September 6, 2002   Friday          9:00 am 

The Bourbon County Commission met with Terry Graham and Robert Query present.  Gary Houston arrived at 9:10 am.  Joanne Long was also present.  Minutes of the previous meeting were read and approved. 

Clyde Killion reported that the asphalt season is done.  There was discussion of having work orders for shop assignments. 

Joanne Long presented a resolution to the commissioners.  It is for Patriot Day, September 11, 2002.  It states that the county will fly the flag at half-staff on Wednesday and asks that all citizens of Bourbon County participate in a moment of silence Wednesday, in observance of the one year anniversary of September 11, 2001.  Robert Query made a motion to adopt the resolution as 19-02.  Gary Houston seconded and all voted in favor. 

Terry Graham discussed the rural fire meeting he attended last night.  He announced that the Fort Scott rural station will receive two votes now, to cover the north and south stations. 

Joanne Long reminded the commissioners that Airport Days is tomorrow and asked who would be notifying the public about Indian Road being closed for aerial maneuvers.  The commissioners called Dean Mann. 

There was discussion of the upcoming demolition of the old Mercy Hospital building.  The commissioners think it would be best to bond the demolition company for the loads they will dump at our transfer station, as there is no way to recoup funds by special assessment if we allow them to charge and they don’t pay before leaving town.  As there will be over $100,000 in dump fees, this is for the county’s security.  No action at this time. 

The commissioners received the monthly progress reports from the Extension Council. 

David Neville asked the commissioners what they wanted to do with the 110 air conditioner unit that was removed from the Jury Room.  The commissioners instructed Mr. Neville to place it in storage. 

Robert Query left the meeting at 10:00 am. 

Terry Graham, Gary Houston and Joanne Long toured the Downtowner at 10:00 am with Charles Parsons.  Mr. Parsons would like to supply rooms for the work release prisoners and stated that 12 rooms of the old hotel would be designated for work release.  He said that 10 of the rooms would be for sleeping, one for an office and another for a common area.  He would like a 3 or 5 yr lease and would pay everything but electric and insurance on the building.  He quoted the price of $20 per day per room.  The commissioners thanked Mr. Parsons for the tour and reminded him that no decisions have been made to house work release prisoners off site as of yet, but assured him they would keep the offer in mind. 

Raymond Taylor spoke to the commissioners about a ditch project.  He notified the commissioners that the fence is out and that it was okay for the grader to return to the area. 

The commissioners approved drawdown #6 from the Tri-Valley Grant. 

The commissioners discussed the request from the City of Fort Scott for matching funds to purchase a truck for emergencies.  The commissioners need more information on the request. 

Joanne Long notified the commissioners of a report from Infinitec on a meeting with Barb Ferguson.  The commissioners also received the report.  Ms. Long suggested Zack Reynolds look at the report, as he wrote the contracts for Kohl Software and Infinitec for Bourbon County.  The commissioners agreed. 

Wayne Thorpe spoke to the commissioners about 18th Street.  He feels something needs to be done to the hill and/or road to prevent further accidents.  The commissioners informed Mr. Thorpe that the county will be blading asphalt into the gravel over the hill to smooth the road.

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Clyde Killion discussed road projects with the commissioners. 

At 10:30 am, Terry Graham and Clyde Killion left the meeting to view a dump site north of Fort Scott and roads on the west side of Fort Scott Lake. 

Also at 10:30 am, Robert Query and Gary Houston left the meeting to view progress at the south end of Elm Creek Lake and the benefit district on 240th Street. 

At 11:40 am, all commissioners returned and discussed what they viewed. 

Commissioners approved payment of a bill for the Sheriff’s Department. 

After routine business, the meeting adjourned at 12:20 pm.

September 13, 2002        Friday       9:00 am 

The Bourbon County Commission met in open session with Robert Query and Gary Houston present.  Terry Graham was absent.  Joanne Long was also present.  Minutes of the previous meeting were read and approved. 

Clyde Killion discussed an OSHA inspection at the rock quarry that took place on Thursday.  

