The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Alice Maffett, Shane Walker, Keith Jeffers met with commissioners to discuss Swine Flu.  Normal flu kills 36,000 each year even though people get vaccinated.  There’s no vaccine for Swine Flu yet as it takes four to six months to create a vaccine.  There are anti-viral meds to lessen your time with the illness, but nothing at this time to prevent it.
 
Terry Graham made a motion to go into executive session, for a period of 10 minutes, under the Security Exception to the Kansas Open Meetings Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session included the commissioners, Alice Maffett, Keith Jeffers, Shane Walker and Joanne Long.  The session began at 9:23 am and ended at 9:33 am with no action.
 
Michael Pommier, reporter with the Fort Scott Tribune, was present. 
 
David Neville met with commissioners.  The commissioners approved the purchase of hand sanitizer dispensers to be placed outside each restroom, in an effort to stem the tide of illness.  Also, David is working on getting the air conditioners up, but he’s waiting on a part.  Mr. Neville also informed commissioners that the basement is likely to flood if we get much more rain, as nothing was ever done to prevent future flooding.
 
Wilma Graham asked commissioners to put Redfield on the list for chip and seal this year.  She would also like an estimate of the cost.  Clyde Killion said it should cost about what it did last time, but he’ll work something up.  Mrs. Graham also asked for a load of gravel for alleyways in Redfield.  Clyde will get it for her.
 
Ryan Weiser and Bob Jurgens, KDHE, met with commissioners to discuss the old landfill.  Clyde Killion, Public Works Supervisor, Bill Keith, Landfill Operator and Terri Johnson, County Counselor, were present.  After discussion, the gentlemen from KDHE will have a draft in the next 30 days of an agreement with specific compliance details for us.
 
Clyde Killion gave a road report.
 
Bill Keith discussed well monitoring.  The company he recommended has not lived up to his expectations.
 
Terri Johnson is working on clearing up the title situation on a property being purchased for a bridge project. 
 
Tom McNeil discussed the flood plain map from FEMA.  FEMA finally admitted it doesn’t show a spillway or emergency spillway at Fort Scott Lake, but still says the burden of proof is on the landowners and won’t correct itself.
 
Sheriff Gray presented paperwork on the six vehicles for the Sheriff’s Department.  The cars are in at Shepherd’s.  Ron said the loan includes the vehicles, lights/sirens and installation.  Terri Johnson reviewed the paperwork and would like a revision to include the cash-basis law clause.  Cindy Bowman at UMB will make the revisions and have it ready Monday.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Charlie Ballou met with commissioners to discuss the disposal of tires.  He has learned that KDHE will allow tires to be dumped at a landfill, without extra fees, if they are cut up in accordance with their guidelines.  Mr. Ballou asked if the County would honor this arrangement.  The commissioners confirmed the information from KDHE but learned that the Iola Landfill, where the County takes its solid waste, will not allow tires, regardless of KDHE’s ruling.  Therefore, Bourbon County cannot either.
 
Darrell Howard spoke with commissioners about the condition of gravel County roads.  He thinks that they are in worse shape now that they were 40 years ago.  The commissioners said that there is more and heavier traffic on the roads now.
 
Reed Hartford met with commissioners to discuss the Good Neighbor Blitz.  He is the co-convener for the Blitz, which is scheduled for the week of June 25-30, 2009, in Fort Scott.  It’s goal is to work on 40 homes in Fort Scott for people who are physically or financially unable to fix up their properties.  He is here to ask the County to please waive the dumping fees during the Blitz.  The commissioners have no trouble waiving the fees on the lumber and other C&D material, but that we need to pay to dispose of anything that would be considered waste, such as trash.  Clyde Killion informed Mr. Hartford that caulking tubes will need to be classified as waste.  Terry Graham made a motion to accept C&D at no charge for the Good Neighbor Blitz, during the week of June 25-30, 2009.  Jingles Endicott seconded the motion and all voted in favor.
 
Clyde Killion gave a road report.
 
Lonnie Chambers, Phoenix Mining Company, met with commissioners to ask for a road variance.  No action at this time.
 
