March 3, 2008     Monday      9:10 am
 
The Bourbon County Commission met in open session with Bill Brittain and Gary Houston present.  Joanne Long was also present.  Terry Graham arrived at 11:00 am.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.
 
Dustin Moreland and Jim Harris presented new screen plant quotes.  A quote was also received in the mail from Kirby Smith.  They were:
 
Kirby Smith Machinery, Inc.: 3- 24 x 60 Portable Stacking Conveyors @ $35,977 for a total price of $107,931.  No screen plant included.
Van Keppel Company:  $243,941 total for a PTSC 3612D Screen package.
Berry Tractor & Equipment:  $99,000 for the screen plant delivered and set up and $119,700 for 3- 24 x 60 Electric Portable Radial Stackers, for a total price of $218,700.
 
The commissioners will have Clyde review the quotes to see that they are what we asked for.  They also said that the delivery date on any purchased equipment would be a key factor in our decision.  They hope to have an answer by Friday.
 
Ann Ludlum presented the monthly progress reports for the Extension Office.  She also asked the commissioners to pick a name of the Walk Kansas teams as Commissioners’ Choice.  After reviewing the 48 team names, they picked “Scrambled Legs and Achin’” as the commissioners’ pick. 
 
Mark Wade spoke with commissioners about KDOT cracking down on truck weight limits.  He wanted to let our road crews know about it. 
 
Jim Miesner asked the commissioners about the Emergency Preparedness position.  He asked about a job description and wage for the position.  Commissioners said that will depend on the applicant chosen. 
 
Terry Graham arrived at 11:00 am.
 
Harold Coleman met with commissioners.  They spoke with him about the presence of Kansas Highway Patrol troopers on Jayhawk Road, Maple Road and 215th Street. 
 
Clyde returned to the meeting after comparing the screen quotes.  After discussion, Gary Houston made a motion to purchase the screening plant and conveyors from Berry Tractor for a total cost of $218,700, provided the payments can be put out as they promised.  Terry Graham seconded the motion and all voted in favor.
 
After routine business, the meeting adjourned at noon.

March 7, 2008     Friday        9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Hal Bradley, a Linn County resident and commission candidate, sat in for part of the meeting to observe.
 
Clyde Killion gave a road report.  He spoke with commissioners about meeting with the micro-surfacing representative this week.  It costs about $21,500 per mile for the treatment.  The commissioners are interested but need to look at the budget to see what we can afford.
 
Joanne Long presented commissioners with revised jail figures, calculated at $55/per day for out-of-county prisoners.  However, we’re not sure if any counties will pay a higher amount.  Jimmy Nichols is researching federal prison contracts.
 
Commissioners discussed possible community service projects for the county.  Clyde Killion said we could always use someone to pick up litter at the landfill.
 
The County received a Certificate of Honor from the Joseph A. Holmes Safety Association for working 50872 hours without incurring a lost workday injury at the quarry.
 
Jack Black asked commissioners if they had an opportunity to watch the DVD he left them.  They had not.  He also spoke with commissioners about a website he’d like them to visit and about alternative fuels.
 
Jimmy Nichols met with commissioners to discuss housing inmates.  He said we’ve had our female prisoners in Cherokee County for some time, but we’re running into problems with the court system about it.  They retrieve the upcoming docket to know who they’ll need when, but it’s being changed and the court wants certain prisoners with no notice.  They have to make several runs to pick up and deliver them and it’s wearing out the staff as well as the transport vehicles.  He asked the commissioners to speak with the judges to try to work something out.  Commissioners asked Mr. Nichols to write up his concerns so the commissioners can speak with the judges. 
 
As for housing federal prisoners, the marshal he spoke with won’t enter into any agreements unless/until there’s a jail to put them in, but he said they generally lease a block of beds for up to three years at a time.  The rate they would pay would be based on the per diem costs of the facility. 
 
Joanne Long informed commissioners of the availability to purchase additional uninsured/underinsured motorist coverage through KCAMP.  Also, KCAMP can now do historical replacement policies for historical buildings.  The building would need to be independently appraised.  After discussion, Terry Graham made a motion to reject the higher uninsured/underinsured insurance.  Bill Brittain seconded the motion and all voted in favor.  No action on the historical insurance.
 