The commissioners spoke to Mr. Killion about the stretch of road from 240th St. to Charles Street.  It is in terrible shape.  They suggest that since the road crew is in the area working on a benefit district, they fix that portion of road at that time. 

Sheriff Coleman and Clyde Killion discussed an abandoned truck near Redfield that was left in the middle of the road. 

The commissioners approved bills and payroll for the period. 

At 10:05 am, Robert and Gary left the meeting to view Osage Road problems and a possible dump route for Mercy demolition.

September 16, 2002        Monday 9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Marty Messer reported to the commissioners that a log jam under the bridge east of Fulton were set on fire Friday and the fire burned most of the day.  He is concerned for the structural safety of the bridge due to the heat from the fire.  The commissioners will inspect the bridge. 

Elaine Shroyer, County Health Nurse, presented the commissioners with the Bio-Terrorism Plan for Bourbon County for approval.  Approval of this plan will help in obtaining federal and/or state funds for the Health Department.  The commissioners and the county attorney will review the plan.  Ms. Shroyer stated that the plan must be turned into the state at the end of the month. 

Clyde Killion and Gary Houston left the meeting at 9:35 am to inspect the bridge east of Fulton. 

Terry Graham left the meeting at 9:50 am to look at an intersection near Redfield. 

The meeting resumed at 11:30 am when all commissioners returned. 

Bob Schweikert discussed a dust problem at his home.  No action. 

Susan Quick presented the commissioners with the latest sales tax income for the Road & Bridge Sales Tax Fund.

September 20, 2002        Friday       9:00 am 

The Bourbon County Commission met in open session with all commissioners present.  Cecelia Key was also present.  Minutes of the previous meeting were read and approved. 

Clyde Killion presented a road update. 

Cecelia Key reminded the commissioners that the ambulance contract expires at the end of September. 

Roger Lee discussed holding tank problems. 

Terri Johnson asked the commissioners to sign a proclamation, making October Domestic Violence Awareness month in Bourbon County.  Robert Query made a motion to pass a proclamation making October Domestic Violence Awareness month in Bourbon County.  Terry Graham seconded the motion and all voted in favor. 

The commissioners also discussed the jail overcrowding situation with Ms. Johnson. 

Ed French presented the Cedar Creek emergency plan to the commissioners.  The commissioners signed the plan. 

At 9:45 am, Robert Query and Clyde Killion left the meeting to view the progress of the benefit district on 240th St. 

Delwin Mumbower discussed rural fire department procedures. 

Terry Graham made a motion to enter into an agreement with the City of Fort Scott, to pay matching funds of $4,500.00, towards the purchase of an emergency vehicle for city and county use.  Gary Houston seconded the motion.  All voted in favor. 

Robert Query returned to the meeting at 10:25 am. 

Karen Paddock asked the commissioners about funding for mental health.  The commissioners referred Ms. Paddock to speak to the county attorney. 

Jeff Davis, Fort Scott Fire Department Chief, discussed 1st Response procedures between Fort Scott and the rural fire departments.  Delwin Mumbower was also present for this discussion and offered input as to rural procedures. 

Wayne Thorpe asked the commissioners for gravel on Slick Rock Road.  The commissioners will notify Clyde Killion of the need. 

Robert Query left the meeting at 11:40 am. 

The commissioners signed a local contingency plan for dam and reservoir emergencies.

September 23, 2002        Monday     9:00 am 

The Bourbon County Commission met in open session with all commissioners present.  Cecelia Key was also present.  Minutes of the previous meeting were read and approved.  

Clyde Killion updated the commissioners on road repairs. 

Tim Pearson met with the commissioners to inquire about the procedures for calls for tow trucks from the dispatch center.  Sheriff Coleman, who was present for the conversation, stated that there is a “wrecker of the day” to give each wrecker service equal use, and they call the wrecker of the day unless someone requests a specific company. 

Steven Orenstein of Kiernan Companies spoke with the commissioners about health insurance.  The commissioners authorized Mr. Orenstein to do preliminary research to get an idea of the cost of health insurance for Bourbon County. 

