July 6, 2009   Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present. 
 
Marty Pearson gave a road report.
 
Jack Black met with commissioners with a recording of a recent radio program that he played for the commissioners.
 
Alice Maffett, County Health Nurse, met with commissioners to get authority to place a larger shed on the lot to help keep her storage.  The commissioners have no problem with that as long as it will fit.  It will be two feet longer and wider than the current one, as well as taller.  The commissioners viewed the site with Mrs. Maffett.
 
Nurse Maffett also gave the commissioners a report on the H1N1 virus.  As of July 1st, there have been 131 cases in Kansas, with the closest in Crawford County.
 
Terry Graham made a motion to go into executive session, for a period of 15 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act, to discuss the applicants for Public Works Supervisor.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners and Joanne Long.  The session began at 10:35 am and ended at 10:50 am with no action.
 
After some discussion, Jingles Endicott made a motion to hire Marty Pearson as Public Works Supervisor, with no public announcement until after the commissioners meet with the Road Department personnel on Tuesday morning at 6:00 am.  Terry Graham seconded the motion and all voted in favor.  The commissioners also agreed to have a performance evaluation at 90 and 180 days.  Jingles Endicott made a motion to make the pay retroactive to July 1st.  Harold Coleman seconded the motion and all voted in favor.  While Clyde is on leave, the employees are to defer to Marty as the supervisor.  
 
Terri Johnson is still looking into storage alternatives.  She also gave the commissioners a corrected easement for a bridge project.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meetings were read and approved.
 
Marty Pearson gave a road report.  He also reported on the damages in Bronson from the storm on Wednesday.  He told commissioners he needs a camera to document damages and to help him remember things about projects and what needs done when he happens upon things.
 
Judge Ward and Karen Paddock presented the 2010 District Court budget request.  They reviewed some of the line items, mentioning the increase in jury trials increases other expenses, like postage.
 
Bob Marshall thanked commissioners for their prompt attention at erecting signs on 240th Street.  Marty mentioned that he will put a 20MPH sign from the north at the curve so it matches the south.
 
Lee Davis called in phone quotes for 200 Gallons of generic Round Up.  They were:

Jingles Endicott made a motion to purchase from Vegetation Management.  Harold Coleman seconded the motion and all voted in favor.
 
Jack Black presented commissioners information about agricultural bills.
 
Susan Quick presented the 2010 proposed budget for the Treasurer’s Office.
 
Shane Walker discussed the computer budget.  He and the department heads have discussed removing the computer capital outlay purchases from their individual budgets and putting them in the computer fund.
 
Joanne Long presented the County Clerk, Election, Commissioner, Coroner and Courthouse General Fund budget proposals for 2010.  She also asked that consideration be given to increasing the Personnel Director salary, as it has a lot of responsibilities with all the insurances, vendors and human resource aspects.  The commissioners will consider the request.
 
Joanne Long asked commissioners if they want to increase the mileage reimbursement to match the State, which increased to .55/mile on July 1.  Not at this time.  Gasoline prices have been decreasing.  They will continue to monitor the situation and perhaps re-visit the issue.
 
Keith Jeffers met with commissioners for a storm update.  He requested the commissioners declare a state of disaster emergency for the storm that hit Bronson on Wednesday.  Terry Graham made a motion to adopt Resolution 18-09, a state of local disaster emergency.  Jingles Endicott seconded the motion and all voted in favor.
 
Terri Johnson asked commissioners for an executive session to discuss land acquisition.  Terry Graham made a motion to go into executive session, for a period of five minutes, under the land acquisition exception to the Kansas Open Meetings Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson and Joanne Long.  The session began at 10:52 am and ended at 10:57 am with no action.
 
Larry Sharp, KCAMP, met with commissioners to discuss the reasons for claims in counties.

Sharon Elder presented the 2010 Register of Deeds budget proposal.
 
Bills and payroll for the period were reviewed and approved.
 
Bud and Ione Eisele asked commissioners for a copy of the Kansas fence law.
 
Jimmy Nichols spoke with commissioners about over-crowding.  He would like to go ahead with re-modeling the courtyard into housing space.  The commissioners authorized him to look into an architect.  Also, he wants to see about hiring an RN part-time to help out in the jail.  Commissioners gave him the okay.
 
Terri Johnson asked for extension to present her budget as she has a family member in the hospital to which she needs to attend. Commissioners told her it was okay.  She did indicate that she would be presenting the same budget, less payroll, as 2009.

The Bourbon County Commission met in open session with present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Jimmy Nichols and Brad Rich met with commissioners with a request to purchase padding gear.  It will be used in cell extraction training and also during their annual fundraiser.  The commissioners approved the request.
 
Sheriff Ron Gray and Fort Scott Police Chief Ron Puterbaugh met with commissioners to request a letter of support for the City’s application for an Enhanced Wireless 911 Grant.  Commissioners signed the letter.

Valorie Leblanc met with commissioners and requested an executive session to discuss land acquisition.  Terry Graham made a motion to go into executive session, for a period of five minutes, under the land acquisition exception to the Kansas Open Meetings Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners, Valorie Leblanc and Joanne Long.  The session began at 9:42 am and ended at 9:47 am with no action.
 
