October 11, 2004 Monday 9:00 am The Bourbon County Commission met in open session with all commissioners and the county clerk present. Minutes of the previous meeting were read and approved. Jason Silvers, reporter with the Fort Scott Tribune, was present. Laura Hyer asked commissioners to sign a letter recommending Laura Hyer be appointed to represent Bourbon County on the Rural Conservation and Development Council. Commissioners signed the letter. At 9:45 am, commissioners left the meeting to perform a fence viewing in Scott Township. Upon return, the commissioners discussed the fence viewing amongst themselves and Roger Lee and approved the following decision, with the stipulation that said decision in no way establishes property boundary lines, only fence responsibility/liability: Blevins’ to be assigned the south 105.57’ and Nation’s are to be assigned the north 105.57’ of the fence dividing the aforementioned properties in Section 8, Township 26, Range 25, Scott Township, Bourbon County, Kansas. Laura Hyer presented Resolution 19-04 for consideration. The resolution lays out the guidelines for the Emergency Preparedness Office and Coordinator and officially appoints Ms. Hyer as Bourbon County Emergency Preparedness Coordinator. Terry Graham made the motion to adopt Resolution 19-04. Robert Query seconded and all voted in favor. After routine business, the meeting adjourned at noon.

October 15, 2004 Friday 9:00 am The Bourbon County Commission met in open session with Robert Query and Gary Houston present. Joanne Long was also present. Minutes of the previous meeting were read and approved. Jason Silvers, reporter with the Fort Scott Tribune, was present. Terri Johnson met with commissioners. She approved the proposed resolutions for emergency preparedness. Ms. Johnson requested an executive session with commissioners to discuss attorney-client matters. Gary Houston made a motion to go into executive session, for a period of ten minutes, under the Attorney-Client Privilege Exception to the Kansas Open Meetings Act. Robert Query seconded and both voted in favor. Those present for the session were Robert Query, Gary Houston, Terri Johnson and Joanne Long. The session began at 9:05 am and ended at 9:15 am. When the regular meeting resumed, commissioners authorized Ms. Johnson to make a counter-offer. At 10:00 am, a public hearing was opened to discuss the proposed lot vacation at Fort Scott Lake. Those present were: Larry Nuss, Mel and Stephanie Cummings, Paul Holman, John and Pat Scott, Jack Hembree and Mike Leachner. Mr. Nuss, attorney for the Cummings’, spoke to commissioners about the proposed vacation. He assured the commissioners that the property involved, though part of Fort Scott Lake, was outside the 3 mile zone for the City and therefore was County jurisdiction. He explained that the last time a vacation like this was granted was at Redfield when Lyle Hixon split one property into several smaller properties. K.S.A. 58-2613 is the governing statute that allows the commissioners to vacate lots. Mr. Cummings stated that the proposed size of the new lots would be similar in size to lots in the City of Fort Scott. Though the County would create the lots, the City restrictions necessitating self-contained septic systems would still be in place. Mr. Cummings showed pictures of the area and described how he wanted to create a nice area with color and size restrictions on the houses. He would also put in a fire hydrant if physically possible. He said that his is a unique lake property and that it is currently the largest single lot. He feels his improvements would result in major beautification of the lake. Some of those who oppose the idea are concerned with increased traffic in the area on small lanes and what sore of precedent this would set to allow other landowners to split their properties. Some are also not convinced the property is outside the three mile zone for the City. Commissioners received a letter from local attorney, Mark Ward, who represents lake lot owners who oppose the vacation. Commissioners also are concerned for the lake itself, which is a main water source for the area. Increased septic systems will cause more contamination of the drinking water. Commissioners want to review the information given with Terry Graham and will discuss the matter more next Friday. After routine business, the meeting adjourned at 11:15 am.

October 18, 2004 Monday 9:00 am The Bourbon County Commission met in open session with Terry Graham and Gary Houston present. Joanne Long was also present. Minutes of the previous meeting were read and approved. Jason Silvers, reporter with the Fort Scott Tribune, was present. Clyde Killion gave a road report. Charlie Blevins met with commissioners to ask who is ultimately responsible for the sale of properties with delinquent property taxes. The Commissioners agreed that they were. Mr. Blevins asked the commissioners if they had anything he could help with for preparing the tax sale, he can help. Commissioners opened quotes for culvert pipe. Two were received. They were:
Terry Graham made a motion to accept the quote from Welborn Sales. Gary Houston seconded and both voted in favor. Joanne Long asked commissioners for an executive session to discuss non-elected personnel. Terry Graham moved to go into executive session, for a period of ten minutes, to discuss non-elected personnel. Gary Houston seconded and both voted in favor. Those present in the session were Graham, Houston, Joanne Long, and Kendell Mason. The session began at 9:22 am and ended at 9:32 am with no action. Laura Hyer discussed Emergency Preparedness. After routine business, the meeting adjourned at noon.

October 22, 2004 Friday 9:00 am The Bourbon County Commission met in open session with all commissioners and the county clerk present. Minutes of the previous meeting were read and approved. Jason Silvers, reporter with the Fort Scott Tribune, was present. Commissioners signed an excavation permit for Dorado Gas of Englewood Colorado. Commissioners spent much of the morning discussing oil prices. Terri Johnson reported that a settlement has been reached in the Dikeman matter. Commissioners authorized payment from the Road and Bridge fund. Mark Ward, Lee Lorimer, Frank Halsey, David Birk and Jim Sather met with commissioners to discuss the proposed vacation of a lot at Fort Scott Lake. All those present were against the proposal. After some discussion, Terry Graham made a motion to deny the request for vacation. Gary Houston seconded and all voted in favor. Reasons given were that once a lot is vacated, the County has no control over what is placed there because the County is not zoned, the extra septic tanks would be a danger to the water supply if/when they leak and that people who bought lots at the lake knew when they bought them that there was only one residence per lot and it wouldn’t be fair to change that. Tim Emerson reminded commissioners of the Candidate Forum next Tuesday at 5:30 pm at Buck Run. Laura Hyer spoke with commissioners about the need for an EOC (Emergency Operations Center). Though some areas were discussed, no final action was taken. After routine business, the meeting adjourned at noon.

October 25, 2004 Monday 9:00 am The Bourbon County Commission met in open session with all commissioners and the county clerk present. Minutes of the previous meeting were read and approved. Jason Silvers, reporter with the Fort Scott Tribune, was present. Laura Hyer discussed Emergency Preparedness. Charlie and Arlone Blevins met with commissioners and thanked them for the recent fence viewing. Fred Savage discussed the new sales tax laws regarding the sale of vehicles. He and the commissioners agree it is not a fair system. Mr. Savage also asked that a 235th St. north of Valley Road be worked on to remove large rocks in the bed and to have it filled with gravel. Don Russell met with commissioners to discuss the proposed tax abatement for Liberty Labels Limited. He was assured that the County is not against the abatement. Mr. Russell needs a letter to that effect. Wilma Graham spoke to commissioners about chip and seal. Commissioners said that if the weather holds, they will be able to finish. After routine business, the meeting adjourned at 12:20 pm.

October 29, 2004 Friday 9:00 am The Bourbon County Commission met in open session with Terry Graham and Gary Houston present. Joanne Long was also present. Minutes of the previous meeting were read and approved. Bills and payroll for the period were approved. Jason Silvers, reporter with the Fort Scott Tribune, was present. Clyde Killion gave a road report. Laura Hyer presented a resolution for approval. It was reviewed by the County Attorney. It will be transferred to resolution paper and considered Monday. Delbert Crays reported a bad culvert pipe. After routine business, the meeting adjourned at noon.
