March 1, 2002          Friday            9:00 am 

The Board of County Commissioners of Bourbon County, Kansas, met in open session with all commissioners present.  Joanne Long, County Clerk was also present.  Minutes of the previous meeting were read and corrected. 

Clyde Killion spoke to the commissioners about road assignments, the clean-up efforts following the ice storm, and personnel matters.  The commissioners would like Mr. Killion to hire some part-time help to aide in the clean-up efforts. 

There was brief discussion of Memory Gardens Cemetery. 

Sheriff Coleman spoke to the commissioners about the county coroner position.  There is an EMT who is showing interest in the job.  No action. 

Treasurer, Susan Quick, updated the commissioners on the sales tax revenues.  When asked how the new computer programs are working, Ms. Quick indicated that things are getting better. 

Charlie Blevins reported a bad patch of road on Margrave St.  The commissioners directed Mr. Blevins to the City, as it is in the Fort Scott city limits. 

There was discussion of Ironwood Road.  It is on the blacktop schedule for this summer. 

The commissioners discussed the Assistant County Attorney salary.  They agreed that as long as it was in the budget, they would approve of raising it to $26,000.00 annually for a full time position.

The Bourbon County Commission met in open session with Gary Houston and Robert Query present.  Joanne Long was also present.  Minutes of the previous meeting were read and corrected. 

The commissioners received a copy of a letter drafted by the County Attorney’s office to the Railroad, as requested.  The original has been faxed. 

Robert Query allotted $400.00 for upkeep of the Garland Park.  The funds will be from the Special Parks and Recreation Fund. 

The commissioners asked Terri Johnson to review a proposal from Heckart Construction Company for laying asphalt this summer.  She felt the proposal was fine as written.  The commissioners delayed signing it until Terry Graham was present. 

The commissioners spoke to Assistant County Attorney, Valorie Leblanc, about mandatory overtime.  She indicated she would look up the law and get back to the commissioners.  After researching, she reported that as long as the work isn’t discriminatory, is for legitimate reasons and the appropriate pay (1 ½ times regular pay) is compensated, mandatory overtime is legal.

March 8, 2002        Friday        9:00am 

The Bourbon County Commission met in open session with all commissioners present.  County Clerk, Joanne Long, was also present.  Minutes of the previous meeting were read and approved. 

Ruth Hillman, Anna Mae Cobler and Marie Stark spoke to the commissioners about the lack of a Senior Citizen Community Center.  They have spoken to the City of Fort Scott about Buck Run Community Center and the city advised them to speak to the county commissioners.  The ladies spoke about how many small cities in the area have a place for senior citizens to meet, play cards, walk, and have social functions, but Fort Scott does not.  They would like that changed.  The commissioners spoke of possible ways to get a building through grants or with tax dollars and agreed to speak to the City Commission about this problem and get back to them. 

Jim Harris, Berry Tractor, met with the commissioners with proposals for the purchase of motor graders.  They were:

2- 830 Galion  5-yr/7,000 hr warranty $146,830 at 4.5% int. *
2- Komat’su GD555  5-yr/7,000 hr warranty  $223,100 at 4.5% int. *

Mr. Harris stated that all graders were in stock and could be delivered within 30 days.  No action. 

Gary Houston signed a 30-day explosion agreement with American East Explosives. 

Dennis Brown, Welborne Sales, spoke to the commissioners about culverts. 

The commissioners received the monthly progress report from the Extension Office. 

The commissioners agreed to the asphalt proposal from Heckart Construction, and Gary Houston signed the agreement and it was faxed to the company. 

The commissioners received several letters of support from citizens regarding the commissioner’s decision to ban nude dancing. 

Clyde Killion discussed road assignments. 

The commissioners received requests from the City of Redfield and the City of Fulton for assistance with chip and seal work this summer. 

Commissioners discussed the 1988 GMC diesel bucket truck available through State Surplus Property.  We put a hold on it earlier and it is now available to us.  Clyde Killion will view it next week and was given the authority to purchase it if it is a good deal. 

