March 2, 2009          Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners and Shirley Goltra present.
 
Clyde Killion gave a road report.
 
Ron Gray and Jimmy Nichols met with commissioners with a quote on the jail remodel.  This will allow the female inmates to return so we can save money on paying other counties to house them.  This will also help the problem with holding cells and put in nine new showers.  The commissioners asked to know what we paid out in housing the females elsewhere and what we bring in from housing Linn County prisoners to compare to the cost of a remodel.  They also want additional quotes on the remodeling.
 
Jess Beerbower asked commissioners to set up a charge account at the landfill.  The commissioners advised him to speak with Lois Coyan.  Terry Graham will let him know if he is approved.
 
David Neville, Ron Gray, Pat Young, Sharon Elder, Terri Johnson, Judy Orton and Clyde Killion met with commissioners to hear the request to allow Bill Prichard into the Community Pool.  All department heads approved the request.
 
With the financial situation at the State, we have been informed that some Road and Bridge and Alcohol funds may be cut from our allocations.
 
Terri Johnson met with commissioners to discuss the old landfill closing situation.
 
Keith Jeffers met with an Emergency Management update.  He and the commissioners reviewed the seven applications for the resource grant position.  Keith will have the ultimate decision.  Mr. Jeffers discussed implementing a burn ban.  Commissioners don’t want to enact a burn ban.  They want people to contact their fire chief before burning.
 
Keith will be contacting the media about bad burning times and burn safety.
 
Kendell Mason requested and received authorization to print a check which didn’t print on Friday.
 
Commissioners received a fax agreement from Running Foxes Petroleum for the right-of-way access.  The commissioners want Terri Johnson to review it.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meetings were read and approved.
 
Karen Endicott-Coyan met with commissioners.  She is the Pawnee Township Trustee and she presented a letter of request to the commissioners from herself and Sharon Middleton, Pawnee Township Treasurer, for commissioners to appoint Ronnie Brown to the vacant Pawnee Township Clerk position.  Harold Coleman made a motion to appoint Ronnie Brown as Pawnee Township Clerk.  Terry Graham seconded the motion and all voted in favor.
 
She also spoke with commissioners about Endicott Cemetery, a private cemetery in the southeast part of Bourbon County.  The owner, Bud Walker, is willing to deed the cemetery and access drive to Bourbon County so Drywood Township can maintain it.  She and her husband currently maintain it and plan to continue to do so as long as they are able.  The commissioners will check with the County Attorney about what can and can’t be done with it.  The commissioners also would like her to ask Drywood Township if they can do it.
 
Keith Jeffers informed commissioners of a grant workshop he attended this week.  Part of the Presidential Stimulus Package has a lot of grant money available to public entities, such as $81 million in Kansas for public safety grants and $20 million in Kansas for the Department of Justice.  Tom McNeil thinks this may be a way to get funding for the Lake Fort Scott Sewer District.
 
The commissioners and Mr. Jeffers discussed the fire department frequencies. 
 
Tex Crutcher, Derek Jones and Tom Quick met with commissioners to renew their request for assistance with property that has poor drainage because of a natural waterway.  They ask that the county install a culvert that they are willing to purchase to alleviate the problem.  Mr. Quick also has fill dirt that they can use.  They said that they will maintain the road repair until the land is settled as well.  They think it is a fair trade for what they pay in property taxes.  After discussion, Jingles Endicott made a motion to approve the request.  Harold Coleman seconded the motion and all voted in favor.  Clyde will put it on the schedule for this summer.
 
Gene Cowan spoke with the new commissioners about his concern that Tom McNeil is doing unnecessary driving in the county vehicle again, including driving it home for lunch.  He feels it is a waste of his tax dollars and would like something done.  The commissioners will look into it.
 
Norman Thole, Running Foxes, presented the amended agreement, based on Terri Johnson’s recommendations.  Commissioners signed the agreement.

