The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Gary Houston arrived at 9:15 am.
 
Clyde Killion gave a road report.
 
Terri Johnson spoke with commissioners about AT&T wanting money from us for damaging their lines in our rights-of-way.  She will look further into the legal matter and get back with commissioners on Friday.
 
Judy Orton discussed the 2007 valuations with commissioners.  She said that Ag Land values are down.
 
Vivian Houston said that the northwest corner of Memory Gardens Cemetery has a drainage problem.  Clyde Killion will look into it with her.
 
Susan Quick informed commissioners that we still don’t have a contract with the attorneys for the tax sale.
 
Laura Hyer and Alice Maffett discussed the Pandemic Flu biological annex report and Laura Hyer went over the courthouse bomb threat plan.  Copies of these were left with Terry Graham.
 
Otis Thomas spoke with commissioners about a strip of land between his property and Bob Campbell on Maple Road.  Mr. Thomas thought the County owned the property but there’s nothing on file with the Register of Deeds so the commissioners will have the County Attorney look into it.

The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Gary Houston arrived at 9:08 am.  Joanne Long was also present.  Minutes of the previous meetings were read and approved.
 
Clyde Killion gave a road report and discussed acquiring a bucket truck.  No action.

Gary Houston made a motion to go with Welborn Sales.  Terry Graham seconded the motion and all voted in favor.
 
Harold Coleman met with commissioners.  The commissioners discussed speeding on Locust Road and Maple Road. 
 
Doylene Kennedy presented quarterly sales tax reports for the Chairman to sign.
 
David Neville met with commissioners to discuss the porch restoration bids.  He looked them over and thinks that Rogers and Sons and Double E seem to be offering the same service.  Mid-Continental is offering more which is why it is so much higher.  David feels it needs to be done correctly and it would be money well spent and would protect the integrity of the building.  Perhaps we can’t afford to do the whole job right now, but we need to do something now to prevent any injuries or further damage.  We should have someone write up specs for the job and re-bid.  Bill Brittain will contact Schwab Eaton to see if there is someone qualified to do it.
 
Joanne Long informed commissioners of a new way we are being billed for the Girard Juvenile Detention Center.  There was a meeting last April where it was decided to charge a flat rate to each county, based on the usage over the past 5 years.  This rate began January 1, 2007.  This means we’ll be charged the same whether they are housing one juvenile or ten.  This will double our budget from $25,000 to nearly $50,000 per year in housing costs.

The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.  Commissioners discussed trying to get the legislature to remove the state taxes on fuel for cities and counties.
 
Laura Hyer informed commissioners of the annual grant award for Emergency Preparedness.  It is $4,199.00.  Elbrader’s will give $4,500 on the trade-in for her truck and has one she wants to buy.  She’d like to use this grant to assist in purchasing this truck.  Commissioners informed her that this grant isn’t a budget stretcher because we get it every year.
 
The County Board of Canvassers met at 9:30 am to finalize the April 3, 2007, City/School General Election results.  Joanne Long and Cecelia Kramer presented the unofficial results and 20 provisional ballots for consideration.  In the end, 12 of the 20 provisional ballots were found to be valid and their votes were added to the unofficial totals.  Ms. Long also informed commissioners that Linda Ashcraft, one of the people who had a tie vote for the third spot on the Mapleton City Council bowed out of the contest.  That means that Arlene Shafer wins that spot.  No other outcomes were changed by the addition of these votes.
 
Commissioners left the meeting briefly to look at the truck Laura Hyer wants to purchase.  There was discussion if a truck is needed or whether a small SUV or even car would be acceptable, as they would get better fuel economy.  Ms. Hyer said she needs a truck to be able to haul equipment and 4-wheel drive in case she needs to get to a remote spill location.  Joanne Long advised commissioners that whatever they purchased for her, she needed to stop using it for personal use or it wouldn’t last very long.  Commissioners stated that if she could purchase the truck for $5,000 plus her trade-in, she’s approved to purchase it.
 
Joanne Long informed commissioners that we’re having a problem with people not turning in receipts for credit card purchases.  We’re waiting on receipts from the jail and sheriff’s departments.  Commissioners will talk to Harold about it.
 
