December 4, 2009     Friday  9:00 am
 
The Bourbon County Commission met in open session with Jingles Endicott and Harold Coleman present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Johnny Endicott met with commissioners to complain about KDOT pulling over farmers.  After numerous complaints, the commissioners will try to speak with someone about it.
 
Joanne Long informed commissioners that she received a phone call from Gary Farlow, KDOT, regarding the letter the commissioners sent on the railroad crossing south of Hammond.  He said KDOT updated the traffic count numbers and the crossing still doesn’t rank high enough for Federal assistance, but he thinks there’s a better than 50/50 shot at getting State assistance and that requires the commissioners to pass a resolution, which he forwarded.  He will also be in southeast Kansas on December 16th looking at other BNSF crossings and could stop to see this one as well.  No action at this time.
 
Shane Walker and Lynn Smith met with commissioners to discuss computer programming possibilities.  The commissioners want to wait until Monday when Terry is here to delve further.
 
Joanne Long spoke with commissioners about the County-wide 1% sales tax.  It sunsets June 30, 2011.  The 2011 budgets will be decided in 2010, so we need to get moving if we want to try to get it back on a ballot.  It would require a special election.  No action at this time.
 
Jingles Endicott left the meeting at 11:00 to meet Marty at Tex Crutcher’s to discuss a drainage issue.

December 7, 2009       Monday     9:00 am
 
The Bourbon County Commission met in open session with all commissioners present.  Shirley Goltra was also present.  Minutes of the previous meeting were read and corrected.
 
Marty Pearson gave a road report.
 
Darrell Howard stopped in to inquire about gravel on Eagle Road.  Marty Pearson said it is on the list and that he drove it last Friday and observed that it was pretty rough.
 
Shane Walker met to update commissioners on the programming costs between CIC and Manatron.  Manatron currently only offers tax, financial management and payroll programs in a Windows setting, but CIC has the whole package of programs we currently run on the AS400, plus additional programs for time management and Road & Bridge, all in a Windows environment.  After discussion, Terry Graham made a motion to go with CIC for Windows-based software for the County.  Jingles Endicott seconded the motion and all voted in favor.  Once we switch to a Windows-based system, we will save money on equipment costs by not having to purchase the expensive AS400 server.
 
Terry Sercer met with commissioners to discuss year-end budget and cash issues.  He said we’ll need to transfer funds from Road & Bridge Sales Tax to the Road & Bridge Fund.  He will review the information he received and report back to the commissioners on Friday.
 
The commissioners received a request to extend the listing of our property on Osage Road.  The commissioners agreed to the extension and Terry Graham signed the paperwork.
 
Leon Fry stopped in to request gravel on the Elm Creek Lake dam.  The commissioners will contact Marty about it.
 
Tom McNeil met with commissioners about people dumping trash at 2nd Street and 205th Street.  He suggested putting a gate up to prevent this.  The landowners are in agreement with this idea, also.  Rural Water would need a key to the gate to access water meters, but commissioners agreed to the idea with the stipulations.
 
John Bellerive, Haynes Equipment Co., Inc., Marvin Springer, Environment One Corporation, Tom McNeil, Jim Gladbach, Keith Jeffers and Curt Shankel met with commissioners to discuss possible grinder pumps at Lake Fort Scott.  They reviewed several models and styles and are leaning toward the DH071/DR071.  Its power consumption is about $8.00/year (roughly, the equivalent of a 40 watt lightbulb) and it accommodates flows of 700 gallons per day and has a capacity of 70 gallons.  For non-full-time residents, they need to purge the pump before they leave for an extended period.  The pump is equipped with a Pump Failure Alarm.  The cost of the system is $3,800, plus $200 for the optional 3-5yr extended warranty (two years is included with purchase).  The cost of a replacement pump would be $1,650.  No action.

December 11, 2009      Friday        9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
David Neville met with commissioners with quotes to replace three heat exchangers (parts and labor) for rooftop air conditioners on the correctional center side.  Three quotes were received.  They were:
 
DC Service                          $4,540.00 total
CDL Electric                        $4,877.00 total
Design Mechanical, Inc.         $4,482.00 each
 
Jingles Endicott made a motion to accept the quote from DC Service.  Terry Graham seconded the motion and all voted in favor.
 
