The Bourbon County Commission met in open session with Terry Graham and Gary Houston present.  Shirley Goltra was also present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.  He also presented quotes for 14 gauge culvert pipe and dimple bands.  Three were received.  They were:

Terry Graham made a motion to accept the quote from Judy’s Iron & Metal for $8,063.17, as it is local and is less than 10% higher than the lowest quote.  Gary Houston seconded the motion and both voted in favor.
 
Donna Matkin-Smith met with commissioners to request a street light at the intersection of 125th Street and Lucky Road near Redfield.  Terry Graham said he would view the area himself because it is very expensive to put lights up.
 
Ann Ludlum presented the monthly progress reports for the Extension Office.
 
Dave Ashcraft spoke with commissioners about treating termite infestation in the basement.  The commissioners will need to ask for quotes through the custodian.
 
Bob Medina, KDHE, met with commissioners to discuss tire elimination through the Orphan Waste Tire Clean-Up Program which will buy tires from us once a month to get rid of our old tires.  There are forms to fill out monthly for the pick up and then they pay us for them.
 
He also discussed illegal dumping and clean-up programs.  Tom McNeil was present for this discussion as he has viewed some of the illegal dump sites as well.  Mr. Medina showed commissioners a sample brochure which can be changed to fit the specifics of Bourbon County to give to citizens for information on how to reduce illegal dumping.
 
Terry Graham reported on the results of a traffic count requested for the following areas:
308 cars in 2 days at 145th & Hackberry and
166 cars in 2 days at 130th & Fern Road
 
Terri Johnson asked commissioners for permission to advertise for a position in her office which will be open soon.  She would like the new person to be able to train under the person they will be replacing.  Commissioners approved the request.
 
Mrs. Johnson also spoke with commissioners about the need for a termite contract.  She indicated that the last contract we have was not signed by anyone from Bourbon County.
 
Mrs. Johnson also asked for an executive session.  Terry Graham made a motion to go into executive session, for a period of 5 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act.  Gary Houston seconded the motion and both voted in favor.  Those present for the session were Terry Graham, Gary Houston, Shirley Goltra and Terri Johnson.  The session began at 10:35 am and ended at 10:40 am with no action.
 
Susan Quick spoke with commissioners about bills for the tax sale.  She asked for approval to pay the attorney, now that all the deeds have been completed.  Commissioners approved payment.  She also indicated there would be a separate bill to Gil Gregory for some assistance with the sale as well.  She indicated that the Tribune and abstracting bills have already been paid.
 
Mrs. Quick also asked commissioners about the next tax sale.  Commissioners would like it to be held in the fall.  They asked her to advertise for sealed bids for abstracting for the next sale.
 
David Neville spoke with commissioners about the termite issue.  Commissioners advised him to get prices and explanations of how the proposed companies would treat the problem.
 
Hubert Stewart met with commissioners to request rock on a section of his road west of Hwy 3 and that a culvert be cleaned out.
 
Keith Jeffers met with commissioners to discuss emergency preparedness topics.  He spoke about emergency shelters and indicated he is researching for more locations for the public to go in case of severe storms.  He also said that he and Shane Walker toured the western part of Bourbon County to check for damage from last night’s round of storms but didn’t find anything to report.
 
Mr. Jeffers also said he would try to get a standard siren procedure set in place so the public will know what to expect when severe weather threatens.
 
Mr. Jeffers asked commissioners about allowing the members of the LEPC to have key cards to the courthouse.  In the event the EOC is activated, those personnel may need access to the courthouse and currently wouldn’t be able to gain entrance outside of regular business hours.  He is also in the process of getting ID badges for the LEPC members.
 
Other topics Mr. Jeffers discussed were water rescue training, recruitment of rural firefighters, safety checks on fire equipment and helping make the public aware when severe weather threatens the area.
 
Tom McNeil spoke with commissioners about broaching the City for assistance with tire clean-up in areas the city owns.
 
Doylene Kennedy asked permission to write a grant for LEPP.  Commissioners approved the request.

The Bourbon County Commission met in open session with Terry Graham and Gary Houston present.  Joanne Long was also present.
 
