August 1, 2008   Friday        9:00 am
 
The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Commissioners spent much of the morning discussing the leaking roof at the Elm Creek caretaker’s house.  It may be due to the hail storms this spring.  Commissioners would like an insurance adjuster to look into it.
 
Terry Sercer finalized the 2009 County budget.  A few more cuts were made before Terry Graham made a motion to publish the proposed budget at 54.057 mills.  Bill Brittain seconded the motion and all voted in favor.
 
Richard Johnson, Martin Tractor, spoke with commissioners about replacing road graders.
 
Lynn Smith spoke with the commissioners about using the parking lot for a rummage sale.  She has learned the Town-wide Garage Sale has been cancelled.  She would like to use the parking lot anyway for a garage sale on October 4th.  The commissioners gave her permission.

August 4, 2008         Monday         9:00 am
 
The Bourbon County Commission met in open session with all commissioners present.  Shirley Goltra was also present.  Minutes of the previous meeting were read and approved.
 
Bill Van Kirk, 6th Judicial District Community Services, met with commissioners for signatures to apply for more grant funds.  Mr. Van Kirk said the program fell short about $19,000.
 
Clyde Killion gave a road report.  He also asked to return the rock crusher workers at the rock quarry back to 5 days a week.  Commissioners approved the request.
 
Harold Coleman spoke with commissioners about the jail.
 
Nina Yakel met with commissioners about the County’s Alcohol and Drug Testing Policy.  She is concerned about the wording as she lives on county property.  Commissioners advised her to take her concerns to Terri Johnson.
 
Commissioners spoke with Lois Coyan about the dump fees for demolition of houses for the City of Fort Scott.
 
Tom McNeil met with commissioners to discuss the number of acres needed for sanitation codes.
 
Charlie Blevins spoke with commissioners about the railroad crossing on Jayhawk Road just east of US 69 Hwy.  He said he busted a tire on them.  The commissioners informed Mr. Blevins that the County has no jurisdiction over railroad crossings and that he would have to speak with the railroad directly.
 
Due to death in the family, Bill Brittain left the meeting at 10:35 am.
 
Mike Hueston stopped in to see if the bridge crew is busy as he needs culverts installed in Mapleton at the new arena.
 
Terry Graham and Gary Houston left the meeting at 11:20 am to check a road in Bronson.

Doylene Kennedy informed commissioners of an upcoming bridge inspection seminar.  Terry Graham will attend.
 
Lee Davis took phone quotes for 100 gallons of generic Round-Up.  They were:

Terry Graham made a motion to purchase from UAP.  Gary Houston seconded the motion and both voted in favor.

Scott Michie, US 69 Hwy corridor study, met with commissioners to discuss the future of US 69 Hwy through Bourbon County.  There was also discussion of access points.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.
 
At 9:30 am, the Board of Canvassers convened to finalize the Primary Election.  Hazel Swarts was present.  Joanne Long and Tony George presented the unofficial reports and the Provisional Ballots for consideration.  Commissioners found 73 of the Provisional Ballots to be valid and their totals were added to the Tuesday night numbers. 
 
Mark Pressly and Curt Shankel met separately with commissioners to discuss the Lake Fort Scott properties.
 
Raymond Taylor spoke with commissioners about 55th St. south of Soldier Rd.
 
After routine business, the meeting adjourned at 11:30 am.

The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Gary Houston arrived at 9:05 am.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.
 
Bills and payroll for the period were reviewed and approved.
 
Joanne Long said she’s gotten an inquiry as to whether we are opening health insurance up for bids this year.  The commissioners will wait to see what the renewal is before making a decision.
 
Harold Coleman requested an employee be allowed access to the Community Pool.  The commissioners asked the clerk to set a meeting for Monday morning for the Executive Board to consider the request.

Bill Brittain made a motion to purchase from UAP.  Terry Graham seconded the motion and all voted in favor.
 
Frank Young, Ag Engineering, met with commissioners to discuss raising the elevation of the landfill.  He also presented a Restrictive Covenant for the property which needs to be put in place limiting future use of the lands used for a landfill.  Terry Graham made a motion to authorize the chairman to sign the Restrictive Covenant.  Gary Houston seconded the motion and all voted in favor.  Joanne Long notarized the document and it will be filed with the Register of Deeds.
 
Jim Ivy from Murphy Tractor presented quotes on road graders.  No action.
 
