October 4, 2002        Friday       9:00 am 

The Bourbon County Commission met in open session with all commissioners present.  Danielle Wells was also present.  Minutes of the previous meeting were read and approved. 

The commissioners received the monthly progress report from the Extension Office. 

Delwin Mumbower of Fire District 3 spoke to the commissioners about the Fire District. 

Commissioners signed Draw Down #7 for the Tri-Valley Grant. 

Terry Graham left the meeting at 10:27 am with Clyde Killion to view an accident scene with an insurance adjuster. 

Troy Arnold asked the progress on 240th St.  Robert Query and Gary Houston left the meeting at 11:14 am to view the 240th St. Benefit District.  Commissioners Query and Houston returned to the meeting at 11:38 am. 

Danielle Wells informed the commissioners of two errors on the last paycheck for employees of the Correctional Center.  The commissioners approved the cutting of two checks immediately to correct the error. 

Lee Davis reported mechanical problems with the Weed Truck.  The commissioners asked Mr. Davis to check prices for repairs. 

The meeting adjourned at 11:50 for the commissioners to attend the Domestic Violence Awareness Rally on the Courthouse steps at noon.

October 7, 2002          Monday        9:00 am 

The Bourbon County Commission met in open session with all commissioners present.  Danielle Wells was also present.  Minutes of the previous meeting were read and approved. 

Roger Lee discussed septic problems. 

Clyde Killion gave a road update. 

Lois Coyan reported on who has responded to the letter regarding chip & seal at Fort Scott Lake. 

Lee Davis informed the commissioners on repairs for the weed truck.  Gary Houston made a motion to have the work completed by Diesel and Turbo of Iola.  Robert Query seconded the motion and all approved. 

A grader man will be off work for 6 weeks undergoing surgery.  Robert Query made a motion that we hire Jim Henning to cover during the time off.  Gary Houston seconded and all approved. 

Dean McFarland with Kirkpatrick Pettis introduced himself to the commissioners.  He would like to be considered for financing for any jail construction. 

Joanne Long reported that information on the State Health Insurance Program is available.  She is planning to request a packet today. 

Delwin Mumbower discussed EMT Service with the commissioners. 

Commissioners received a phone call from Sam Mason, asking the commissioners to appoint Janet Braun to the Mental Health Board.  Terry Graham made a motion to appoint Janet Braun to the SEK Mental Health Board.  Gary Houston seconded and all voted in favor.

October 11, 2002         Friday       9:00 am 

The Bourbon County Commission met in open session with Robert Query and Gary Houston present.  Joanne Long was also present.  

The commissioners discussed a problem with the roof over the correctional center. 

Clyde Killion gave the commissioners a road update. 

Don Danley of Mapleton asked the commissioners if he could purchase a pipe for his property near Bronson.  The commissioners informed Mr. Danley that the county only sells pipe to private individuals if Judy’s doesn’t stock it.  The pipe Mr. Danley is asking to purchase is 36” pipe, which Judy’s does not carry.  The county will sell the pipe to Mr. Danley. 

Joanne Long asked the commissioners about a letter from David George about preserving section corners.  The commissioners stated they never saw such a letter.  Mr. Houston will call and speak to Mr. George. 

Alec Beth reported that an architect would be meeting with the commissioners to consult on any jail construction.  

Robert Query asked Mr. Beth about the kitchen area in the existing correctional center.  As it is not large enough to prepare meals, it is a storage facility for breakfast foods and a prep area for breakfasts and bag lunches.  Mr. Query asked if the kitchen could be converted into sleeping areas to alleviate some of the over-crowding.  Mr. Beth stated that it is not suitable from a security standpoint. 

Terri Johnson reminded the commissioners of Elders and the Law in District Court this morning.  The commissioners are planning to attend. 

Gerald Beerbower spoke to the commissioners about the roof over the correctional center.  He stated he needs a plumber to remove a pipe that has sunk into the roof before he can fix it.  He stated that support brackets were not made at the county barn to hold the pipe off the rooftop and now the pipe has damaged the roof. 

Gary Houston viewed the roof damage with Alec Beth and Gerald Beerbower.  Mr. Houston reported that the roof damage was not caused by the pipe the support brackets were supposed to support, but by another pipe altogether.  The commissioners approved plumbing repairs by Brandon Malone. 

At 10:10 am, the commissioners went to the District Court to participate in Elders and the Law Day.  They returned at 10:50 am. 

At 10:55 am, Robert Query left the meeting to view 240th St.  The meeting adjourned due to lack of quorum.

October 14, 2002          Monday        9:00 am 

The Bourbon County Commission met in open session with all commissioners and the county clerk present.  Minutes of the previous meetings were read and approved. 

Robert Query discussed his working with the road crew last Friday afternoon.  He feels that Clyde Killion needs a back-up supervisor to help with problems that Clyde can’t get to because he’s doing other things on the other end of the county.  No action. 

Gerald Beerbower presented a bill for roof repairs and gave the commissioners a roofing update. 

