The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.
 
Susan Quick spoke with commissioners about delinquent mineral rights.  After discussion, the commissioners authorized her having a special tax sale for them as soon as possible.
 
Jingles left the meeting at 9:50 am to attend a memorial service.
 
Roger Lee spoke to Clyde about the condition of Quail Road between 235th and 255th Streets.  The chip and seal work needs holes patched.
 
Lee Davis presented chemical quotes for 250 gallons of Glyphosate.

Harold Coleman made a motion to accept the quote from Crop Protection Services for $5,375.00.  Terry Graham seconded the motion and both voted in favor.
 
Dale Yager, USDA Rural Development, met with commissioners to discuss the Lake Fort Scott Sewer Project.  Curt Shankel, Bob Hosack and John Scott were present.  They discussed funding opportunities for the project.  They will be setting up future meetings.
 
Jingles Endicott returned at 10:48 am.
 
Ann Ludlum, Delta George, Carol Hill, Lynda Foster, Dr. J.D. McNutt, Rhonda Hoener, Allen Warren and Teresa Bahr presented the 2010 Extension Council budget request.  They are not asking for any increases.  They also discussed the County Fair.
 
Jack Black presented commissioners with some information for them to review.  He will speak with them on Friday after they’ve had a chance to review it.
 
Terry Graham made a motion to enter into contract with Mercy Health Center of Kansas for ambulance services.  Harold Coleman seconded the motion and all voted in favor.  The cost and duration is as follows:
 
                July 1, 2009 – June 30, 2010 =      $23,000/month
                July 1, 2010 – June 30, 2011 =      $23,920/month
 
The commissioners informed David Neville that they want flowers along the south walkway.  They said we can put a ramp near the air conditioner tower to help him access the area between the health department and the sidewalk with the mower. 
 
Tom McNeil held an LEPP meeting/lunch with commissioners present.

The Bourbon County Commission met in open session with Jingles Endicott and Harold Coleman present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.  He requested permission to hire a third mower.  The commissioners approved the request.
 
Sheriff Gray and Jimmy Nichols met with commissioners.  They explained that the jail population is on the rise again.  Neither want to send any of our inmates out of county.  They would like to make a dormitory out of the classroom and house bunk beds in it.  Jingles Endicott made a motion to purchase 5 bunk beds.  Harold Coleman second the motion and both voted in favor.  Jimmy said if this works out we may see about getting a roof put over the courtyard.
 
Phillip Pavey stopped in to inquire when a portion of 205th, between US 54 Hwy and Maple Road, will be built up.  The commissioners will check with Clyde. 
 
David Stuart spoke with commissioners about his culvert.  He wants the County to look at it.  The commissioners will inform Clyde about it.
 
Jack Black gave commissioners another DVD and asked that they view it.

The Bourbon County Commission met in open session with all commissioners present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave an equipment report.
 
Curt Shankel updated commissioners on the Lake Fort Scott Sewer project.
 
John Scott spoke with commissioners about putting a 20 MPH speed limit back up around the west side of Lake Fort Scott.
 
Doylene Kennedy had Terry Graham sign a monthly sales tax report for the landfill.
 
Sharon Elder spoke with commissioners about applying for a grant from the Heritage Trust Fund.  She said that 1% of all mortgage registration fees paid go into the grant and counties can apply for funding for repairs to historical buildings.  No action at this time.
 
Joanne Long presented two proposed resolutions for consideration.  One was a meal reimbursement resolution to distinguish between overnight meal reimbursement and same-day trip meals, the other is a resolution regarding county-owned vehicle usage.  These resolutions surround IRS regulations on taxable benefits.  The commissioners will review them and consider them at a future meeting.

The Bourbon County Commission met in open session with all commissioners present.  Shirley Goltra was also present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.  He discussed the size of rocks used in the rock crusher.  He said that Yale Road between Mapleton and Blue Mound needs work.  Commissioners said that speed limit signs need to be put back up at Fort Scott Lake.
 
Jack Black asked commissioners to pass a resolution prohibiting martial law in Bourbon County.  No action.
 
Kenny Clark was present for part of the meeting.
 
Michael Pommier, reporter with the Fort Scott Tribune, was present.
 
Teddy Wilson, Joshua Wilson and Roger Jones, all of Fire District #3, met with commissioners and requested an executive session.  Terry Graham made a motion to go into executive session, for a period of five minutes, under the personnel exception to the Kansas Open Meetings Act, to discuss non-elected personnel.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners, Shirley Goltra, Teddy Wilson, Roger Jones and Joshua Wilson.  The session began at 9:45 am and ended at 9:50 am with no action.
 
