May 02, 2005   Monday         9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Clyde Killion gave a road report. 

Commissioners discussed hiring part-time help for base work.  Commissioners agreed to hire Richard Ramsey.  The exact rate of pay is still under negotiation.  He is scheduled to begin work May 15, 2005.  There will be no benefits. 

Jason Silvers, reporter with the Fort Scott Tribune, was present. 

Lu Warren, Chuck White, Shanda Stewart and Kevin Russell met with commissioners to discuss the 6th Judicial District Community Corrections Comprehensive Plan and their duties.  After discussion, commissioners signed the plan. 

Laura Hyer presented commissioners with a letter for their signature which requests that an LEPC control station be placed in the Fort Scott Police Department dispatch.  It also requests placement of two voting station monitors at dispatch.  Commissioners signed the letter. 

Ms. Hyer also reported that the tentative date for officials training has been set for Friday, June 17, 2005, from 9:00 am to noon, at FSCC.  She will notify the other agencies of the date and time. 

Susan Quick and Sharon Elder met with commissioners to apologize for their behavior recently about raises.  They said they don’t like conflict and don’t want the commissioners to think that because they are disappointed about this issue that they will hold a grudge and not cooperate with commissioners in the future.  The commissioners thanked the officials. 

The commissioners spent the rest of the meeting discussing the County’s current liability for grader payments.

May 06, 2005       Friday        9:00 am 

The Bourbon County Commission met in open session with all commissioners present.  Cecelia Kramer was also present.  Minutes of the previous meeting were read and approved. 

Clyde Killion gave a road report.  He also discussed bridge repairs and mentioned that he is going to post in-house a position at the landfill for full-time, 40 hours per week, which includes working Saturdays. 

John Jackson, H&H Agency, spoke with commissioners about the status of a road near Lewis Allen’s property at 195th Street between Yellowstone and N. 31 Hwy.  No action. 

Gail Potter inquired about putting storm sirens outside the city of Fort Scott.  Commissioners will check with Emergency Preparedness. 

Vivian Houston asked the commissioners for rock for Memory Gardens Cemetery. 

Clyde Killion asked the commissioners if regular trash and tires will be charged for in the Clean-Up Program.  The commissioners agreed that was correct. 

Lee Davis wanted to know if he could buy a push mower for the Weed Department.  Commissioners approved the request. 

At 10:50 am, Bill Brittain left the meeting to discuss communications with the City. 

Gary Houston called John Jackson about the road in question and informed him that it is an open road and relayed the process to close a road. 

Laura Hyer visited with commissioners about the cost to install phones in the rural areas for emergency preparedness. 

David Neville, Laura Hyer and Judge Rebecca Stephan met with commissioners to discuss courthouse security.  Judge Stephan explained to commissioners about an incident that occurred Wednesday of this week involving an out of control prisoner.  She is asking for a bailiff or some sort of security system.  Commissioners agreed that the court system could hire a bailiff for a reasonable amount. 

Harold Coleman asked for placement of a stop sign or some sort of warning one mile south of Fulton at 215th Street. 

Judge Stephan also requested a video security camera system, which she says would have prevented Wednesday’s incident.  Commissioners asked to have the Court Clerk look into information about video systems.  Judge Stephan will have the Court Clerk check into costs and get back with commissioners.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.

Terri Johnson spoke to commissioners about legal issues. 

Jason Silvers, reporter with the Fort Scott Tribune, was present. 

Commissioners discussed the employment status of Richard Ramsey.  As of May 15, 2005, he will be put on part-time status, in a non-KPERS covered position.  His benefits are to stop as soon as possible and Mr. Ramsey will hold off applying for his KPERS retirement until all benefits have been paid out.  He will make $12.50 per hour.  Ms. Long indicated that an addendum to the salary resolution will have to be passed in order to increase part-time wages to that amount.  Commissioners agreed but no immediate action was taken. 

Commissioners spent much of the morning updating the 5-year bridge plan. 

John George spoke with commissioners about flooding concerns surrounding Marmaton Watershed site K-1. 

Laura Hyer discussed communications with commissioners. 