Ron Gray presented the paperwork for the lease purchase of the sheriff’s vehicles from UMB.  Terry Graham made a motion to adopt Resolution 10-09 (the lease purchase agreement).  Harold Coleman seconded the motion and all voted in favor.  All commissioners signed the documents and Joanne Long attested the signatures.
 
Joanne Long asked commissioners if they have heard anything about re-opening the south courthouse door.  After speaking with District Court, the commissioners authorized re-opening the south door and correctional center entrance, immediately.  The commissioners will leave the west door locked for key-card entry.
 
Terri Johnson informed commissioners that she is reviewing the details of the land acquisition for the bridge project.  She will be speaking with Larry Nuss, the attorney for the trust on the one property that needs to be corrected.  She’s also reviewing all the acquisitions to be sure there are no more problems.  She should have the information ready for them on Friday.
 
Mrs. Johnson asked for authorization to replace a computer in her office.  She has the money budgeted and explained that she’s replacing one computer annually, so that she never has to replace all five at once.  Advantage Computers out of Iola will be helping her, as they have the software agreement and know what is needed for full interface.  The commissioners authorized the purchase.
 
Doylene Kennedy presented the monthly sales tax report for the Landfill for signature.  Terry Graham signed the report.
 
Mrs. Kennedy also informed commissioners that the Road & Bridge radios are out.  It appears that the repeater in the southern part of the County is out.  We are working on fixing them as soon as possible.
 
Keith Jeffers updated commissioners on the H1N1 virus.  There will be another conference call this afternoon with the State.

The Bourbon County Commission met in open session with all commissioners and Shirley Goltra present.  Minutes of the previous meeting were read and approved.
 
David Neville met with commissioners to inform them of roof leaks on the correctional side.  He’s been trying to get Certainteed to cover their warranty with no success.  They said they would come, but never have.  Commissioners will have the County Counselor write a letter to Certainteed.
 
Marty Pearson met with quotes on repeaters.  They asked him to get more information on them.  After discussion, commissioners approved purchase of the cheaper one.
 
Clyde Killion gave a road report.  Gene Cowan called in a culvert at 180th and Eagle Road that needs work.  Clyde will look into it.
 
Kendell Mason asked permission to cut an early check for the sheriff’s cars so that they may be titled and tagged.  Commissioners approved the request.
 
Jerry Lyons reported a hole on 205th Street which needs fixed.  Clyde will check into it as well.
 
Keith Jeffers reported on flooding in our area from this morning’s storms.  We received nearly three inches of rain in about two and a half hours.  Commissioners re-signed paperwork for 800 MHz radios that he picked up from KDOT.
 
Shane Walker reported that a computer in the Correctional Center sustained damage due to the roof leak.  It will likely need to be replaced.  An insurance claim has been filed.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Lee Davis presented chemical quotes for 200 gallons of Glyphosate, 41% equivalent w/surfactant (Credit Extra, or equivalent).  Three were received.  They were:

Jingles Endicott made a motion to accept the quote from Vegetation Management for $4,600.00.  Terry Graham seconded the motion and all voted in favor.
 
Clyde Killion gave a road report.
 
Robert Lamb asked commissioners when the County would be finishing the project on Soldier Road.  He also informed commissioners of a blind intersection in the area.  Terry Graham will look into both situations.
 
Curt Shankel, James Gladbach and John Scott met with commissioners to discuss the proposed Lake Fort Scott Sewer District.  We haven’t received funding during the past two application cycles.  Mr. Shankel informed Mr. Coleman and Mr. Endicott of the project so far, as they are new commissioners.  Curt also reviewed a workshop conference he attended in Salina recently regarding CDBG funding.  The commissioners will have Stuart Porter come over in the next week to answer questions the new commissioners may have.
 
Joanne Long reminded commissioners that the Appraiser contract is up June 30th of this year.  Per state statute, the appraiser contract runs for four years.  The commissioners will need to speak with Judy Orton about it.
 
Keith Jeffers updated commissioners on the H1N1 cases in Kansas and nationally.  The Centers for Disease Control put the number of confirmed cases in Kansas at 36, as of 10:00 am today.  The Kansas Department of Health & Environment says there are only 22 cases in Kansas.
 