Arcadia Mayor Paul Starne and Deputy Clint Parsons met with commissioners to discuss a patrol vehicle.  They heard we have vehicles that we have to donate or sell.  The commissioners advised them to speak with Sheriff Gray.  The law may require that they be sold at auction.
 
Charlie Blevins told commissioners that his life has been threatened on five separate occasions.  He also spoke with the Sheriff’s Department about it.  No action.
 
Joe Savage was present for part of the meeting.
 
Judy Orton met with commissioners to discuss her contract for County Appraiser.  After discussion, both parties came to an agreement and Terry Graham made a motion to renew the County Appraiser contract with Judy Orton with a 3% cost-of-living increase each January of the four-year contract.  Jingles Endicott seconded the motion and all voted in favor.
 
Ms. Orton also discussed a new ruling from the legislature on Section 42 low-income housing.

June 15, 2009     Monday      9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.
 
Tim Cunningham and Bill Fiscus met with commissioners to present the 2010 Tri-Valley Budget request.  They also discussed some services and upcoming events.
 
Bill Martin informed commissioners of an accident over the weekend involving one of the new patrol cars.  He hit a deer but there was no personal injury.  He will be getting three estimates for the insurance company.
 
Clyde Killion gave a road report.  He said that Eddie Harrison had an accident the first week of the month on Tomahawk between 185th and 195th.  He moved over for our mower and his truck and trailer went off a washed out culvert.  He says it messed up the alignment on his truck and broke the jack on the tongue of trailer.  Joanne Long will contact him to make an insurance claim.
 
Jack Black met with commissioners.  He asked that the commissioners view the videos he has presented to them and to research the information afterwards.
 
Bills and payroll for the period were reviewed and approved.
 
Ralph Carlson met with commissioners to ask that the County waive the fees for C & D on a house he is assisting with for Katherine Yount.  He helps poverty level families with improving their houses, similar to Habitat for Humanity.  Jingles Endicott made a motion to waive the fees for the project.  Terry Graham seconded the motion and all voted in favor.
 
Karen Paddock met with commissioners to discuss when the doors to the courthouse are opening in the morning.  On two separate occasions, the jail has allowed people in just after 8:00 am, not waiting until 8:25 am.  This is a security risk, because the District Court Clerk’s Office is alone and doesn’t have any support at that time.  The bailiff comes in at 8:30.  After discussion, the commissioners said they will speak with the Correctional Center and remind them not to open the doors early.
 
Mrs. Paddock also informed commissioners of the order to close the District Court Clerk’s Office at 4:00 pm daily, beginning today.  It is due to budget cuts.  The employees will still be there working, they will just be closed to the public. 
 
Jerry Lyons spoke with commissioners about mowing a ditch.
 
Bill Brittain requested the County’s annual donation to the Elk’s fireworks display.  Jingles Endicott made a motion to donate $500 from the Special Parks and Recreation Fund to the Elk’s Club for the fireworks exhibition.  Harold Coleman seconded the motion and all voted in favor.
 
Terry Sercer met with commissioners to present the audit report.
 
Charlie Blevins met with commissioners to complain about his road.  He wants them all to go with him to view it.  The commissioners will do that this Friday at 11:30 am.
 
Joanne Long presented the requested disaster declaration resolution for last Tuesday.  Terry Graham made a motion to adopt the resolution.  Jingles Endicott seconded the motion and all voted in favor.

June 19, 2009     Friday        9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meetings were read and approved.
 
Jack Black and Jess Black met with commissioners to discuss the DVDs the commissioners were previously asked to view.  They feel the federal government is over-reaching its powers and ask that the County Commission pass a resolution prohibiting martial law in the county.  The commissioners will have the County Attorney to view the proposed resolution, but said they would likely not pass it.
 
Marty Pearson gave a road report.
 
