April 3, 2009   Friday  9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.
 
Doylene Kennedy presented the tonnage fees quarterly and monthly sales tax reports for Terry Graham to sign.
 
Eric Bailey met with commissioners to request that the County help with the Spring Clean-Up Program.  Jingles Endicott made a motion to waive the gate fees in conjunction with the Spring Clean-Up Program as we have in years past.  Harold Coleman seconded the motion and all voted in favor.
 
Sheriff Gray and Jimmy Nichols met with commissioners.  Sheriff Gray mentioned that a position is open, due to the retirement of Darrell Spencer.  He is moving people up internally and will leave a position unfilled on the night shift.  He is moving Jimmy Nichols into the Director of Security spot, Brad Rich to Program Director and moving Logan Probasco and Jackie Fields to Lieutenant positions, effective April 1, 2009. 
 
The Sheriff said he is applying for a “COPS:  Secure Our Schools” grant on behalf of USD 235.  Terry Graham signed the application.
 
Jimmy Nichols asked that his new salary as Director of Security be reduced $1.50/hr in order to increase the positions of Program Director and Business Administrator by .75/hr each.  He feels that the positions of the office staff should be more equal.  Terry Graham made a motion to amend the salary resolution to reduce the Director of Security by $1.50/hour and to increase the Programs Director and Business Administrator positions by .75/hour, effective April 1, 2009.  Harold Coleman seconded the motion and all voted in favor.
 
Norman Thole, Running Foxes Petroleum had commissioners sign road bore permits.
 
Chuck Weyant met with commissioners to ask that they donate the fees to rent the large shelter house at Elm Creek Lake for a charity concert the last weekend in August.  He said that 100% of the proceeds of the concert will go toward the correctional center’s Christmas Adopt-a-Family project and toward a scholarship at Fort Scott Community College in honor of John Taylor.  Commissioners approved the request and asked that he make arrangements with the caretaker as soon as possible.

April 6, 2009   Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners present.  Shirley Goltra was also present.  Minutes of the previous meeting were read and approved.
 
Brian Comstock met to ask commissioners for help.  He wants to put up a fence and his neighbor doesn’t want trees removed to put up a fence.  Also, there’s an issue with where his gate is located with another owner.  At the time it was constructed, there was an oral agreement between himself and the neighboring property owner.  Harold Coleman and Jingles Endicott will talk to the owners to see if the fence situation can be resolved without a fence viewing.
 
Clyde Killion gave a road report.  He said it’s nearly time to hire part-time mowers for the season.  He said we should have four mowers and they should start in May.
 
Terry Graham signed a quarterly report for Kansas Department of Wildlife & Parks for the CFAP program.  He also signed a voucher for KDOT Project 6-C3855-01.
 
Sharon Elder presented the RVI contract for signature.
 
Mike Hueston, Mayor of Mapleton, met to ask for the County’s assistance in reshaping some roads in Mapleton.  He said that some of the driveways are too high.  He also asked for help with some clean-up work by the Methodist Church in Mapleton.  The commissioners will schedule some blade work.
 
While hauling rock, an unknown Bourbon County employee knocked down a high line pole and tore down a transformer line.  We’ve received a bill from KCP&L for the damages, totaling $3,052.68.  We will submit it to our insurance company.
 
Commissioners asked Clyde Killion when we’ll be starting the chip and seal program.  We will start this summer, as soon as the weather permits.
 
Keith Jeffers met with Emergency Preparedness updates.  He informed commissioners that he went to ID card making training program last Friday.
 
Herschel George stopped by to see that commissioners received his email.  They had.

April 10, 2009           Friday  9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Employees from Fort Scott City Public Works Todd Farrell, Street Supervisor, Russ Hughes, Parks Supervisor, and Eric Bailey, Public Works Supervisor, met with commissioners to ask for a few loads of shot rock to be donated to help with a handicap dock project at Fort Scott Lake.  The commissioners approved the request.  This rock will be put toward the City’s match for a grant.  It will be on the west side where the boat launch and fish feeder are.
 
Clyde Killion gave a road report.
 