Lloyd Olson met with commissioners about his valuation notice.  He doesn’t understand the justification for the large increases.  The commissioners explained that the Appraiser uses state guidelines for valuations.  They said they only have control over the mill levy at budget time.
 
Harold Coleman spoke with commissioners about the correctional center doors.  Commissioners approved the purchase.
 
The commissioners asked Sheriff Coleman to fill in seed on some areas of the courthouse yard in anticipation of more rain this week.  They did say it is looking very good in the parts that took the seed.

The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Joanne Long was also present.  Gary Houston arrived at 9:08 am.
 
Bills and payroll for the period were reviewed and approved.
 
Clyde Killion presented culvert quotes.  Greg Schick was also present for the quotes.  He asked why Welborn Sales didn’t present a quote this time.  Mr. Killion said that he called them but they just didn’t send anything.  Mr. Schick thinks there’s collusion going on between Judy’s Iron & Metal and Welborn Sales and is having the KBI look into it.  He doesn’t think the County is involved.

Terry Graham made a motion to accept the quote from Judy’s Iron & Metal for $6,831.25.  Gary Houston seconded the motion and all voted in favor.
 
Susan Quick reported that she has 75 parcels back from the abstractor for the tax sale.  We also have the contract with Meeks & Klutman.  Bill Brittain made a motion to enter into contract with Meeks & Klutman for the tax sale.  Terry Graham seconded the motion and all voted in favor.  Terry Graham signed the contract as Chairman.  Mrs. Quick showed the commissioners a letter from the abstractor stating how far he searched in the titles.  Commissioners asked Mrs. Quick to check with her association to see if this is the norm, or if it needs to go further back.
 
Clyde Killion gave a road report.  He said Federal Surplus Property has a used tire machine for $950.  Clyde thinks it’s a good buy.  He’s also been looking at bucket trucks.  No action on the bucket truck.  Terry Graham made a motion to purchase the used tire machine from Federal Surplus Property for $950.00.  Gary Houston seconded the motion and all voted in favor.  Clyde wants to build on to the south of the County barn 40’ x 15’ with concrete floor for tire machine to keep it out of the main shop. 
 
Don Stewart met with commissioners to discuss the land we have for sale.  He and the commissioners discussed offering a different section of the land.  Mr. Stewart will draw up new contracts reflecting the change.
 
Mr. Stewart also said he thinks the County needs to study countywide zoning.  He said the 4-lane highway will make us grow and that more industry leads to more population.  He said we need to protect the citizens of the County.  He said that Agricultural-zoned property can still have family farming because Agricultural land is exempt from state zoning statutes.  He said that a common misconception of zoning is that it infringes on individual rights, when actually it protects people from bad situations.  He thinks we should study it and put together a committee or task force, representing all areas of the County for feasibility.  Mr. Stewart will think of some names and commissioners will likewise and meet back next week.
 
Laura Hyer reported that she purchased the truck from Elbrader’s for her trade-in plus $5,000.  She reported on a meeting in Topeka she attended.  She also discussed the request by Linn County for a joint Emergency Management office.  Commissioners authorized her to do an assessment but not to enter into any agreements.
 
Bill Brittain informed Ms. Hyer that the mediator from Wichita, who was recommended by the Kansas Association of Counties, to assist with the dispatch issues can’t help us due to family illness.  He recommended someone from Reno County for us to contact.
 
Susan Quick returned to the meeting.  She spoke with a couple of treasurers and got mixed responses.  Commissioners asked her to speak with Meeks and Klutman.
 
Gene Parker met with commissioners about purchasing bunk beds.  Commissioners already approved this on March 23rd when Jimmy Nichols brought it up.
 
David Neville met with commissioners to ask what’s happening with the courthouse porch.  Bill Brittain called Rick Zingre, a local architect.  We can mail him what we’ve got and he can study them and then get a third party’s opinion.  He can do that for under $1,000.  Commissioners asked Mr. Neville to contact Terry Hughes to see if he can help us.
 
Bill Brittain discussed a meeting with Jim Pickett this week.  They drove around looking at roads and gave recommendations for repairs and maintenance.
 