Robert Query left the meeting at 11:20 am to help set up for the Pioneer Harvest Fiesta.

The commissioners asked the clerk to fax a written request for financial statements to Mercy Health Center.

September 27, 2002        Friday       9:00 am 

The Bourbon County Commission met in open session with Gary Houston and Terry Graham present.  Joanne Long was also present.  Robert Query was absent.  Minutes of the previous meeting were read and approved. 

Clyde Killion notified the commissioners that the oil truck is out of commission.  The commissioners authorized Clyde to put a State Surplus truck on hold.  Mr. Killion also stated that the road crew is finishing patch work. 

Terri Johnson notified the commissioners that October 4, 2002, there will be a Domestic Violence Awareness Rally at noon on the courthouse steps.  She asked if it was okay for the offices to participate in the rally.  The commissioners approved the request. 

Alec Beth presented the commissioners with preliminary cost estimates for housing work release prisoners off-sight.  It would cost approximately $100,000 annually and would require an additional vehicle for the Correctional Center.  The commissioners thanked Mr. Beth for the figures.  The commissioners will speak with Ralph Carlson about the boys home. 

Jack Hembree spoke with the commissioners about paying for the overlay of the cul-de-sac at Fort Scott Lake.  The commissioners are not ready for payments.  Mr. Graham stated that he gave the lot owners until October 7, 2002, to notify the county if they were interested in participating.  Lois Coyan also mentioned that bookkeeping would be better served if payments were not made yet.  Mr. Graham also stated that if some lot owners do not participate, the money will have to be made up by someone else.  Mr. Hembree disagreed, stating that he’s a taxpayer.  Mr. Graham stated that the cul-de-sac is a private drive.  Ms. Coyan also stated that sales tax may have to be added to the cost per lot owner. 

Terry Henning requested funds for repairs to the roof of the Fulton Community Building.  The commissioners informed Mr. Henning that there were no funds at this time. 

Gary Houston made a motion to go into executive session for a period of five minutes to discuss non-elected personnel.  Terry Graham seconded and both voted in favor.  Those present for the session were Commissioners Graham and Houston and Joanne Long.  The executive session lasted from 10:30 to 10:35 am.  The regular meeting resumed at 10:35 am with no action. 

Joanne Long informed the commissioners that she has not received any of the requested information from Mercy for the Ambulance contract. 

Don Banwart spoke to the commissioners about Rural Fire issues.

September 30, 2002        Monday        9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meeting were read and approved. 

Clyde Killion met with the commissioners to discuss road projects and the broken oil truck.  Mr. Killion also notified the commissioners of an accident involving a road grader that occurred on Friday. 

Robert Query contacted Heckert Construction concerning our broken oil truck.  Heckert offered to loan us an oil truck, temporarily, at no cost. 

Douglas Thompson asked the commissioners to do something about a patch of Johnson grass on Osage Road near his property.  The commissioners will have Lee Davis spray it. 

The commissioners called State Surplus Property on the 1987 oil truck they put on hold Friday.  After looking at budgets, the commissioners approved the purchase from State Surplus Property.   

Robert Query notified Heckert Construction that we will not need the oil truck they agreed to lend us. 

Wilma Graham met with the commissioners to ask when the county would be chip and sealing the roads in Redfield.  The commissioners notified Ms. Graham of the delay due to the oil truck, and said that they should be in Redfield in about a week, weather permitting.  They stated that Fulton was ahead of Redfield on the schedule. 

Ms. Graham also notified the commissioners of vandalism over the weekend.  Stop signs and road/street signs were destroyed.  The commissioners notified Clyde Killion. 

The commissioners approved payroll for the period. 

Accounts payable was not ready as the clerk’s office was waiting for a final bill to finish out a grant.  After a delay, accounts payable was approved without the bill for the grant. 

Robert Query stated that the Pioneer Harvest Fiesta thanked the commissioners for the use of Robert Query last Friday for preparation and demonstrations at the Fiesta. 

The remainder of the meeting was spent discussing the ambulance contract.  No action. 

After routine business, the meeting adjourned at noon.