Diana Mitchell, Eric Bailey, Tom Robertson, Larry Fink and Paul Martin, members of the Youth Activities Team (YAT), met with commissioners for an update on the Ellis Park project.  After last summer’s world records they have been laying low but they’re back in the public eye again.
 
Matt Sanders, Waste Management, met with commissioners.  He manages the landfill at Arcadia.  He would like to get Bourbon County’s business.  The commissioners would like to see a proposal.  Mr. Sanders will have something for us by next week.
 
Randy Glessner was present for part of the meeting.
 
Michael Pommier, Fort Scott Tribune, was present for the discussion of the ambulance contract.  Mercy has asked that the amount the County subsidizes for ambulance service be increased, beginning in July 2009, from $14,651/month to $23,000/month.  After discussion, Terry Graham made a motion to agree to Mercy’s request of $23,000/month, effective July 1, 2009, and exercise our right to financial documents, as provided in the contract.  Jingles Endicott seconded the motion and all voted in favor.
 
Ronnie Brown, David Middleton, Sharon Middleton, Warren Schooley, Irene Schooley and Jackie Messer met with commissioners to discuss Hiattville Fire Department seceding from Fire District 3.  Mr. Brown said there was a meeting between the township officers of Drywood, Pawnee and Walnut Townships and with Scott Township Fire Department a few weeks ago.  They’d like to start discussion of what to do to leave Fire District 3 and create their own.  Joanne Long explained that there is a deadline of July 1 to make changes to fire district boundaries.  Also, fire districts will be limited to 10.000 mills.  There looks to be a petition requirement and would be opportunity for a protest petition.  The commissioners will have the county attorney look into it to be sure.  Mr. Middleton asked if the townships can assume responsibility of the Hiattville station in the meantime.  The commissioners said that is not possible.  Mr. Middleton said that’s how the Scott Twp Fire Dept. works.  The commissioners said that’s how that department was created.  The Hiattville station is part of Fire District 3, so it must stay under Fire District 3’s authority until such time it is not part of Fire District 3.
 
Joanne Long informed commissioners that she is ordering signs to be posted at the polling places prohibiting all except service animals.  She asked commissioners if they would like her to order signs for the courthouse at the same time.  The commissioners authorized the order, but declined to use the signs at the courthouse until such time as it becomes a problem.

The Board of Bourbon County Commissioners met in open session with Harold Coleman and Jingles Endicott present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.
 
Bills and payroll for the period were reviewed and approved.
 
Clyde Killion gave a road report.
 
Brian Comstock met with commissioners to discuss the fence issue with his neighbor.  Joanne Long explained how a fence viewing works.  Mr. Comstock presented commissioners with a copy of a court case [Ks Court of Appeals-Muhl v. Bohi, No 96,262 (2007)], which he says supports his case of needing to remove trees in order to erect a proper fence.  He said that he will eventually be putting cattle on the land so he wants to request that the entire fence be constructed with at least 5-wire fence to keep the cattle in.  He formally requested a fence viewing by all three commissioners and paid his fee to the County Clerk.  The commissioners will set a date when all are present.  Mr. Comstock informed commissioners that he will be unavailable the last of April through about May 5th and wants to schedule around that, as he wants to attend the fence viewing. 
 
The Board of County Canvassers met at 9:30 am to finalize the results of the April 7, 2009 City/School General Election.  Joanne Long and Tony George presented the election information.  There were nine ballots to review to determine if they should be added to the totals:  7 Provisionals and 2 Advance Ballots returned with no signatures.  In the end, the election was certified with 1,500 total votes cast.  The commissioners ruled as follows:
 
5 ballots deemed valid—added to totals
2 ballots rejected—not registered
2 ballots rejected—Advance ballots not signed

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.
 
Sheriff Gray presented the application for a “COPS” grant for two officers for Terry Graham to sign as chairman.  He said we won’t know if we are awarded the grant until Sept 30th.  He also informed commissioners that USD 235 Uniontown has applied, through Greenbush, for a “Secure Our Schools” grant for 16 cameras and 23 magnetic door locks. 
 