Richard Johnson, Martin Tractor, presented proposals for the purchase of two motor graders as follows:

2- 12H Cat 5 yr/5,000 hr warranty $275,156 at 4.4% int.*
2- 120H Cat 5 yr/5,000 hr warranty $226,670 at 4.4% int.*

                                 * Price after trade-ins and government discounts. 

Mr. Johnson also discussed the option of a 5-yr/7,500 hr warranty.  No action.

March 11, 2002        Monday     9:00 am 

The Bourbon County Commission met in open session with Terry Graham and Robert Query present.  Gary Houston arrived at 9:10 am.  Minutes of the previous meeting were read and corrected. 

The commissioners spoke to Clyde Killion about the proposals on road graders, which were received on Friday.  No action. 

Robert Query discussed boom truck prices.  He learned this weekend that trucks with a longer reach could be purchased for around the price being asked for the 28’ truck from State Surplus Property.  We will keep our hold on the State truck but will inquire into others through magazines. 

The commissioners approved core drilling and a Slope Stability Analysis, from GeoSystems Engineering, Inc., for bridge project 6C-3674-01.  Chairman Houston signed three copies of the agreement. 

Lee Davis opened chemical quotes at 10:00 am.  They were:

The commissioners agreed to accept the quote from UAP Timberland, as it was the lowest. 

Lee Davis also discussed weeds at Elm Creek Lake.  He suggests that since the lake is being drained, now may be a good time to spray for weeds.  No action. 

Terry Graham made a motion to give permission to Carroll Deer and Don Parr to erect a gate across a county road approximately 7/10 mile east of 125th St. & Valley Road.  Gary Houston seconded the motion and all voted in favor.  The county will install a “Road Closed Ahead” sign. 

Robert Query and Clyde Killion left the meeting at 10:15 am to view the progress at Elm Creek Lake.

Frank Adamson spoke to the commissioners about Watersheds.  The commissioners directed him to speak to the Appraiser. 

Bob Marshall visited with the commissioners. 

Commissioners received a Retrospective Review from Blue Cross/Blue Shield of Kansas. 

Jack Lawrence spoke to the commissioners about a bad road.  It is at Bunker Hill (Osage and 213th St.).  Mr. Lawrence says it is full of chug holes and is in desperate need of rock.  The commissioners will talk to Clyde Killion, however if it is a private drive, there may be nothing the county can do. 

The commissioners were updated on the cost of erecting a fence around the new county barn, as provided in the contract with Morris Nelson for safety and aesthetic purposes.  To date, the fence has cost over $12,000 for materials and labor. 

Doylene Kennedy spoke to the commissioners about Resolution 11-02.  She thanked the commissioners as a mother, a taxpayer and as an employee, for signing the resolution banning nude dancing. 

The clerk spoke to the commissioners about the new Policy Manual.  The commissioners asked that she give a copy to each department head to read this week, and to report back next Monday with any questions or suggested changes before the book is adopted and distributed to all employees.

March 15, 2002          9:00am       Friday 

The Bourbon County Commission met in open session with Robert Query and Terry Graham present.  County Clerk, Joanne Long was also present.  Gary Houston arrived at 9:05am.  Minutes of the previous meeting were read and corrected. 

Emergency Preparedness Coordinator, Ed French, met with the commissioners.  Bourbon County has been awarded a grant for Emergency Preparedness in the amount of $6,767.00.  Mr. French would like a raise in salary.  No action. 

Robert Query reported that the concrete valve box at Elm Creek Lake was severely weathered.  Mid-Continental Restoration is donating its time and materials to repair the box.  Bourbon County is grateful to the generous donation by Gary & Matt DeLoney. 

Mr. Query also mentioned that Gary Wescoat is offering to sell the scales at the old Coop to us for $1,000, providing Bourbon County fills the hole with dirt.  The scales could be very useful at the asphalt plant.  No action. 