Ann Ludlum presented the monthly progress reports for the Extension Office.  She also asked commissioners to choose a “Commissioners’ Choice” among the 51 Walk Kansas teams.  After perusing the list, commissioners decided on the Sassy Steppers.
 
Terri Johnson spoke with commissioners about the old landfill.  She received the regulations from the 1970s from the Secretary of State’s Office which shows fewer requirements needed for closing a landfill and no well monitoring.  She thinks this is beneficial to us.
 
Jimmy Nichols spoke with commissioners about the cost of the booking program.  Originally, it was set to come out of the commissary fund, but it is too costly to continue.  He said the commissary fund is not as flush as it has been, possibly a sign of the economic times.  The commissioners said it would need to be paid out of the regular budget but suggested that the commissary fund may be able to pay a few months a year if it gets built back up. 
 
Jimmy also informed commissioners that the female inmates are back, so we should be able to save money that we were spending on outside housing.
 
Terry Graham made a motion to enter into agreement with the City of Fort Scott to accept demolition houses at the landfill for $1.62/sq ft for a 6 month trial period, to be reviewed at the end of 6 months.  Jingles Endicott seconded the motion and all voted in favor.

The Bourbon County Commission met in open session with all commissioners present.  Shirley Goltra was also present.  Minutes of the previous meeting were read and corrected.
 
Clyde Killion gave a road report.
 
Shane Walker brought a map to commissioners showing the path of the storm damage by winds on Sunday.
 
Keith Jeffers and Delwin Mumbower met with commissioners.  They gave commissioners a report on the storm from Sunday.  Mr. Jeffers says that the damage is approximately $325,000 involving several rural properties.
 
Mr. Jeffers asked commissioners to sign a declaration of a local disaster emergency.  Commissioners signed the resolution.
 
Keith asked permission to purchase a GIS camera for Emergency Preparedness.  Commissioners approved the purchase of one such camera.
 
Mr. Mumbower spoke with commissioners about radio frequencies for fire fighters.  He said that some rural fire departments are not using the assigned frequency; therefore they are not able to communicate with other departments.
 
Herman Yeager spoke with commissioners about putting a no passing line on the road on the hill at Maple and 195th Street to keep cars on their side of the road for safety reasons.  Commissioners called the County Barn to ask that it be done.
 
Judy Orton spoke with commissioners about a bill that was coded to her department but that she says is not hers, nor was approved by her.  The commissioners think it may belong to another department and will have it researched.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.  He asked commissioners to officially designate Gilbert Fleeman as lead man on the asphalt crew.  He said it would just be for the title’s sake and not include a change in pay.  Terry Graham made a motion to formally appoint Gilbert Fleeman as lead man of the asphalt crew.  Harold Coleman seconded the motion and all voted in favor.
 
Kendell Mason spoke with commissioners about a request she has received to put a stuffer in the employee checks for requests for good foster parents in the area.  Commissioners approved the request.
 
Bills and payroll for the period were reviewed and approved.
 
Sheriff Gray requested to donate the office’s old uniforms to another law enforcement agency.  Commissioners approved the request.  He also asked commissioners to designate Police Chief Puterbaugh’s personal vehicle as an emergency vehicle.  There are two other such designations for rural fire departments in the county.  Commissioners approved the request for Chief Puterbaugh’s vehicle.
 
Clyde Killion presented quotes for 50 15 x 16 24’ culvert pipe.  Two were received:

Terry Graham made a motion to accept the quote from Judy’s Iron & Metal, as it is less than 10% higher and local.  Harold Coleman seconded the motion and all voted in favor.               
 
Terry Graham made a motion to purchase a used tractor from R&R Equipment for $17,500.00.  Jingles Endicott seconded the motion and all voted in favor.
 
Norman Thole, Running Foxes, received a road bore permit from commissioners.
 
Joanne Long asked commissioners if they would approve a one-time ACH payment to Baystone Financial for late fees and the first payment for the re-financed motor grader, which was due March 1st.  Commissioners approved the request.  The amount is $239.26 in late fees and $10,940.88 for the payment.
 