At 10:00 am, a public hearing was held for the application for CDBG funding for a community building/emergency shelter in Garland, in Drywood Township.  Those present were:  The commissioners, Joanne Long, Representative Bob Grant, Representative Shirley Palmer, Jeff Locke, Darrell Bloomfield, Keith Jeffers, Shirley Colvin, Bill Hamilton, Neil Underwood, Jack Colvin, Kevin Howard, Bill Martin and Laura Moore.   Ms. Moore stated that this will be the third application for this project, but she said that FEMA and Stimulus funding is available this go-around to help.  The total project cost is $325,910 and we would be applying for $243,411 in CDBG funds.  Representatives Grant and Palmer each gave a statement of support for the shelter.  Jeff Locke is a council member in Arma, and also submitted his support of the project.  Upon no further discussion, Terry Graham made a motion to close the public hearing.  Harold Coleman seconded the motion and all voted in favor.  Jingles Endicott then made a motion to apply for CDBG funding in the amount of $243,411 for the Garland Center.  Terry Graham seconded the motion and all voted in favor.  Terry Graham made a motion to sign the FEMA documentation on the project.  Jingles Endicott seconded the motion and all voted in favor.  The commissioners and county clerk executed the documentation for the grant application.
 
Keith Jeffers spoke briefly with commissioners about future ICS training.
 
Lee Davis presented chemical quotes for Pasturegard and Plateau.  He said that he would like to purchase extra than what was quoted for, as demand has increased.  Three quotes were received:

Ron Gray spoke with commissioners about Arcadia’s request for one of their old patrol vehicles.  There are particular steps needed to be taken to dispose of County property.
 
John Green, SEK Area Agency on Aging, met with commissioners for the 2010 budget request.
 
Robert Lamb asked commissioners about improving Soldier Road.
 
At 11:15 am, the commissioners met with Sheriff Gray to go to Rocher Addition to view Charlie Blevins’ road, as he requested.

Daisy Black met with commissioners to ask if they presented her proposed resolution to the county attorney.  They had not, but she was out of the office until today.  They will get it to her today.

Ronnie Brown, Cheryl Bennett, Wynea Buford, Dean Bailey, Wayne Thorpe and Bob Larkin met with commissioners to present the 2010 Bourbon County Soil Conservation District Budget request.
 
Darrin Petrowsky, KDOT, met with commissioners.  He gave them an update of the scheduled projects for this summer throughout Bourbon County.
 
Terry Graham left the meeting at 10:35 am for a medical appointment.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Robert and Ann Gillmore-Hoffman invited commissioners to a meeting Monday night in the Greyhound Room of the Community College at 6:30 pm.  It’s for Shirley Yeager’s Animal Friends (Formerly known as the Friends of the Fort Scott Animal Shelter).  They’re trying to set up a shelter in the County.
 
Daisy Black met with commissioners to ask about the resolution she wants the County to adopt.  The commissioners gave a copy to the County Attorney, but she’s been in a jury trial all week.  They suggested Mrs. Black contact the Attorney’s Office directly to get her take on the resolution.
 
Marty Pearson gave a road report.  He updated the commissioners on the 2009 oil price for dust control oil at $2.74.  He also presented quotes for culverts.

Harold Coleman made a motion to purchase from Judy’s Iron & Metal.  Jingles Endicott seconded the motion and all voted in favor.
 
Susan Quick spoke with commissioners about four parcels from tax years 1996-1999 where a mobile home was on real estate and is not there any longer.  These are what is known as “Blue Sky Properties” because the mobile home is no longer there and the person didn’t own the land it was on.  These are on Personal Property as of 2000 as “Leaseland Mobile Homes”.  She is asking that the commissioners abate these four, as they keep coming up on the tax sale and there’s nothing there.  Terry Graham ordered them abated.  Susan will put together the information in a letter for documentation.
 
Judy Orton spoke with the commissioners about the GIS contract with R&S Digital.  It is about $6,000 annually, but it keeps us from having to have someone on payroll to keep up with the updates.  She will have Terri Johnson look at it and then bring it up for commissioners to sign.
 
Ms. Orton informed commissioners that Twin Oaks Nursery donated 12 plants to us for our flowerbeds.  She also mentioned that someone stole five flowers Wednesday morning after she planted them Tuesday night.  The commissioners want to re-plant.
 