Joanne Long asked if commissioners planned to pass a resolution to request KDOT funding for warning devices at Crossing Number (DOT#668699M), located on 225th Street, ¼ mile south of Hammond.  Jill, from Gary Farlow’s office at KDOT said that it’s an 80/20 match with KDOT and the Railroad, respectively.  Mr. Farlow plans to be in the area next week to look at crossings in the area and can put this one on his route if the resolution is signed.  Harold Coleman made a motion to adopt Resolution 24-09, requesting the assistance.  Terry Graham seconded the motion and all voted in favor.
 
Terry Graham made a motion to adopt Resolutions 25-09 and 26-09, regarding continuation of the Bourbon County Enterprise Zone with no changes.  Jingles Endicott seconded the motion and all voted in favor.
 
There was discussion of appointing two people from Bourbon County to the SEK Mental Health Board.  Terry Graham made a motion to appoint J.W. Endicott and Diana Endicott as Bourbon County’s members to the SEK Mental Health Board.  Harold Coleman seconded the motion and all voted in favor.
 
Harold Coleman made a motion to adopt the amended and restated Bylaws and Inter-local Agreement for KCAMP and Resolution 27-09 as same.  Jingles Endicott seconded the motion and all voted in favor.  One original will be filed with the Register of Deeds and another will be filed with the Secretary of State.
 
Terry Graham left the meeting at 11:00 am to attend a conference call regarding the Lake Fort Scott Sewer project in the basement with Tom McNeil.
 
Bill Keith spoke with commissioners about a letter he received from the State regarding the landfill.  The commissioners asked him to come back on Monday when Terry is also here.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Bills and payroll for the period were reviewed and approved.
 
Marty Pearson gave a road report.  He said that Phoenix Coal Company is complaining about the condition of Deer Road.  They are supposed to reimburse us but are behind about $6,000 in maintenance fees at this time.
 
Shane Walker spoke with commissioners about the programming for the courthouse.  Manatron is now trying to get us to reconsider changing and wants us to wait until April to see their product.  After discussion, the commissioners agreed to continue with the plans to sign with CIC for Windows-based programming.
 
Terry Sercer met with commissioners to discuss the year-end budgets.  Everything seems fine, provided that Road & Bridge Sales Tax transfers the $250,000 it budgeted to Road & Bridge.  All other funds appear to be fine.
 
Bill Keith met again with commissioners to discuss the landfill letter he received concerning new proposed regulations for smaller C&D Landfills, of which we are.  After discussion, the commissioners drafted a letter in return voicing our concerns that the additional restrictions are unnecessary and excessive for small landfills.
 
Mark Wade spoke with commissioners about an entrance on 9th Street, 1 ¾ miles north of US 54.  He needs an entrance culvert to a pasture.  They will let Marty know.
 
Michael Pommier stopped in to discuss the railroad crossing south of Hammond.  The commissioners said that KDOT and the railroad will be viewing the crossing later this week, which we hope will get a warning device erected there.
 
After routine business, the meeting adjourned at 11:35 am to attend the courthouse holiday dinner.

December 18, 2009   Friday  9:00 am
 
The Bourbon County Commission met in open session with Jingles Endicott and Harold Coleman present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.  Terry Graham was not present due to a meeting in Topeka regarding the old Landfill.
 
Marty Pearson gave a road report.  He spoke with commissioners about holiday hours for the landfill.  The local trash haulers have asked that we be open a half-day on Thursday (Christmas Eve).  Therefore, the commissioners agreed holiday hours for the Landfill to be open from 8:00 am – noon, Thursday, December 24th, closed Thursday afternoon, all day Friday, December 25th and closed Saturday, December 26th.  Joanne Long will publish the announcement with the courthouse closing notice.
 
Mr. & Mrs. David Wade spoke with commissioners about a gate in the vicinity of 130th and Valley.
 