Terry Graham made a motion to return to executive session, for a period of five minutes, under the land acquisition exception to the Kansas Open Meetings Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners, Valorie Leblanc and Joanne Long.  The session began at 9:56 am and ended at 10:01 am.  In open session the commissioners decided to view the property at 11:00 am today.
 
Laura Moore presented an environmental review for consideration.  It’s the last piece of the grant application for the Drywood Township Community Building/Shelter.  Harold Coleman made a motion to sign the review.  Jingles Endicott seconded the motion and all voted in favor.  Commissioners signed the review.
 
Keith Jeffers reported on H1N1 flu and the storm from July 8th.
 
Shane Walker and Lynn Smith presented the 2010 computer budget.  They reminded commissioners that all courthouse computer capital outlay is now in this budget, instead of individual office budgets.
 
At 11:00 am, the commissioners viewed a building for possible use by the County Attorney.  They returned at 11:30 am.
 
Once back in the courthouse, Terry Graham made a motion to go into executive session, for a period of ten minutes, under the land acquisition exception to the Kansas Open Meetings Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the county commissioners and Joanne Long.  The session began at 12:01 pm and ended at 12:11 pm.  Back in open session, the commissioners authorized the Attorney’s Office to make an offer, contingent on financing and inspections.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.  He also presented culvert quotes for 48” 14-gauge galvanized tubes and bands.  They were:

Terry Graham made a motion to accept the quote from Welborn Sales.  Harold Coleman seconded the motion and all voted in favor.
 
The funeral for Ida Mae Killion, Clyde Killion’s wife, is at 10:00 am tomorrow.  All commissioners will attend.  Joanne Long will inform the media of the outing, but that no business will be conducted.
 
A group of people met with the commissioners to discuss the state of our federal government.  Those present were:  John L. Jackson, Frances of the Schassar Family, Norman Gates, Joan Loller, Jess Black, Bill Good, Eldon Isaac, Dean Erwin, George Warren, Deb Martin, Mel Barker, Joe Savage and Jack Black.  Jack Black spoke for the group.  He said there are five things the people can ask their county elected representatives to do:  Pass a resolution to uphold the Constitution of the United States, write our state legislators and encourage them to pass Senate Concurrent Resolution 1609, write all the other county commissioners in the state and ask them to do the same, reserve Memorial Hall once a week for town hall meetings and encourage the sheriff to organize and train a posse to protect the citizens of Bourbon County.  Others present spoke to the commissioners about their fears of the decline of the nation.  Everyone thanked the commissioners for hearing their concerns.  Jack Black passed out information to those in attendance and said he will be back next week.
 
Jeff Judy met with commissioners to ask for repairs to the Elm Creek handicapped dock.  The commissioners plan to go view the dock in question in the near future.
 
Keith Jeffers reminded commissioners of the FEMA public assistance meeting today at 1:00 pm.
 
Judy Orton presented her 2010 budget request for the Appraiser’s Office.  She reminded commissioners that her contract includes a 3% increase in wages each year, regardless of whatever is allowed for the rest of the employees.
 
Valorie Leblanc met with commissioners.  Terry Graham made a motion to go into executive session, for a period of 15 minutes, under the land acquisition exception to the Kansas Open Meetings Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the county commissioners, Valorie Leblanc and Joanne Long.  Crystal Mason was brought in for a portion of the session.  The session began at 11:29 am and ended at 11:44 am.  Once in open session, Terry Graham made a motion to make an offer on a property, pending inspections and financing.  Jingles Endicott seconded the motion and all voted in favor.  Terry Graham signed the contract with the offer.
 
Crystal Mason spoke with commissioners about drainage issues on Justice Lane.

July 24, 2009  Friday  9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Shane Walker presented an amended Computer Fund budget.  He cut about $34,000 from the 2010 expenditures.
 
Brad Rich met with commissioners to request permission to take a group of kids to a Kansas City T-Bones Game on a Big Brothers/Big Sisters outing using the jail van.  The expenses are to be paid with proceeds from fundraisers and a softball tournament.  The commissioners said it will be fine as long as the insurance will cover it.  We’re looking into that but awaiting a call back.  The game is in mid-August.
 
Jeffrey and Londa Picard spoke with commissioners about issues they are having at Hidden Valley Lakes, including dogs running at large, drugs and poor roads.  The commissioners informed them that they have no jurisdiction at the Lake, because it’s a private association.  They did agree to contact the association to see if anything can be worked out on the roads, like a contract for services.  Otherwise, they recommended that the Picard’s voice their concerns to the association at the next board meeting.
 
Bill Keith met with commissioners and presented quotes for environmental monitoring of wells at the landfill.  They were:

Terry Graham made a motion to accept the quote from Terracon for $2,150.00 for environmental services testing.  Jingles Endicott seconded the motion and all voted in favor.
 
Lynn Smith met with commissioners with a request to purchase a camera and laser range finder for the Appraiser’s Office from Equipment Reserve Fund.  This will allow for more accurate calculations of buildings and properties and to have digital images attached to land records.  The cost is roughly $2,800 total.  It would be paid for out of the Equipment Reserve Fund from monies that realtors and others who subscribe to our web search modules pay.  Commissioners approved the request.
 