Clyde Killion gave a road report.
 
Chuck Delp and Jim Triplett, SEK Recycling, met with commissioners to discuss a possible regional recycling program.  They explained that none of the counties in Southeast Kansas really has the population to have a sole operation, but if we were to join together, it would be more feasible.  The commissioners indicated they were interested, but would need the county attorney to look over the paperwork first.  Terry Graham asked that they not go forward without hearing from us.
 
Keith Jeffers informed commissioners of the possibility of severe weather on Tuesday and Wednesday this week.  He also showed the commissioners a supply of cellular antennae he purchased which he says will work well for cellular and cordless phones as well as response radios.  He wants to purchase a large quantity to give to all the responders to increase their coverage in areas where the signal is weak.  The commissioners approved the request.
 
Delwin Mumbower spoke with commissioners about Fire District 3.
 
 Brian Wade spoke with commissioners about the cellar in Hammond.  The County agreed to help tear it out and all he has to do is coordinate with Clyde.
 
The commissioners left the meeting at 10:10 am to conduct a fence viewing.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meetings were read and approved.
 
Jimmy Nichols and John Stokes, representing the City of Bronson, met with the commissioners to request road work coming into Bronson.  The commissioners explained that the wet weather has been hampering our progress but that we would put them on the list.
 
Bills and payroll for the period were reviewed and approved for payment.
 
Bill Van Kirk, 6th Judicial District Community Services, met with commissioners to review programs and to ask us to accept the 2009 Comprehensive Plan.  Bill Brittain made a motion to accept the FY09 KDOC Comprehensive Plan.  Terry Graham seconded the motion and all voted in favor.  Bill Brittain signed the document as Bourbon County’s representative.
 
Delwin Mumbower spoke with commissioners about Fire District 3.  Hiattville station has indicated that it wants to withdraw from the district.  The commissioners want to speak with the county attorney about the situation.  Mr. Mumbower indicated he would be available for discussion as well.
 
Clyde Killion gave a report on trees down from the storms this weekend, including a large tree here at the courthouse.
 
Harold Coleman informed commissioners of his intent to use a part-time deputy more often.
 
Terri Johnson met with commissioners.  Terry Graham made a motion to go into executive session, for a period of 10 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act.  Bill Brittain seconded the motion and all voted in favor.  Those present for the session were the commissioners, Delwin Mumbower, Keith Jeffers, Joanne Long and Terri Johnson.  The session began at 9:53 am and ended at 10:03 am with no action.
 
Gary Houston then made a motion to return to executive session for an additional 10 minutes to continue the discussion from before on non-elected personnel.  Bill Brittain seconded the motion and all voted in favor.  Those present for this session were the commissioners, Delwin Mumbower, Keith Jeffers, Joanne Long and Terri Johnson.  The session began at 10:04 am and ended at 10:14 am with no action.
 
Delwin Mumbower informed commissioners that the Fire District 3 meeting is tonight in Devon at 7:00 pm.
 
David Neville spoke with commissioners about termites.  He received two quotes for addressing the problem.  One, from David Ashcraft, was less, as it was for spraying the length of the courthouse on the east only, for $850.  Presto-X suggested spraying and using bait traps and re-spraying in a few years at approximately $2,500.  Commissioners agreed to go with Ashcraft.
 
Keith Jeffers informed commissioners of the storm forecast for Tuesday.  He also spoke with the commissioners about getting satellite weather radio.  He will look into that.  He has also released a storm siren policy news release and discussed storm shelters.
 
Arnold Schofield met with commissioners to get their approval to begin the process of getting monuments for the courthouse representing the Bourbon County Korean and Vietnam veterans.  The commissioners approved the request and thanked Mr. Schofield in advance.
 
Rhonda Fernandez met with commissioners to review the 1st quarter 2008 health insurance report.
 
Joanne Long informed commissioners that the Secretary of State’s Office notified her that they will fund 95% of the programming software that she ordered to help reduce costs on ballot programming.  That means that Bourbon County will only be responsible for 5%, approximately $1,675.
 
Terri Johnson returned to the commissioners meeting to inform them that Ronnie Brown, the chief of the Hiattville fire station, is interested in mediation.
 
