February 2, 2009      Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.
 
Lee Davis met with commissioners.  The truck he was authorized to purchase last Friday was no longer available.  He presented information on other trucks.
 
Keith Jeffers and Alice Maffett met again with commissioners and placed names on the flow chart for emergency response.
 
Jimmy Nichols asked commissioners for authority to purchase television sets for the pods in the jail.  As the classroom is now being used for living quarters, they have to provide some form of recreation time.  He said the inmates likely wouldn’t damage the sets, because it is a benefit to them.  Commissioners authorized Mr. Nichols to get price quotes on the number he needs and for the equipment to brace them to the wall and get back to them.
 
Terry Graham left the meeting at 11:10 am.
 
Tom Job, KCAMP, presented commissioners with the 2009 policy.  He also introduced himself to the new commissioners and reviewed the programs available to employees.
 
Joanne Long reminded commissioners that there would be no meeting Friday, February 6th, as Commissioners Coleman and Endicott will be attending New Commissioner Training in Topeka.
 
After routine business, the meeting adjourned at 11:45 am.

February 9, 2009         Monday     9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.  Oil quotes from Coastal.
 
Bill Keith met with commissioners to discuss the landfill.  He has been corresponding with KDHE regarding the old landfill closing.  There is an issue with the closing date.  Terry Graham thinks we may need to get the County Counselor involved with this.  Mr. Keith also spoke about testing of the monitoring wells.  There have been questions about the veracity of the test results in the past.  He would like to see if we can find another company that is more consistent.  He will come back on Friday with more information.
 
Ann Ludlum met with commissioners and presented the monthly progress reports for the Extension Office.  She also informed commissioners that she would like their help choosing the Commissioners’ Choice team of Walk Kansas when they are set.
 
Harold Coleman made a motion to increase the speed limit from 30 MPH to 45 MPH on Soldier Road between 245th Street and 265th Street, and on 265th Street between Soldier Road and Range Road.  Terry Graham seconded the motion and all voted in favor.
 
Lee Davis met with commissioners about a truck again.  He needs to clarify what is available to transfer from the end of year funds available.  Whatever that is, plus the capital outlay for 2008 and 2009 should cover the purchase.  He has two more trucks from Shepherd’s but they haven’t given him a solid purchase price.  Terry Graham will speak with the dealer.  In the mean time, commissioners approved the purchase of a battery and tires for the current truck.
 
Ron Gray and Bill Martin presented commissioners with information on the lease purchase of a fleet of vehicles for the Sheriff’s Department.  They sent out inquiries to 12 dealers and received responses from five.  The commissioners would prefer to deal with local companies when possible.  They asked for the price to have the police equipment installed locally so they can compare the prices in full.  Also, the vehicles should all be a police package and not include any civilian purposed vehicles.
 
John Doty requested that commissioners lower the speed limit on Osage Road east of Old 69 Hwy (215th Street).  No action at this time.
 
Charlie Blevins met with commissioners again.  He wanted to make sure the commissioners dealt with his neighbors about clearing the road during snows because they damage it.  The commissioners didn’t speak with his neighbors but informed the road crew to include that section of road when clearing Jayhawk.  Mr. Blevins also spoke with commissioners about the Extension Office parking vehicles in the south lot.  He’s concerned that when they are parked in the eastern most spots, visibility is blocked and people can’t see oncoming traffic and accidents may happen.  He was nearly hit there earlier this year.  He’s trying to keep someone from being killed at 3rd Street & National Ave.  Mr. Blevins wants the large vehicles, including Extension Vehicles, out of the east spots.  The commissioners and the sheriff informed Mr. Blevins that they can’t forbid people from parking there.  All they can do is ask. 
 
Following an accident involving a horse, Harold Coleman will speak with the Amish community about lighting or reflective strips on their buggies.

The Bourbon County Commission met in open session with all commissioners and the county clerk present. 
 
Bills and payroll for the period were reviewed and approved.
 
Bill Keith returned to talk about landfill testing.  He recommends we use Terracon.  Commissioners approved the request.  Terry Graham signed the contract.
 
A public hearing was opened at 10:00 am for consideration of a permit to close a portion of Hackberry Road for temporary inundation of the road by flood waters retained by the approved Marmaton Watershed Joint District #102 flood water retention dam Thomas Site.  Terry Graham made a motion to close the hearing at 10:10 am after hearing no opposition.  Jingles Endicott seconded the motion and all voted in favor.  Terry Graham made a motion to approve the permit as requested.  Jingles Endicott seconded the motion and all voted in favor.
 
Terri Johnson, Bill Keith, Clyde Killion and commissioners discussed the old landfill situation.
 
Terri Johnson informed Terry Graham that she checked on the burning regulations for him.  It is not allowed to burn buildings used for agricultural purposes without going through the channels of burning other buildings.
 
Jimmy Nichols met with commissioners to discuss the jail meals.  If meals are to be prepared in house, some modifications will be required.  We will need a hole and put a frame in the north wall of the kitchen for a meal counter and ventilation.  There would also be a security door to the kitchen in the window to lock it down.  Commissioners would like him to contact KDHE and the fire marshal to see what they will require us to do.  Jimmy suggested contacting the Kansas Jail Association.  Our meal contract has a 30 day out clause.
 
Lee Davis presented annual reports for commissioners to sign.  Terry Graham signed the reports.
 