Bills and payroll for the period were reviewed and approved. 

Commissioners received a letter and pictures of the courthouse roof from Charles Parsons which indicate that CertainTeed has viewed the roof with Mr. Parsons and suggested additional details for the replacement.  No action. 

Ms. Long reminded commissioners of the KCCA conference to which they are all attending this week.  Therefore, there is no commission meeting this Friday.

May 16, 2005           Monday         9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Merlin Messer spoke with commissioners about a road problem.  Clyde Killion will meet with Mr. Messer tomorrow morning about it. 

Joanne Long informed commissioners that the agreement between the County and Phoenix Coal Company has been returned signed.   

Clyde Killion gave a road report. 

The commissioners asked Clyde how Saturday’s free dump day went.  He said it was slow and that many people didn’t know it was free until they got there.  He suspects next Saturday will be busier. 

Joanne Long informed the commissioners of a request by the City of Fort Scott to keep the Transfer Station open late to accommodate the fire clean-up effort.  No action at this time. 

The clerk also informed commissioners about a problem with cement trucks south of Fulton on Old 69 highway that was brought up by Charlie Blevins.  He was almost involved in an accident last week and wants the commissioners to do something immediately for safety, like dust control and signs.  The commissioners said that signs were already put up north and south of the area and that the State was considering a solution to the dust problem. 

Clyde Killion spoke with commissioners about getting signs for buggy traffic from the new Amish families in the area.  Since they travel Old 69, they could be given an alternate route to avoid so much traffic and potential high speeds.  Clyde will look into an alternate route south. 

Commissioners discussed the problem with speeders on county roads.  They mentioned getting the camera set up which photographs the license plate of offenders and also the lighted signs which tell how fast a driver is going.  No action.

Commissioners approved payment of a re-issued check for a witness for the attorney’s office. 

Joanne Long asked when to schedule the City/County luncheon.  Commissioners asked the clerk to set it for next Monday, May 23rd at noon at the BBQ Pit, and to contact the City officials to invite them. 

Bill Brittain made a motion to amend the Salary Resolution (07-05) to add the following paragraph:   

“Part-time employees who do base work for hard surface roads (Sales Tax) will be paid between $9.00 and $12.50 per hour.  The exact rate of pay will be determined by the County Commission and based on experience of the individual.” 

Terry Graham seconded the motion and all voted in favor. 

Bill Brittain asked the clerk to inform the City of the number of job titles that will be involved in the salary survey.  She was asked to keep the elected officials separate but to give that amount also.  Counting only base jobs and all deputies as one and all clerical employees as one, the clerk determined there are 31 non-elected positions and 6 elected positions. 

David Neville reported to commissioners that his cordless phone is broken.  He has had several types of communication in the past, from walkie-talkies to pagers to lower megahertz cordless phones and needs something as strong as he has had for the past three years.  A replacement, from Tindel’s Telephone, will cost $380.  Commissioners asked Mr. Neville to check with Radio Shack to see if they have something and to buy the best deal. 

Howard Post asked the progress on Xavier Road.  Some rock has been hauled but more is on its way.  This is one of the roads the gas company is digging up and they agreed to buy the rock to repair it, but haven’t yet. 

 

Wilma Graham asked commissioners when the County would be getting to Redfield for chip and seal.  Commissioners said around the first of July. 

Ms. Graham also spoke with commissioners about bad holes in the Old Redfield Road.

Bill Brittain made a motion to accept the quote from Van Diest Supply Company.  Terry Graham seconded and all voted in favor.  When asked, commissioners authorized Mr. Davis to purchase an additional 50 gallons of Pasture Guard from Van Diest also. 

Laura Hyer gave a communications update, based on the Friday meeting at City Hall, to commissioners.  She also spoke of the need to have a current map of critical infrastructure for risk analysis. 

After discussions with City Hall, commissioners approved the request from the City to keep the Transfer Station open late for fire debris clean-up.  They informed the clerk that any overtime for this project will be reimbursed by the City’s urgent needs funds.  The Transfer Station will be open, beginning Thursday, 7:00 am to 7:00 pm, daily.  However, regular dumping will only be allowed during regular business hours.  Only fire debris will be allowed in the additional hours/days of operation.