Bill Gold of Redfield spoke to the commissioners about obtaining a Cereal Malt Beverage license for a convenience store he is opening in Redfield.  The commissioners told Mr. Gold that he needs the approval of the Redfield City Council.  The commissioners also stated that it has been their policy to go along with whatever the city or township decides. 

Robert Query informed the commissioners that construction of the first of three piers at Elm Creek Lake is 50% completed.  He also stated that the lake is down about 7’ from the top. 

Lloyd and Mary Wilson spoke with the commissioners about dust control.  Mr. Wilson suffers from emphysema and needs to have the dust control.  The commissioners stated that they would most likely continue the dust control program, but that a person will still be required to present a letter from a doctor stating the need, and the county will have to see what oil prices are for 2002. 

Mr. Wilson also has a drainage problem in his ditch that will need attention before dust control is sprayed again.  Terry Graham said that he and Clyde Killion will inspect the ditch this afternoon. 

Mr. & Mrs. Wilson also had a question about the 911 system.  They live approximately 6 miles east of Moran but 911 calls are answered through Fort Scott and response times for an ambulance are significantly longer.  They stated that Devon Fire can respond very quickly. They wondered if it was against Bourbon County policy for Moran ambulances to enter Bourbon County.  The commissioners stated there was no policy that they knew of, and that perhaps Allen County has a policy prohibiting crossing county lines.  They suggested the Wilsons contact Allen County to see, and if it is allowed, to call Moran for ambulances and 911 for fire and other emergencies. 

Clyde Killion spoke to the commissioners about Elm Creek Lake.  He stated that 580 ton of rock has been placed around the pier.  Mr. Killion also discussed bucket trucks.  The county decided to release its hold on the State Surplus Property bucket truck. 

Doylene Kennedy spoke to the commissioners about the two bridges the county wants to add to the 5-yr bridge plan.  We have been notified that the bridge near Garland has been rejected, as it is not poor enough.  The bridge near Xenia has been declared an historical bridge and therefore cannot be repaired, so a new bridge will be constructed.  Ms. Kennedy also stated that the drum at the county barn has been determined to be paint remover and has been disposed of.  She also asked if she is required to publish part-time job openings in the paper.  The commissioners decided that part-time openings will not be published in the future. 

Gary Houston signed some COPS Grant reports. 

Terry Graham reported that Tim Emerson called to set up an appointment for the bank to inspect the rock quarry.  Mr. Graham will meet Mr. Emerson at 1:15pm today. 

Mr. Graham also stated that Bill Madison has asked if the county can provide asphalt to the Middle School.  No action. 

Clyde Killion reported that the Uniontown School wants to buy 30” tubes.  The commissioners approved the request to the public entity. 

Cindy Gillispie, Harold Coleman and Doylene Kennedy spoke to the commissioners about the COPS Grants.  Bourbon County is currently in violation of the grants, as we do not have five full time law enforcement positions.  Ms. Gillispie recommends that she be removed from the COPS Grant, effective April 1, 2002, and returned to a Deputy position.  This way, she can file an extension for two years, to pay for Ron Gray’s salary on the grant.  If nothing is done, Bourbon County must repay the Federal Government what we have received in grant funds.  The commissioners agreed to the transfer, adding that the Sheriff will have to watch his budget closely. 

Judy Orton told the commissioners that she filed for an extension to mail valuation notices and plans to mail them March 29, 2002.  She noted that agricultural land values increased slightly. 

Ms. Orton also discussed the policy manual.

March 18, 2002        Monday        9:05am 

The Bourbon County Commission met in open session with all commissioners present.  County Clerk Joanne Long was also present.  Minutes of the previous meeting were read and approved. 

Terri Johnson, County Attorney, discussed the new employee handbook with the commissioners.  She had two changes she felt needed to be made.  The commissioners agreed with her recommendations. 

The commissioners received two more letters of support from citizens on the ban on nude dancing. 

