July 2, 2004   Friday  9:00 am 

The Bourbon County Commission met in open session with Terry Graham and Gary Houston present.  Joanne Long was also present.  Minutes of the previous meeting were read and approved.

Clyde Killion gave a road report. 

Delwin Mumbower asked commissioners the status on the addition of Marion Township, Uniontown and Bronson to Fire District 3.  The 30 days from the publication is almost up and there has been no protest petition so everything is progressing as if it will go ahead as scheduled.  Next week we will adopt the final resolution.  We will discuss the matter with Terri Johnson for details. 

Commissioners received phone quotes for chemicals with Lee Davis.  30 Gal. Pastureguard from UAP/Timberland Van Diest both came in at $44.09 and N.R.S. didn’t quote.  Commissioners approved the purchase from Van Diest as the last purchase was from UAP. 

Sheriff Coleman asked the commissioners to increase Darrell Spencer’s salary by $500.00 per month to compensate for the additional duties he has taken on since the vacancy of a jail administrator.  This will put the salary in line with Linn and Allen Counties.  He would also like to discuss an increase in his own salary but will discuss that matter when he presents his budget request.  Terry Graham made the motion to increase the salary of the Director of Security by $500/month, effective July 1, 2004, to compensate for additional duties in the position.  Gary Houston seconded and both voted in favor. 

David Neville presented prices on lawn mowers.  He presented seven quotes.  They are as follows:

After some discussion, Terry Graham made a motion to purchase the MTD Yard Machine from Mayco Ace Hardware for the price of $1,399.00.  Gary Houston seconded and both voted in favor. 

Barbara Swearingen spoke to commissioners about an intersection at 230th & Kansas Road where a stop sign was recently removed.  She presented a drawing of the intersection and pointed out areas of low visibility and asked commissioners to reconsider the stop sign.  Commissioners will view the intersection today and get back with her before the next meeting. 

Mrs. Swearingen also asked commissioners to look into why their 1993 stock trailer is being taxed as an RV and is not exempt like others are in Bourbon County.  Commissioners will also look into that for her. 

Ann Ludlum presented the monthly progress reports for the Extension Council and a corrected 2005 budget request.  The dates were incorrect on the previous one. 

Terry Graham asked Ms. Ludlum about a vegetable garden that was sprayed with weed spray.  Ms. Ludlum encountered a similar situation a few years ago and was advised by K-State not to eat the vegetables. 

Bills and payroll for the period were approved. 

Terri Johnson reviewed the status of the fire district project.  She needs to review the law to see when the new boundaries take effect. 

Gene Cowan requested that Johnson grass be sprayed on 739 Eagle Rd, west.  Lee Davis will try to get to it next week. 

Commissioners left the meeting at 11:25 am to view the intersection of 230th & Kansas Rd.

July 9, 2004        Friday        9:00 am 

The Bourbon County Commission met in open session with all commissioners present.  Cecelia Key was also present.  Minutes of the previous meeting were read and approved. 

Clyde Killion gave a road report. 

Robert Query signed quarterly sales tax reports. 

Joanne Long, Susan Quick, Sharon Elder, Judy Orton, Terri Johnson and Harold Coleman met with commissioners to request that raises be built into the 2005 budget.  After much discussion, commissioners approved allotting $50.00 per employee per month in the budget requests and they will see what they can do. 

Gerald Beerbower discussed roof problems with commissioners. 

Dan Laughlin asked about thistle control.  Commissioners will check into it with the Noxious Weed Director. 

At 10:00 am, a public hearing was opened to discuss the proposed opening of a portion of road in Scott Township.  Those present for the hearing were the commissioners, Cecelia Key, Bob Davis and Pete Allen.  Mr. Davis has petitioned to have the portion of road opened so that his daughter can access lots she has purchased.  Mr. Allen has no interest in opening the road.  He owns property to the south of the proposed opening and has had to provide his own roads in Marco Estates before.  He feels that the County should not be providing roads for a developer.  Mr. Allen would not oppose the county opening the entire half mile of road, which would allow access to his lots.  Commissioners will have to discuss the matter with the county attorney.  No action at this time.  The public hearing closed at 10:35 am. 

Judy Orton presented the Appraiser’s 2005 budget request. 

Greg Schick spoke to the commissioners about cleaning up the area around the old county barn.  Mr. Schick owns property near there and is concerned about the appearance.  He would like a commitment from the commissioners that it will be torn down in a year.  Commissioners cannot promise that and informed Mr. Schick that the County doesn’t own all the property concerned.  Commissioners will look into the clean-up efforts. 