Joanne Long said we only received one bid for the drug and alcohol screening.  Bill Brittain asked if we should re-bid.  Joanne Long said this was the second bid.  No action at this time.
 
Harold Coleman asked commissioners for the county’s assistance with removal on an old storm shelter at Hammond Community Building.  As it is for the community building, commissioners agreed. 
 
Kenneth Karleskint asked commissioners for help filling a pothole on the road around Lake Fort Scott.  Commissioners know of the hole and said it’s on the list for filling.
 
Bill Brittain issued the following statement about the Jayhawk Road situation:  “As agriculture is the backbone of this County and this country, I do not believe local government should interfere with any agriculture operation from entering or traveling on any of the roads.  However, concerning the complaints we have had on Jayhawk Road, I believe Bourbon County has a responsibility for public safety, but I also believe each citizen has the responsibility to strive to be a good neighbor.  The owners of the operation on Jayhawk Road have assured me that they want and intend on being good neighbors and are taking steps to do so.”
 
David Neville met with commissioners.  He said that Soutwestern Bell will be here Monday to finish moving the line to the health office.  After that is done, the sewer screen can be installed.
 
Doylene Kennedy presented commissioners with several items.  He gave Terry Graham the sales tax figures he asked for concerning the micro-surfacing, she had Bill Brittain sign the monthly sales tax report for the landfill, and she gave Gary Houston paperwork on a bridge project.

Bill Brittain made a motion to accept the quote from UAP, for a total of $12,956.35.  Terry Graham seconded the motion and all voted in favor.
 
Commissioners received a mailed request for dust control on an area on 155th St.  This is an annual request.  Commissioners will forward it on to the Public Works department.
 
Gary Houston phoned the attorney’s office to ask Terri Johnson to draw up an agreement for core drillings for his bridge project.

March 10, 2008   Monday     9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.  He said he called Koch and Beachner for prices on micro-surfacing to compare what we’ve already gotten.
 
Terry Graham received a phone call from Mike Hueston, mayor of Mapleton who informed them that Mapleton got its grant for road improvements.  The County will do the work and Mapleton will either supply the materials or pay us for them, through their grant funds.
 
Terry Graham also reminded the other commissioners that the County needs to work on roads in Uniontown this year.  They’ve asked for several years.  Much of the meeting was spent discussing the cost of oil and fuel and what that will calculate per mile to the cost of asphalting roads.
 
Harold Coleman informed commissioners that he will be sending out a crew of prisoner workers to clean up the fairgrounds from the rodeo this weekend.
 
Part of the morning was spent discussing the jail.
 
Gary Houston left the meeting at 11:45 am.

March 14, 2008        Friday  9:00 am
 
The Bourbon County Commission met in open session with Bill Brittain and Terry Graham present.  Joanne Long was also present.  Gary Houston arrived at 9:30 am.  Minutes of the previous meeting were read and approved.
 
Bills and payroll for the period were reviewed and approved.
 
Clyde Killion gave a road report.
 
Jack Black asked commissioners if they watched the DVD he left them.  They had not.
 
The commissioners signed a letter to Fort Scott Lake residents regarding funding opportunities for the proposed sewer district.
 
David Neville asked commissioners when they would like to close down to one entrance.  After discussion, commissioners settled on Monday, March 31st.  They asked David and the Clerk to notify the public with a press release and signs on the doors to give everyone a head start in advance of the change.
 
Mr. Neville informed commissioners that Marberry will be ready next week to get to work on the sewer work in the west parking lot.
 
Terry Graham left the meeting at 10:20 am with Clyde Killion to view a problem with a portion of Maple Road that was brought to our attention in a letter from the post office.  Mr. Graham returned to the meeting at 10:35 am.
 
Terri Johnson showed Gary Houston a draft of a letter he requested.  Mr. Houston asked for a few changes.  Mrs. Johnson will make the changes and have Mr. Houston sign it in her office later today.
 
Mrs. Johnson also asked commissioners about going to one entrance.  She wanted to be sure that she could still access the courthouse at night and on the weekend when she needs to work.  Commissioners assured her that she would be able to enter from the east door with a key. 
 
