April 1, 2002        Monday     9:00 am 

The Bourbon County Commission met in open session with Robert Query and Terry Graham present.  Cecelia Key was also present.  Minutes of the previous meeting were read and approved. 

Clyde Killion updated the commissioners on the status of Elm Creek Lake. 

Ed French inquired about the Bio-Terrorism Disaster Drill, June 26-27, 2002, in Topeka.  He would like a list of persons who will be attending from the county. 

Doylene Kennedy presented the commissioners with the county’s FEMA report and gave a brief explanation. 

The commissioners gave approximate dates for projects.  They were:

April 15, 2002 Complete First 4 Miles of Redfield/Mapleton Road
April 22, 2002 Complete 240th St. Benefit Dist.
June 01, 2002 Begin blacktop work

 There was brief discussion of SEK, Inc.  It was slated for discussion for Friday, April 5, 2002, at 11:00 am. 

Ed French returned with some names for the Bio-Terrorism Disaster Drill.  He stated that Terri Johnson has indicated that she will attend.  Also, someone from the Sheriff’s Department, the Public Health Department, Gary Houston or Terry Graham from the Commissioners, and Joanne Long, as Information Officer will possibly attend. 

Joanne Long requested permission to purchase a Xerox Digital Copier.  The SEKRCC has indicated it would like to purchase the Xerox 5820 copier currently in the Clerk’s Office.  The commissioners agreed to the request, providing the Correctional Center has the funds to purchase the copier. 

Jim Harris met with the board to discuss road graders.  After discussion, Terry Graham made a motion to enter into a lease purchase agreement with Berry Tractor on one 2002 850 Galion road grader, with the first payment due January 7, 2003.  There will be a trade-in of a 1996 850 Galion grader.  Robert Query seconded the motion.  Both voted in favor.  Robert Query signed the agreement agreement as Vice-Chairman. 

Don Dikeman spoke with the commissioners about a drainage problem on his property.  This is a result of work done by the county last year.  He would like a resolution to the problem, even if it means putting everything back like it was before the county did any work.  The commissioners assured Mr. Dikeman that the problem would be taken care of. 

Terry Graham made a motion to enter into a lease purchase agreement with Martin Tractor on one 2002 12H Caterpillar road grader, with a trade-in of a 120G Caterpillar grader.  Robert Query seconded the motion.  Both voted in favor.  Robert Query signed the agreement as Vice-Chairman.

April 5, 2002          Friday          9:00am 

The Bourbon County Commission met in open session with Terry Graham and Robert Query present.  Joanne Long was also present.  Gary Houston arrived at 9:08 am.  Minutes of the previous meeting were read and corrected. 

Ted Miles of Arcadia spoke to the commissioners about land he owns in Belltown, in the flood plain.  There was discussion of the buyout plan by the State of Kansas and Mr. Miles feels there should be a plan put in effect to stop the erosion on the Marmaton.  Terry Graham assured Mr. Miles that he would find out what he could and get back to him. 

The commissioners discussed the Community Lake Assistance Grant that we applied for to assist with Elm Creek Lake.  It is for a match of $5,625.00 to construct two T-piers and to clear the silt from the lake.  The application was mailed yesterday. 

Clyde Killion discussed road assignments.  He also mentioned that with fuel prices on the rise again, we might need to rethink our price for asphalting.  No action at this time. 

Joan & Rolly Curry of Lansing, Illinois, spoke to the commissioners about a fence in Drywood Township.  The commissioners explained the fence viewing laws and told Mrs. Curry her options with regards to the fence at her property. 

Gary Houston signed quarterly sales tax reports. 

The Commissioners received the monthly Extension Council reports. 

The clerk noted an error in the March 29, 2002, minutes.  In the paragraph about moving the scales, an agreement with Walker’s Wrecker service incorrectly noted that Walker’s would reimburse Bourbon County the remaining balance, if any, of a credit of $1,500 for C & D disposal at the landfill by December 31, 2002.  It should have read that Bourbon County would reimburse Walker’s Wrecker for any remaining balance as of December 31, 2002.  The commissioners agreed. 

The commissioners spoke, by phone, to Richard Johnson of Martin Tractor.  He is unable to fulfill the contract agreement for the grader, which was approved on Monday, April 1, 2002.  He is unable to supply the requested tires at the price he quoted.  He is therefore rescinding his offer and will present a new contract with a lower grade tire, but with an additional $1,000 toward the trade-in of our old grader. 

Joanne Long presented the commissioners with Resolution 13-02, Notice of Primary Election.  Robert Query made a motion to adopt Resolution 13-02.  Gary Houston seconded the motion and all voted in favor.  It was placed in Resolution Book 4 and a copy sent to the Fort Scott Tribune for publication, as required by law. 

