July 7, 2006   Friday  9:00 am
 
The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Joanne Long was also present.  Gary Houston arrived at 9:20 am.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.  There was discussion of loaning our lay-down machine to the City of Fort Scott and who is trained in the County to operate our equipment.  The City wanted to use it this week on Jayhawk Road but we didn’t allow it because our main operator is out ill and the other person who can run it is on another piece of machinery and the County can’t stop its operations to help the City.  Clyde Killion informed commissioners that Berry Tractor recently offered a machine to the City to use and they refused it.
 
Lee Davis sent quotes for tires for his truck for commissioners to review.  They asked him to get a quote from 5-Corners.  Then they said to buy from the least expensive quote.
 
Brett Dalton, reporter with the Fort Scott Tribune, was present.
 
Joanne Long asked the commissioners to review and adopt the Voting System Security Policy, dated July 5, 2006.  She said it is required by each County in the State of Kansas and will be on file in the Secretary of State’s Office.  It covers the procedures with regard to access to the system, transmitting data, testing of voting equipment, polling place security, equipment storage and voting equipment certification.  The commissioners will review the document.  Ms. Long also added that, as a part of the policy, she will need a laptop to hold election data only.  She can’t use the current laptop which she takes minutes on and other things because it must be stand alone, not connected to the county’s programming or connected to the internet.  She said she has the money in the Election Fund and is having Lynn Smith get quotes.
 
Commissioners received the 2007 budget request from District Court.  They are asking for $286,700.  This is an increase over 2006’s approved budget of $78,672.
 
Frank Shelton spoke with commissioners about the Brownfield Program, through KDHE, which would benefit Bourbon County in improving some land areas the County owns.  Other cities and communities have used it for parks, movie theaters, etc.
 
Mr. Shelton asked to discuss the landfill lease.  Terry Graham made a motion to go into executive session, under the land acquisition exception to the Kansas Open Meetings Act, for a period of ten minutes, to discuss the landfill lease.  Bill Brittain seconded the motion and all voted in favor.  Those present for the session were the commissioners, Frank Shelton and Joanne Long.  The session began at 9:43 am and ended at 9:53 am with no action.
 
Clifton Beth asked commissioners if he can clear trees out of the county right of way at his property north of Fort Scott on 215th Street.  He is cleaning up trees on his property and wants to clear up the ditch too.  He plans to burn them on his property.  Commissioners approved the request.
 
Bill Brittain made a motion to appoint Don Russell as Bourbon County’s representative on the See-Kan RC&D board, pending his acceptance to the offer.  Terry Graham seconded and all voted in favor.
 
Joanne Long asked commissioners if an employee, who was hired as part-time in April, moved to full-time June 12, 2006, is eligible to receive holiday pay for the 3rd and 4th.  After reviewing the employee manual, it was determined that he is eligible because he was on the payroll for 30 days.
 
Sharon Elder asked commissioners if sick leave can be donated to the Community Pool when people leave.  Only vacation leave is eligible for the Community Pool.
 
Dolyene Kennedy presented Landfill and Road and Bridge quarterly reports for signature.  Gary Houston signed the reports as chairman.
 
Joanne Long reported on direct deposit fees for UMB.  There is a maintenance fee of $10.00 per month, a transmission file fee of $5.00 per pay period and a fee of .07 for every ACH debit and .10 for every ACH credit originated.  Commissioners would like to start it January 1, 2007.
 
Jim Harris, Berry Tractor, met with commissioners to offer a special price on a Bomag compactor we demoed of $88,500.  Commissioners will think about it.

The Bourbon County Commission met in open session with Bill Brittain and Gary Houston present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.
 
Commissioners received the 2007 budget request from Noxious Weeds.
 
Clyde Killion gave a road report.
 
Bill Van Kirk and Erin Lyon presented the Community Corrections budget for 2007.  Gary Houston signed the budget for Bourbon County.  Erin Lyon reviewed the program where underage people try to purchase cigarettes.  She is looking for Bourbon County kids between 15 and 17 to help with the program.  She is also looking to set up a kid-friendly interview space in Bourbon County for interviewing children.  We currently contract through a company in Pittsburg, but would like to stay in the county.  Mr. Van Kirk also encouraged commissioners to attend advisory board meetings the second Tuesday of each month in Mound City.  The next meeting is August 8th.
 
Gene Parker, Garland, met with commissioners to ask about spraying weeds at 245th and Grand.  Commissioners said it has been sprayed but they’ll check again with the weed director.  He also said that an area north of the railroad needs cleared out for better visibility.  Commissioners said that if it’s on the railroad right of way, we’ll have to coordinate with the railroad and that could take some time.
 