Mark Pressly met with commissioners representing the Lake Fort Scott owners.  He said they recently had a lake owners meeting and is here representing them with some areas they identified as wanting the County to work on.  There was an incident last weekend with stray and/or vicious dogs.  The County does have a resolution about stray/vicious dogs and gave Mr. Pressly a copy and have contacted the Sheriff about the concern.  He also is concerned about run-down, semi-vacant properties with weeds around the lake and wants to know what, if anything, can be done.  The commissioners said that the County is not zoned, and therefore, all they can do is write a letter to the owners requesting that they improve their property, but they don’t really have any “teeth” behind it, unless it is considered a health issue with rats, etc.  Then the Health Department can get involved.  As far as run-down docks on the lake, Mr. Pressly said that some of the owners would be willing to get them off the water, but would like the County to allow them to be dumped for free.  The commissioners are willing to work with the volunteers who help, as long as it’s C&D, because we don’t have to pay to have that removed to another landfill.  However, we can’t offer a County truck to remove the debris, as it is the asphalt season and the trucks are busy.  Mr. Pressly said they can possibly get the owners of the dilapidated docks to pay for the debris to be moved to the Transfer Station.  Also, Mr. Pressly would like to set up a Spring clean-up, like is done annually in the City of Fort Scott.  The commissioners will look into it.  Finally, Mr. Pressly discussed pot holes along the lake roads he would like the County to repair.  He would like the commissioners to drive out and see them.
 
Mr. Pressly is also still looking for the survey results from last fall on the vacant or near-vacant lots.  Terry Graham will look for the results.
 
Terri Johnson met with commissioners.  She said the Consent Agreement for the old landfill looks okay to sign.  She said that KDHE wants information about the Wade Aluminum clean-up.
 
Sam Mason, Karen Owen and Alan Hauser presented the SEK Mental Health 2010 budget request.  The commissioners thank Sam for his service on the board and he thanked the commissioners for allowing him to serve for 16 years.  Mr. Mason will be stepping down from the board.  The commissioners asked him if he has any replacement ideas.  He does.  He would like to see a County Commissioner spend at least one year on the board.  He said it would give you a tremendous insight into the program.  It’s six meetings annually, at most.  He said that Janet Braun will also be leaving the board at this time.
 
Sam Mason and Janet Braun met with commissioners to resign from the SEK Mental Health Board.
 
The rest of the meeting was spent reviewing the applications for Public Works Director.  They want to have a special meeting on Tuesday and asked the clerk set up interviews.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Bills and payroll for the period were reviewed and approved.
 
Craig and Dana McKenney, Reece McKenney, Andrew Suddock, Patrick Swetz and Senator Bob Marshall met with commissioners to discuss the curve at 1100 240th Street, the site of an accident last week which claimed the life of the McKenney’s daughter, Parker.  Sheriff Ron Gray, Undersheriff Bill Martin and County Attorney Terri Johnson were also present.  The McKenney’s asked that additional signage and reflectors be placed before the curve, coming from the south, to prevent a future tragedy, though, they stressed that they did not blame the County for their daughter’s death.  They asked that improvements be made today. 
 
Terry Graham made a motion to go into executive session, for a period of five minutes, under the attorney/client privilege exception to the Kansas Open Meetings Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson, Marty Pearson, Joanne Long and Ron Gray.  The session began at 9:54 am and ended at 9:59 am with no action.
 
Commissioners signed the R&S Digital contract, which was discussed last week and has been reviewed by Terri Johnson.
 
After speaking with KCAMP, commissioners authorized Marty Pearson to place new signs prior to the curve at 1100 240th Street.  Marty said we have two signs and that he will order reflectors.

Jim Garrett, GBA Architects Engineers, spoke with commissioners about bridge inspections.  The commissioners will keep his company in mind for the future.
 
Cindy Delfelder and John O’Brien, ING, met with commissioners to discuss a Deferred Compensation plan available through the State.  No action.
 
Terri Johnson spoke with commissioners about easement issues.
 
Mrs. Johnson also spoke with commissioners about the space situation with her office.  Commissioners authorized her to look into alternatives.

The Bourbon County Commission met in open session for a Special Meeting with all commissioners and the county clerk present.
 
The purpose of this special meeting is to hold interviews for the position of Public Works Supervisor.  There are six candidates and each met with the commissioners, in executive session.
 
At 9:00 am, Terry Graham made a motion to go into executive session, for a period of 20 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act, for a job interview.  Harold Coleman seconded the motion and all voted in favor.  Those present were the commissioners, Robert Query and Joanne Long.  The session began at 9:00 am and ended at 9:20 am with no action.

At 10:00 am, Terry Graham made a motion to go into executive session, for a period of 20 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act, for a job interview.  Harold Coleman seconded the motion and all voted in favor.  Those present were the commissioners, Doug Holt and Joanne Long.  The session began at 10:00 am and ended at 10:20 am with no action.

At 11:18 am, Terry Graham made a motion to go into executive session, for a period of 10 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act, to discuss the job applicants.  Those present for the session were the three commissioners.  The session began at 11:18 am and ended at 11:28 am with no action.
 
After discussion, the meeting adjourned at 11:40 am.