Mr. Jeffers asked commissioners to declare a state of local disaster emergency from the heavy rains last Friday.  Harold Coleman made a motion to adopt Resolution 11-09, a local state of disaster emergency.  Terry Graham seconded the motion and all voted in favor.
 
The commissioners left at 10:50 am to conduct a fence viewing.  They returned at 11:40 am.  Terry Graham made the following motion:
 
Regarding the property line beginning at the SW corner of the SW ¼ of Section 12, Township 25, Range 24, traveling North approximately 660’ or 1/8 of a mile:  The north approximately 330’ of the fence will be assigned to Brian J. and Rebecca L. Comstock.  The south approximately 330’ of the fence will be assigned to Connie M. Krug and etal.  The fence shall be a 5-wire fence with a post at least every rod (16.5’).
 
Jingles Endicott seconded the motion and all voted in favor.  In accordance with state law, the decision was signed and recorded with the Register of Deeds.
 
The commissioners asked that, in addition to the official fence viewing decision that the following recommendations be forwarded to the owners:
 
Push hedge the entire 1/8 mile 15’ from the property line in each direction (30’ total).  Expense for debris removal, hedge clearing and fence cost should be equally divided between the two landowners.
 
Robert Query asked commissioners about the Public Works Supervisor position.  The commissioners are hoping to have someone hired by July 1st so that they may work with Clyde for some time.  Mr. Query is interested in applying for the position.
 
Mr. Query also spoke with commissioners about the Hiattville Fire Department situation.  He was approached this weekend about signing the petition to split from Fire District 3.  He wanted to get some information straight about the expenditures.

Clyde Killion gave a road report.
 
Ann Ludlum presented the monthly progress report for the Extension Office.
 
David Neville updated commissioners on the roof leak over the correctional center/Sheriff’s Department.  Scott Young with Certainteed came and compiled a list and took pictures of the problem areas.  Jess at KCAMP also came and assessed the damages on the interior areas.
 
Commissioners approved purchase of an air compressor through State Surplus Property for $500.
 
Tom McNeil spoke with Fort Scott City Manager, Joe Turner, to get the City involved with the incorrect FEMA flood plain map regarding Lake Fort Scott.
 
Stuart Porter, USDA Rural Development, Tom McNeil, Jim Gladbach and Curt Shankel met with commissioners to the discuss Lake Fort Scott Sewer project.  Mr. Porter gave the new commissioners a preliminary history of the project, design and proposed funding sources.
 
Keith Jeffers reported to commissioners on the tornado damage, including pictures.
 
Terry Graham made a motion to declare a State of Local Disaster Emergency, from the tornadic storm which hit Bourbon County Wednesday night, May 13th.  Jingles Endicott seconded the motion and all voted in favor.  Joanne Long will type up the resolution when she returns.

Clyde Killion gave a road report.
 
Harold Coleman discussed a low water bridge which needs work and some signs put up.  It’s ¼ mile south of Valley Road on 225th St.  Clyde Killion will look into it.
 
Keith Jeffers updated commissioners on last week’s storm.  Delwin Mumbower was present.  FEMA will be here this week to assess the damages.  Keith also updated commissioners on the H1N1 flu.
 
Commissioners left at 10:20 am to view the low water bridge mentioned above.  They returned at 11:35 am.

The Bourbon County Commission met in open session with all commissioners and the county clerk present. 
 
Clyde Killion gave a road report.
 
Gary Harvey spoke with commissioners about excessive dust on his road.  He asked if the speed limit should be lowered.  Commissioners will look into it.
 
Michael Pommier, reporter with the Fort Scott Tribune, was present.
 
