Bourbon County Emergency Management
Public Assistance Program
Due to the recent snow storm in the area the office of Emergency Management has issued the following information.
Introduction
The Public Assistance Program provides supplemental Federal disaster grant assistance for the repair, replacement, or restoration of disaster-damaged, publicly owned facilities and the facilities of certain Private Non-Profit (PNP) organizations. The Federal share of assistance is not less than 75% of the eligible cost for emergency measures and permanent restoration. The State determines how the non-Federal share (up to 25%) is split with the applicants.
Eligible Applicants
bullet 
Eligible applicants include the States, local governments, Indian tribes and certain PNP organizations.
bullet 
Eligible PNP facilities must be open to the public and perform essential services of a governmental nature. Eligible PNP facilities generally include the following:
bullet 
Medical facilities, such as hospitals, outpatient and rehabilitation facilities.
bullet 
Custodial care facilities that provide institutional care for persons who require close supervision and some physical constraints in their daily activities.
bullet 
Educational facilities, such as primary and secondary schools, colleges and universities.
bullet 
Emergency facilities, such as fire departments, rescue squads, and ambulance services.
bullet 
Utilities, such as water, sewer, and electrical power systems.
bullet 
Museums, zoos, community centers, libraries, homeless shelters, senior citizen centers, shelter workshops and facilities which provide health and safety services of a governmental nature.

This program offers assistance for non-insured damages as well as deductible reimbursement for insurance claims.

In compliance with K.S.A. 25-105, and the General Election Laws of the State of Kansas, I submit herewith the list of National, State and District Candidates certified to me by the Secretary of State, and the list of those filed as candidates in Bourbon County in the forthcoming General Election to be held Tuesday, November 7, 2006.
 
And, I hereby give further notice that the election will be held in the voting places listed below in the several precincts of Bourbon County, Kansas, and that the polls will be opened and closed at the regular time specified by law for the conduct of elections.  Al precincts in the county will be open at 7:00 am and will close at 7:00 pm.

A citizen of the United States who is 18 years of age or older, or will have attained the age of 18 years at the next election, must register before he or she can vote.  Registration is open until the close of business on the 15th day before the election.
 
When a voter has been registered according to law, the voter shall remain registered until the voter changes name by marriage, divorce or other legal proceedings or changes residence.
 
The voter may re-register in person, by mail or other delivery when registration is open or the voter may re-register on Election Day.
 
Application forms shall be provided by the county election officer or the Secretary of State upon request.  The application shall be signed by the applicant under penalty of perjury.

Dear Landowner:
 
Being a landowner or resident located within one-half mile of the Phoenix Coal Company-Garland Mine Permit BB-SM-1402 blasting area you are hereby informed of the proposed blasting schedule.
 
"BLASTING NOTICE"
In accordance with Kansas Surface Coal Mining regulation K.A.R. 47-9-1(c) (816.64), PHOENIX COAL COMPANY, INC., PO Box 498, 310 S. Scraper, Vinita, OK 74301, (918) 256-7873 operating under permit number BB-SM-1402, is making public the following information concerning the blasting operations at the Garland Mine located approximately 2 1/2 miles south-southwest of Garland, KS.
 
The blasting area for the upcoming year of operation is located within a portion of the northeast quarter and the northeast quart of Section 10, T27N, R25E, Bourbon County, Ks.
 
The days and time periods when explosives may be detonated are 7:00 am to 7:00 pm, Monday through Sunday.  The explosives will be detonated only during the hours outlined above between sunrise and sunset.
 
The methods to be used to control access to the blasting area include the posting at all mine entrances "Danger Blasting" or "Explosives in Use" or similar sign and the days and time periods of explosives use.  A survey of the immediate blasting area will be made prior to the detonation and all roadways will be blocked and guarded.
 
The types of audible warnings include two (2) loud and long siren blasts to be given five (5) minutes before the shot.  One (1) long siren will be given immediately following the shot indicating an all clear.
 
Except in unavoidable hazardous situations, no blasting will be conducted at times different from those listed above.  Those unavoidable situations include ones where rain, lighting, or other atmospheric conditions, or operator or public safety requires unscheduled detonation.
 
If any structure owner within one-half mile of the permit area would like to request that a pre-blast survey be conducted on their structures, then they may do so by sending a written request to Phoenix Coal Company, Inc., or the Kansas Department of Health and Environment, Surface Mining Section, 4033 Parkview Drive, Frontenac, Kansas 66763.  The pre-blast survey will be provided at no cost to the owner.

