October 2, 2009       Friday     9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Keith Jeffers spoke with commissioners about emergency management issues.  He said that some of his discussion needs to be in executive session, for security reasons.  Terry Graham made a motion to go into executive session, for a period of five minutes, under the security exception to the Kansas Open Meeting Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners, Keith Jeffers and Joanne Long.  The session began at 9:43 am and ended at 9:48 am with no action.  After further discussion with Mr. Jeffers, Terry Graham made a motion to appoint Alice Maffett, Mary Wynn and Keith Jeffers as the persons to decide who gets the first inoculations for H1N1 in Bourbon County.  Jingles Endicott seconded the motion and all voted in favor.
 
Bob Hartley and Bob Shufflebotham, Phoenix Mining Company, met with commissioners.  Marty Pearson was also present for the discussion.  They would like to take their trucks onto 260th Street, south of Deer Road, but it is very narrow.  The commissioners want to look at it and will view it Monday at 10:00 am before making a final decision.
 
Susan Quick asked commissioners why the west door to the courthouse is still locked and requires a card key.  All the other doors have been re-opened except this door, and this is the door the elected officials use and it’s very difficult to maneuver the door when your arms are full.  The commissioners decided to open it back up during work hours.  The key card will be required to enter before/after hours.
 
The commissioners informed the clerk that they will be attending a meeting Tuesday night at 6:30 pm, at the Fairgrounds, for consideration of creating a joint Extension Council District with Allen and Neosho Counties.
 
After routine business, the meeting adjourned at noon.

October 5, 2009  Monday      9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Bob Shufflebotham, Phoenix Coal Company, met to ask for a road variance.  Jingles Endicott made a motion to accept the requested road variance agreement in Section 10, Twp 27E, Range 25S.  Terry Graham seconded the motion and all voted in favor.  The commissioners signed the agreement.
 
Marty Pearson gave a road report.
 
Jim Hazelton, KDOT, introduced himself to the commissioners.  He and his colleagues are here on a state-wide tour to do spot-inspections of bridges to compare their findings to the engineer’s reports.
 
Joanne Long spoke with commissioners about the cost of training for a correctional center employee to go to a train-the-trainer course.  The course is covered for the cost of two employees and he would be the third.  He offered to pay the registration fee personally, but she feels that the County should pay, since it’s training for his job and the County will reap the benefits once he’s a certified trainer, not the employee.  All registration fees from future classes taught by this individual would go to the General Fund, not to him.  Therefore, she feels that the County should pay the registration.  Jingles Endicott made a motion to have the County pay the registration fee for the class.  Harold Coleman seconded the motion and all voted in favor.
 
The commissioners left at 10:00 am to view 260th Street, south of Deer Road, for the request from Phoenix Coal Company to take their trucks onto it.  They didn’t return.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Bills and Payroll for the period were reviewed and approved.
 
Keith Jeffers has requested the commissioners pass a Declaration of Local Disaster Emergency.  Terry Graham made a motion to pass Resolution 23-09, a Declaration of Local Disaster Emergency.  Harold Coleman seconded the motion and all voted in favor.
 
Joanne Long asked commissioners to nominate a KAC Voting Delegate and two alternates and a KCAMP Voting Delegate and alternate for the annual meeting this November.  Harold Coleman made a motion to name Jingles Endicott as the KAC Voting Delegate.  Terry Graham seconded the motion and all voted in favor.  Jingles Endicott then made a motion to nominate Harold Coleman as KAC 1st Alternate.  Terry Graham seconded the motion and all voted in favor.  Harold Coleman then made a motion to nominate Judy Wallis as 2nd Alternate for KAC.  Terry Graham seconded the motion and all voted in favor.
 
Jingles Endicott made a motion to nominate Harold Coleman as Voting Delegate for the KCAMP annual meeting.  Terry Graham seconded the motion and all voted in favor.  Harold Coleman made a motion to name Jingles Endicott at the Alternate for KCAMP.  Terry Graham seconded the motion and all voted in favor. 
 
Marty Pearson gave a road report.  He reported that we’ve had over 6 ½” of rain so far from this storm.  He said he’s received a request for 4-way stop at 230th & Jayhawk to slow down traffic.  The commissioners denied the request stating that stop signs are not used to control speed.  The commissioners authorized advertising for a mechanic at the shop.
 
Bill Keith discussed the landfill.
 
Commissioners discussed Phoenix Coal Company’s request to use 250th Street, 3/8 of a mile south of Deer Road to take their coal trucks down.  The commissioners viewed the road last Friday.  Jingles Endicott made a motion to deny the request because of safety and road conditions.  Harold Coleman seconded the motion and all voted in favor.  Joanne Long wrote a letter to Bob Hartley with the decision.  Mr. Hartley then arrived at the meeting and was presented with the letter.
 
Pat Simpson presented the monthly progress report from the Extension Council.
 
Sheriff Gray and Jimmy Nichols met with commissioners to discuss putting a roof over the jail courtyard and putting bunk beds in the classroom.  The cost of hiring an architect for this project is $19,960.  Regulations require us to separate the high security prisoners from the lower security ones.  Commissioners will consider the request.
 