Delwin Mumbower and Roger Jones, Bourbon County Fire District #3, met with commissioners.  Delwin said he got a copy of the petition from Hiattville Fire Department and would like the commissioners’ decision as to its fate.  Joanne Long informed commissioners that there were 101 verified signatures, or approximately 18% of the owners.  The statute requires 10%.  She said the statute leaves it to commissioners to either accept it or reject it.  After discussion, Terry Graham made a motion to reject the petition.  Harold Coleman seconded the motion and all voted in favor.  The request to split the Hiattville Fire Station response area from Fire District #3 is denied.  Delwin Mumbower told the commissioners he appreciates the consideration they put into this and feels they made the right decision.  Keith Jeffers was present for some of the discussion and said that if the County needs a public meeting for the people who will not understand why the commissioners voted to reject the petition, Keith will set one up.  Terry Graham said he based his decision on the safety of the citizens of the people in the area and for no other reason.  He feels it’s simply not the right thing to split off and have a fire department like 25 years ago and truly believes that if a majority of the people who signed the petition had the other side of the story, they wouldn’t have signed it.
 
Keith Jeffers gave an update on the H1N1 virus.  He said that there have been no new confirmed cases in Mexico for a week.  There are 62 confirmed cases in Kansas.  He also gave a disaster report from the Kansas Division of Emergency Management (KDEM).  Commissioners signed the disaster declaration which was approved last week after the tornado.
 
Lee Davis presented phone quotes for 200 gallons of PastureGard.  They were:

Terry Graham made a motion to purchase from Crop Protection Services for $9,496.00.  Harold Coleman seconded the motion and all voted in favor. 
 
Ron Gray and Jimmy Nichols met with commissioners.  Ron asked commissioners if the sewer trap box can be dumped at a later time, as the smell is horrible.  Commissioners said it is the City who does that but we can ask if they will come later in the day. 
 
Sheriff Gray and Jimmy Nichols said that we’re seeing a large savings by doing our own meal preparations.  We should save over $100,000 annually.  They would like the captains, lieutenants and sergeants pay to be increased by .50/hour for meal preparation.  Harold Coleman made a motion to amend the salary resolution, effective June 1, 2009,  for the following:
 
Correctional Officer Captain     $  1,098.55 semi-monthly
Correctional Officer Lieutenant $  1,029.60 semi-monthly
Correctional Officer Sergeant   $     950.45 semi-monthly
 
Terry Graham seconded the motion and all voted in favor.  This will affect six employees.
 
Judy Orton met with commissioners.  Her contract is up July 1, 2009.  Per Kansas Law, the County Appraiser is appointed July 1st of every fourth year.  She presented the commissioners with a survey of statewide county appraiser salaries and benefits/out-sourcing.  She is asking for a 3% increase in salary as of July 1 and 3% increases on January 1 each year of the contract.  No action at this time.
 
Marty Pearson met with commissioners and asked to speak with them in executive session.  Terry Graham made a motion to go into executive session, for a period of 5 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners, Joanne Long and Marty Pearson.  The session began at 11:01 am and ended at 11:06 am with no action.
 
Terry Graham left the meeting at 11:45 am.  After routine business, the meeting adjourned at noon.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meetings were read and approved.
 
Clyde Killion gave a road report.
 
Bills and payroll for the period were reviewed and approved.
 
Commissioners reviewed applications for part-time mower positions.  Clyde will set up interviews for about four or five and we will hire two.
 
Wayne Thorpe and Raymond Taylor spoke separately with commissioners about culvert situations.  Commissioners will have Clyde check into them.
 
The commissioners approved the purchase of a motor from State Surplus Property.
 
Part of the meeting was spent putting together the help wanted ad for the position of Public Works Supervisor.  When it was completed, the commissioners approved publishing it, beginning next week for two weeks and applications will be due at 4:30 pm, Friday, June 19, 2009.
 
The commissioners discussed the truck at Elm Creek Lake.  It is in very poor shape.  The commissioners approved sending the old weed truck to the lake as its replacement.
 
Bob Steele spoke with commissioners about dust control on his road.  The commissioners just got the prices so they will be getting to it.
 
Commissioners discussed the flowers along the south walk of the courthouse.  Since it is the main entrance, they decided that they want flowers planted along the entire length of sidewalk and will just inform David Neville that he will have to take the riding lawnmower around the courthouse, instead of across the flower area.  As he is mowing today, they will inform him and Judy Orton about their decision on Monday.