Bills and payroll for the period were approved. 

Terry Graham and Robert Query left the meeting at 9:40 am to conduct a fence viewing. 

Commissioners Graham and Query returned to the meeting at 10:35 am.  The commissioners made the following decision regarding the property line between Larry Martin and Tom Mason: 

          The west ½ of the fence line along the north border of the

          SW ¼ of Section 10, Township 25, Range 23 will be assigned

          to Larry Martin.  The east ½ of the fence line along the north

          border of the SW ¼ of Section 10, Township 25, Range 23 will

          be assessed to Thomas Mason.

This decision of fence was made on October 14, 2002, and filed with the Register of Deeds office. 

Commissioners received a contract from Diehl, Banwart, Bolton, Jarred & Bledsoe for auditing and budgeting services.  No action. 

Commissioners discussed a county employees residency status.  Commissioners discussed the situation with County Attorney, Terri Johnson.  Commissioners will have the employee sign an affidavit stating he lives in Bourbon County.

The Bourbon County Commission met in open session with Robert Query and Terry Graham present.  Gary Houston arrived at 9:10 am.  Cecelia Key was also present.  Minutes of the previous meeting were read and approved. 

Ed French, Emergency Preparedness Coordinator, spoke to the commissioners about the importance of attending the Emergency Preparedness meetings. 

Terri Johnson and the commissioners discussed the State Health Insurance information. 

Steve Davis & Rick Freeman, HMN Architects from Overland Park, discussed the possible expansion of the correctional center and the most feasible way to expand it.  No action. 

Robert Query left the meeting at 11:35 am to inspect construction on 240th and Charles St.

October 21, 2002         Monday     9:00 am 

The Board of County Commissioners of Bourbon County, Kansas, met in open session with all commissioners and the County Clerk present.  Minutes of the previous meeting were approved. 

David Neville spoke with the commissioners to get updated on the roof repairs. 

Robert Query stated that he would not be here Friday. 

Clyde Killion reported on the stands, oiling of 240th Street and chip and seal projects. 

The commissioners looked into information that catfish at Cedar Creek Reservoir were dead.  After talking with Jingles Endicott, the commissioners learned that the lake turned over and the new fish did not adapt to the lower oxygenated top water, but that the existing fish followed the “good” water down.  Don George is aware of it and didn’t put in two loads of fish for that reason.  The water isn’t contaminated. 

Larry Davenport, Birk-Sather-Davenport Financial Services, spoke to the commissioners about Deferred Compensation and investment opportunities for employees.  Mr. Davenport will meet again with the commissioners regarding the County’s Section 125 Plan. 

Robert Query left the meeting at 10:55 am to view 240th St. 

Susan Quick informed the commissioners that the Special City/County Highway Sharing money arrived in the amount of $136,753.20.

October 25, 2002   Friday          9:00 am 

The Bourbon County Commission met in open session with Gary Houston and Terry Graham present.  Cecelia Key was also present.  Minutes of the previous meeting were read and corrected. 

Clyde Killion updated the commissioners on road repairs. 

Sheriff Coleman asked the commissioners if the county would be providing flu shots this year for county employees.  The commissioners said the county would provide flu shots to all county employees and all courthouse employees. 

Larry Davenport met with the commissioners to explain the Security Benefit Flex 125 plan. 

Kevin “Skitch” Allen spoke to the commissioners about a problem he is having with getting a water hook-up for his property.  No action. 

David Mullies and John Jackson met with the commissioners regarding a property line dispute between Lewis Allen and Terry Henning.  There is an old road that is the only access to part of Mr. Allen’s property that Mr. Henning has erected a gate across, denying access.  Commissioners determined that the road is an open road and must not be blocked.  The commissioners will speak with Mr. Henning about removing his gate. 

Tom Hill spoke to the commissioners about the county’s oil business.  No action. 

Alec Beth updated the commissioners on the roof repairs. 

David Neville spoke to the commissioners about costs for a fire alarm inspection.  Commissioners directed Mr. Neville to inquire what is involved in the larger price before deciding on a plan.

October 28, 2002         Monday     9:00 am 

The Bourbon County Commission met in open session with Terry Graham and Robert Query present.  Cecelia Key was also present. 

Ed French informed the commissioners of a legal authority meeting in Wichita on December 6, 2002.  This meeting is for emergency management personnel.  He recommends that at least one commissioner attend. 

Leon Fry inquired as to when the county would chip & seal the road north of Hiattville.  The commissioners explained the schedule for chip & seal projects. 

Patty West, Atkins Insurance Agency, discussed loss control with the commissioners.  She explained how the county can upgrade the control loss program.  The county has until April 1, 2003 to comply to these recommendations.  Ms. West asked the commissioners to write a letter expressing the county’s intent to comply. 

Lynn Smith asked the commissioners about combining the service agreement on computer maintenance.  The 2003 cost is $7,500.  Commissioner Query signed the agreement, which takes effect January 1, 2003.