Terry Graham informed commissioners that he would not be here on June 6th.
 
Joanne Long asked commissioners about the fence viewing from May 5th.  Gary Houston made the following motion:
 
The west portion of the fence, beginning at the NW corner of the E ½ of the SW ¼ of Section 1, Township 25, Range 24, traveling East approximately 673 feet, shall be the responsibility of Mack F. & Pansy P. Comstock, Trustees of Trust, Dated 9/18/92.  The east portion of the fence, beginning at the NE corner of the E ½ of the SW ¼ of Section 1, Township 25, Range 24, traveling West approximately 612 feet, shall be the responsibility of Mark R. & Jamie J. Pollmeier.  Each individual shall be responsible for all costs incurred for construction and repair to their portion of fence.
 
Terry Graham seconded the motion and all voted in favor.  As provided by law, the viewing was signed by the commissioners and filed with the Register of Deeds.
 
Ed Pitts asked commissioners about a moving permit.  Joanne Long indicated her office sells those.
 
Robert Query stopped in and asked that the parking spaces along National Avenue be made to be 15 minute parking, now that all entry comes through the front door.
 
Bill Brittain left the meeting at 12:15 pm.

The Bourbon County Commissioners met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.
 
Joanne Long informed commissioners of a meeting with the entities in the Neighborhood Revitalization plan to be held next Friday at 9:00 am at the USD 234 Board Office.  Dale Bunn called to invite one or all of the commissioners to the meeting.  There are requests from those in the program to go back on prior years for rebates and the entities will need to decide if that will be permissible.  Bill Brittain will attend the meeting for the County.
 
David Neville met with commissioners to talk about a replacement lawn tractor.  He wants it with the power booster bagging system and would prefer a steering wheel instead of lever drive and therefore only has estimates from out-of-county businesses.  The commissioners asked him to get prices from local vendors R&R Equipment and Fort Scott Truck & Tractor, who would have a comparable machine for horsepower and cut, even if they only have the lever system and report back.
 
Lynn Smith spoke with commissioners about the County’s internet.  We currently use DSL, but with the imaging of deeds and maps and the web services we offer, it’s all getting bottlenecked.  She proposed an upgrade to a bonded T-line.  It would be significantly higher, but the user fees would help pay for it through the end of this year and she could budget the internet expenses from the Computer Fund starting next year.  The cost would go from approximately $1,500/yr to $18,000/yr.  The commissioners asked Lynn and Shane Walker to investigate other options and to see if it would benefit to do a joint effort with the City of Fort Scott
 
Joanne Long reported that the Kansas Legislature did not reinstate the LAVTR and City/County Revenue Sharing demand transfers to Counties for 2009.
 
Commissioners left the meeting at 10:00 am to prepare the Employee Appreciation Luncheon at the 4-H building.

Several employees expressed their thanks to the commissioners for the Employee Appreciation Lunch last Friday.
 
Clyde Killion gave a road report.  Commissioners discussed the scheduled use of mowers this summer and the cost of fuel.

Shane Walker discussed the internet again.  He said spoke further with Barry from RTS Microsystems about it also.  Funding assistance would be from the Register of Deeds Technology Fund and from the User Fees paid by those who access the information.  However, since the booking system, GIS maps, deeds management and video court systems are all on our system, it needs an upgrade.   Commissioners approved the upgrade but asked Mr. Walker to see where he can save money on it.  There was also discussion of increasing the user fees, which have not been increased since they were established. 
 
Tom McNeil spoke with commissioners about a follow-up meeting with KDHE this week over illegal dumping.  He also discussed a problem he is having with a prescription.

Commissioners approved the purchase of the John Deere from Deems Equipment in Nevada for $4,550, as the salesman is from Bourbon County. 
 
Paul Morris spoke with commissioners about recovering metal for salvage at our landfill.  No action.
 
Don Stewart met with commissioners to have them approve an extension of a closing date for property we are selling.  Commissioners signed the paperwork to extend the closing to June 2nd.
 
Commissioners discussed the 5-year bridge plan.
 
Gary Houston left the meeting at 10:00 am with Clyde Killion to view a road.
 