Lee Davis requested approval to purchase an automatic spray controller package.  Commissioners approved the purchase from VMS for $2,253.00.
 
Jingles Endicott left the meeting at 10:55 am.
 
Karen Paddock spoke with commissioners about a night this week where they had late court and had to walk out after dark with no security.  They were frightened and would like commissioners to look into metal detectors for the building.  She said that Linn County got their security through a grant.  Commissioners will look into it, but reminded Mrs. Paddock that the courthouse has video surveillance at this point.
 
Sheriff Gray introduced Chief Puterbaugh to commissioners.

The Bourbon County Commission met in open session with Terry Graham and Harold Coleman present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.
 
Earl Brown would like to see signs posted of speed limit 30 MPH in Hiattville and 45 MPH out north on 130th St.  There is a 30 MPH by the church on the southbound lane currently.  The commissioners don’t have a problem with putting a 30 MPH on the northbound side, then.  They would like to discuss the other with Jingles when he returns next week, as it is his district.  The current speed limit on gravel roads is 55 MPH, unless otherwise posted. 
 
Mr. Brown also informed commissioners that he feels that Kevin Wagner drives the fire truck out of control. 
 
Dr. Gerald Kerr spoke with commissioners about “feed lots”.
 
Ann Ackerman, Chairman of the Bourbon County Inter-Agency Coalition, met with commissioners to explain what they do and invite them to a visioning meeting on April 23rd at the First United Methodist Church.
 
Tim Cunningham, Tri-Valley, met with commissioners, to ask commissioners to adopt a resolution to support HB 2094.  He said that Tri-Valley is trying to get all 105 counties to pass the same resolution.  Harold Coleman made a motion to adopt Resolution 09-09.  Terry Graham seconded the motion and both voted in favor.
 
Ben Culbertson met with commissioners to request assistance.  KDOT’s restriction on axle weight in trucks is limiting his ability to deliver lime for farmers.  The commissioners said they can’t make any promises but they’ll do their best by talking to KDOT.
 
Keith Jeffers gave a report on Emergency Management.  He’s got the equipment to make ID cards for county employees.  He also mentioned that there is a fire danger due to the weather today.
 
Terry Graham left the meeting to view an area on Jayhawk which has caused a stir over a large cattle production.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Karen Endicott-Coyan and Melvin Endicott met with commissioners to discuss the Endicott Cemetery in Drywood Township.  They want to know what has been decided about deeding it to the county for Drywood Township to maintain.  Terri Johnson was present for the discussion.  She has been reviewing cemetery statutes and believes that the property should be deeded to the township if the township is to maintain it.
 
Terry Graham made a motion to go into executive session, for a period of 10 minutes, under the land acquisition exception to the Kansas Open Meetings Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson, Clyde Killion and Joanne Long.  The session began at 9:38 am and ended at 9:48 am with no action.
 
Robert Jackson, 678 130th St., spoke with commissioners about lowering the speed limit on 130th Street, north of Hiattville.  He has spoken with the Sheriff’s Department, but was told to speak with the commissioners.
 
Basil Freeman met with commissioners.  He has landlocked property in the northwest part of Bourbon County.  He’ll talk to his neighbors on either side to ask about putting up a gate.  The road is not a county road, so the commissioners cannot help him.

Jingles Endicott made a motion to accept the quote from Van Diest, for a total of $11,793.58, as it was the lowest.  Harold Coleman seconded the motion and all voted in favor.
 
Keith Jeffers informed commissioners of the storm predictions for tonight.  They include the chance for golf ball sized hail, strong winds, 1½” rain and possible tornadoes.  We may get as much at 3” of rain by Wednesday.
 
Harold Coleman left to speak with the County Appraiser at 11:10 am.  He returned at 11:20 am.
 