Ron Gray presented the local cost for equipping vehicles, including a police package comparison on the Ford Crown Victorias between Olathe and Shepherd’s.  Harold Coleman made a motion to purchase six Crown Victorias from Shepherd’s.  Terry Graham seconded the motion and all voted in favor.  Financing will be through UMB at 4.25% for 5 yrs.  Shepherd’s needs 120 days to get the vehicles.  Commissioners would like Sheriff Gray to look into what to do with the vehicles they will be replacing.
 
Jingles Endicott made a motion to go into executive session, for a period of 10 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act.  Terry Graham seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson and Joanne Long.  The session began at 11:38 am and ended at 11:48 am with no action.
 
The commissioners want to set up a meeting with the road crew.  They will see about scheduling something.

February 20, 2009    Friday 9:00 am
 
The Bourbon County Commission met in open session with all commissioners present.  Shirley Goltra was also present.
 
Clyde Killion gave a road report.
 
Curt Shankel met with commissioners to give them an update on the Lake Fort Scott Sewer grant.
 
Diane Clay brought the US 69 Corridor Agreement between the County, the City of Fort Scott and KDOT for the commissioners to sign.  Terry Graham signed the agreement.
 
Norman Thole, Running Foxes, met with commissioners to ask permission to lay ¾ of a mile of pipe on county right-of-way to complete a 14 mile project.  He has access for the remainder of the project to private lands.  The commissioners would like him to check with the two remaining property owners once more to be sure they won’t allow access to their land before they will consider approval.
 
Brad Rich, SEKRCC, met with commissioners to discuss kitchen improvements in the jail.  He has prices for equipment.  Jingles Endicott made a motion to purchase a 17’ refrigerator for $667.00 and a dishwasher for $744.00 from Heidricks, a heat tray for $1,411.00 from Joe Harding Restaurant Supply and wiring from Matt Brock in the amount of $150.00.  Harold Coleman seconded the motion and all voted in favor.
 
Lee Davis met with commissioners about a truck for Noxious Weeds.  Terry Graham made a motion to purchase a 2009 Chevy Silverado 3500 from Shepherd’s for $25,969.00.  Jingles Endicott seconded the motion and all voted in favor.
 
Keith Jeffers updated commissioners on Emergency Management issues.  He is currently seeking applicants for a resource grant to help take inventory of resources in the county by August 31st.  The commissioners will help him when the applications are in.
 
Jingles Endicott made a motion to go into executive session, for a period of 10 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act.  Terry Graham seconded the motion and all voted in favor.  Those present for the session were the commissioners, Clyde Killion and Shirley Goltra.  The session began at 11:26 am and ended at 11:36 am.  When back in open session, commissioners changed the position and pay of two employees at the county barn.
 
The commissioners will be meeting with all public works employees on Wednesday, February 25, 2009, at 7:00 am, at the county barn.

February 23, 2009       Monday     9:00 am
 
The Bourbon County Commission met in open session with all commissioners and Shirley Goltra present.
 
Clyde Killion gave a road report.
 
Bill Keith, Landfill Supervisor, met with commissioners.  Terri Johnson was also present.  They spoke with commissioners about the closing of the old landfill.
 
Nina Yakel, Elm Creek Lake Caretaker, met with commissioners about a family who wants to reserve Shelter #1 for the whole summer.  The commissioners decided anyone renting any shelter would need to pay the deposit plus the nightly charge in advance.  They also need to give two weeks notice if they want to cancel in order for funds returned which are not used.
 
Nina asked about replacing windows in Shelter #3.  Commissioners asked her to get quotes.  Commissioners approved the purchase of a gas weed eater for the Lake.  Clyde Killion will purchase it.
 
Keith Jeffers spoke with commissioners about a structure fire over the weekend and various burning regulations.
 
Lee Davis brought his new truck up for commissioners to look at.
 
Steve Anthony met with commissioners about a low water crossing where the county is planning to build a bridge.  He wants to give a proposal on the project.

February 27, 2009       Friday        9:00 am
 
The Bourbon County Commission met in open session with all commissioners and Shirley Goltra present.
 
Bills and payroll for the period were reviewed and approved.
 
Jingles Endicott said that he received a call from a lady that has a tremendous amount of black birds and starlings on her property.  She wants to know what can be done.  The commissioners will contact Tom McNeil and have him speak to KDHE about it.
 
Clyde Killion gave a road report.  He spoke with commissioners about railroad crossings in different areas of the county.  Commissioners signed an agreement with BNSF Railway Company.
 
Karen Paddock met with commissioners to ask that Bill Prichard be allowed access to the Community Pool.  Commissioners will meet with department heads on March 2nd about it.
 
Judy Orton met with commissioners to inform them that agricultural values are down again this year.  The appraiser’s office is requesting an extension to set values and hope to have valuation notices out by April 1.
 
Norman Thole, Running Foxes, met with commissioners to discuss access to county right-of-way for a gas pipeline.  He says the company will pay $10 a rod for ½ mile on the county right-of-way and clean up after themselves to the County standards.  Commissioners approved access on Tomahawk between 110th and 115th on the south side of the road, with the stipulations above.

Terry Graham made a motion to purchase the bed from Harris Shop & Truck Sale for $2,617.21.  Jingles Endicott seconded the motion and all voted in favor.
 
Harry Wymar stopped in to tell commissioners about a culvert in need of repair on Unique Road, between 165th St. and 175th St.  He said it has washed out.  Commissioners will inform Clyde.
 
Eric Dietcher, KDOT, met with commissioners.  He went over the right-of-way acquisition steps.  He also left commissioners a guide on it.  He went over the steps and stressed that commissioners should discuss land acquisition in executive session and keep the amounts offered quiet.  The County Counselor should also be involved in all aspects of land acquisition.