Shane Walker presented the contract for programming services with CIC.  Jingles Endicott signed the documents in the absence of the Chairman.
 
Chief Ron Puterbaugh and Sheriff Ron Gray met with commissioners to discuss recent grant awards to the Fort Scott Police Department.  He presented a proposed inter-local agreement stating that the County will not receive any funds from the JAG Grant.  Jingles Endicott signed the agreement in the absence of the Chairman.
 
Keith Jeffers and Tom McNeil met with commissioners about FEMA Flood Plain maps.  After meeting with FEMA in Frontenac, and hearing from other counties and states having similar problems, it seems that FEMA doesn’t care that their maps are wrong and are not willing to try to fix them.  We need to get the City of Fort Scott to join us, as it is their lake.  Also, we can join forces with surrounding counties to try to get something done.
 
Nancy White stopped in to request gravel on 205th Street between Wagon and Valley.

December 21, 2009      Monday      9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Terri Johnson met with commissioners to discuss the meeting she and Terry Graham attended last week regarding the old landfill site.  Harold Coleman made a motion to go into executive session, for a period of 8 minutes, under the attorney/client privilege exception to the Kansas Open Meetings Act.  Terry Graham seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson, Marty Pearson and Joanne Long.  The session began at 9:05 am and ended at 9:13 am with no action.
 
Mrs. Johnson also spoke with commissioners about storage.
 
Marty Pearson gave a road report.
 
Shane Walker spoke with commissioners about computer issues.  He informed commissioners that the County will be installing secure wireless for some programming.
 
Christie McReynolds, USDA Rural Development, met with commissioners regarding Bourbon County Sewer District #1.  She’s here to receive a letter of conditions on the project, prior to the final grant awards.  Terry Graham made a motion to adopt Resolution 27-09, Procurement procedures for the Sewer District and to sign the letter of conditions for the project.  Jingles Endicott seconded the motion and all voted in favor.   
 
Tom McNeil discussed the electric providers for Lake Fort Scott.  One side is on Westar and the other is on Heartland.  There is concern for the consistency of the power stream for grinder pumps.
 
Lane Cutler met with commissioners to discuss Maintainer on Fern Road.  He feels it needs more rock and more attention than it has been receiving.
 
Duane Hill, Kansas Gas Service, met with commissioners to ask for a permit to open cut at Indian Road and 10th Street.  Jingles Endicott made a motion to open cut Indian Road at 10th Street.  Terry Graham seconded the motion and all voted in favor.
 
Shane Walker and Susan Quick discussed a question by a taxpayer who believes he’s being improperly billed on his tax statement for a watershed district.  After reviewing the tax records and the watershed map, it was determined that his billing statements are correct as billed.
 
Terry Graham left the meeting at 11:40 am to meet with Tom McNeil in the basement.

December 25, 2009      Friday No meeting—Christmas

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Bills and payroll for the period were reviewed and approved.
 
Marty Pearson gave a road report.  He discussed the blizzard over Christmas.
 
Keith Jeffers requested the commissioners approve a disaster declaration for the storm over Christmas.  If we qualify, public entities, such as the City and County, can get reimbursed for expenses incurred during the storm.  Terry Graham made a motion to declare a disaster.  Jingles Endicott seconded the motion and all voted in favor.  The Declaration was numbered Resolution 28-09.
 
Mr. Jeffers informed commissioners that he would be checking on the repeater at 125th and Tomahawk.  Dispatch has been getting an error message for the last three days.
 
Karen Paddock spoke with commissioners about 2009 budget surplus in District Court.  She asked commissioners about progress on the storage situation.  She said she has about $15,000 she can not spend this year, which would carry over into 2010 in the General Fund, or she can spend it on other items.  She hopes the commissioners are looking for a solution to the storage issue.
 
Jake Underwood met with commissioners to say that Maple Road from 75th to 95th needs attention.  He also discussed the county-wide sales tax which expires June 30, 2011.  If the County wants to continue it, a Special Election will likely need to be held this spring.  The commissioners asked for Mr. Underwood’s continued support of the tax.
 
Terry Graham left at 11:00 am to attend to an ailing family member.