Bob Larkin, Cheryl Bennett, Wayne Thorpe, Ronnie Brown, Robert Miller and Bill Schoenberger presented the 2007 Soil Conservation budget request.  They are not requesting an increase in funding from the county.  They discussed the possibility of the USDA office closing in Fort Scott and combining with another County.  Soil Conservation shares office space with USDA and if it were to close, that would put all the rent on the Soil Conservation Department and that would be an undue hardship.  Commissioners asked the clerk to send a letter to the State asking that the USDA Fort Scott office remain open. 
 
Wilma Graham stopped in to be sure that Redfield is on the list of projects this year for chip and seal.  Commissioners assured her it is.
 
Jimmy Nichols, Gene Parker and Darrell Spencer of SEKRCC, and Adam Kuehl of Shaughnessy Fickel and Scott Architects met with commissioners to discuss jail improvements.  Mr. Kuehl explained that his company specializes in judicial system projects and also designed the new Allen County facility.  His plans will improve the current facility and increase capacity while allowing it to stay open during renovations.  He reviewed the proposed plans with the commissioners.  The plans include increasing bed space, relocation of the control room, day rooms for inmates and changing the recreation area.  Commissioners would like to see a cost estimate, by phase, for the project.  Mr. Kuehl will get those numbers together later this week.
 
Joanne Long asked commissioners to adopt the Voting System Security Policy.  Bill Brittain made a motion to adopt the policy, dated July 5, 2006.  Gary Houston seconded the motion and both voted in favor.  This policy will be sent to the Secretary of State to be placed on file.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Jerry Taylor, Midwest Training and Consulting Services spoke with commissioners about oil spill prevention.  It involves preparing plans to have on file regarding possible spill locations.  He reviewed other projects he has worked on.  The county has three sites that this could concern—the County barn, the Weed barn in Uniontown and the rock quarry/asphalt plant.
 
Commissioners discussed the situation with SEK Multi-County Health.  Linn County has not agreed to continue funding at the rate requested by the health board and it has determined that the existing structure of the SEK Multi-County Health board cannot continue.  It has requested that each county pass a resolution to disband as of 12/31/06.  The board will restructure but the current bylaws state that we need to act on this today.  Gary Houston made a motion to adopt a resolution to withdraw from the current SEK Multi-County Health Department.  Terry Graham seconded the motion and all in favor.
 
Lynn Smith presented commissioners with the 2007 Computer fund budget request.  Her main concern is a request for an increase for the Assistant Computer Systems Operator, Shane Walker, who she says is a great asset as he knows a lot about personal computers.  She also asked for an increase for the remainder of 2006, which was budgeted but not allowed, earlier this year.  Commissioners will consider the request.
 
Mrs. Smith also informed commissioners that 9 computers in the county will need to be replaced next year.  They have operating systems of Windows 95, 98 or Me and will not be supported by Windows anymore.  She said Shane can install them and save the County money on that.
 
Brett Dalton, reporter with the Fort Scott Tribune, was present.
 
Doylene Kennedy asked Gary Houston to sign the CFAP quarterly report.  He signed the report at the direction of the Commission.
 
Bill Brittain made a motion to spend $950 to get a cost estimate for the jail refurbishment.  Gary Houston seconded the motion and all voted in favor.  Joanne Long notified the correctional center so they can contact the architect with the decision.
 
David Neville presented prices for generators with a five year warranty.  He said some of the companies require an additional preventive maintenance agreement when providing a 5 year warranty.  Commissioners feel that the lowest priced unit will do the job and probably last as long as our current one has.  David said that new government standards on emissions take effect July 19th.  Prices will go up after that.  He said that wire and conduit prices fluctuate too.  Bill Brittain made a motion to purchase the Comet Industrial, natural gas generator.  Terry Graham seconded and all voted in favor.
 
Bills and payroll for the period were reviewed and approved.
 
Sharon Elder presented the 2007 budget request for Register of Deeds.  She reported that she increased the personal services line to include part-time pay, which the commissioners allowed for 2006 also.  She said it is for additional help when people are out of the office for business trips, vacations or illnesses.  She has spent about $250 in 2006 so far.  Per a question about staffing from Bill Brittain, Mrs. Elder reported that on-line programming hasn’t slowed the workload down in her office.  She said she can’t lose a person because she’s trying to increase the amount of information available online.  That process entails scanning multiple documents per deed.
 