May 20, 2005      Friday        9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and corrected. 

Clyde Killion gave a road report. 

Commissioners discussed the speed limits on several county roads with no action. 

Manny Vermillion spoke to commissioners about a road problem at 2029 Jayhawk Rd.  Clyde Killion will meet Mr. Vermillion at 10:00 am this morning to discuss it. 

Clyde mentioned that the buggy signs are in.  There was discussion of an alternate route for the buggies so as to keep 215th Street (Old US 69) safer for motorists and the buggies.  Commissioners would like buggy signs on 215th also but would like to look into a path strictly for the horses and buggies. 

Susan Quick reported that the quarterly Special City/County Highway payment was received in the amount of $122,154.54. 

Norval Schnichels, KDOT, asked the commissioners if they had made any decisions about the T-intersection at US 31 and US 7, north of Devon.  The commissioners said no.  No action. 

Commissioners signed an inter-local agreement with the City of Fort Scott for the 2005 Byrne Justice Assistance Grant (JAG) Program Award. 

Terri Johnson and Harold Coleman met with commissioners.  Bill Brittain made a motion to go into executive session, for a period of 20 minutes, to discuss pending litigation under the attorney/client privilege exception to the Kansas Open Meetings Act.  Terry Graham seconded and all voted in favor.  Those present for the session were the commissioners, Terri Johnson, Harold Coleman and Joanne Long.  The session began at 10:33 am and ended at 10:53 am.  No action. 

Terry Graham made a motion to go back into executive session, for a period of 15 minutes, to further discuss pending litigation under the attorney/client privilege exception.  Bill Brittain seconded the motion and all voted in favor.  Those present for the session were the commissioners, Terri Johnson, Harold Coleman and Joanne Long.  The session lasted from 10:54 am to 11:09 am.   

The commissioners directed the county attorney to write an appeal on an unemployment claim and directed the sheriff to have statements prepared for such by himself and members of his staff.  They also asked the clerk to contact Mercy Health Center about random drug testing. 

Laura Hyer updated commissioners on emergency preparedness. 

Commissioners discussed a proposal from the City to form an advisory board for dispatch.  Gary Houston will represent the County.

May 23, 2005      Monday      9:00 am 

The Bourbon County Commission met in open session with Gary Houston and Bill Brittain present.  Joanne Long was also present.  Terry Graham arrived at 9:05 am.  Minutes of the previous meeting were read and approved. 

Clyde Killion gave a road report.  He also reported on his meeting with Manny Vermillion last Friday.  Mr. Killion said the work will be on this week’s schedule. 

Mark Wade asked for a culvert at a property near Uniontown. 

Commissioners discussed using the telecommunications tower on Couch Street for the emergency system.  Since the tower is on Bourbon County property, the lease allows the County a place on the tower.  Bill Brittain will contact the lessee to see if we can be placed on the top of the tower for optimal reception. 

Clyde Killion relayed a request from Tom Hill for the County to lay dust control at his north station.  Koss Construction would pay for it if the County would lay it.  Clyde reminded the commissioners that we have done this in the past.  After discussion, commissioners declined, citing liability issues if the County does business on private property, as well as a recent law forbidding government entities from interfering with private enterprise. 

Paul Pavey spoke with commissioners about the opening under US 69 Hwy and the potential for bad drifts if the young timber on the east of the overpass were to break off in an ice storm.  He stated that the Millcreek Watershed would offer dozing services if the State, who is the owner of the property, would allow clearing of several acres.  The commissioners will contact the State to see if they’re interested.  Mr. Pavey thanked the commissioners for their time.  Gary Houston then left a message for Norval Schnichels. 

Joanne Long told commissioners that she spoke with Lynette Sanders at Mercy Hospital about the drug testing procedures.  She relayed how the Public Works Department testing system works and that it would be simple to add additional employees to the pool for testing. 