Commissioners discussed the County’s purchasing policy.  We already sent a letter last year stating any purchases over $500 must have prior commissioner approval.  Bill Brittain said it’s not happening.  Joanne Long said that the commissioners need to make people follow our policies.  That goes for cell phones, county vehicles and purchases.  They are the final say and need to say something or nothing will ever be fixed.
 
Lee Davis met with commissioners to report the aerial application fee for Elm Creek Lake is up .50 per acre to $8.00/acre.

April 16, 2007     Monday      9:00 am
 
The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Joanne Long was also present.  Gary Houston arrived at 9:10 am.  Minutes of the previous meetings were read and approved.
 
Clyde Killion gave a road report.  Commissioners discussed the latest rain and its effect on our roads.
 
Don Stewart presented commissioners the new contracts for the land we’re selling, as per the discussion last Friday.  Bill Brittain made a motion to authorize the Chairman to sign the revised contracts with Stewart Realty.  Gary Houston seconded the motion and all voted in favor.  Terry Graham signed the contracts.
 
Eric Bailey, Director of Public Works for the City of Fort Scott, met with commissioners to discuss Fort Scott’s annual Spring Clean-up in early May.  He is asking that the landfill fees be waived again.  Bill Brittain made a motion to waive all fees except our cost for the City to dump at the landfill for the Spring Clean-up.  Terry Graham seconded the motion and all voted in favor.
 
Clyde Killion also discussed Ecology Day, April 27, 2007.  This is when the Fort Scott High School students go around town picking up trash.  They are once again asking that the County help pick up the bags they collect.  Commissioners approved the request.
 
Bill Brittain mentioned that Richard Nienstedt recommends we use the parking lot behind Nu-Grille and Rusty’s for the recycling trailers.  The commissioners are concerned that the lot in question is very busy with restaurant traffic and wondered about the lot at the west end of Old Fort Blvd., just south of the Westar office.  Mr. Brittain will ask the City Manager about that lot.
 
Joanne Long informed commissioners that there’s a Juvenile Detention Center meeting coming up April 24.  There will be beginning 2008 budget talks at this meeting.  Terry Graham made a motion to appoint Bill Brittain as the Bourbon County representative on the Girard Juvenile Detention Center board and Valorie Leblanc as the alternate.  Gary Houston seconded the motion and all voted in favor.
 
Commissioners watched a demonstration video of the Asphalt Zipper.
 
Terri Johnson met with commissioners.  Regarding a street that was platted but never opened in the County, we must vacate it, according to law.  There was some question as to whether the City has jurisdiction because it is within the 3-mile limit around the City, but the Kansas Association of Counties and League of Kansas Municipalities both agree it is up to the County to vacate it. No action at this time. 
 
Gary Houston made a motion to go into executive session, for a period of seven minutes, under the non-elected personnel exception to the Kansas Open Meetings Act.  Terry Graham seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson and Joanne Long.  The session began at 10:41 am and ended at 10:48 am with no action. 
 
Mrs. Johnson also discussed expanding the County’s random drug and alcohol testing.  KCAMP recommends that we test all who drive County vehicles.  Our handbook also includes all employees of the Correctional Center.  They also believe that testing should be conducted by an independent third party.  Commissioners asked Mrs. Johnson if the insurance company could provide us with a letter in writing to that effect.
 
Susan Quick informed commissioners that she spoke with Justin Meeks.  Mr. Meeks will speak with the abstractor about the letter we received regarding the title searches for the tax sale..
 
Gary Houston left the meeting at 11:15 am for an appointment.

The Bourbon County Commission met in open session with all commissioners present.  Cecelia Kramer was also present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.  He forwarded a request from a bus driver for gravel for a bus parking space on private property.  Commissioners refused the request, because we don’t provide gravel for private land.  Mr. Killion also stated that beginning in May, the recycling trailers will be located in the parking area northeast of the Nu-Grille for the Fort Scott weekends.
 
Judy Orton asked commissioners about flowers for the courthouse lawn.  She is checking with Heidrick’s, Mayco and the Clayton Greenhouse and will have prices for commissioners on Monday.
 
