October 1, 2004  Friday        9:00 am 

The Bourbon County Commission met in open session with Terry Graham and Gary Houston present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved. 

Clyde Killion reported on work assignments and road projects. 

Bills and payroll for the period were approved. 

Commissioners left the meeting at 9:25 am with Clyde Killion to view ditch cleaning projects and the landfill.  They returned at 11:10 am.

Laura Hyer and Doylene Kennedy separately reminded commissioners of emergency preparedness training at Fort Scott Community College in October. 

After routine business, the meeting adjourned at 12:10 pm.

October 4, 2004       Monday         9:20 am 

The Bourbon County Commission met in open session with Terry Graham and Gary Houston present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved. 

Jason Silvers, reporter with the Fort Scott Tribune, was present. 

Clyde Killion gave a road report. 

Commissioners discussed the change of address from Highway 54 to Locust Road east of Fort Scott to the state line, for the “old highway” now that it has been re-routed north of the former highway.  Commissioners asked if the Tribune could do a story on it.  Jason will see what he can do. 

Terry Graham made the motion to go into executive session, for a period of ten minutes, to discuss non-elected personnel.  Gary Houston seconded and both voted in favor.  Those present for the session were the commissioners, Clyde Killion and Joanne Long.  The session began at 9:25 am and ended at 9:35 am.  No action. 

Ann Ludlum and Delta George presented the commissioners with a gift basket of goodies and office supplies in honor of National 4-H Week.  They thanked the commissioners for all the County does for 4-H. 

They also presented the monthly progress reports from the Extension Council. 

Terry Graham made a motion to go into executive session, for a period of ten minutes, under the land acquisition exemption of the Open Meetings Act.  Gary Houston seconded and both voted in favor.  Those present for the session were the commissioners, Clyde Killion and Joanne Long.  The session began at 9:48 am and ended at 9:58 am with no action. 

Laura Hyer spoke with commissioners over concern over her expenses.  She has been driving a lot of miles and wondered if the county could purchase an inexpensive truck for her to drive around the county.  Commissioners explained the mileage allowance, how it provides for the actual expense of the fuel and wear and tear on a vehicle. 

Ms. Hyer also discussed dispatch locations and ODP funding for communications.

October 8, 2004         Friday            9:00 am

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.

Don Russell met with commissioners to discuss a proposed county tax abatement for Liberty Labels, Limited, a printing company out of Kansas City, Missouri, that recently purchased the John Deere building.  A hearing and analysis will be made to see if the company, which hopes to have 20 employees, will qualify for the abatement.

Jason Silvers, reporter with the Fort Scott Tribune, was present.

Mr. Russell also discussed with the commissioners a situation of overflow from the Industrial Park into a pond owned by Bob Hill.  In a gesture of being a "Good Neighbor", Bourbon County Economic Development Council (BEDCO) would like the County and City to pay for a replacement tube at the dam and BEDCO will pay to have the tube installed.  The required size is 72' of 36" tube.  After confirming with Clyde Killion that the County has said tube, the commissioners approved the request.  The County will bill the City of Fort Scott for one-half the price of the tube and bands.

Don Russell also commented on how appreciative the City was for Clyde's and the County road men's assistance on the Flood Mitigation Program.

Clyde Killion gave a road report.

Dona Bauer and Judy Orton met with commissioners to request that the Commission proclaim the week of October 10 through October 16 as "National FCE Week" in Fort Scott and Bourbon County.  Mrs. Bauer went over some of the volunteer efforts the FCE group assists with each year and thanked the commissioners for the County's support of the Extension Office, which handles FCE.  Commissioners signed the proclamation.

PROCLAMATION

WHEREAS, the family is the core of society; and

WHEREAS, the well-being of the family is dependent upon the development of the value system; and

WHEREAS, Kansas Association for Family and Community Education joins with the National Association for Family and Community Education in promoting National FCE Week with the campaign "Make a Date with Your Family."

WHEREAS, the dates that individuals have with their families will foster communication, love and understanding within each family and strengthen their communities.

NOW, THEREFORE, We, the County Commissioners of Bourbon County, Kansas, do hereby proclaim the second full week in October as:  "NATIONAL FCE WEEK" in Fort Scott, and urge all citizens to join FCE members to "Make a Date with Your Family."

Commissioners discussed the price of fuel in conjunction with asphalting projects.

David Neville presented commissioners with three quotes for turning the east courthouse walk into a ramp.  They were:

Marbery Concrete, Inc. $2,325.00
Rogert & Sons Concrete $2,855.00
Carl Hyer $3,250.00

Commissioners will review the information. 

Laura Hyer presented commissioners with two resolutions for consideration.  They are for Emergency Preparedness.  Commissioners will have them reviewed by the county attorney.

Commissioners signed the 5-year bridge plan.

Commissioners reviewed phone quotes for Noxious Weed to purchase 32 gallons of Tordon.  They were:

UAP/Timberland $79.95
Van Diest Supply $85.40
Vegetation Management $87.60

Commissioners approved the quote from UAP/Timberland, as it was the lowest.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Jason Silvers, reporter with the Fort Scott Tribune, was present. 

Laura Hyer asked commissioners to sign a letter recommending Laura Hyer be appointed to represent Bourbon County on the Rural Conservation and Development Council.  Commissioners signed the letter. 