Joanne Long asked commissioners for a ruling on the new holiday on the weekend resolution that was passed in June.  An employee in the Sheriff’s office worked both Sunday, July 4th and Monday July 5th and feels he should be paid for both holidays.  Commissioners backed the resolution as written, which states that the holiday is the actual holiday for 24/7 departments, therefore the employee will only receive double-time for hours worked on Sunday, July 4th

Robert Query left the meeting at 11:45 am. 

Terry Graham made a motion to adopt Resolution 15-04, re-defining the boundaries of Fire District 3.  Robert Query seconded and all voted in favor. 

Commissioners discussed the clean-up at the old county barn.  Jason Sutterby of Ag Engineering in Uniontown will be sending the commissioners a letter about the guidelines for the clean-up.  Basically, the ash at and immediately around the fireplace will need to be removed in KDOT certified hazardous waste receptacles and the other dirt will have to be removed and tested before dumping.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Joanne Long presented the 2005 budget requests for County Clerk, Election, Commissioners and Coroner. 

Clyde Killion gave a road report. 

Laura Hyer requested an executive session to discuss land acquisition for LEPC.  Terry Graham made a motion to go into executive session, for a period of fifteen minutes, under the land acquisition exception of the Kansas Open Meetings Act.  Robert Query seconded and all voted in favor.  Those present for the session were the commissioners, Laura Hyer and Joanne Long.  The session began at 9:33 am and ended at 9:48 with no action. 

David Neville thanked the commissioners for the new lawn mower.  He also informed the commissioners that Laura Hyer is in need of keys to the courthouse.  Mr. Neville told her to get the keys from Ed French but Mr. French won’t relinquish them.  His last day is July 30th but he doesn’t do business in the courthouse so the commissioners asked Terry Graham to talk to Mr. French about turning in his keys. 

Mrs. Lloyd Wilson asked the commissioners about her dust control.  Terry Graham said that dry days are ahead so they should be getting to the list now.  He’ll make sure they’re on the list.  Mrs. Wilson also spoke about her road and culvert.

July 16, 2004            Friday  9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Clyde Killion and the commissioners went over the schedule for fair week to determine when the field needs grading before events. 

Commissioners received budget requests from the County Attorney, Noxious Weeds and the Bourbon County Fair. 

Joanne Long relayed a request from Kenneth Cochran for gravel on the entrance road to Maple Grove Cemetery. 

There will be a meeting in Chanute July 22nd concerning the 4-lane 69 Highway project north of US 54.  Clyde Killion and Gary Houston will attend for Bourbon County. 

Terry Graham mentioned that he hadn’t had the opportunity to ask Ed French about his keys yet. 

Bills and Payroll for the period were approved. 

Susan Quick presented the Treasurer’s budget request for 2005.  She emphasized that employee raises shouldn’t be the last thing the commissioners considered when preparing the budget. 

Ms. Quick mentioned that a second tax sale will be held in the upcoming months. 

Sharon Elder presented the Register of Deeds budget request. 

Harold Coleman presented the Sheriff’s budget request and said he will present the Correctional Center budget on Monday. 

Bob Davis met again with commissioners for the progress on his petition to open a stretch of road in Scott Township.  Commissioners have asked the county attorney to view the information but she has not had the opportunity at this time.  Mr. Davis said he is getting material quotes in preparation to build the house on the property within a year. 

Lynn Smith presented the Computer budget request. 

Laura Hyer presented the Emergency Preparedness budget request.

July 19, 2004            Monday         9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Ed French returned his courthouse keys. 

Clyde Killion gave a road report. 

Lee Davis presented phone quotes for 100 gallons of generic Glyphosate.  Three were received.  They were:  UAP/Timberland $14.50, Van Diest $13.89, and Ag Choice $15.00.  Commissioners approved the Van Diest quote, as it was the lowest. 

Laura Hyer spoke to commissioners about emergency preparedness.  She has been given office space in the basement that was occupied by the Sheriff’s Department.  She will re-locate her communications equipment there for security.  Fire District 3 officials will construct a desk and a cabinet to hold monitors for the proposed courthouse security.  She also mentioned that she has applied for a user’s fee for the KDOT tower at Xenia.  If approved, communication problems should be alleviated.  

Mike Norris delivered a quote for an air conditioner in the Register of Deeds office.  Other quotes are expected. 

Terri Johnson met with commissioners at their request to review the documentation in the proposed road opening in Scott Township.  She will research the data and get back with commissioners. 

Ms. Johnson also spoke briefly with commissioners about the salary of her assistant county attorney.  She would like an increase in the salary or she will lose her.

July 23, 2004      Friday        9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Clyde Killion gave a road report. 