I am writing to let you know that many of the Polling Places in Bourbon County will be changing, effective immediately.  The implementation of the Help America Vote Act (2002) requires some electronic equipment in each polling place in America starting in 2006.  Buying enough equipment to staff all our previous polling places is cost prohibitive, so I have decided it is time to consolidate.  I have chosen to consolidate to the incorporated cities of the 3rd class and within the City of Fort Scott.  The polling places are as follows:

AS A RELAY FOR LIFE COMMUNITY
AND THE WEEK OF JUNE 12, 2006,
AS RELAY FOR LIFE WEEK  
 
WHEREAS, cancer is the second leading cause of death in the United States; and
 
WHEREAS, one in four deaths in the United States is from cancer; and
 
WHEREAS, an estimated 570,280 Americans are expected to die from cancer, more than 1,500 per day; and
 
WHEREAS, the American Cancer Society is the nationwide community-based health organization dedicated to eliminating cancer as a major health problem; and
 
WHEREAS, the Relay for Life event is the American Cancer Society’s signature event and means by which the organization accomplishes its mission; and
 
WHEREAS, the Relay for Life event consists of over 4,000 events nationwide to honor cancer survivors, educate the general public about the importance of early detection and prevention of cancer, and raise funds in the fight against cancer; and
 
WHEREAS, Bourbon County has the pleasure of hosting a Relay for Life event at Frary Field at Fort Scott High School beginning at 6:00 pm on June 16, 2006.
 
NOW, THEREFORE, the board of county commissioners of Bourbon County, Kansas, does hereby proclaim Bourbon County to be a Relay for Life community and further declares the week of June 12, 2006, as Relay for Life Week in Bourbon County, Kansas.

Due to the extreme heat and little rain for the months of January and February, fire-hazard conditions in Bourbon County are very high.  Because of the limitations of water usage by rural fire districts, there is concern for the capabilities of those fire districts to address any fire.  Once started, with the present weather conditions, a fire will be difficult to control by fire departments.  Water usage is of great concern to all fire departments, and the availability of enough water to contain any fire.
 
The dry conditions, above-normal temperatures and fire danger will continue unabated until sufficient rainfall occurs across the area.
 
It is hereby proclaimed, directed and ordered by the Bourbon County Commissioners, in accordance with K.S.A. 48-932, that the following acts are prohibited within the boundaries of this county by all citizens and visitors:
 
          1.  All outside burning, unless specifically approved in writing
               by the Fire Chief
 
The knowing and willful violation of this order shall constitute a Class A misdemeanor and any person convicted of such violation shall be punished as provided by law.  [K.S.A. 48-939]
 
This Proclamation shall be in full force and effect for a period of seven (7) days, unless terminated according to law; and may be extended by the action of the Board of County Commissioners for additional seven-day periods according to law.

We were advised by our liability insurance carrier to remove the "Slow, Children Playing" signs from around the County.  The liability arises when/if a child is hit in an area that is not covered by one of the signs or that the signs gives the indication that it's okay for a child to play in the street, which it never is.  We are attempting to remove all the signs and put slower speed limit signs in their place.

NEWS RELEASE:  SCHOLARSHIP INFORMATION
 
The Kansas County Clerk’s and Election Officials Association is taking scholarship applications from those students that are majoring in Journalism, Political Science or Communications.  The scholarships are available to High School Seniors or College Freshmen or Sophomores.
 
The monies from these scholarships are made available by the effort put forth by local Election Officials and Supervising Judges of the State of Kansas.  Each is asked to call a toll free telephone number and report to the Voter News Service, specified races in the General Election.
 
The Voters News Service collects and tabulates a single, accurate set of election returns for broadcast and publication throughout the nation and abroad for the Associated Press, CBS News, ABC News, NBC News and United Press International.
 
Due to the joint efforts of the County Clerks, Secretary of State’s Office and the Voters News Service, the Scholarship Committee will be awarding scholarships in the amount of $500.00.
 
Applications may be picked up at your school or at the County Clerk’s Office and all applications must be returned to your local county clerk or mailed to Marilyn Horn, PO Box 28, Oberlin, KS 67749, on or before April 3, 2006.
 
The scholarship winners will be announced at the County Clerk’s and Election Officials Association Seminar in May.  The County Clerk from the recipient’s county will award them at their local school awards assembly.

The City of Fort Scott has called a Special Election for Tuesday, February 21, 2006, for the following question:
"Within the City of Fort Scott shall sale at retail of cereal malt beverage in the original package be allowed on any Sunday, except Easter, between the hours of 12 noon and 8 p.m. and shall the sale at retail of alcoholic liquor in the original package be allowed on any Sunday, except Easter, between the hours of 12 noon and 8 p.m. and on Memorial Day, Independence Day and Labor Day?"
Advance ballot applications will be accepted through Friday, February 17, 2006, and are available here to download and fill out.  Advance voting in person will begin at the courthouse on Monday, February 13, 2006, and end at 3:00 pm Friday, February 17, 2006.  Monday, February 20, 2006, is a federal holiday and the courthouse will be closed that day.  The polls will be open at 7:00 am on Tuesday, February 21, 2006, and close at 7:00 pm.  The only voting location for this election is the lobby of the courthouse at 210 S. National Ave. 
Only registered Fort Scott city residents are eligible to vote in this election.  Voter registration will close at the end of business on February 6, 2006.  If you have moved or changed your name since you last voted, you should re-register to vote.  If you have any questions, don't hesitate to call the office at 620-223-3800.