Robert Query made a motion to appoint Gary Houston to the Bourbon County Economic Development Council for 2002.  Terry Graham seconded the motion and all voted in favor.  A letter was sent to Larry Nuss, noting the appointment. 

The commissioners discussed joining SEK, Inc.  After discussion, Terry Graham made a motion to pay the dues and join SEK, Inc. for one year.  Robert Query seconded the motion and all voted in favor.  The commissioners agreed to join for a trial period to see if being a member benefits Bourbon County and will only keep the membership if it is proven that being a member of SEK, Inc. directly helps Economic Development in Bourbon County. 

County Treasurer, Susan Quick, spoke to the commissioners.  She is preparing to invest a large sum of the county’s funds and would like to be notified of any large payments that are coming due, to assure that she has the funds available.  The commissioners agreed to inform the Treasurer if and when any large amounts need to be paid out. 

Terry Graham left the meeting just before noon to attend the Tri-Valley groundbreaking ceremony.

Clyde Killion updated the commissioners on road repairs and Elm Creek Lake. 

Don Russell, City of Fort Scott, visited with the commissioners about a business in Bronson wanting to qualify for tax relief.  The commissioners stated that according to the county’s tax exemption policy, Section 7, page 5, the county cannot help within the limits of an incorporated city. 

Commissioners Query and Houston left the meeting at 10:30 am to view Elm Creek Lake and observe piers and fishing spots.  They returned at 11:45 am. 

Kent Roberts met with the commissioners about heavy trucks driving 240th Street.  The commissioners have posted No Heavy Truck signs on the road because of a benefit district for chip and seal and the trucks are ignoring the posted signs.  The commissioners asked Clyde Killion to post 10 Ton weight limit signs from 54 Hwy to Jayhawk Road. 

Don Dikeman visited with the commissioners about a possible road closing.  The commissioners informed Mr. Dikeman that a petition is already being circulated on the matter. 

Don Stewart sent a letter of resignation from the Southeast Kansas Mental Health board.  The commissioners accepted the resignation.

April 12, 2002      Friday  9:00 am 

The Bourbon County Commission met in open session with all commissioners present.  County Clerk Joanne Long was also present.  Minutes of the previous meeting were read and approved. 

Sandy Wells met with the commissioners to discuss a countywide disaster drill that is scheduled for April 26, 2002.  She would like to use the courthouse as the site of one of the “disasters”.  The object of this drill is to have two separate emergencies, simultaneously, to test the city and county emergency personnel in the event of a disaster, such as a tornado.  She would need to use all county employees briefly, to follow procedures for a Tornado Warning and would need to have about six “victims” for about an hour for the emergency personnel to tend to.  The commissioners approved the request.  Ms. Wells said she would ask the employees for volunteers to be a victim in the drill.  Ms. Wells thanked the commissioners. 

Robert Query stated that he has left a message with Dale Curry asking if Mr. Curry is interested in filling the vacancy on the Southeast Kansas Mental Health Board, left by the resignation of Don Stewart. 

Mr. Query also stated that he has left a message with the Missouri Northern and Arkansas Railroad about his dissatisfaction of how the railroad recently blocked traffic while doing cleanup work along the tracks.  The barricades were placed directly before the railroad crossing, rather than at the entrance of the road, so large vehicles had difficulty turning around. 

Clyde Killion presented the commissioners with the resignation of Gilbert Fleeman, quarry supervisor.  According to the resignation notice, Mr. Fleeman’s last day will be April 19, 2002.

Mr. Killion updated the commissioners on the productivity of the rock crusher for the first quarter of 2002. 

Phil McGilvra spoke to the commissioners about Delwin Mumbower using the Fire District 3 vehicle at all times.  He is concerned with the private use of a public vehicle.  The commissioners stated that, because the Jaws of Life are in that vehicle, they must be available at a moment’s notice, therefore Mr. Mumbower drives the Fire District 3 vehicle, similar to police or sheriff’s employees driving their patrol vehicles home. 

Terry Graham and Clyde Killion left the meeting at 10:05 am to view Elm Creek Lake. 

There was discussion of the upcoming fish salvage at Elm Creek Lake.  Preliminary information had the salvage scheduled for tomorrow, Saturday, April 13, 2002.  However, there has been no final word on whether the salvage has been approved by the Department of Wildlife and Parks.  Jim Bussone met with the commissioners and was asked the progress of the salvage.  He spoke with Don George, Fish Biologist, and learned that the salvage would be tomorrow, and that signs would be posted at midnight tonight. 

Dale Cox spoke with the commissioners.  He requested gravel near his house at 379 40th Street.  He stated that the last time gravel was placed was last year and that it is getting very thin and vehicles are getting stuck.  The commissioners assured Mr. Cox that they would get some gravel delivered. 