Joanne Long informed commissioners that Terri Johnson reviewed the drug & alcohol proposal from TMHC Services and approves of it.  She just cautions that whatever contract we have has the cash basis clause in it.  Since they work with many counties, it’s not likely to be a problem.
 
Ms. Long also spoke with commissioners about purchasing software from ES&S to program election equipment at the county level.  Other states have seen significant increases in programming costs at the end of their contract cycle.  Kansas will likely see those same increases at the end of its contract in 2011.  Based on actual 2006 and 2007 figures and projected 2008-2011 programming costs, Bourbon County would save money if we purchased the software and did some or all of our own programming.  The state is currently offering assistance in purchasing the required software.  Commissioners approved the proposed purchase at a projected savings of $6,300 through 2011.
 
Bill Brittain discussed attending the open house welcoming the new executive director at the Fort Scott Area Chamber of Commerce.  There was discussion of joining the Chamber.  No action at this time.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Marty Pearson gave a road report.
 
Charles Griffin, part-time correctional officer, met with commissioners to ask that an early check be cut.  He didn’t get a check on Friday because his time was not reported to be paid.  Commissioners approved the issuance of the check.
 
Commissioners reviewed the applications submitted by the deadline for emergency preparedness director.  Commissioners asked the clerk to set up interviews, beginning Friday, for the following:  Ralph “Allen” Schellack, Jr., Kevin Wagner, Keith Jeffers, Bart Yoder and Eric Shoemaker.
 
Bill Prichard introduced himself to commissioners.  He is the new bailiff and he starts today.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Bill Brittain made a motion to go into executive session, for a period of 15 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act, to conduct an interview for Emergency Preparedness Director.  Terry Graham seconded the motion and all voted in favor.  Those present for the session were the commissioners, Ralph “Allen” Schellack, Jr. and Joanne Long.  The session began at 9:01 am and ended at 9:16 am with no action.
 
Joanne Long asked which department should pay for the remodel of the sheriff’s department and the carpet for the correctional center.  Commissioners said that since the remodel was done because of the new security measures of going to one entrance, the courthouse general fund should pay for them.
 
Joanne Long also spoke with commissioners about the Red Cross being denied access to the FEMA water we have.  Mr. Brittain said he has left messages with both Laura Hyer and the owner of the building where the water is stored but neither has called back.  Ms. Long said that even though the Red Cross can get more water donated to them, they shouldn’t have to use that resource when we have all this water that needs to be used up.  After discussion, commissioners authorized Red Cross to get some FEMA water if they still need it.  The commissioners said to call the owner before we go to notify him of our impending entry.
 
Clyde Killion asked about hiring the mower men we had last summer.  Commissioners agreed to ask them if they are interested in returning.
 
Bill Brittain made a motion to go into executive session, for a period of 15 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act, to conduct an interview.  Gary Houston seconded the motion and all voted in favor.  Those present for the session were the commissioners, Eric Shoemaker and Joanne Long.  The session began at 9:30 am and ended at 9:45 am with no action. 
  
Members of the Youth Activities Team (YAT) met with commissioners to discuss their plans for Ellis Park.  Those present were:  Clayton Tatro, Larry Fink, Linda Stone, Paul Martin, Amanda Johnson, Tom Robertson and Eric Bailey.  In the effort to improve the park, they have several projects.  They started “Pennies for the Park” in an effort to raise funds.  They hope to set two world records in the process:  longest coin chain and laying the fastest mile of pennies.  There are accounts set up for it in banks all through the county. 
 
Jack Black read an article from the Kansas City Star about NAFTA and the proposed super-highway from Mexico to Canada.  He urged commissioners to condemn the idea as it will be a huge problem for our nation’s security.   
 
Bill Brittain made a motion to go into executive session, for a period of 15 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act, to conduct an interview.  Gary Houston seconded the motion and all voted in favor.  Those present for the session were the commissioners, Joanne Long and Keith Jeffers.  The session began at 10:26 am and ended at 10:41 am with no action.
 
Lee Davis spoke with commissioners about a proposed bill in the Kansas Legislature which would make jimson weed illegal.  SB481 also turns the local Noxious Weed Director an investigator for it.  Mr. Davis doesn’t like the bill because it is a native grass that probably every farmer has on his property.  He thinks it could be very bad for farmers if it passes.
 