Terry Graham asked that a clarification be made on the Fire District 3/Hiattville situation that only some members of the Hiattville Department have expressed an interest in leaving Fire District 3.
 
Keith Jeffers met with commissioners to discuss emergency preparedness issues.  Commissioners approved the purchase of a basic subscription to a Foundation Directory of $195 which will help with researching various grant opportunities for the county.  Mr. Jeffers will review and help to prepare an updated storm spotter policy, in light of the recent death of a storm spotter after the May 10, 2008, deadly tornado that destroyed parts of southwest Missouri and northeast Oklahoma.  The commissioners approved a request by the sheriff to use the Emergency Preparedness vehicle 2-3 nights per week for a part-time deputy.  The sheriff’s department will help maintain the vehicle expenses.  Mr. Jeffers is reviewing programs like Reverse 911 to help notify groups of residents in case of an emergency in their area.  Mr. Jeffers is also reviewing the equipment on emergency vehicles to ensure that necessary items are on board.  He’s continuing to work on the lease for the Heartland Tower, researching radar/internet programs for helping with storm spotting and will be attending IS-300 training in Girard next week.
 
Gary Houston returned to the meeting at 10:53 am.
 
Sheriff Coleman informed commissioners that he and four other counties in the area--Allen, Crawford, Cherokee and Labette, have decided to form a regional law enforcement competition to aid in training that the departments require, as well as a possible fundraiser to help adopt families at Christmas.  This year is the first year and Bourbon County will be hosting the event.  There will be several track and field events involved.
 
The Sheriff also informed commissioners that he purchased a new refrigerator for the jail out of the commissary account.
 
Doylene Kennedy informed commissioners that the screen machine is in.  Commissioners purchased the equipment earlier this year. 
 
Bill Brittain left the meeting at 11:15 am to attend a US 69 Hwy Corridor Study meeting at city hall.

The Bourbon County Commission met in open session with Terry Graham and Gary Houston present.  Shirley Goltra was also present.  Bill Brittain was at a Neighborhood Revitalization meeting at the USD 234 Board Office until 10:15 am.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road update.
 
Sheriff Coleman informed commissioners that we need some iron/metal grates on the north end of the correctional center to block possible contraband from entering there.  The commissioners and the sheriff agreed it would be a job for the public works crew.  Commissioners approved the request.  Marty said that there were some guys downstairs working already and advised the sheriff to go talk to them and tell them what he needs.
 
Jim Harris, Berry Tractor, met with commissioners to discuss financing for the screen machine.  The commissioners are also looking into rates at local financial institutions.
 
The commissioners and Mr. Harris also discussed putting a program together for replacing motor graders.  No action.
 
Jeff Judy contacted the county clerk’s office about the caretakers moving the fish feeders at Elm Creek Lake.  Mr. Judy is in a wheelchair and can’t get to the middle of the lake.  Don George will be out in a few days to move them where they need to be.
 
Keith Jeffers met with commissioners to discuss Emergency Preparedness.  He asked for approval to purchase the “My Own Radar” program on a trial basis.  The program will give us access to live radar images, rather than delayed ones.  This will assist us during severe weather.  The total cost is $255.00 for one year.  This will give the EOC, Rural Fire District 3 and the Fort Scott Public Safety Building access to these live images.  Commissioners approved the request. 
 
Mr. Jeffers also updated commissioners on the Net-EOP progress.  He anticipates that all Emergency Support Functions will be complete by the end of June.
 
He also said that Wal-Mart will have Emergency Preparedness booths each Saturday in June.  The schedule for people in the booth is:

Terri Johnson asked commissioners for permission to replace a computer in her office.  Commissioners approved the request.
 
The commissioners received a request from Mill Creek Watershed District #98 for a permit for the following:
 
Intermittent closing of Overbrook Road from a point beginning 250 feet west of the intersection of Overbrook Road with 205th Road, west to a point 1000 feet west of said intersection.  Said closing will be caused by temporary inundation of the road by flood waters retained by the approved Mill Creek Watershed #98 flood water detention dam Site I-4.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Payroll and accounts payable for the period were reviewed and approved.
 