Clyde Killion reported on oil prices for 2002.  They are .95 for MC30 and $1.60/ton for asphalt oil.  The commissioners also discussed road projects with Mr. Killion.

 

Alec Beth, SEKRCC Administrator, discussed his proposed changes to the new policy manual.  The commissioners asked Mr. Beth to speak with Lynnette Sanders regarding the proposed Drug-testing policy. 

Richard Johnson of Martin Tractor phoned to inform the commissioners of an error in the approved minutes from March 8, 2002.  His quote for the 12H Caterpillar grader was with a 5-yr/7,500 hr warranty, not a 5-yr/5,000 hr warranty, as was printed. 

Regarding the policy manual, Joanne Long suggested changing the Approval date on the cover to April 2002.  The commissioners agreed. 

There was discussion of road graders. 

Ann Ludlum spoke to the commissioners regarding Walk America, the exercise program sponsored by the Extension Office. She asked for approval to purchase a corkboard for the north wall of the courthouse entrance to post the progress of the program and to leave for future use.  The commissioners approved the request, with the understanding that the Extension Office would purchase the board. 

Alec Beth reported back to the commissioners regarding the proposed Drug-testing policy.  Lynnette Sanders stated that Bourbon County would have one pool of names for the random drug screens, so any employees that would be added would be pooled along with the Road & Bridge employees.  The commissioners felt this was a fair system.

Mr. Beth also discussed the term “Safety Sensitive Employee” from the policy manual.  Currently, that term only applies to persons who hold a position, which requires a Commercial Driver’s License (CDL).  Mr. Beth feels the term should also include all the employees of the SEKRCC, as transporting and guarding prisoners are very safety-sensitive issues.  The commissioners agreed. 

Judy Orton, County Appraiser, reported that the preliminary ratio study is in and that Bourbon County is in compliance. 

The commissioners set the dust control price for 2002 at $1.30/running foot.  This price covers the cost of the oil and the labor and machinery to lay it. 

There was discussion of the Emergency Preparedness grant that was secured for Bourbon County in the amount of $6,767.00.  This grant will compensate 50% of the salary for an Emergency Preparedness Coordinator, as well as provide funds for training.  Terry Graham made a motion to raise the salary of the Emergency Preparedness Coordinator from $500 to $750 per month, with 50% of the salary to be reimbursed by the grant.  In effect, Bourbon County will be paying $250 less per month to support the position.  Gary Houston seconded the motion and all voted in favor.  The salary increase is to take effect April 1, 2002. 

The commissioners spent the remainder of the session discussing bomb threat procedures, the proposed Cereal Malt Beverage license for Redfield and the possible purchase of the scales from the old Coop.  No action.

The Bourbon County Commission met in open session with all commissioners present.  County Clerk, Joanne Long was also present.  Minutes of the previous meeting were read and approved. 

At 9:00am, members of the Federal Emergency Management Agency (FEMA) met with members of public entities regarding claims for damage during the ice storm last January.  Those present were:  Dave Van Sant, FEMA; Cecil Sutliff, FEMA; David Hill, FEMA; John Durbin, City of Fulton; Merle Rose, City of Uniontown; Ellen Harper, City of Bronson; David Edward, City of Bronson; Shawn Tillotson, City of Bronson; Gary Judd, City of Redfield and Marmaton Township; Don Russell, City of Fort Scott; Terry Graham, Bourbon County and Dayton Cemetery; Robert Query, Gary Houston, Ed French and Joanne Long. 

The FEMA members helped with filing forms and went over covered expenses. 

Clyde Killion, Public Works Supervisor, asked to purchase road signs.  The commissioners approved the request. 

Robert Query reported that Walker’s Wrecker Service would relocate the scales from the Coop to the rock quarry for $1,000.  The commissioners agreed to purchase the scales and have them relocated to the quarry. 

Joanne Long asked the commissioners if they would approve AFLAC representatives offering individual dental insurance to those interested.  The commissioners approved the request and the representatives will be in the commission room Monday at 9:00 am and 10:00 am to present the plan to interested employees. 