Rayma Silvers, reporter with the Fort Scott Tribune, met with commissioners to discuss the Emergency Preparedness position and the Lake Fort Scott sewer project.
 
Glen Sewell phoned to ask if the County has any interest in his building on 8th Street because he has an offer from someone to purchase it.  The commissioners said they are not interested in it.
 
Bill Brittain informed commissioners of a meeting he had this week with Senator Brownback’s office about the US 69 Hwy Corridor Study. 
 
He also said that someone from KDHE will be in contact with Tom McNeil soon about old tires in the county.

March 24, 2008        Monday         9:00 am
 
The Bourbon County Commission met in open session with Bill Brittain and Terry Graham present.  Joanne Long was also present.  Gary Houston arrived at 9:06 am.  Minutes of the previous meeting were read and approved.
 
Earl Brown spoke with commissioners about the emergency preparedness position and about closing an alley in Hiattville. 
 
Joanne Long reminded commissioners that Mercy asked for an answer on the ambulance contract for 2009 and 2010 by June 20, 2008.  Commissioners said we’ll need to get bids out soon.
 
Clyde Killion gave a road report.  He informed commissioners that Ron Chaney is no longer with Phoenix Coal Company.  He also said that Phoenix Coal Company has not re-paid the county for maintaining Deer Road, per our signed agreement, for some time.
 
Jean Younggren, 881 120th Street, met with commissioners to discuss her concerns about a road that is planned to be blacktopped.  She said that it currently doesn’t drain well.  She also has an issue with gravel being pulled from her driveway to the road by the grader operator when he turns around.
 
Jimmy Nichols asked commissioners if they could name their summer softball league team after the Bourbon County Sheriff’s Office.  There is no financial responsibility; they just want to use the name.  Commissioners approved the request.  Also, Jimmy and Brad Rich are going to a power lifting tournament this weekend in Iowa and hope to break the state bench press record.  They’d like to use the name Bourbon County Sheriff’s Department for this as well.  Commissioners approved the request. 
 
Clayton Tatro and Ron Gray met with commissioners to discuss community college security.  We’ve learned from our liability insurance that there are three ways this could be accomplished:  1. FSCC starts its own campus police force; 2. Bourbon County has a full-time deputy assigned to the community college, like an SRO at the high school; or 3. Fort Scott Community College hires an employee to be a campus security guard and that person also works part-time for the County as a deputy, provided the two uniforms are distinctly different.  Mr. Tatro said the college is prepared to fund the position in its entirety.  He said there would be 6-8 weeks in the summer down time where the person could assist the county deputies who want to take vacation time.  Our insurance will cover it with a hold harmless waiver.  Mr. Tatro said this is exactly what he envisioned when he first spoke with us.  The commissioners asked Ron Gray to speak with the county counselor about it.
 
Ron Gray also asked commissioners about raising part-time deputy pay, which is currently only $7.21/hour.  He said the County recently increased the pay for part-time correctional officers and he would like the deputy pay increased as well.  Bill Brittain made a motion to increase the wage of a part-time deputy to $10.36/hr.  Gary Houston seconded the motion and all voted in favor.  Mr. Gray also asked to use part-time help more frequently to cover night shifts.  The commissioners advised him to see whatever their budget and the sheriff will allow. 
 
Dean Bailey spoke with commissioners about some concerns he has at Elm Creek Lake.  He said the low water crossing on the north end has several very deep ruts and needs attention.  He also said that someone has rolled a large boulder in front of a path at one of the shelter house ramps and it is in the way.
 
Terri Johnson and Judge Ward met with commissioners and asked for an executive session to discuss courthouse security.  Bill Brittain made a motion to go into executive session, for a period of 10 minutes, under the security exception to the Kansas Open Meetings Act.  Gary Houston seconded the motion and all voted in favor.  Those present for the session were the commissioners, Judge Mark Ward, Terri Johnson and Joanne Long.  The session began at 11:10 am and ended at 11:20 am with no action.    
 
Commissioners discussed monitoring options for prisoners with Terri Johnson.
 
The balance of the meeting was spent discussing the Emergency Preparedness Director position.  No action at this time.

