August 3, 2009    Monday     9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Michael Pommier, reporter with the Fort Scott Tribune, was present. 
 
Jack and Jess Black, Charlie Blevins, Phillip Pavey, Frances of the Schassar Family, John Hennessy, Brian Switzer and Eldon Isaac met with commissioners.  Jack Black discussed more articles pointing to the fact that the federal government is overstepping its bounds.  Terry Graham said he, personally, doesn’t have a problem with the Senate Concurrent Resolution, but the commissioners still won’t adopt the resolution he asks of them.
 
Lee Davis presented chemical quotes for Escort. He said that much of it is spoken for and wants to purchase another case.  Three quotes were received.  They were:

Terry Graham made a motion to purchase six cases from Vegetation Management.  Jingles Endicott seconded the motion and all voted in favor.
 
Earl Brown asked if he can still buy chemicals.  Commissioners informed him to contact Lee Davis.
 
Department heads, or their designees, met at 10:30.  Those present were: Lee Davis, Tom McNeil, Marty Pearson, Shane Walker, Keith Jeffers, Joanne Long, Bill Keith, Lora Holdridge, Mark Ward, Angel Wilson, Ron Gray and Susan Quick, Lynn Smith, Judy Orton and David Neville.  The commissioners informed them of the final budget that will go to publication.  They said they appreciated the departments’ help with cuts, and reminded them that we need to tighten our belts and save as much as possible for the rest of 2009 as well.  They asked that any purchases of substance be considered before being made.  Judy Orton mentioned that she appreciated the commissioners allowing the department heads involved in the process and not just cutting without their input.
 
Keith Jeffers spoke with commissioners about Emergency Preparedness issues.
 
David Neville informed commissioners that he’s having the porch column patched, as it is falling apart. 
 
Harold Coleman made a motion to set the County budget hearing for 10:00 am, Monday, August 17, 2009.  Jingles Endicott seconded the motion and all voted in favor.  This budget reflects the same mill levy as 2009, which results in fewer taxes levied, as the County’s overall valuation is down over a million dollars.
 
Harold Coleman left the meeting at 11:30 for a dentist appointment.
 
After routine business, the meeting adjourned at 11:55 am.

August 7, 2009         Friday           9:00 am
 
The Bourbon County Commission met in open session with all commissioners present.  Shirley Goltra was also present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.  He also said that the generator at the rock quarry needs a radiator.
 
Craig and Dana McKenney thanked commissioners for the quick improvements to 240th St.  They asked that yellow lines be put down the center of the road to keep drivers on their side of the road.  They would also like the commissioners to print off the Uniform Traffic Control Devices off the internet and have the County implement them.  Mr. McKenney also spoke of other roads in the County which he feels need improvements and asked the County to put some system in place to identify them and fix them.  He also feels that 240th Street needs a traffic study.
 
Shane Walker updated commissioners on the Register of Deeds software and server plans.  The commissioners reminded him to keep within budget.
 
David Neville presented an estimate on repairs to the correctional center and sheriff departments’ ceilings from water damage.  They wil be sent to the insurance company.
 
Harvalee Waltmire spoke with commissioners about a culvert which needs cleared out at 2404 209th St., Fulton.
 
Terry Graham left the meeting at 11:40 am.
 
Harold Coleman spoke with Jason Williams of BNSF Railroad about installing a signal at the crossing on 225th St., approximately ¼ mile south of Soldier Road.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Brad Rich thanked commissioners on behalf of the correctional center employees for allowing them to take the kids with Big Brothers/Big Sisters to the T-Bones game over the weekend.  They all had a great time.
 
Terri Johnson requested an executive session.  Harold Coleman made a motion to go into executive session, for a period of five minutes, to discuss land acquisition.  Terry Graham seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson and Joanne Long.  The session began at 9:32 am and ended at 9:37 am with no action
 
Marty Pearson gave a road report.
 
Joe Savage met with commissioners.  He requested a copy of the proposed county budget, which he received.  He also spoke with commissioners about a recent newspaper article based on the visits by Jack Black.  The commissioners explained why they will not sign the proposed resolution. 
 
Tom Palzer met with commissioners to see about closing a portion of Yale Road.  Commissioners gave him a petition and told him what steps are required by law.
 
Keith Jeffers met with commissioners to discuss emergency preparedness issues.  The next LEPC meeting is this week.  He also will be meeting with city officials to discuss dispatch. 
 
Lloyd Marsh asked about a road.

Bills and payroll for the period were reviewed and approved.
 
Marty Pearson gave a road report.
 
Earl Maloney spoke with commissioners about dust control in front of his house.  The commissioners said they will put down fines and water it.  Mr. Maloney also asked about lowering the speed limit.  The commissioners will not change the speed limit.
 
