crane.  She requested a street light be put in at 240th St. and Jayhawk Road, because she says it is a dark and dangerous area.  The commissioners will speak with Jingles about it, as it is in his district.
 
Lee Davis stopped in to say that some of the people who wanted Escort have not come back to purchase it.  He asked permission to use what is left and if the people return, to get quotes to replace it.  The commissioners advised him to get quotes and to keep record, but approved the request.
 
Marty Pearson called and said they have to get a new computer component in the dash for a rock truck.  The cost is $1,800. for a new one and $900 for a used one.  The commissioners approved the cost of the new one, as it should last longer.

September 21, 2009            Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
David Neville met with commissioners.  In light of recent events, should we purchase surveillance cameras to cover the outside areas of the courthouse property?  The commissioners said it’s not in the budget, but he should get with Keith Jeffers to see if there are Homeland Security funds available to assist.
 
Charlie Elliott met with commissioners and gave a road report.
 
Tom McNeil spoke with the commissioners about Lake Fort Scott sewer issues.  He discussed FEMA Flood Plain maps and GIS.  The commissioners asked him to coordinate with Shane Walker.
 
Karen Paddock asked about storage, as her contract is up for renewal.  The commissioners asked if she can get them to go month to month instead of signing an extended contract.
 
Jimmy Nichols and Brad Rich met with commissioners to discuss raising the wage for the jail nurse to accommodate the part-time LPN.  After discussion, Harold Coleman made a motion to amend the salary resolution for the Nurse position to $16.00/hr, effective September 21, 2009.  Terry Graham seconded the motion and all voted in favor.  She will be part-time and work approximately 20 hours per week.
 
Susan Quick informed commissioners that, in an effort to save money, she wants to put a box on the tax statement for people to check a box if they want a receipt.  Otherwise, she will not send one.  The commissioners think that’s an excellent idea and support her efforts.  She will send out a press release about it as well.  She said that receipts are not required by law to be sent, only a courtesy.

September 25, 2009  Friday  9:00 am
 
The Bourbon County Commission met in open session with Harold Coleman and Jingles Endicott present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.
 
Dan Laughlin met with commissioners.  He commended the commissioners for not increasing the mill levy and praised the road work done on the streets in Mapleton, but asked about sericea lespedeza and what the Weed Director does in the winter.  The commissioners said they have been discussing that themselves and will be getting more information about it.
 
Joanne Long presented the proposed Resolution 21-09, which has the updated numbers on the Lake Fort Scott Sewer project.  This resolution, if passed, will become part of the grant documentation for the project.  Harold Coleman made a motion to adopt Resolution 21-09, assurance to the Kansas Dept. of Commerce that funds will be continually provided for the Sewer District at Lake Fort Scott.  Jingles Endicott seconded the motion and all voted in favor.
 
Charlie Elliott gave a road report.
 
Keith Jeffers met with commissioners with an H1N1 update.  Also, the state wants a new uniform resolution to be passed in each county, laying out the duties of a County Emergency Manager.  He will present it on Monday, when Terry Graham is here.
 
Bill Keith spoke with commissioners about issues regarding the old landfill.  Jingles Endicott made a motion to have Bill Keith contact engineers to set up a work plan on monitoring wells at the old landfill.  Harold Coleman seconded and both voted in favor.
 
Duane Hill and John Warren, Kansas Gas Service, met with commissioners about replacing a gas main along the county right-of-way along 10th street, south of Indian Road.  They asked the gentlemen to return on Monday morning, when Terry Graham will be back, as it is located in his district.
 
Lee Davis spoke with commissioners about the process of dealing with sericea lespedeza.  He said he sends a letter to the landowner when he receives a complaint.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.

Bills and payroll for the period were reviewed and approved.
 
Bill Van Kirk, Department of Corrections, Community Services, met with commissioners to present the FY2009 Year-End Outcome Report.  Harold Coleman made a motion to instruct the chairman to sign the report.  Terry Graham seconded the motion and all voted in favor.  Terry Graham signed the report.  Mr. Van Kirk will present us with a fully executed copy of the report at a later date.
 
Charlie Blevins spoke with commissioners about the location of the County rock quarry.  He doesn’t think its location is appropriate.  Commissioners tried to explain that it is almost exactly in the center of the county, just east of Redfield.  Mr. Blevins disagrees.  Mr. Blevins also spoke with commissioners about his road.  He asked when the County would be repairing it.  The commissioners said it’s on the list.
 
Duane Hill and John Warren, Kansas Gas Service, met again with commissioners to ask about gas lines.  After discussion, the commissioners advised Kansas Gas Service to get an easement on private property.
 
Shane Walker, Tom McNeil, Keith Jeffers, Senator Bob Marshall, Representative Bob Grant and Representative Shirley Palmer met with commissioners to discuss the Flood-Plain determinations by FEMA of the Lake Fort Scott Area, as well as other areas in Bourbon County.  It appears that the FEMA maps are wrong.  Shane, Tom and Keith measured the Lake last week and there are serious errors.  Now the question is how do we get FEMA to correct them?  If there are errors here, then it’s likely that there are houses they don’t have in the flood-plain that should be.  Finney County is already suing FEMA over the maps.  We need to coordinate with Crawford County and try to work with Federal legislators to get them fixed.  The only way FEMA will listen is if there are several of us voicing concerns.
 
Keith Jeffers asked commissioners to adopt a new resolution appointing a County Emergency Manager with all the designations the office has now.  The State is asking each county to do this, as some haven’t had a new resolution since the 60s, and they want all 105 counties to have the same resolution.  Jingles Endicott made a motion to adopt Resolution 22-09, as presented.  Terry Graham seconded the motion and all voted in favor.  Terry Graham signed the resolution and it will be published in the official county newspaper.
 
Karen Paddock spoke with commissioners about storage.  She’s asked to pay month-to-month and it is $360/month.
 
The commissioners left the meeting at 11:20 am to attend a retirement party for Clyde Killion at the 4-H Building.
