November 1, 2004       Monday      9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Jason Silvers, reporter with the Fort Scott Tribune, was present. 

Clyde Killion gave a road report. 

Laura Hyer discussed Emergency Preparedness. 

Joe Watts, Western Land Services, spoke with commissioners about a possible gas lease on .15 acres of land owned by Bourbon County.  Commissioners asked Mr. Watts to draw up a contract for review by the county attorney. 

After routine business, the meeting adjourned at noon.

November 5, 2004     Friday  9:00 am 

The Bourbon County Commission met in open session with Terry Graham and Gary Houston present.  Minutes of the previous meeting were read and approved. 

Jason Silvers, reporter with the Fort Scott Tribune, was present. 

Clyde Killion gave a road report.  He also discussed chip and seal projects. 

Commissioners received the monthly progress report from the Extension Council. 

Commissioners discussed the value of a truck that was totaled last month. 

Joanne Long presented a bill that has been put in for payment from a County Employee for a local lunch with an associate.  She feels it should be denied for several reasons:  no County employee is ever reimbursed for a meal in Fort Scott; it is not County policy to pay for anyone else’s meals outside of the courthouse; and new tax laws require meals to be taxable if not on overnight trips.  Commissioners will review the information. 

David Wade reported a road problem at the intersection of Yale and 155th.  He needs it fixed immediately. 

Brent MacDougall, outgoing Osage Township Treasurer, presented the commissioners with the name of a replacement when his term ends at the end of the year.  Commissioners will consider the request. 

Laura Hyer reported on a workgroup meeting on communications held Thursday.  She said it is proceeding nicely and hopes to have weekly meetings.  Joanne Long asked Ms. Hyer to check with her for dates to use the commission room as it is used by other departments and she doesn’t want a scheduling conflict.  Ms. Hyer suggested a commissioner attend the meetings to keep informed.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.

Payroll for the period was approved. 

Commissioners denied payment to the voucher for a lunchtime meal between a county employee and an associate. 

At 9:30 am, the County Board of Canvassers was convened to finalize results and rule on Provisional ballots from the November 2, 2004, General Election.  County Election Officer Joanne Long and Deputy Ceceila Key presented the unofficial election results and 258 ballots for consideration.  In the end, 157 ballots were added to the Tuesday totals.  No races were changed by the additional votes.

November 12, 2004     Friday        9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Laura Hyer reported that her computer has a virus and is being repaired.  She also reported on a communications meeting she and several others attended in Iola earlier in the week.  She hopes the commissioners can attend similar training. 

Clyde Killion gave a road report.  The weather should be appropriate for chip and seal early next week so that the season can be finished. 

Don Russell presented landfill gate tickets that the County agreed would waive the County fees.  Commissioners confirmed that State tipping fees must still be paid.  The Public Works office will submit a bill to the City. 

Joanne Long asked commissioners if the County would be sponsoring a holiday dinner for employees this year.  After reviewing money taken in this year for pop commission, processing fees and other unexpected reimbursements, commissioners agreed to the dinner.  Joanne Long will make the arrangements.

Susan Quick reminded commissioners that the 2nd part of the tax sale starts at 10:00 am. 

Terry Graham left the meeting at 10:00 am.

November 15, 2004     Monday      9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved.

Clyde Killion gave a road update. 

Laura Hyer informed commissioners that she would be gone later this week to a Haz Mat symposium in Wichita.  She also informed commissioners that she is in the process of organizing a CERT team that includes area businesses.  She also would like someone from Bourbon County, perhaps David Neville, to attend training in Topeka this December.  This training would enable the attendee to become a trainer who could teach others. 

There will be a Multi-Hazard Crisis Management seminar at Fort Scott Community College February 23-24, 2005.  It will concern school plans.  Laura would like at least one county commissioner to attend. 

Joanne Long reminded the commissioners that there will be no commission meeting next week as the KAC annual conference will cover the Monday meeting and Thursday and Friday are county holidays due to Thanksgiving. 

Susan Quick, County Treasurer, reported on the most recent Tax Sale.  One of the properties was incorrectly advertised and therefore, the sale cannot be finalized.  Commissioners agreed to give the purchaser her money back, fix the legal description and sell it at the next sale.  It will actually have to be voided in District Court but shouldn’t be a problem.  The sale grossed approximately $20,000.  Ms. Quick announced that she hopes the 3rd part of the tax sale will be early spring next year.  At that point we should be able to have one per year. 

Robert Query left the meeting at 10:15 am. 

Ronnie Brown asked commissioners the status of the sanitary codes for Cedar Creek.  They are waiting for approval from KDHE. 

Terri Johnson responded to commissioners about the proposed gas lease.  Her only concern is that there is information on the lease under the commissioners’ signature lines.  She would prefer there be nothing under the signatures.  Joanne Long will relay that information. 

Commissioners reviewed the proposed Community Pool for employees to donate their unused leave to employees who may need it.  Commissioners asked Ms. Long to remove the ability to donate sick leave and they would approve the policy.  Ms. Long re-worked it and commissioners Graham and Houston signed the policy, which is an addendum to the Policy manual for County Employees. 

Doylene Kennedy spoke to commissioners about a problem with a utility company whose bill comes after cut-off and is due before the next pay period.  Subsequently, there is a late charge each month that is building up.  Both the Clerk’s Office and Public Works Office have tried to get the due date changed with no luck.  Gary Houston will speak to them.

Charlie Blevins spoke with commissioners about the tax sale.  He still feels that it’s taking too long and that many people are getting away with not paying their property taxes.  Commissioners said that the next tax sale will be next spring.

November 29, 2004     Monday      9:00 am 

The Bourbon County Commission met in open session with Robert Query and Gary Houston present.  Joanne Long was also present.

Clyde Killion gave a road report. 

Joanne Long reported on the Kansas Association of Counties (KAC) conference.  The bylaw amendment proposed by the commissioners passed, establishing the Legislative Policy Committee with 7 commissioners 1 sheriff, 1 treasurer, 1 county clerk, 1 register of deeds and 1 non-elected associate.  At the affiliate meetings Tuesday morning, the sheriff’s, treasurer’s and clerk’s association voted to withdraw membership from the KAC.  The register of deeds association couldn’t take any action because they didn’t have a quorum present.  They plan to meet in December to discuss the matter. 

Sharon Elder spoke with commissioners about her hotel bill from the conference.  Her cellular phone died so she made two phone calls from her room.  The charges add up to over $90.  The hotel did not charge her for the second night stay.  Commissioners want to wait until the final bill arrives before deciding anything. 

Wilma Graham spoke with commissioners about fire districts.  Fire District 3 wants to take over a small area that is currently covered by Fire District 4.  She is unsure why this is happening and doesn’t know what to do about it.   

Bills and payroll for the period were approved.