Joanne Long discussed a payroll problem.  Last October, when Susan Quick was compensated for her accumulated sick and vacation time, she was only paid for 10% of her sick leave, not 25% as stated in the policy.  The commissioners ordered the clerk to pay the balance. 

Terri Johnson spoke with the commissioners about the commissioners’ authority on a one to one basis.  Ms. Johnson said that that would vary depending on the situation, but she would look into Attorney General Opinions. 

Terry Graham returned at 11:45 am. 

Robert Query stated that State Surplus Property would be faxing documentation on a dump truck that the county has had a hold on.

April 15, 2002        Monday     9:00 am 

The Bourbon County Commission met in open session with Gary Houston and Terry Graham present.  Robert Query was absent.  Deputy County Clerk Cecelia Key was also present.  Minutes of the previous meeting were read and approved. 

Noxious Weed Director, Lee Davis, met with the commissioners to say he has received a $340.00 credit from Sears.  He would like permission to purchase an air compressor.  No action at this time. 

Clyde Killion, Public Works Supervisor, notified the commissioners that Ross Schwalm has been suspended without pay for two days due to poor judgment on the job. 

Bill Gold met with the commissioners.  He presented a letter from the Redfield City Council rejecting his request for a cereal malt beverage license.  Mr. Gold indicated he was still interested in pursuing the matter. 

Ed French, Emergency Preparedness Coordinator, appeared before the commissioners to request the purchase of a radio.  No action. 

County Attorney, Terri Johnson and Assistant County Attorney, Valorie Leblanc, updated the commissioners on legal matters. 

Terry Graham made a motion at 9:47 am to go into executive session, for a period of five minutes, to discuss non-elected personnel.  Gary Houston seconded the motion.  Both voted in favor.  Those present for the session were Terry Graham, Gary Houston, Cecelia Key and Doylene Kennedy.  At 9:52 am, the regular meeting resumed with no action. 

Alvin Ted Miles spoke with the commissioners about flood problems and erosion behind his property in Belltown. 

Gary Houston signed a housing agreement with the City of Fulton, to house prisoners in the Southeast Kansas Regional Correctional Center, for $40/day, providing there is room. 

Lee Davis returned to the meeting to request the purchase of an air compressor from Sears.  He brought a catalog to check prices.  The commissioners approved the order.  The cost is $639.99, but with the $340 credit, we would only have to pay the balance.

Robert Query was not at the meeting, as he was asked to demonstrate corn planting to be used at the Pioneer Harvest Fiesta this fall.

April 19, 2002           Friday          9:00 am 

The Bourbon County Commission met in open session with all commissioners present.  Cecelia Key was also present. 

Robert Query discussed the progress at Elm Creek Lake and updated the commissioners on road projects, in the absence of Clyde Killion, who was working at Elm Creek Lake. 

Danielle Wells spoke to the commissioners about payroll problems.  An employee was terminated but no one notified the personnel department.  The commissioners will discuss the problem with the appropriate personnel. 

The commissioners allotted $400 from Special Parks and Recreation to the Uniontown Ruritan.  It will be paid from Terry Graham’s portion of the fund. 

David McBee inquired about putting up a gate on his property at the end of 65th Street.  The commissioners suggested Mr. McBee gain approval from his neighbors and then the commissioners would also agree to the request. 

The commissioners discussed Earth Day and applauded the efforts of the high school students for taking an active role in cleaning up the community. 

Robert Query left the meeting at 10:00 am to check a valve at Elm Creek Lake.  He will report back on Monday. 

Lois Coyan brought a credit application from Sears for the commissioners to sign.  This is to purchase the air compressor for Noxious Weed.  The commissioners signed the application. 

Doylene Kennedy asked the commissioners to sign the five-year plan with Schwab-Eaton, P.A. engineers.  The commissioners signed the document. 

Alec Beth discussed going to Nashville for stun gun and security belt training.  The cost is $800 for three days.  The commissioners approved the request.

The Bourbon County Commission met in open session with all commissioners present.  Cecelia Key was also present.  Minutes of the previous meeting were read and approved. 

Dennis Brown, Welborn Sales Company, met with the commissioners to discuss a new railroad-crossing adhesive that is applied with heat.  No action. 

Clyde Killion and Robert Query reported on the valve work at Elm Creek Lake. 

Mr. Killion reported that the annual safety training will be held Wednesday, April 24, 2002. 

Robert Elbrader and Douglas Thompson spoke with the commissioners about a portion of road in front of the Elbrader property.  The commissioners said they would look at it at 11:00 am before making any decisions. 

Judy Orton reported some problems with 911 addressing at Lake Fort Scott.  Fire Chief Jeff Davis visited with Ms. Orton about the situation.  The commissioners directed Ms. Orton to use the 195th Street Terrace address and give the two houses in question odd numbers.  On the West Side, they need signs for 911 addresses.  Ms. Orton will meet with Chief Davis to see if 911 city funds will pay for the signs. 