At 9:45 am, commissioners left the meeting to perform a fence viewing in Scott Township.  Upon return, the commissioners discussed the fence viewing amongst themselves and Roger Lee and approved the following decision, with the stipulation that said decision in no way establishes property boundary lines, only fence responsibility/liability: 

        Blevins’ to be assigned the south 105.57’ and Nation’s are to be assigned the north 105.57’ of the fence dividing the aforementioned properties in Section 8, Township 26, Range 25, Scott Township, Bourbon County, Kansas.   

 Laura Hyer presented Resolution 19-04 for consideration.  The resolution lays out the guidelines for the Emergency Preparedness Office and Coordinator and officially appoints Ms. Hyer as Bourbon County Emergency Preparedness Coordinator.  Terry Graham made the motion to adopt Resolution 19-04.  Robert Query seconded and all voted in favor.

The Bourbon County Commission met in open session with Robert Query and Gary Houston present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.

Terri Johnson met with commissioners.  She approved the proposed resolutions for emergency preparedness. 

Ms. Johnson requested an executive session with commissioners to discuss attorney-client matters.  Gary Houston made a motion to go into executive session, for a period of ten minutes, under the Attorney-Client Privilege Exception to the Kansas Open Meetings Act.  Robert Query seconded and both voted in favor.  Those present for the session were Robert Query, Gary Houston, Terri Johnson and Joanne Long.  The session began at 9:05 am and ended at 9:15 am.  When the regular meeting resumed, commissioners authorized Ms. Johnson to make a counter-offer. 

At 10:00 am, a public hearing was opened to discuss the proposed lot vacation at Fort Scott Lake.  Those present were:  Larry Nuss, Mel and Stephanie Cummings, Paul Holman, John and Pat Scott, Jack Hembree and Mike Leachner.  Mr. Nuss, attorney for the Cummings’, spoke to commissioners about the proposed vacation.  He assured the commissioners that the property involved, though part of Fort Scott Lake, was outside the 3 mile zone for the City and therefore was County jurisdiction.  He explained that the last time a vacation like this was granted was at Redfield when Lyle Hixon split one property into several smaller properties.  K.S.A. 58-2613 is the governing statute that allows the commissioners to vacate lots.  Mr. Cummings stated that the proposed size of the new lots would be similar in size to lots in the City of Fort Scott.  Though the County would create the lots, the City restrictions necessitating self-contained septic systems would still be in place.  Mr. Cummings showed pictures of the area and described how he wanted to create a nice area with color and size restrictions on the houses.  He would also put in a fire hydrant if physically possible.  He said that his is a unique lake property and that it is currently the largest single lot.  He feels his improvements would result in major beautification of the lake.  Some of those who oppose the idea are concerned with increased traffic in the area on small lanes and what sore of precedent this would set to allow other landowners to split their properties.  Some are also not convinced the property is outside the three mile zone for the City. 

Commissioners received a letter from local attorney, Mark Ward, who represents lake lot owners who oppose the vacation.  Commissioners also are concerned for the lake itself, which is a main water source for the area.  Increased septic systems will cause more contamination of the drinking water.  Commissioners want to review the information given with Terry Graham and will discuss the matter more next Friday.

Charlie Blevins met with commissioners to ask who is ultimately responsible for the sale of properties with delinquent property taxes.  The Commissioners agreed that they were.  Mr. Blevins asked the commissioners if they had anything he could help with for preparing the tax sale, he can help.

October 22, 2004               Friday  9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Jason Silvers, reporter with the Fort Scott Tribune, was present. 

Commissioners signed an excavation permit for Dorado Gas of Englewood Colorado. 

Commissioners spent much of the morning discussing oil prices. 

Terri Johnson reported that a settlement has been reached in the Dikeman matter.  Commissioners authorized payment from the Road and Bridge fund. 

Mark Ward, Lee Lorimer, Frank Halsey, David Birk and Jim Sather met with commissioners to discuss the proposed vacation of a lot at Fort Scott Lake.  All those present were against the proposal.  After some discussion, Terry Graham made a motion to deny the request for vacation.  Gary Houston seconded and all voted in favor.  Reasons given were that once a lot is vacated, the County has no control over what is placed there because the County is not zoned, the extra septic tanks would be a danger to the water supply if/when they leak and that people who bought lots at the lake knew when they bought them that there was only one residence per lot and it wouldn’t be fair to change that. 

Tim Emerson reminded commissioners of the Candidate Forum next Tuesday at 5:30 pm at Buck Run. 

Laura Hyer spoke with commissioners about the need for an EOC (Emergency Operations Center).  Though some areas were discussed, no final action was taken.

Charlie and Arlone Blevins met with commissioners and thanked them for the recent fence viewing.  

Fred Savage discussed the new sales tax laws regarding the sale of vehicles.  He and the commissioners agree it is not a fair system. 

Mr. Savage also asked that a 235th St. north of Valley Road be worked on to remove large rocks in the bed and to have it filled with gravel. 

Don Russell met with commissioners to discuss the proposed tax abatement for Liberty Labels Limited.  He was assured that the County is not against the abatement.  Mr. Russell needs a letter to that effect. 

Wilma Graham spoke to commissioners about chip and seal.  Commissioners said that if the weather holds, they will be able to finish.