Commissioners spent part of the morning discussing the possible roof quotes.  They said that whoever the County goes with, there will need to draw up a contract and that Terri Johnson has stated that she is not comfortable writing such contracts and she recommends we check to see if City Attorney, Robert Farmer, can assist us, since he’s done several of these types of contracts for the city.  After discussion, Bill Brittain made a motion to accept the quote from Contractor’s Alliance.  Gary Houston seconded the motion and all voted in favor.  Commissioners stated that any contract would have a stipulation that a portion of the payment would be withheld until the work is certified by CertainTeed Roofing. 

Commissioners received a request for 30 MPH signs on Deer Road west of US 69 Hwy.  After discussion, commissioners approved placement of 45 MPH signs in that location. 

Laura Hyer spoke to commissioners about rural storm sirens and rural fire hydrants. 

Joanne Long spoke with commissioners about the County’s credit card.  UMB is trying to get away from blanket accounts like the County currently has and is now moving toward accounts for each department.  The cards could be signed out as they are now but billing should be easier since sheriff bills will be on the sheriff account and clerk bills will be on the clerk account, etc.  Commissioners approved the change. 

Bills and payroll were approved.

May 27, 2005      Friday        9:05 am 

The Bourbon County Commission met in open session with Terry Graham and Bill Brittain present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.  Gary Houston arrived at 9:35 am. 

Jason Silvers, reporter with the Fort Scott Tribune, was present. 

Marty Pearson asked to purchase grader tires.  Commissioners asked Mr. Pearson to get quotes and come back. 

David Neville reported to commissioners the estimate for running electricity for a vending machine in the lobby.  It is $301.39.  Commissioners want Mr. Neville to see if Mr. Streeter, the vending machine man would pay for running the electricity in lieu of the county’s percentage of the profits for a year.  If it is worth Mr. Streeter’s while, he should do it.  After checking with Mr. Streeter, David reported back that Mr. Streeter is open to that arrangement, as long as he makes his money back.  He would like to extend the no profit time to completely make up the cost of the electric hook-up.  Commissioners will do it for the first year, have Mr. Streeter keep a running total of sales and report to us after the first year. 

Robert Query met with commissioners to ask that the 45 MPH limit sign on Deer Road be lowered to 30 MPH.  He stated that people drive in access of 60 MPH there, in a residential area with horses and the speed and excess dust spooks the horses.  Commissioners authorized the 30 MPH sign. 

Mr. Query also stated that the cemetery roads in the 2nd District have not been mowed and time is running out before Memorial Day.  Commissioner Brittain said that crews were on their way. 

Judy Orton met with commissioners to discuss her upcoming contract renewal.  By statute, the County Appraiser must be appointed July 1 every 4 years.  Ms. Orton went over some office statistics, including the number of parcels in the county (12,359) and number of hearings on valuations (87) this spring.  She mentioned that her department is in procedural and statistical compliance with the State.  She presented a salary survey that the Appraisers Association put together.  She highlighted area counties and things that are different between Bourbon County and others, such as contracting out some appraisal services, driving a county vehicle and family health insurance paid by some counties.  Commissioners would like to see total budget figures for these counties as well, to give some sort of idea of how money is spent in other counties.  Ms. Orton will be back in early June to discuss salary. 

Ronnie Brown, See-Kan RC&D presented commissioners with an updated fire plan for Bourbon County.  It has been over 10 years since the plan has been updated.  It is endorsed by area rural fire stations.  Gary Houston signed the plan as Chairman. 

Commissioners received a phone call from Renee Thompson about coal trucks running stop signs on Deer Road.  She also thinks that Cavalry Road would be a better coal road.  Commissioners called the sheriff to report the running of stop signs. 

Laura Hyer gave a communications update. 

Ms. Hyer reported that she, Sheriff Coleman and Delwin Mumbower have been invited by Governor Sebelius next week on a radio initiative. 

Joanne Long reported that UMB bank, our Visa Card issuer, would like individual names on the county credit card.  They said that some merchants are likely not to accept a card without a name and any fraudulent purchases would not be protected by Visa without a name on the card.  They are doing away with blanket cards like we have used in the past.  Commissioners authorized Ms. Long to ask each department who should have a card with their name on it.  The cards will still be kept in the Clerk’s Office and checked out when needed.