Christine Booth met with commissioners to discuss situations in the jail and her son, who is an inmate awaiting trial.  She said that the inmates are destroying a camera in the visiting room, telephones are non-working, the visiting room is sometimes used for a holding cell, which means that people can’t visit inmates at times.  She also mentioned unsanitary smells.  As for her son, she said that he has been in the jail for over three years and he is being unfairly and illegally held in administrative segregation.  The commissioners said they would have to speak with the sheriff about her accusations and that the sheriff doesn’t determine how long a person is in jail, but the court systems do.
 
Bob Shufflebotham, Phoenix Mining Company, spoke with commissioners about mining in the southeast portion of Bourbon County.  He said that one of the cross roads to Deer Road was very boggy with mud due to heavy rains and that they needed to use a different intersection to cross until the road hardens.
 
Marty Pearson gave a road report.  He also informed commissioners of a problem he is having with a worker’s compensation claim.  Commissioners advised him to speak with the Insurance Commissioner, as the claim is on a company we no longer use.
 
Greg Couch, David Murphy and Greg Reynolds, Producer’s Grain Company, met with commissioners to discuss the possibility of the County using their biodegradable dust control product.  It is a bi-product of soybeans.  The commissioners are interested in seeing it on a test area.  They advised Mr. Couch to speak with Clyde Killion on Monday.
 
Thomas Dick spoke with commissioners about volunteering for the emergency preparedness department.  Commissioners advised him to speak with Keith Jeffers. 
 
Charlie Blevins stopped in to speak with commissioners but decided to come back Monday when Clyde Killion will be here.
 
Dennis Lisack, JayHawk Energy (formerly Galaxy Energy), met with commissioners.  There are some gas lines in Bourbon County currently.  He wants to know if he can make an arrangement with the commissioners for future lines on a more flexible plan of getting the legal descriptions to us after the fact.  The commissioners aren’t comfortable with that plan.  They want to know where the lines will be and what roadways would be affected, as they don’t want any digging under our paved roads.
 
Phillip Pavey asked commissioners if they plan to chip and seal his father’s road this year.  The commissioners said it is on the schedule.
 
Dennis Brown met with commissioners to discuss crack sealing of County roads.  He said he’s done a lot of work in Cherokee County.  Bill Brittain would like to take him out to look at portions of Jayhawk Road (Catt School Road).

Commissioners agreed to finance through UMB at 3.65% interest.  Joanne Long will notify the financial institutions of the decision.
 
Bill Brittain left the meeting at 10:55 am with Mr. Brown to view Jayhawk Road.
 
Doylene Kennedy asked commissioners for an executive session to discuss non-elected personnel.  Terry Graham made a motion to go into executive session, for a period of five minutes, under the non-elected personnel exception to the Kansas Open Meetings Act.  Gary Houston seconded the motion and both voted in favor.  Those present for the session were Terry Graham, Gary Houston, Doylene Kennedy and Joanne Long.  The session began at 11:08 am and ended at 11:13 am with no action.
 
Bill Brittain returned to the meeting at 11:35 am.
 
Bill Keith spoke with commissioners about height restrictions at the landfill.  He’s been researching options for us.  Commissioners encouraged him to continue.
 
Marty Pearson returned to the meeting to discuss a dock at Elm Creek Lake.  He said the walkway and dock are broken away from each other.  He thinks they can be fixed with steel rods.  The commissioners advised him to fix it or to rope it off if it can’t be fixed right away.  He also said that a load of gravel is needed at the lake.
 
Jason Yakel has also indicated he would like to purchase a used finishing mower for $300.  It needs a little work.  The commissioners asked Marty to look at the mower first to see if it’s a good deal.
 
Tom McNeil updated commissioners of a situation concerning a private property which may be in violation of septic tank regulations.  He’s working with Sheriff Coleman to try to resolve the matter, but he wants the commissioners to be aware of it.
 
Bill Brittain said that Mr. Brown will be sending a quote for the crack sealing on Jayhawk Road.  Mr. Brittain would also like to see the treatment on Horton to Indian Road if possible.
 
After routine business, the meeting adjourned at 12:10 pm.