Gene Parker, SEKRCC, met with commissioners to discuss an upcoming taser class he will be instructing.  He needs to purchase 56 cartridges for the class and they cost approximately $840 for a box of 50 cartridges.  He said the Sheriff and jail can use them and outside people who attend the class will reimburse us for the cartridges they use in the class.  He is a certified taser instructor and he hopes to get masters instructor training soon.  That will benefit the county because of the money we can make from classes he instructs.  Commissioners approved the purchase of the cartridges.
 
Bill Brittain left the meeting at 10:30 am to take his daughter to the airport.
 
Judy Orton presented the County Appraiser budget request for 2007.  It includes increases to accommodate GIS mapping, in connection with the City of Fort Scott and fuel increases.  She said GIS will help all county departments but she has put it in her budget solely at this time.  She said we should have the complete system by the end of 2007.  On the personal services line of the budget request, she asked commissioners about the salary for the GIS coordinator, Shane Walker.  She said he is very enthusiastic about the new system and taking it upon himself to learn the programming.  If commissioners have any questions on the budget, she asked that they speak to her before finalizing it.
 
She also reminded commissioners that this is the last year that we get revenue from new equipment personal property and starting next year that will affect our valuations.  She said the time to fund definite projects is this year.
 
John Wunderly needs two brush piles cleared out from a fence row on Catt School Road.  Commissioners will burn the brush that is on the County’s right of way.
 
Jack Adamson spoke with commissioners about the entrance tube at his property on 95th Street, ½ mile north of 65 Hwy.  Commissioners will have Clyde look at it and either clean it out or replace it.
 
Susan Quick presented the 2007 Treasurer’s Office budget request.  Her only increases are because of gas prices and the need to replace a computer in her office.  She also mentioned that the statute for motor vehicle pay increased and hopes that will be followed.
 
She also informed commissioners that she is sending out the letters to area lawyers about the upcoming tax sale.
 
Frank Shelton responded to commissioners’ request about the oil spill prevention presentation from earlier today.  He said that Emergency Preparedness should have the plans in her work and the county’s insurance company handles safety training.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.
 
Clyde Killion gave a road report.
 
Harold Coleman informed commissioners that he found a gravestone dumped on the side of the road.  He is trying to locate where it belongs.
 
Frank Shelton, County Sanitarian, met with commissioners to discuss the landfill.  Bill Brittain made a motion to go into executive session, for a period of ten minutes, under the land acquisition exception to the Kansas Open Meetings Act.  Gary Houston seconded and all voted in favor.  Those present for the session were the commissioners, Frank Shelton and Joanne Long.  The session began at 9:22 am and ended at 9:32 am with no action.
 
Commissioners reviewed the Fort Scott Lake survey results, as compiled by the County Clerk.  140 surveys were mailed and she has 102 responses and four envelopes returned undeliverable.  43 indicated were in favor of forming a benefit district and 36 were opposed.  82 were interested in attending a public hearing on the subject.  Mr. Shelton has more work to do before scheduling the public hearing.
 
Frank Shelton presented his 2007 budget request.  Commissioners also received the budget request from the County Attorney.
 
Commissioners signed paperwork for AAT Communications.  They are attempting to obtain debt financing and we are the landlord.  Commissioners authorized Gary Houston to sign the paperwork.
 
Frank Shelton spoke with commissioners about emulsified asphalt.  Commissioners asked him to speak with Clyde about it.
 
Terri Johnson met with commissioners to discuss a lease.  Gary Houston made a motion to go into executive session, for a period of five minutes, under the attorney-client privilege exception to the Kansas Open Meetings Act.  Bill Brittain seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson and Joanne Long.  The session began at 10:29 am and ended at 10:34 am with no action.
 
Mrs. Johnson also spoke with commissioners about setting up classes through KCAMP to help us with our insurance rates.  Classes would be for Road and Bridge and basic sexual harassment, employment law and others.  Commissioners asked the clerk to work with Terri in setting these up and also agreed that all department heads should participate.
 
Bill Brittain left the meeting at 11:05 am for a doctor’s appointment.

The Bourbon County Commission met in open session with all commissioners present.  Joanne Long was also present.  Minutes of the previous meeting were read and corrected.
 
Clyde Killion gave a road report.  Commissioners discussed using emulsified asphalt.  Commissioners approved the use of emulsified asphalt and Bill Brittain notified Coastal Energy Corporation.
 
Joe Savage met with commissioners to inform them where a grader operator dug up a pipe in the road at Unique Road and 235th St.  Clyde will send someone out to remove it.
 