Terry Graham spoke with Marty Pearson about putting down yellow lines along the curve on 240th St. at Kansas Road.
 
George Warren asked the commissioners why Maple Road (Old 54) is only 45 MPH.  He said that 215th St. (Old 69) is 55 MPH.  The commissioners said the speed limit is lower because of the conditions of the road and how narrow it is.
 
Lee Davis called in with phone quotes for 320 oz. of Escort.  They were:

Terry Graham made a motion to purchase from Van Diest.  Harold Coleman seconded the motion and all voted in favor.
 
Karen Paddock stopped in to say that the budget in Linn County didn’t get cut.  The commissioners said the mill levy in Linn County probably went up too.

August 17, 2009       Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Laura Moore and Darrell Bloomfield met with commissioners.  Ms. Moore had some supplemental paperwork for the Drywood Township Grant.  Terry Graham and the other commissioners signed the documents.
 
At 10:00 am, Terry Graham opened a public hearing for the consideration of the 2010 Bourbon County Budget.  The county commissioners, Joanne Long, Michael Pommier of the Fort Scott Tribune, Joe Savage and Terry Sercer were present.  This proposed budget has no mill levy increase and about $53,000 less in property taxes from 2009.  Valuation is down, sales tax revenues are down, state aid is down, interest is down, and the ambulance contract is up.  Joe Savage asked commissioners questions about some of the line items.  When there were no further questions, Terry Graham made a motion to close the public hearing at 10:29 am.  Jingles Endicott seconded the motion and all voted in favor.  Terry Graham then made a motion to approve the 2010 County budget as published.  Harold Coleman seconded the motion and all voted in favor.  The commissioners signed several copies of the budget.
 
Terri Johnson and Crystal Mason met with commissioners to discuss the possible acquisition of real estate.  Jingles Endicott made a motion to go into executive session, for a period of 10 minutes, under the land acquisition exception to the Kansas Open Meetings Act.  Harold Coleman seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson, Crystal Mason and Joanne Long.  The session began at 10:39 am and ended at 10:49 am with no action.
 
The commissioners will view a ditch problem south of Redfield and the handicapped ramp at Elm Creek Lake this Friday beginning at 10:30 am.

August 21, 2009  Friday        9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.  He showed commissioners pictures from Elm Creek Lake.  He will meet the commissioners out there at 11:15 am this morning.
 
Several people met with commissioners to discuss the proposed Lake Fort Scott sewer.  Among those present were:  Mark Pressly, Jim Gladbach, John Scott, Gerald Chester, Bob Hughes, Tom McNeil, Roger Lee and Don Stewart.  Mr. Pressly is concerned that there is conflicting information in the different documentation for the project.  He attended the City Commission meeting this week and spoke about his concerns too.  The City decided not to give a letter of support of the project at this time.  He wants the County and City to get better financial information before they make the lake landowners pay for a system that might not work properly.  He wants there to be a joint committee formed to research this information and he would like to be on it.  Mr. Pressly also asked that he be notified by email when upcoming lake sewer meetings are scheduled, as he does not subscribe to the newspaper and the online version doesn’t list public notices.
 
Karen Paddock met with commissioners.  She said she supports the efforts of the County Attorney to obtain more space.  She would be willing to bring her off-site storage back only if there was a good plan in place for it.  She said that the books in the law library are redundant because the attorneys all subscribe to Westlaw and obtain the information over the internet from their offices.
 
Lee Davis called to ask to purchase 50 gallons of Roundup.  Commissioners approved the purchase of the cheapest.  Three quotes were received.  They were:

At 10:00 am, a public Hearing for the vacation of property in Freedom Township was opened.  Those present for the hearing were the commissioners, Joanne Long, Harvalee and Janice Waltmire and Harry and Dollie Shadden.  The Shaddens requested to close this portion of unplatted road.  The notices were sent and published according to law and now, the commissioners have a resolution to vacate the land, if they choose.  Hearing no objections, the hearing was closed at 10:03 am.  Harold Coleman made a motion to pass Resolution 19-09, vacating a portion of land in Freedom Township.  Jingles Endicott seconded the motion and all voted in favor.  It will be recorded in the Register of Deeds Office and with the Public Works department, as well as published once a week for two consecutive weeks in the official county newspaper.
 
Terry Graham made a motion to re-appoint Ken Anderson to the Tri-Valley board.  Harold Coleman seconded the motion and all voted in favor.
 
Terry heard from Fort Scott City officials that there is a work session scheduled for August 25th at 5:00 pm, at city hall between the City and the County to discuss the Lake Fort Scott sewer project.
 
Bill Keith met with commissioners to discuss the landfill.
 