At 10:00 am, a public hearing was opened for consideration of the 2009 Bourbon County budget.  Those in attendance were the commissioners, Joanne Long and Rayma Silvers of the Fort Scott Tribune.  At 10:10 am, after hearing no objections, Terry Graham made a motion to close the public hearing.  Gary Houston seconded the motion and all voted in favor.  Bill Brittain then made a motion to adopt the County budget as published.  Gary Houston seconded the motion and all voted in favor.
 
Keith Jeffers met with commissioners to discuss Emergency Preparedness.  He has just come from two weeks of training and has learned that the County EOC needs to be able to accommodate 25 persons.  To that end, he is looking for surplus computer and office equipment to staff the EOC. 
 
George Welch spoke with commissioners about his property appraisal.  He feels his house in Bronson is valued too high and wants to avoid meeting with the County Appraiser for an appeal.  The commissioners informed him that he has to have the meeting with the Appraiser first but can move on to the SBTA if he’s not satisfied with those results.
 
David Neville spoke with commissioners about removing a boiler in the basement which is no longer functional.  Commissioners authorized him to start on that and recommended he talk to Jimmy Nichols to see if some inmates can help him.
 
The commissioners discussed the In Demand Network reality show.  They want to shoot at Elm Creek Lake.  The commissioners approved the request but want a copy of their liability insurance.
 
Doylene Kennedy gave commissioners a budget update on Road & Bridge Sales Tax.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
James Miles met with commissioners to ask for a job.  Commissioners directed him to the Public Works office.
 
Bob Hartley and Bob Shufflebotham, Phoenix Mining Company, met with commissioners to discuss closing and permitting 7/10 of mile of Deer Road.  The commissioners want to discuss it with Clyde Killion and Terri Johnson.  No action.
 
Culvert quotes were opened for 50-15” arch tubes 17 x 13 16 ga. 24 ft.  Two quotes were received.  They were:

Terry Graham made a motion to purchase from Judy’s Iron & Plumbing, as it is the local company and is less than 10% higher than the lower quote.  Bill Brittain seconded the motion and all voted in favor.
 
The following were present for a meeting of the Executive Board of the Community Pool: Harold Coleman, Susan Quick, Judy Orton, Joanne Long, Terri Johnson, Terry Graham, Bill Brittain and Gary Houston.  Bill Brittain made a motion to go into executive session, for a period of five minutes, under the non-elected personnel exception to the Kansas Open Meetings Act, with those present listed above.  Terry Graham seconded the motion and all voted in favor.  The session began at 9:21 am and ended at 9:26 am.  After returning to the open session, a vote was taken and a unanimous decision to allow John Taylor access to the Community Pool.
 
Marty Pearson gave a road report in Clyde Killion’s absence.  He got permission from the commissioners to cut a tree at 245th and Yale.
 
Terri Johnson asked to talk to commissioners about the In-Demand agreement for filming a reality television show at Elm Creek Lake.  Bill Brittain made a motion to go into executive session, for a period of five minutes, under the attorney/client privilege exception to the Kansas Open Meetings Act.  Gary Houston seconded the motion and all voted in favor.    Those present for the session were the commissioners, Joanne Long and Terri Johnson.  The session began at 9:32 am and ended at 9:37 am.  Terri Johnson recommended that the commissioners not sign the agreement until the changes are made that she wants and the proof of insurance is provided.
 
David Neville asked to speak with commissioners in executive session.  Bill Brittain made a motion to go into executive session, for a period of ten minutes, under the non-elected personnel exception to the Kansas Open Meetings Act to discuss a payroll issue.  Gary Houston seconded the motion and all voted in favor.  Those present for the session were the commissioners, David Neville and Joanne Long.  The session began at 9:39 am and ended at 9:49 am.  Bill Brittain made a motion to approve the change to payroll for David Neville.  Gary Houston seconded the motion and all voted in favor.
 
Richard Johnson asked if commissioners were ready to act on the road grader offers.  The commissioners indicated they are still waiting to hear from Berry Tractor.
 
Tom McNeil discussed the proposed changes to the floodplain management resolution.
 
Gary Houston indicated he wouldn’t be at the meeting on August 29th and Bill Brittain indicated he wouldn’t be at the meeting on September 8th.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Jim Harris, Berry Tractor, presented prices for road graders.  No action.
 
Terri Johnson discussed the location agreement for the In-Demand program and the drug and alcohol agreement for employees.  After discussion, Terry Graham made a motion to authorize the chairman to sign the revised location agreement.  Bill Brittain seconded the motion and Terry Graham and Bill Brittain voted in favor.  Gary Houston voted against.  Motion carried.
 