The commissioners received a letter from Mid-Continental Restoration stating the cost of the donated materials and labor toward repairing the flow valve house at Elm Creek Lake.  The commissioners, again, stated how grateful they were at the generosity of Mid-Continental. 

Robert Query left the meeting at 11:15 am to view progress at Elm Creek Lake.  He will report back on Monday.

The Bourbon County Commission met in open session with all commissioners present.  County Clerk, Joanne Long was also present.  Minutes of the previous meeting were read and corrected. 

Al Hurt and John Vaughn of AFLAC presented two proposals for individual dental insurance for employees.  Those employees present were:  Terri Johnson, Cecelia Key, Monique Umphenour, David Neville, Emmett Chapman, Diana Durbin, Susan Quick, Earl Gillispie, Danielle Wells, Valorie Leblanc, Kathy Ausemus, Janice Ramsey, Joanne Long, Terry Graham, Robert Query and Gary Houston. 

Clyde Killion showed part-time applications to the commissioners. 

Robert Query reported that Elm Creek Lake is down another 18” and will be completely drained soon. 

Jim Harris, Berry Tractor, presented some additional quote information to the commissioners regarding road graders.  These quotes were with a buy-back option, rather than a trade-in.  No action.  They were:

Richard Johnson, Martin Tractor, spoke to the commissioners about his quotes for road graders.  Mr. Johnson offered to raise the buyback amount on his quote.  No action. 

Don Presson, Southeast Kansas Field Coordinator for Experience Works, formerly known as Green Thumb, and Lois Payne, area representative from Arcadia, met with the commissioners to discuss the program.  It enables eligible persons, 55 years and older, to find part-time work, subsidized through state programs.  Mr. Presson wanted to let the commissioners know of the program so that they can recommend it to people who need reliable, hard-working part-time help.

Robert Query made a motion to accept the low bid on Spiral culverts, from West Pipe Co., the low bid on Plastic culverts, from Judy’s Iron & Plumbing, and the bid from Welborn Sales for Welded culvert.  (The winning bids are indicated by an asterisk (*) next to their line items above.)  Terry Graham seconded the motion and all voted in favor. 

Clyde Killion met with the commissioners to update road projects.  Robert Query notified Mr. Killion of a bridge in need of repair, via an email he received. 

The county clerk asked the commissioners who would be attending the Kansas County Commissioners Association’s Spring Conference, May 8-10, 2002, in Wichita.  Gary Houston and Terry Graham indicated they would attend. 

Earth Day was discussed.  Each year, the city and county participate with the USD 234 school district by providing trash receptacles for the Earth Day clean-up efforts.  We will participate this year also.  It will be April 17, 2002.  Additionally, Bourbon County will wave landfill fees for trash collected by the students in the Earth Day clean-up effort. 

There was discussion of the scales Bourbon County is purchasing from Gary Wescoat.  Walker’s Wrecker Service has been hired to move the scales for us and it was agreed that, in exchange for moving the scales, Bourbon County will credit Walker’s $1,500 toward C & D disposal at the Bourbon County landfill.  This agreement lasts through December 31, 2002, and if the entire credit is not used by that date, Walker’s will pay the remainder of the balance to $1,500.  

Don George, Kansas Department of Wildlife & Parks (KDWP), met with the commissioners to discuss Elm Creek Lake.  He asked the commissioners if they would be interested in having a public salvage for fish at the lake.  The county is interested.  As the lake is still considerably full, the commissioners settled on Saturday, April 13, 2002, as a good day for the salvage.  Mr. George will contact KDWP to finalize the plans and will handle all public notices and guidelines for the salvage. 

The commissioners also discussed the possibility of receiving additional grants for Elm Creek Lake.  Mr. George said there are a number of grants available and would be happy to work with Bourbon County to research them.  No action. 

The commissioners approved accounts payable and payroll for the period.