County Attorney, Terri Johnson, spoke with the commissioners on county business.  At 10:10 am, Gary Houston made a motion to go into executive session, for a period of 7 minutes, under the attorney-client privilege exception to the Kansas Open Meetings law.  Terry Graham seconded the motion.  All voted in favor.  Those in attendance were:  Gary Houston, Robert Query, Terry Graham, Terri Johnson and Cecelia Key.  At 10:17 am, the regular meeting resumed with no action. 

At 11:30 am, Terry Graham and Gary Houston left the meeting to view an access road to determine if it is a county road or a private drive.  They returned to the meeting at 12:07 pm. 

After discussion, the commissioners agreed that the portion of road in question is a county road.  The commissioners directed the county clerk to draft a letter to that effect and fax it to Othick Abstract Company.

April 26, 2002           Friday          9:00 am 

The Bourbon County Commission met in open session with Terry Graham and Gary Houston present.  County Clerk Joanne Long was also present.  Minutes of the previous meeting were read and approved.  Robert Query arrived at 9:17 am. 

Joanne Long notified the commissioners and Clyde Killion of the next 17-county officials meeting.  It will be held Thursday, July 11, 2002, in Independence, Kansas.  Clyde Killion and Terry Graham indicated they would attend. 

Gerald Beerbower spoke to the commissioners about roof matters.  He presented a bill for $1,960.00 for work completed this week on the Correctional Center’s roof.  He also mentioned that the rain has made some leaks apparent at a new location.  Mr. Beerbower indicated he would fix those leaks, no charge. 

Clyde Killion discussed road projects.  He indicated the Mapleton/Redfield Road work is nearly done. 

Robert Query stated that he and Mr. Killion removed the valve from Elm Creek Lake on Wednesday. 

Ed French spoke with the commissioners.  The commissioners asked Mr. French if the pipe at Elm Creek Lake could be cleared out with a Roto-Rooter.  Mr. French felt that was possible.  It was also suggested that a fire hose be used to clear the pipe.  No action. 

Mr. French discussed the Storm-Spotter meeting he had this week.  He presented the commissioners with booklets on the subject. 

Robert Query made a motion to adopt the new Employee Manual, effective April 2002.  Terry Graham seconded the motion and all voted in favor. 

Robert Query left the meeting at 11:00 am.  He went to Elm Creek Lake.

April 29, 2002        Monday     9:00 am 

The Bourbon County Commission met in open session with all commissioners present.  Joanne Long was also present.  Minutes of the previous meeting were read and corrected. 

Josh Lundberg spent part of the morning observing the meeting. 

It was mentioned that we might borrow the Master Blaster from the City of Fort Scott to clear the pipe at Elm Creek Lake.  Clyde Killion will speak to the City about it.  Since the heavy rains over the weekend, the water level at Elm Creek Lake is near its original depth. 

There was discussion of a weekend car accident south of Redfield. 

The commissioners spoke to Clyde Killion about the summer mowing schedule, the progress of the brush clean-up, road repairs needed, work assignments and the need to hire part-time help for mowing.  The commissioners felt the current part-time help should be given the first opportunity at a mowing position.

After reviewing the extended warranty from Berry Tractor Company, the commissioners contacted Jim Harris to request a change.  Mr. Harris said he could be here this afternoon to discuss it. 

The commissioners approved accounts payable for the period. 

Robert Query notified Clyde Killion that he has spoken with Chris Wang about a rough railroad crossing, and that Mr. Wang should be contacting Clyde about it. 

Delwin Mumbower and Ed French met with the commissioners to request storage space for emergency equipment.  The commissioners informed them that there is no extra storage room. 

Joey Collins reported on a road problem near his house. 

The commissioners spoke to Undersheriff Dion O’Dell about the sheriff’s department cellular phone bill.  Mr. O’Dell is waiting to hear from Tim McKenney for details on the county’s plan, but informed the commissioners that we have recently updated it. 

The commissioners discussed the possibility of hiring a part-time employee for the Public Works department for two days per week.  No action. 

In the afternoon session, discussion continued on the possibility of hiring a part-time employee for Public Works and also as a secretary to Ed French.  No action. 

Bill VanKirk of Community Corrections met with the commissioners over the Community Corrections Plan.  Gary Houston made a motion to sign the plan.  Terry Graham seconded the motion and all voted in favor. 

The commissioners spoke with Sheriff Coleman about break-ins in Uniontown over the weekend. 

Jim Harris, Berry Tractor Company, brought an amended warranty agreement for the Komatsu grader.  The amended agreement had the line about transport costs for repairs stricken.  The commissioners signed the amended agreement. 

After routine business, the meeting adjourned at 2:40 pm.