Keith Jeffers met with commissioners to give an emergency management report.
 
Marty Pearson gave a road report.  He presented prices for 10-36” x 24’ culvert pipe and bands.  They were:

David Neville spoke with commissioners about maintenance issues on the courthouse.  With the courthouse over 80 yrs old, there are a lot of issues.  Commissioners asked him to list the issues and their priorities so that we can schedule for them.
 
Terry Sercer presented the 2010 County budget, based on requests from the different departments.  It reflects a 10 mill increase at this time.  Mr. Sercer will be back Monday morning to help out with any changes.  He explained that there are several factors, including: we’ve received very little interest on our funds, state payments have been cut, other fees are lower than expected and valuations are down from last year.
 
Alan Warren presented the 2010 Bourbon County Fair budget request.  He is requesting the same in 2010 as 2009.
 
Valorie Leblanc met with commissioners.  Terry Graham made a motion to go into executive session, for a period of 10 minutes, under the contract negotiation exception to the Kansas Open Meetings Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners, Valorie Leblanc and Joanne Long.  The session began at 11:07 am and ended at 11:17 am with no action.
 
Sharon Elder spoke with commissioners about her part-time help.  She has someone help cover when the office is short-staffed due to vacations and training.  Also, someone will fill in when Lesley is off after the baby is born.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Jack Black, Frances of the Shassar family, Jess Black, John L. Jackson, Jimmy Shadden, Sr., Randall Readinger, Debra Martin, Jeff Locke, Jan Seested and Eldon Isaac met with the commissioners.  Jack Black re-iterated his request to commissioners to endorse Senate Concurrent Resolution 1609.
 
Marty Pearson gave a road report.
 
Department Heads met at the commissioners’ request to discuss the 2010 budget situation.  Several factors have come together to make this one of the most difficult years.  To have exactly the same budget as 2009, it will require a 7-8 mill increase.  To give what was requested by each department, it will require a 10 mill increase.  The commissioners asked each department to look through their 2010 request and their 2009 approved budget to see what they can forego in order to lessen that burden.  Anything not spent in 2009 will not need to be levied for in 2010.  The department heads left to see what they can do.  Judy Orton, Joanne Long, Shane Walker, Sharon Elder, Susan Quick, Lee Davis, Valorie Leblanc, Marty Pearson, Lynn Smith, Ron Gray, David Neville, Bill Keith, Keith Jeffers and Jimmy Nichols were present. 
 
Dean Mann and Bob Love presented a power point presentation on the Riverfront project.  The commissioners indicated they support the project and appreciate the efforts of the board members.
 
Susan Quick spoke with commissioners.  A local company has been working to catch up on their back property taxes.  They have delinquent taxes in 2005 which will put them up for auction if they aren’t caught up in time.  They have asked that the interest penalties be waived in order to help them catch up quicker.  The commissioners denied the request.
 
Several department heads returned with amended 2009 and/or 2010 budgets for their departments.  Terry Sercer worked with commissioners on budget.  Work Session 1pm Wednesday.
 
Dwayne Neil requested an extension to remove the hay at Elm Creek.  The commissioners gave him until August 17th.

Marty Pearson gave a road report.
 
Bills and payroll for the period were reviewed and approved.
 
Terry Graham signed documentation for the Drywood Township Department of Commerce Grant, which was awarded.
 
Terry Sercer met with commissioners to present the latest draft of the 2010 County Budget.  The commissioners reviewed the document and asked for him to change some figures in the Road & Bridge Fund between 2009 and 2010.  Terry will make the changes and present the final draft Monday morning to get it approved to publish. It will represent a 0.000 mill levy increase and a tax decrease of 1.16% from 2009. 
 
Keith Jeffers reported that there are now two confirmed cases of H1N1 in Bourbon County.  He said that there are no obvious connections between them.  He’s continuing with press releases and reports to the public on safety measures that should be taken.  He also said that there are damage assessment meetings for the July storms set for next week in his office.
 
Jack Black dropped off information to commissioners he’d like them to read concerning Town Hall meetings.
 
Sheriff Gray got approval to send several of the old Sheriff vehicles to the Kansas City auto auction.  He is keeping the black truck, the white truck and the blue Tahoe for himself and for bad weather vehicles.
 
Lynn Smith met with commissioners to obtain a signature from the Chairman to add the AS400 to maintenance, as the warranty expires this fall.  Terry Graham signed the document.
 
Lee Davis met with commissioners.  Harold Coleman said that he’s been called by people who wanted to purchase PastureGard but were told we were out.  The commissioners authorized purchasing 100 Gallons.  He called and received phone quotes.  They were:  Van Diest at $47.24/gallon and Crop Protection Services at $47.50/gallon.  Harold Coleman made a motion to purchase from Van Diest.  Jingles Endicott seconded the motion and all voted in favor.
 
Valorie Leblanc presented a budget for the Attorney’s Office in writing.  It represents a $4,500 decrease from 2009.