The Sheriff informed commissioners that he’s received a complaint about the south door being locked.  Since there’s a security camera on that door, can we see about re-opening it?  The commissioners closed down to one entrance on the recommendation of the judicial district survey.  The commissioners will ask District Court about it.
 
Judy Orton spoke with commissioners about the courthouse flowerbeds.  David needs the south beds removed in order to cross with the lawnmower.  She also spoke about how narrow the sidewalk is coming around to the main entrance from the south parking lot.  Oftentimes you have to step off into the grass to let someone pass. 
 
Michael Pommier, reporter with the Fort Scott Tribune, was present.
 
Keith Jeffers spoke with commissioners about Emergency Management issues.
 
A large group of people met with commissioners in support of Hiattville Fire Station remaining within Bourbon County Rural Fire District #3.  They were:  Leanna Howard, Louella Howard, Jerry Page, David Hurd, Dale Cathey, Justin Hueston, Jeremy Wilson, Robyn Wilson, Terry Kiser, Kevin Wagner, Jeff Reed, Michael Vanzant, Alvin Beerbower, Delwin Mumbower, Jack Sutterby, Rhonda Vanzant, Ruth Waring, Whendi Martin, Jarry Dunlay, Lester Waring, Roger Jones, Bill Martin and Keith Jeffers.  They represented Hiattville, Garland, Fulton, Devon, Uniontown and Mapleton fire stations, Bourbon County Red Cross, the Sheriff’s Dept, FSCC and Emergency Management.  They’re here to voice concerns and ask for Commissioners’ support for the district as it is.  All the equipment and vehicles were acquired to benefit the entire district, not just a specific station.  That’s why the district was created, because the smaller communities couldn’t afford to do it themselves.  They have mutual aid agreements with neighboring districts.  All three commissioners said they support Fire District 3, stating that tax dollars in Bourbon County for fire service should be used in Bourbon County.  In the past ten years, the district went from a bunch of people with hoses and bucket brigades to a trained, unified district.  It was mentioned that there are seven EMTs and one First Responder in the room now.  They stated that they are here for the people of the district.  They admitted they are not perfect and that mistakes happen, but every one of them do their very best for the people of the district.  The commissioners thanked the group for coming and the group thanked the commissioners for listening.
 
Joanne Long reminded commissioners that they have received a formal request for a fence viewing and need to set the date and time.  Commissioners asked that it be set for 11:00 am, Monday, May 11, 2009.  The location is the described as: beginning at the SW corner of the SW ¼ of Section 12, Township 25, Range 24, Scott Township, Bourbon County, Kansas, traveling north approximately 660 feet or 1/8 of a mile.  The landowners are Brian Comstock and Connie Krug.  Joanne will send out the letters to the owners involved, as prescribed by law.

Terri Johnson spoke with commissioners about the old landfill situation.  The commissioners will set up a meeting with the State to discuss our options.
 
Dale Hixon met with commissioners to say that the ditch in front of his house is holding water.  Clyde will go look at it.

Tom McNeil and Shane Walker spoke with commissioners about the new FEMA flood plain map of Bourbon County.  It now includes areas at Lake Fort Scott which have never flooded, as water would have to go over the spillway and the emergency spillway before that happened.  Tom has learned from FEMA that in order to have the map corrected, someone would have to hire a survey.
 
Ronnie Brown met with commissioners to discuss a board position on See-Kan RC&D.  No action.

The Bourbon County Commission met in open session in the Commission Room of the Bourbon County Courthouse with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.
 
Harold Coleman said that he spoke with Karen Paddock about re-opening the south courthouse doors.  She isn’t opposed to it, but Judge Smith needs to be asked, as he is the chief judge of the district.  Judge Ward said he will speak with Judge Smith about it.  Also, if the south door is re-opened, we should open the corrections door too.  No action at this time.
 
Terry Graham made a motion to accept the dedications on a plat map of Westbury Addition.  Harold Coleman seconded the motion and all voted in favor.  Terry Graham signed and Joanne Long attested three copies of the map for the City of Fort Scott.
 