Commissioners discussed the new sales tax policy on cars.  The state sets the value of all vehicles based on class and you have to pay sales tax on the value, rather than what you pay for the car.  They feel it is very unfair, because it doesn’t take into effect the condition of the vehicle. 

Robert Query signed the permits needed to begin the hazardous waste removal of ash at the old county barn.  Treated wood and destroyed marijuana crops have raised arsenic levels in the ash and must be removed according to KDHE standards.  The removal will begin next Thursday. 

Robin Hixson, reporter with the Fort Scott Tribune, was present. 

Bob Davis and Connie Sue Wollenhaupt asked the commissioners for an update on their request to open part of a road in Scott Township.  The commissioners have not heard from the county attorney.  Terri Johnson reported that she has asked the Kansas Association of Counties for their input on the matter and have not heard back from them, but expect to hear something to report Monday. 

Commissioners discussed the rising cost of health care for prisoners.  They asked the clerk to review alternatives. 

Commissioners approved a $5,000 bond for an excavation permit. 

Sheriff Coleman presented the Correctional Center budget request.  He would also like to see additional raises for the Business Administrator and Programs Director in the amount of $150 per month and $50 per month for the 3 Correctional Officer Supervisors.  For himself, he would like to be more compatible to the sheriffs in Linn, Allen and Cherokee Counties. 

Sheriff Coleman also discussed the possibility of having a Spanish teacher from Linn County come down to teach Spanish basics to courthouse employees. 

David Neville presented quotes for air conditioners in the computer room, the treasurer’s office and the register of deeds office.  No action at this time. 

Terry Sercer went over the first draft of the County budget with commissioners.  He would like the commissioners to make changes as they like and he will update the copy.  Mr. Sercer will be back Monday at 11:00 for further discussions.

July 26, 2004            Monday         9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Bob and Erma Davis met with commissioners for an update.  Terri Johnson explained her view of the documentation as that the road was vacated and therefore the county has no interest in the road.  The center road through the section was platted but never accepted by the county.  She feels the original minutes are too broad in their statement.  Since there was never any work done, there will need to be an easement from the landowner.  The commissioners asked Sharon Elder to look if the property was ever deeded over to the county.  Ms. Elder reported back that she didn’t find anything but she will pull the deeds from the beginning to see if there was ever mention of a road. 

Terri Johnson again asked the commissioners to consider raising the salary of the assistant county attorney to $30,000 annually. 

Commissioners discussed expenditures of Fire District 3 in how they relate to the funds being appropriated to Fire District 5.  Mr. Banwart feels that he’s being shorted.  Commissioners asked the clerk to get a breakdown of expenditures from the District. 

Commissioners received a check for bridge guardrail repair due to an accident.  Commissioners want more estimates before repair begins. 

Terry Sercer met with commissioners for a budget work session. 

Raymond Taylor requested gravel. 

Delwin Mumbower popped in to present the figures requested earlier.  Commissioners thanked Fire District 3 and Fire District 5 for help with water at the Bourbon County Fair last week. 

Terry Graham left the meeting at 12:20 pm and the meeting adjourned at 12:30 pm.

July 30, 2004      Friday        9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present. 

Don Russell told commissioners that Larry Nuss would be in this morning for commissioners to sign a lien release for Twister Trailer.  Since the Millennium Industries sale fell through, the lien must be released. 

Mr. Russell also spoke with commissioners about sanitation codes at Lake Fort Scott. 

Bills and Payroll for the period were approved. 

Clyde Killion gave a road update. 

Sharon Elder spoke with commissioners about Mr. Davis’s road opening.  As the closing was never recorded, it is causing some concerns. 

Commissioners signed an excavation permit for Hendricks Enterprise in the amount of $5,000. 

Terri Johnson also discussed the Davis property.  She feels that if the property is deeded to Mr. Davis before the vacation is filed, it should work.  Commissioners asked Mr. Davis to talk to Mrs. Johnson before filing his deed to be sure. 

Ms. Johnson asked commissioners for an executive session to discuss the Dikeman case.  Terry Graham made a motion to go into executive session, for a period of ten minutes, under the attorney-client privilege exception of the open meetings act.  Robert Query seconded the motion and all voted in favor.  Those present for the session were the commissioners, the county clerk and the county attorney.  The session began at 10:30 am and the regular meeting resumed at 10:40.  The commissioners authorized the county attorney to write a letter to Charles Gentry. 

Laura Hyer discussed emergency preparedness issues. 

Larry Nuss presented a lien release for Twister Trailer.  Robert Query signed it. 

Terry Sercer came for budget discussion with the new draft of the county budget.  After some further cuts, commissioners approved publication of the budget with a 2.000 mill decrease and $26,488 tax decrease over 2004.  Commissioners were pleased and felt the department heads presented very good budgets.