Karen Paddock spoke with commissioners about security.  In light of the recent shooting at Virginia Tech and with our security assessment complete, she said the courthouse needs a security system as soon as possible.  No action at this time.
 
Commissioners discussed the roof at the Elm Creek Lake caretaker’s house.  It is leaking.  As per the contract with Nina Yakel, the roof is the County’s responsibility.  Commissioners will need to have someone look at it.
 
Terry Graham left the meeting at 9:50 am to take his wife to a doctor’s appointment.
 
Sharon Elder spoke with commissioners about the annual support agreement for RVI.  This annual agreement is paid out of the Register of Deeds Technology fund.  Commissioners will discuss it Monday because the chairman has to sign it and Terry is gone for today.
 
Greg Schick met with commissioners to discuss the deadline for a materials quote.  He also asked if the County picks and chooses the best prices for each item or if they do a complete package.  The commissioners indicated that they consider the quote as a package deal.  Mr. Schick also informed commissioners he has some used materials and asked if the County would be interested in them.  The commissioners indicated they would.  He also asked if the City and County ever went in together on a purchase and split the contents.  Commissioners said we have in the past but would have to ask to see if they are interested in each offer.
 
David Neville informed commissioners that he spoke with Terry Hughes about the porch, per the commissioners’ request.  Mr. Hughes’ opinion was that we contact an architect and get all new recommendations.  Bill Brittain directed Mr. Neville to contact Rick Zingre and have Mr. Zingre contact the interested companies to get specs together.
 
Jimmy Nichols informed commissioners that we have had to transport 12 of our inmates for housing in Cherokee County.
 
Tom McNeil informed commissioners that there is a local contractor who is not certified but who has been installing septic systems.  Commissioners asked Mr. McNeil to have him get licensed like all the others.
 
Mr. McNeil also asked commissioners if Sandy Stinnett could do data entry for him on the computer as he says he is not computer literate.  She would not want compensation for this.  Commissioners will have to check on our liability for this.  No action.

The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Joanne Long was also present.  Gary Houston was absent because he took his father to a doctor’s appointment.
 
Bill Van Kirk, 6th Judicial District Community Corrections, met with commissioners for an update.  Bill Brittain made a motion to authorize Terry Graham to sign the amended 3-year comprehensive plan.  Terry Graham seconded the motion and both voted in favor.  Terry Graham made a motion to appoint LaShawn Miller, Robert Chase and Gary Houston to the Community Corrections Board.  Bill Brittain seconded the motion and both voted in favor.
 
Delwin Mumbower met with commissioners to ask that the fire station captains be appointed as second alternates for the Board.  Currently we have the chief and assistant chief as member and alternate, respectively.  This will allow for another back-up for a vote if the chief and assistant chief are both unavailable at a meeting.  Terry Graham made a motion to amend the Fire District 3 Guidelines regarding appointing board members to allow for a second alternate.  Bill Brittain seconded the motion and both voted in favor.  Terry Graham then made a motion to appoint the following as second alternates to the Fire District 3 Board:

Terry Graham signed the annual software support agreement with Real Vision Software, Inc. (RVI).  This $3,000.00 agreement is paid annually from the Register of Deeds Technology Fund.
 
Joanne Long presented commissioners with a letter from KCAMP with their advice to have all drug and alcohol testing for county employees done by a third party contractor and in the same random screening to protect us from any possible liability.

The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Joanne Long was also present.  Minutes of the previous meetings were read and approved.
 
Clyde Killion gave a road report.
 
Brett Dalton, reporter with the Fort Scott Tribune, was present.
 
Laura Hyer met with commissioners.  Terry Graham presented her with a certificate of Certified Emergency Manager from the State of Kansas.
 
Ron Chaney and Frank Pulliam of Phoenix Coal Company met with commissioners to ask that the road closing agreement be extended.  Terry Graham made a motion to renew the road closing agreement until 6/1/08.  Bill Brittain seconded the motion and both voted in favor.
 
Jimmy Nichols met with commissioners about the correctional center doors.  The wrong ones were brought up before.  The new amount is $25,875 from Montgomery Door Closers.  Commissioners approved the purchase.
 
Gary Houston arrived at 9:30 am after a meeting at the County Barn.
 