Curt Shankel went over a letter/survey he is preparing to send out to owners of undeveloped property at Lake Fort Scott to find out who is willing to have the sewer work done now, rather than pay more at a later date.  He also wants to email the information out to everyone at the lake and put it on the website.
 
Joanne Long presented Resolution 17-08 for consideration.  It is a resolution by reference for the updated flood plain management policies.  Bill Brittain made a motion to adopt resolution 17-08.  Terry Graham seconded the motion and all voted in favor.  Joanne Long will publish the resolution as provided by law.
 
Keith Jeffers discussed emergency preparedness issues.
 
Doylene Kennedy asked commissioners to sign paperwork for federal-aid road construction engineering by consultant.  The commissioners signed 3 copies of the document.
 
Gary Houston left at 11:45 am.

The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Shirley Goltra was also present.  Gary Houston arrived at 9:30 am.  Minutes of the previous meeting were read and corrected.
 
Richard Johnson, Martin Tractor, and Jim Ivy, Murphy Tractor, met separately with commissioners to ask if they have decided anything on the grader quotes they presented earlier in the month.  No action at this time, but commissioners hope to have an answer Friday.
 
Clyde Killion gave a road report.
 
Harold Coleman met with commissioners and asked to speak with them in executive session.  Bill Brittain made a motion to go into executive session, for a period of 10 minutes, under the non-elected personnel exception to the Kansas Open Meeting Act.  Terry Graham seconded the motion and all voted in favor.  Those present for the session were the commissioners, Harold Coleman, Clyde Killion and Shirley Goltra.  The session began at 10:16 am and ended at 10:26 am with no action.

August 29, 2008          Friday        9:00 am
 
The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Joanne Long was also present.  Gary Houston arrived at 9:05 am.  Minutes of the previous meeting were read and approved.
 
Much of the morning was spent in discussion of the road grader lease options.  In the end, the commissioners decided none of the options allows for enough hours.
 
Harold Coleman and Terri Johnson met with commissioners.  They discussed the dumping of the sewer line.  The City will dump it every two weeks but needs the trash to be dry.  According to Emmett Chapman, there was no blockage of the line this time.
 
Jim Ivy, Murphy Tractor, met with commissioners.  The commissioners explained that none of the quotes allotted for enough hours on the equipment.  They want new figures allowing for 1,500 hours/year.  They want to see the new numbers next Friday.
 
Joanne Long reported that the insurance adjuster said that the damage to the roof of the caretaker’s house at Elm Creek Lake was normal wear and tear and is not a claim.  We have a bid for repairs.  No action.
 
Judge Mark Ward and Bill Prichard met with commissioners.  There’s a class they want to send Bill to on courthouse/courtroom security.  District Court will pay half and they would like the commissioners to pay the other half from the General Fund.  The commissioners approved the expense.  It’s a week-long class.  They thanked the commissioners.
 
Bill Brittain told Judge Ward that he is putting together a meeting with all the law enforcement entities for a demonstration on efforts to reduce the jail population.  Judge Ward will be interested to attend.
 
Keith Jeffers informed commissioners that he has been put on alert for Hurricane Gustav and may be deployed to the Gulf Coast next week.  He said the County needs a document on file that says he’s eligible for overtime when deployed so the State and Federal governments can reimburse us.  Commissioners signed the document about overtime when deployed.
 
Mr. Jeffers also updated commissioners on the staffing in the EOC with water and cots.
 
Jimmy Nichols met with commissioners and requested an executive session to discuss a matter concerning non-elected personnel.  Terry Graham made a motion to go into executive session, for a period of 5 minutes, under the non-elected personnel exception to the Kansas Open Meetings Act.  Bill Brittain seconded the motion and all voted in favor.  Those present for the session were the commissioners, Jimmy Nichols and Joanne Long.  The session began at 10:20 am and ended at 10:25 am with no action.
 
Raymond Taylor asked about a culvert.
 
Gary Houston made a motion to appoint Bill Brittain as Bourbon County’s delegate for KWORCC at the annual Kansas Association of Counties conference.  Terry Graham seconded the motion and all voted in favor.  Gary Houston then made a motion to appoint Terry Graham as the alternate delegate for KWORCC.  Bill Brittain seconded the motion and all voted in favor.
 
Joanne Long reminded commissioners that Monday is a holiday.