Terry Graham signed two copies of the architect agreement for the Drywood Community Building.
 
The commissioners left at 10:40 to view a ditch south of Redfield and the handicapped dock at Elm Creek Lake.

August 24, 2009       Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Jimmy Nichols met with commissioners to report on the training he and two other jail staff attended last week in Denver.  He said there is additional training in October that they would like to attend.  The airline tickets, hotel and class expenses are completely paid by the federal government.  The commissioners asked him if the inmate work crew can work around the handicapped ramp at Elm Creek Lake.
 
Travis Allen, SEK-CAP, met with commissioners with another program available to entities.  Terry Graham said he’ll pass out the application to anyone with projects he can think of.  Mr. Allen said this grant lasts until Sept. 30, 2010.
 
Commissioners spent part of the morning discussing the ditch south of Redfield that they viewed on Friday.
 
Mark Ward asked the commissioners to explain to him what the Lake Fort Scott people were here for last Friday, as he owns property at the lake.  The commissioners did so.
 
Terri Johnson met with commissioners.  The commissioners asked her about landfill issues and spoke with her about the ditch south of Redfield that they viewed last week.  She will look into the issues for the commissioners.

Kendell Mason spoke with commissioners about an employee who habitually doesn’t fill out his time sheet.  With paying 100 employees, there’s no way to chase after everyone’s time sheets.  The commissioners advised her to put a note with his paycheck that if it happens again, that his check will be docked and he won’t get paid again until the next cycle.

The Bourbon County Commission met in open session with all commissioners present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.

Marty Pearson gave a road report.
 
Bill Wiggans met with commissioners.  He’s gotten a partial release from the doctor, with restrictions, and wants to come back to work.  With his restrictions, especially the “no vibrations”, we haven’t got any work for him.  He continues to be on Worker’s Compensation.
 
Larry Paddock, Mayor of Fulton, met with commissioners to ask about chip and sealing in Fulton.  He’s been waiting for several years now.  Marty said that the asphalt program is still running and we’re behind a bit in schedule.  Once they get the chip and sealing going they can be done in Fulton in a day’s time. 
 
Joanne Long informed commissioners that the Health Office will be offering flu shots again this year.  The cost will be $20.  In past years, the County has paid half the cost of a flu shot for County and Courthouse employees who which to have one.  Jingles Endicott made a motion to pay half the cost of flu shots for those County and Courthouse employees who wish to get one.  Harold Coleman seconded the motion all voted in favor.

Jimmy Nichols and Terri Johnson met with commissioners to discuss mental health for inmates.  It is cost-prohibitive to send the inmates to the clinic because one or two officers have to accompany them for the trip, which sometimes takes over two hours.  They would like to set it up for the doctors to come to the jail instead or to set up for video conferencing, like in other counties.   They are having difficulties with the clinic about this suggestion.  The commissioners will see if Sam Mason can speak with Bob Chase about our concerns.

August 31, 2009       Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Doug Miller asked about closing the road which dead ends on the way to Guthrie’s Mound.  Commissioners gave him a road closing petition and explained the steps needed for closing a road.
 
Marty Pearson gave a road report.
 
Curt Shankel and Tom McNeil met with commissioners with drafts of letters regarding the proposed sewer district at Lake Fort Scott.  The first is the proposed letter the City of Fort Scott would sign to coincide with the grant application and the second is a memo to lake lot owners of the situation to date.  There are a few changes to make before they are finalized.
 
Ben Mitchell met with commissioners to discuss assistance with finances for the Watershed 98 project on Overbrook Road.  In April 2007, the commissioners agreed to provide $34,250 in funding.  After some discussion, however, Jingles Endicott made a motion to allot $37,500 with the following breakdown:  $25,584 for tubes and bands, $3,800 for warning signs, etc., approximately $3,500 for XYZ for tube insulation and $4,616 cash assistance.  Terry Graham seconded the motion and all voted in favor.  Mr. Mitchell thanked the commissioners.
 
Keith Jeffers met with commissioners to update them on FEMA training he attended last week.  He said they provided tips on how to get additional funds from disaster situations if the county passes a resolution allowing overtime for salaried individuals.  He will look further into this and report back.
 
Fred Hixon asked commissioners for an update on the Lake Fort Scott meeting with the City commissioners last week.
 
Joanne Long asked commissioners to appoint a voting delegate and alternate for the KWORCC annual meeting at the KAC conference in November.  Harold Coleman made a motion to appoint Jingles Endicott the voting delegate for the KWORCC meeting.  Terry Graham seconded the motion and all voted in favor.  Jingles Endicott then made a motion to appoint Harold Coleman as the alternate for the KWORCC meeting.  Terry Graham seconded the motion and all voted in favor.