Terry Sercer met with commissioners to review the 2007 County budget.  He presented the initial budget figures to the commissioners.  He will be back Monday morning to start working on it.
 
Harold Coleman, Jimmy Nichols and Gene Parker spoke with commissioners.  Mr. Nichols has been putting together numbers for a road crew of prisoners.  It would be a volunteer program of non-person felony and misdemeanor inmates for clean-up programs around the County.  Supervision would be by himself or a deputy sheriff and would be with tasers.  He discussed limitations of such a program, such as the inmates can’t work in conditions over 90 degrees or a heat index of 90 degrees or higher and if females are involved, a female correctional officer will supervise.  He said there would be initial costs to start the program for the purchase of work boots, hats and vests but that it would maintain itself.  The prisoners would be working for television privileges and other benefits inside the jail.  The Sheriff would approve of the program and it would have nothing to do with the court system.  Other counties who have such a program include Douglas, Sedgwick and Shawnee.  Since everyone in the county already pays for the jail, this service would be for everyone.  Commissioners want to start on a trial basis.  Mr. Nichols said that it would cost $1,500-1,600 for boots, caps and vests.  All these supplies will be the property of the County and will remain the County’s if and when a prisoner leaves the program.  Any prisoners who agree to the program will sign a contract.  Commissioners want any contracts reviewed by the county attorney before anything starts.  Commissioners approved the program and approved the initial expense of purchasing caps and vests.  Commissioners asked that we hold off on purchasing boots, the most expensive item, until we have a trial period to see how it will work.  Commissioners think it will be good for the prisoners and for the community.
 
Harold Coleman spoke briefly about a table top exercise he and several other Bourbon Countians attended this week in Iola on pandemicHe said the County needs to think about and set a policy to prepare if this happens in Bourbon County.  He said there should be priorities on correctional officers and first responders for their health.  According to figures at the exercise, 30% of population is to be affected in the first 2 weeks of a pandemic.  He reminded commissioners that those numbers will apply to county employees too. 
 
Gene Parker met with commissioners to discuss several things.  He indicated a need to order chemical to mop and disinfect the jail.  He purchases it in a 55 gallon drum and it lasts about a year.  It kills blood-borne pathogens.  Gary Houston asked to check a price on the product with another company before making a decision.  Bill Brittain asked if Mr. Parker checks locally for these items in the jail.  Mr. Parker said he does and buys locally when he can.  The local merchants don’t sell the large quantity and other items don’t come with a lifetime warranty he can get elsewhere.  
 
He also reminded commissioners of the taser class coming up which he is teaching.  He said there are 20 students signed up.  He invited the commissioners to come out at 11:00 am on Saturday, August 5, to view the demonstration of a person getting hit with the taser.  He has also invited the media.  The class will be at FSCC Heritage Room.
 
Mr. Parker also informed commissioners that we are no longer using Vista Pharmacy.  We will be switching to Woods.  Bill Brittain said that Mercy said they would give the Medicaid rate.  Gene said he is afraid to switch to Mercy because it will mess up the pharmacy licensing for the jail.  He informed the commissioners that 81% of the jails prescriptions are from Mental Health.
 
He informed commissioners that the jail has changed to orange socks and is going to dye boxers and tee shirts pink so the prisoners won’t walk off with them.  That should cut expenses.
 
Mike Hueston spoke with commissioners about communications for fire districts out in the county.  Commissioners want the best of both worlds when it comes to the communications for the County.
 
Terry Graham left the meeting at 11:35 am to pick up his wife from a doctor’s appointment.

Marty Pearson met with commissioners to discuss the need for a replacement truck in the public works department.  Commissioners went downstairs with Mr. Pearson to view a truck and returned to say they will authorize Mr. Pearson look into prices for a truck.

The Bourbon County Commission met in open session with Gary Houston and Terry Graham present.  Joanne Long was also present.  Minutes of the previous meetings were read and approved.
 
Clyde Killion gave a road report.
 
Bills and payroll for the period were reviewed and approved.
 
Fred Hixon spoke with commissioners about the proposed benefit district around the lake and a few area neighborhoods.  He doesn’t think he should have to pay for the Lake’s problems.  Commissioners asked Mr. Hixon to speak with Frank Shelton.
 
Harold Coleman spoke with commissioners about cutting up trees that were cut down at the overpass on Old 69 (215th St.).
 