Wilma Graham asked about chip and seal for Redfield.  The commissioners said we still have some to do this year, but it’s dependent upon the weather.  Redfield is second on the list after Mapleton.  Wilma asked if it’s not done this year, to be moved up the list next year.  No action.
 
Mel Antrim just stopped in to say hi.
 
Louie Pool asked to have a Dead End sign moved from his driveway further up the road.  The commissioners will speak with Marty about it.
 
Jingles Endicott made a motion to authorize moving Bill Metcalf to the Shop Foreman position, effective October 11, 2009.  Harold Coleman seconded the motion and all voted in favor.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.  The Commissioners informed him of a problem David Singmaster is having with a ditch at his driveway.  Mr. Singmaster stopped in later also.
 
Charlie Blevins asked commissioners when the County would be fixing his road.  Marty will come look at it.
 
Bill Van Kirk, 6th Judicial District, Community Corrections, met with commissioners.  Harold Coleman made a motion to authorize Terry Graham to sign the Budget Summary.  Jingles Endicott seconded the motion and all voted in favor.
 
Bob Hartley and Bob Shufflebotham, Phoenix Coal Company met with commissioners to try to reach an agreement about Phoenix’s request to use part of 250th Street to haul their trucks.  Each agreed to make a list of their needs and concerns and meet back next Friday to see where we stand.
 
Robert Query stopped in looking for employment.
 
Don Doherty and Jeremy Bowman met with commissioners to discuss insurance.  Mr. Doherty said we’ll have no increase for the group life insurance in 2010.  He also went over other insurance they offer.  No action.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Terri Johnson met with commissioners.  The commissioners discussed the request from Phoenix Coal Company to use part of 260th Street to haul their trucks.  She will research the laws.
 
Keith Jeffers and Tom McNeil met with commissioners.  FEMA sent a survey to us asking if the Flood Plain Maps have any errors.  We’re working on answering it.  Keith will also be meeting regarding the concert for the Youth Activities Team to set up inter-operable agreements with surrounding counties to man an EOC during the concert, should it be needed.
 
Ron Gray and Jimmy Nichols met with commissioners.  Terry Graham made a motion to approve hiring the architect and engineer, as presented at the previous meeting.  Jingles Endicott seconded the motion and all voted in favor.
 
Terry Graham left the meeting at 11:15 am.

The Bourbon County Commission met in open session with all commissioners present.  Shirley Goltra was also present.  Minutes of the previous meeting were read and approved.
 
Bill Keith met with commissioners to discuss the old landfill site.  He had bids for well monitoring.  Four were received.  They were:

Jingles Endicott made a motion to hire Ag Engineering.  Terry Graham seconded the motion and all voted in favor.
 
Don Doherty called to ask about offering employees voluntary insurance options.  The commissioners allowed him to offer the insurance to any employee who is interested.
 
Terry Graham left the meeting at 11:00 am to go to the county barn to look at a furnace.

October 26, 2009      Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners present.  Shirley Goltra was also present.
 
Terry Graham signed the agreement between Bourbon County and Ag Engineering for well monitoring at the old landfill.
 
Marty Pearson gave a road report.  Harold Coleman asked about the County knocking down and filling in the old storm cellar at the Hammond Community Center.  It’s been on the list for a while.  Marty said they will get to it.
 
Bob Hartley, Jim Brakefield and Bob Shufflebotham, Phoenix Coal Company, met with commissioners.  The commissioners relayed the information from the County Attorney that the County doesn’t have to allow them to use any other roads and that they should contract with private landowners to make arrangements to get them to Deer Road, the official haul road.  The folks from Phoenix presented commissioners with a proposal to use 250th Street for approximately 3/8 of a mile and to place $0.15 per ton into an escrow account to build up to help repair the road once they’re done.  They figure that will raise about $57,000.  They want Jingles Endicott and Terri Johnson to come out and look at the road and also to have an engineer look at it.  The County doesn’t have an engineer on staff, so we would need to hire Schwab-Eaton.  After checking with Schwab-Eaton, the County learned that would cost $1,500 to evaluate the road and to present a write-up of conclusions.  The commissioners relayed that information to Phoenix Coal Company and both parties agreed that, should a survey be conducted, that Phoenix Coal Company would pay for it.  No action at this time.
 
Jim Harris stopped in to say that Berry Tractor Company will have a booth at the Kansas Association of Counties annual convention in November and invited the commissioners to visit it and perhaps join him for dinner.
 
Shane Walker and Susan Quick met with commissioners to discuss software for the Vehicle Department.  Should they sign the contract to purchase now, they will save the 15% increase that is coming.  They would also put off payments until 2011, less a 10% down payment.  No action yet until we can confirm budget figures.
 
Herschel George stopped in to find out the status of a county road.

Adam Kuehl and Steve Davis, HMN Architects, and Sheriff Gray met with commissioners.  They presented an architectural contract for the proposed jail project.  The commissioners will have the county attorney review it.
 
Sheriff Gray asked commissioners about disposing of equipment from the old sheriff vehicles.  It may be auctioned, put up for bid, traded or given away.