Lou Howard and Kevin Wagner met with commissioners.  They’re concerned about misinformation being spread about the Hiattville Fire Station.  It’s beginning to take toll on recruitment of volunteers.  K.S.A. 8-1506 allows for authorized emergency vehicles to exceed the posted speed limits, as long as it does not endanger life or property. Lou said that they may go 10 MPH over the posted speed for a road but they don’t exceed that because it’s not safe and on gravel, they don’t even use the whole 10 MPH.  They discussed the membership and automatic mutual aid agreements, also.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.  He informed commissioners that we need to order a screen for the asphalt plant.
 
Charlie and Dola Cress spoke with commissioners about spraying.  The commissioners informed them that the utility company is responsible for the area of their concern.
 
Doylene Kennedy reminded commissioners to review the 5-yr bridge plan.  She also presented prices for fish food for Elm Creek Lake.  The commissioners mentioned that the feeding of the fish at the lake is subsidized by Kansas Department of Wildlife & Parks’ Community Fisheries Assistance Program (CFAP).  Three prices were received:

Terry Graham made a motion to purchase fish food from Miller Feed & Oil for the 2009 season.  Harold Coleman seconded the motion and all voted in favor.
 
Part of the morning was spent discussing the 5-yr bridge plan.  Harold Coleman mentioned that he would like to see two bridges from his district on the list.
 
Keith Jeffers met with commissioners to discuss the upcoming winter storm.  He said that Kansas Division of Emergency Management (KDEM) would like the county to sign a disaster declaration in case we need it this weekend.  He will not implement it until/unless needed and will not do so before notifying the Chairman.  Terry Graham made a motion to adopt Resolution 10-09, a disaster declaration.  Jingles Endicott seconded the motion and all voted in favor.  Mr. Jeffers says we are predicted to receive between six and eight inches of snow from this storm.  He said also that we are likely to lose power lines and trees from the heavy snow and strong winds that will accompany the storm
 
Keith Butler asked commissioners to clean out a ditch west of Indian Rd and 215th St.  Clyde will see to it.
 
Joe Savage spoke with commissioners about recent arsons, county-wide zoning and speed limit signs in ditches where people mow.  He would like them to be moved.
 
Sheriff Gray met with commissioners to request permission to apply for a COPS grant through the new Stimulus Bill.  He would also like to fill a school resource position for USD 235.  Commissioners authorized the requests to apply for the grants.  Sheriff Gray also informed commissioners of his intent to turn the Process Server position into a full deputy position later on.  He said it would only result in about $4,000 more in salary.

The Bourbon County Commission met in open session with all commissioners present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.
 
Bills and payroll for the period were reviewed and approved.
 
Sheriff Gray asked commissioners what to do about a stray bull calf in Max Bradbury’s area which he penned up and has torn up his property.  He’s not been able to locate the owner.  Harold Coleman recollected that after he’s checked around to see if it belongs to anyone, the Bradbury can sell it at the sale barn and turn in the proceeds to the County Treasurer.  He can recoup his damages and then she holds it for 6 months.  After that time, anything left over goes to County General.
 
The commissioners received a letter from the County Attorney written to KDHE for the closed landfill.  Commissioners reviewed it and signed it.
 
Keith Jeffers and Tom McNeil gave a storm report and discussed flood plain issues.  Keith said that about 25 houses lost electricity due to the storm.  As there was no disaster, Terry Graham made a motion to rescind Resolution 10-09.  Jingles Endicott seconded the motion and all voted in favor.
 
Terry Graham made a motion to appoint Jingles Endicott to the US 69 Hwy Corridor Study Committee.  Harold Coleman seconded the motion and all voted in favor.
 
Commissioners opened bids for Elm Creek hay at 10:00 am.  Only one bid was received.  It was from Dwayne Neil for $852.00.  Jingles Endicott made a motion to accept the bid.  Terry Graham seconded the motion and all voted in favor.
 
Lee Davis showed commissioners the prices of Remedy and PastureGard.  The price of Remedy has come down so that the prices are comparable now.  As some people prefer one over the other, the commissioners asked that he split his order between the two.
 
Marty Pearson spoke with commissioners about a dump truck which needs repaired or replaced.  He said we currently have four down and five on the road right now.