Keith Jeffers spoke with commissioners about emergency management issues and reported on last night’s fire officers meeting.  He also informed commissioners that we received a grant from KDEM in the amount of $9,580.60 for planning, public education and training and exercises.  It’s a 50/50 grant with his salary as our match.
 
Susan Quick met with commissioners for a final report on the most recent delinquent tax sale.  The amount brought in at the sale wasn’t enough to cover the cost of the sale, but it was made up with the interest and penalties gained by those who redeemed their properties prior to the sale.  Mrs. Quick has already set the date for the next tax sale for Wednesday, January 27, 2010.
 
Shane Walker updated commissioners on flood zone maps.  He reported that FEMA has said what we believe to be errors on the most recent Flood Plain map is our problem to fix.
 
Judge Ward and Judge Stephan spoke with commissioners about air conditioning.  It’s been hot this week and it gets really hot on the third floor in the closed off courtroom.  Commissioners will speak with David about when he plans to get the air conditioners ready for the season.  The cooling tower powers most of the units in the courthouse and he doesn’t get it going too early in the year in case there is a late freeze.
 
Commissioners spoke with David Neville about the air conditioner situation.  He said that it’s on the schedule next week to work on the cooling tower to get it ready.  It takes about a day and a half to get cleaned out and primed for the season.  Joanne Long asked if the portable units could work for the courtroom in the meantime.  It wouldn’t work, because they need to be vented out of a window and there are no windows in the small courtroom.  He hopes to have the system up and running next Tuesday or Wednesday.
 
Lee Davis met with commissioners.  The truck he bought didn’t come with a spare tire.  The wheels are 17”.  Commissioners asked him to price one.

The Bourbon County Commission met in open session with Jingles Endicott and Harold Coleman present.  Joanne Long was also present.  Terry Graham arrived at 9:05 am.  Minutes of the previous meeting were read and approved.
 
Bills and payroll for the period were reviewed and approved.

Bill Van Kirk, 6th Judicial District Community Corrections, met with commissioners to present the application for the FY2010 Department of Corrections budget.  Harold Coleman made a motion to sign the budget request.  Jingles Endicott seconded the motion and all voted in favor.  Mr. Van Kirk said that his department is facing budget cuts.
 
George Erny spoke with commissioners about pot holes on 125th Street.  He also spoke with commissioners about a neighbor with a pool and no gate around it.  He thinks that’s unsafe.
 
Terri Johnson spoke with commissioners about one of the properties the County is purchasing for a bridge project.  It’s in a trust, not just a name.  The check and deed were written only in the name and need to be corrected.  Unfortunately, the check was cashed so we’ll need to get that money back before we can re-issue in the name of the trust.
 
Terri Johnson also agreed to accompany Jingles Endicott tomorrow to a meeting regarding the sale of the golf course.

Jingles Endicott made a motion to purchase the supplies from Fort Scott Lumber.  Terry Graham seconded the motion and all voted in favor.
 
Mrs. Yakel also spoke with commissioners about the mowing tractor at the Lake and asked if the lake would be getting the old weed truck.  No action.
 
Jimmy Nichols asked commissioners for permission to book a motel in Oklahoma City for a conference in which Jimmy and Brad will attend.  The conference was recommended by the gentleman who assessed the jail last year and will be held the first week in June.  The conference is free except for the motel.  Commissioners approved the request.    
 
Keith Jeffers gave commissioners information on Swine Flu.  There are two confirmed cases in Kansas at this point.  They are both in Dickinson County.  He said the main thing is to keep your hands clean by washing them frequently.
 
Jesse Beerbower asked commissioners if he can go back to charging at the landfill.  He has been paying weekly but would like to get back to charging and paying his bill once a month.  The commissioners will have to speak with Lois Coyan to see what she recommends.
 
David Goodbody spoke with commissioners about the speed limit on Maple Road.  He thinks the limit should increase west of 190th Street, once you’re out of the residential area.  At this time, it is 45 MPH only.  Even gravel roads are 55 MPH if not posted lower.  The commissioners will look into it.