David Neville spoke with commissioners about the annual boiler inspection.  According to the inspection, we need to replace the tank on the correctional center’s unit.  The existing tank is 14 years old.  He has several quotes for an 80-90 gallon commercial unit.  They are:

Terry Graham made a motion to purchase the tank from Judy’s Iron & Metal for $4,317.55.  Gary Houston seconded the motion and both voted in favor.  Installation will be through Taylor plumbing for an estimate of $720.00.
 
David also spoke with commissioners about the main air conditioner for the courthouse.  He said we need a larger circulating pump and electric motor to help keep cool with the higher temperatures.  Commissioners asked Mr. Neville to get quotes.  He said it would be approximately $3,000.00, installed.
 
Mitzi Riley met with commissioners to discuss rules on fences.  She is having problems with a new neighbor.  Her neighbor has built a new fence about a foot and a half on his property.  She built her fence on the fence line and now they’re having problems joining the two fences together.  He won’t let her tie onto his corner post and after it’s all said and done, there will be an area of land between the two fences which may allow his cattle to get out.  Commissioners advised her to set up her own corner post and if his cattle get out to call the sheriff.
 
Bob Tuchscher, Vista Pharmacy, met with commissioners to discuss the correctional center.  He lost our business when we switched to Diamond Pharmaceuticals.  He also spoke about inspections he used to do on the jail.  He hasn’t done it since Jimmy Nichols started there.  It can be inspected by an RN but he doesn’t know anything that’s being done now.  He’s unhappy about the articles that have been written saying what has not been happening in regard to his business and the County.  He said he has done everything that has been asked of him and is required of him.  He said that he’s received several phone calls from the correctional center about the most recent bill and that the calls were rude and hateful.  He doesn’t want to be bad-mouthed.  Commissioners apologized for the situation and said they would look into it.
 
Kent Boyd spoke with commissioners about a problem he is having with Johnson grass and other noxious weeds.  If the weed director would spray the ditch, he could manage the weeds on his property.  Mr. Boyd also informed commissioners of a bad pothole on Maple Road (Old 54) that needs filled.
 
Karen Paddock met with commissioners to discuss increasing jury fees.  The statute changed July 1 and the commissioners haven’t decided anything.  She would like to keep it at $10 for the first day but it’s the following days that are of question.  She needs an answer before August 8th, because that’s her next jury trial.
 
Mrs. Paddock also discussed the grand jury petition which was turned in.  It was certified by the county clerk.  If/when it proceeds, all expenses for the grand jury will be paid out of County General Fund of the County.  She said that many people would be called and 15 members seated.  If it happens, it will be very expensive for the County.
 
Gary Houston made a motion to appoint the Bourbon County Sheriff and the Director of Public Safety for the City of Fort Scott as Special Deputy Coroners for Bourbon County.  Terry Graham seconded the motion and both voted in favor.  This is done because we don’t have a County Coroner.
Harold Coleman spoke with commissioners about a man who offered to give a class on safety for the courthouse.  He wouldn’t charge anything.  He used to work at Fort Riley.  It would be about a two hour class and all courthouse employees are welcome to attend.  Commissioners approved the idea.  Harold will make the arrangements.
 
Terry Graham made a motion to go into executive session, for a period of five minutes, to discuss non-elected personnel.  Gary Houston seconded and both voted in favor.  Those present for the session were Terry Graham, Gary Houston, Harold Coleman and Joanne Long.  The session began at 11:00 am and ended at 11:05 am with no action.
 
Laura Hyer spoke with commissioners about communications, emergency preparedness and storm sirens.
 
Lee Davis met with commissioners.  He needs chemical.  He said that after he sells what he has in stock, he will have to end the cost-share program for 2006, but will continue to sell to people at our cost for noxious weeds.  Commissioners approved Mr. Davis to get quotes on more chemical.
 
After routine business, the meeting adjourned at 12:30 pm.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meetings were read and approved.
 
Commissioners spent part of the morning discussing county roads and the hard surface road program.
 
Joanne Long informed commissioners that the Clerk and Treasurer’s offices have no air conditioning today.
 
Bill Brittain discussed a request from Garland for help with obtaining a storm shelter.  He said there may be a way for the county to apply for a grant on their behalf, as they are unincorporated.  There was also discussion of whether the County would assist in digging the hole for a shelter.  The commissioners agreed to that.
 
Terry Sercer met with commissioners to finalize the 2007 Bourbon County budget.  After discussion and a few adjustments, the commissioners approved the budget to be published with a .009 mill levy decrease over 2006.
 
After routine business, the meeting adjourned at 11:25 am.