March 28, 2008        Friday  9:00 am
 
The Board of County Commissioners of Bourbon County, Kansas, met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.  Commissioners relayed the information about Elm Creek Lake needs.  Bill Brittain said he’s been getting complaints about Deer Road again.  This is in response to Phoenix Coal Company not paying for the work on the road for some time and the road conditions are deteriorating until we find out what will happen.  Clyde also said there was an inspection at the quarry this week.  They had to stop production until a windshield was fixed.
 
Judy Orton asked what she can do about the courthouse flowers this year.  She said that she and Harold Coleman had some plans for improvements.  Commissioners again praised the work done last year and told Ms. Orton to use her discretion on the costs.  Harold Coleman was present for part of the discussion and he said that the yard needs to be worked on too because of the excess clover and weeds. 
 
Doylene presented commissioners copies of a bridge report by Schwab-Eaton.
 
Harold Coleman informed commissioners that the prison population has gone down enough that we may be able to bring back the female prisoners next week.
 
Wanda and Phil McGilvra spoke with commissioners about issues in Devon, such as dogs on the loose, speeding and high taxes.  They were told by the sheriff’s department that they don’t have the manpower to sit in Devon looking for speeders.  The commissioners advised them to speak with the Highway Patrol about the speeding issue as that is 7 Hwy and under their jurisdiction. 
 
Joanne Long presented commissioners with the drug and alcohol testing contract for consideration.  Gary Houston made a motion to enter into an agreement with TMHS Services, Inc. for employee drug and alcohol testing.  Terry Graham seconded the motion and all voted in favor.  Bill Brittain signed two copies of the contract.  This will cover random testing of Road & Bridge, security positions and anyone who drives a County vehicle or drives regularly for County business.  It also covers pre-employment, post-accident, reasonable suspicion, return to duty, and/or follow-up testing.
 
Gary Houston made a motion to appoint Joanne Long as the Primary and Doylene Kennedy as the Secondary Contact for the drug testing.  Bill Brittain seconded the motion and all voted in favor.

Joanne Long asked commissioners if she should hold Laura Hyer’s last check until all Bourbon County equipment has been returned.  Those items that are still out are the cellular phone for the office and its accessories, some keys, uniforms, a zip drive for the computer and a DVD hand-held recorder.  After discussion, the commissioners agreed not to hand over the last check until those items are returned.  Bill Brittain will call and notify her about it.
 
Bills and payroll for the period were reviewed and approved.
 
Terry Graham left the meeting at 11:45 am.  The meeting adjourned at 11:50 am.

March 31, 2008        Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.  He said we will have problems with the heavy rains today.  It’s not helping things at the quarry and we’ll have some flooding.
 
Bill Brittain spoke with Bob Hartley of Phoenix Coal Company about paying us for work on Deer Road.  He said that Mr. Hartley will be sending a check to get us up to date.
 
Allen Schellack met with commissioners to ask if they have decided anything about the emergency preparedness job.  Commissioners said they had not at this time.
 
Bids for hay at Elm Creek Lake were opened at 10:00 am.  Three were received.  They were:
 
Robert Query           $825.00
Dwayne Neil            $829.00
Brent Smith             $833.00
 
Gary Houston made a motion to accept the bid from Brent Smith for $833.00.  Bill Brittain second and all voted in favor.  Mr. Smith’s check will be deposited and the others will be returned, as is policy.
 
Mike Castl asked commissioners if they County is hiring.  The commissioners directed him to the Public Works department. 
 
Louella Howard stopped in to the meeting to speak to commissioners about the severe weather we’re having.  She also invited one or all commissioners to attend a fire department meeting.
 
Terry Graham made a motion to go into executive session, for a period of 5 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act to discuss the emergency preparedness position.  Bill Brittain seconded the motion and all voted in favor.  Those present for the session were the commissioners, Harold Coleman and Joanne Long.  The session began at 11:05 am and ended at 11:10 am.
 
Once in open session, Gary Houston made a motion to hire Keith Jeffers as the Emergency Preparedness Coordinator, full-time, at the probationary rate of $889.56/semi-monthly.  Terry Graham seconded the motion and all voted in favor. 
 
Bill Brittain left the meeting at 11:20 am.
 
After routine business, the meeting adjourned at noon.