Clyde Killion presented bids for the proposed extension at the County Barn.  Three were received:

Bill Brittain made a motion to approve the bid from Judy’s Iron and Plumbing, as it was the low bid.  Gary Houston seconded the motion and all voted in favor.
 
Bill Brittain spoke with Dr. Miller about drug and alcohol testing for the County.  He gave us a quote.  Commissioners asked Doylene Kennedy to find out what exactly Mercy does for us.
 
A representative with Oneok Energy Marketing met with Joanne Long this week asking for access to our gas bill for the last two years to see if we could save by joining Oneok in their bulk purchasing of natural gas.  Commissioners authorized the clerk to provide Mr. Jurgensmeier with the authority to research our accounts.
 
Tom Christy, 1239 Grand Road, met with commissioners.  Someone put in a driveway to access his property and didn’t install a culvert and now water is backing up.  Commissioners said they can install one but he will have to purchase it.  Commissioners will call Clyde and have him work on it.  Mr. Christy thanked the commissioners.
 
Bills and payroll for the period were reviewed and approved.
 
Sharon Elder and Carol Lydic of Century 21 met with commissioners to discuss a manufactured home that is encroaching on a property in Xenia.  Several years ago there was a resolution to close a group of roads, but one part was not included.  This is the portion that is being encroached upon.  Commissioners said that in order to close it, the landowner will have to petition to have it closed and then the procedures will go from there.
 
Bill Brittain told commissioners he got in touch with the lady from Reno County who was recommended to us to assist with dispatch communications but she feels awkward to do it since she didn’t even do it for her own County.  She put him in touch with an association which does this.  Bill Brittain will speak with the City to see if they still plan on splitting the expenses.  The company will send us an offer.
 
Mrs. Norman Brillhart met with commissioners to relay problems she’s having with the road grading on 210th Street.  The commissioners will have Clyde look into it.

The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Gary Houston arrived at 9:10 am.  Joanne Long was also present.  Minutes of the previous meeting were read and corrected.
 
Curtis Shankel met with commissioners as a follow-up to the income survey for the Lake Fort Scott proposed sewer.  The survey is completed and now he’s waiting on the grant administrator to see if there are any loose ends to wrap up.  Then he will submit the grant application(s).  Mr. Shankel confirmed that the lake committee has done all it can.  Commissioners agreed.
 
Clyde Killion gave a road report.
 
Ben Mitchell met with commissioners to discuss an upcoming Millcreek Watershed District project.  The proposal is for the County and the Watershed to share the expenses.  The original request was for the County to spend about $10,000 more on the project than the Watershed District.  Terry Graham asked if we could split the difference and end up with a 50/50 split on the expenses.  Mr. Mitchell will have to take the request back to his board for consideration.  In the meantime, Bill Brittain made a motion to approve the project with a 50/50 split of $34,250 each for the County and Millcreek Watershed District.  Terry Graham seconded the motion and all voted in favor. 
 
Dean Mann met with commissioners to ask them to appoint three people to the Fort Scott/Bourbon County Riverfront Authority as directors.  There will be three members from the City and three from the County.  The committee’s recommendations are:  Dean Mann (3-year term), Bob Love (2-year term), and Mike Lakeman (one year term).  Bill Brittain made a motion to appoint them to serve as recommended.  Terry Graham seconded the motion and all voted in favor. 
 
Rhonda Fernandez met with commissioners for an update on our first quarter health insurance.  She says we’re improving.  Mrs. Fernandez discussed ways to save on prescription costs.  She also has a payroll stuffer that focuses on prescription costs.  She said one main thing is to educate employees about switching to generic to keep costs down.
 
Paul and Lavonne Kmiec met with commissioners.  They have a question about a right-of-way location so they can replace a fence.  Documents show a 60’ right-of-way but the existing, old fence, isn’t back far enough on either side of the road and isn’t straight.  This is a problem all over the County, according to commissioners.  Commissioners advised the Kmiec’s that they must abide by the 60’ right of way.
 
Lora Holdridge met with commissioners about the home encroaching on the road in Xenia.  She has the list of adjacent landowners.  We’re still waiting for a petition to close the road from the landowner.
